Hoe werkt een impeachmentprocedure?
Een afzettingsprocedure kun je niet zomaar beginnen. Er moet sprake zijn van een serieuze schending van de wet. Artikel II van de Amerikaanse grondwet formuleert het zo:
“The President, Vice President, and all civil Officers of the United States shall be removed from Office on Impeachment for, and conviction of, Treason, Bribery, or other High Crimes and Misdemeanors.”
Het Congres fungeert bij een afzettingsprocedure als een soort rechtbank, waarbij het Huis van Afgevaardigden de rol van aanklager heeft en de Senaat de rol van rechtbankjury. Leden van het Congres kunnen een afzettingsprocedure initiëren, maar de aanzet kan in theorie ook van buiten het Congres komen.
De commissie-Justitiële Zaken van het Huis van Afgevaardigden (en in sommige gevallen ook de House Committee on Rules) buigt zich over het verzoek. Veel van het voorwerk en het onderzoek vindt in deze commissie plaats. Als de commissie oordeelt dat Trump de wet heeft overtreden, dan stellen ze de zogeheten Articles of Impeachment op. In wezen is dit de formulering van de aanklacht: wat heeft de president precies fout gedaan? De commissie stuurt een aanbeveling naar het hele Huis van Afgevaardigden.
De procedure bestaat vervolgens uit twee fases. De eerste is de impeachment zelf. Het Huis van Afgevaardigden moet oordelen of de overtreding van de wet zwaar genoeg is voor afzetting van de president. Een simpele meerderheid voldoet. Nadat het Huis van Afgevaardigden voor impeachment heeft gestemd, selecteert het een aantal ‘managers’. Die fungeren als aanklagers die de zaak presenteren aan de Senaat. Een impeachment is niet hetzelfde als een afzetting. Alleen de Senaat kan de president daadwerkelijk afzetten.
In de Senaat begint dan ook de tweede fase: trial. De opperrechter van het Supreme Court leidt deze procedure en de senatoren worden beëdigd als juryleden. Zij beslissen uiteindelijk of impeachment ook daadwerkelijk tot afzetting leidt. Voor afzetting is een tweederde meerderheid vereist. Als de Senaat voor afzetting stemt, dan moet de president onmiddellijk aftreden. De uitspraak is niet aanvechtbaar via de rechter. Wel kan de afgezette president in aanmerking komen voor strafrechtelijke vervolging.
In de Amerikaanse geschiedenis is nog nooit een presidentiële afzettingsprocedure met succes afgerond. Wel stemde een meerderheid van het Huis van Afgevaardigden twee keer voor een impeachment van een president (Andrew Johnson in 1868 en Bill Clinton in 1998). Het kwam in beide gevallen niet tot een daadwerkelijke afzetting, omdat er niet genoeg steun was in de Senaat. Tegen Nixon werden tijdens het Watergate-schandaal Articles of Impeachment opgesteld, maar het kwam niet tot een afzetting, omdat Nixon uit eigen beweging aftrad.

Dit allemaal door meerdere getuigen geverifieerd.
Zo moeilijk is het allemaal niet om 1+1 bij elkaar op te tellen

Het vonnis (van de rechters in DC) in de zaak van het House Oversight and Reform Committee heb ik gedeeltelijk gelezen. Het argument van de commissie was blijkbaar dat ze de gegevens niet opvragen om misdrijven van Trump te zoeken (wat de taak van de uitvoerende macht zou zijn), maar om te kijken of er wetswijzigingen nodig zijn (om in de toekomst corrupte presidenten te voorkomen??). 2 van de 3 rechters gaven het huis gelijk (ze haalden oa een oud SC vonnis aan dat zei dat het niet aan de rechterlijke macht was om de motieven van het Huis in vraag te stellen), de derde, benoemd door Trump, zei dat het doel niet uitmaakte, ze zouden naar misdrijven door de president zoeken, en dat is enkel mogelijk in een impeachment onderzoek (het subpoena dateert van april, is dus geen onderdeel van het impeachment proces) . |

Context! Here’s the Proof that Trump’s “No Quid Pro Quo” Call Never Happened
quote: At the heart of the impeachment inquiry, members of Congress may have been mistakenly led to believe that there were two phone calls between President Donald Trump and Ambassador Gordon Sondland in early September—with the second call having the possibility of helping the President’s case. That’s not what happened. There was only one call, and it was highly incriminating.
The call occurred on September 7th. In this call, Trump did say there was “no quid pro quo” with Ukraine, but he then went on to outline his preconditions for releasing the security assistance and granting a White House visit. The call was so alarming that when John Bolton learned of it, he ordered his’ deputy Tim Morrison to immediately report it to the National Security Council lawyers.
Sondland has testified there was a call on September 9th in which Trump said there was “no quid pro quo,” but that he wanted President Zelenskyy “to do” the right thing. A close reading of the publicly available evidence shows that the latter call was actually the very one that sent Morrison to the lawyers, and that Ambassador Bill Taylor foregrounded in his written deposition to inform Congress of the quid pro quo.
As this article was in the publication process at Just Security, the Washington Post published a report raising doubts about the existence of the September 9 call. The analysis that follows is consistent with the Post’s report and, among other points, shows why Sondland’s “no quid pro quo” call is in fact the same as the September 7th call that Morrison reported to NSC lawyers on September 7th.

IV. The “No Quid Pro Quo” Call Was In Fact a Demand for Quid Pro Quo
Whether due to a faulty memory, or due to intentional deceit, Sondland’s testimony about the “no quid pro quo” call omitted the most critical part of the conversation: President Trump’s rejection of the compromise offer for the Prosecutor General to announce the investigations, and his demand that Zelenskyy himself do it. The “no quid pro quo” call was, in reality, a “here is the specific quid pro quo I want” call. And, by erroneously placing the call on September 9th, Sondland helped obscure these omissions from his testimony, by divorcing the call from its actual context in the ongoing negotiations with Ukraine over what form of quid pro quo would be acceptable. More importantly, it also gave the appearance that the call Sondland was describing was somehow different from the call that was described by two other witnesses – both of whom testified that the call included an explicit demand by Trump for a quid pro quo.

Normale mensen zouden al lang zijn veroordeeld. Snap ook niet zo dat er nog zo tegen gediscussieerd wordt alsof het nog ter discussie staat dat Trump volgens de constitutie illegale dingen heeft ondernomen. Het blijft gewoon een politiek proces. Ook al schiet Trump iemand neer, als de republikeinen zeggen 'niet impeachment waardig' dan stopt het bij de senaat en blijft Trump zitten. End of story.
Ik ga er van uit dat hij na zijn presidentschap wel degelijk in een rechtszaal terecht komt. Hij heeft immers aantoonbare belastingfraude gepleegd. En als het niet naar hemzelf leidt, dan krijgen zijn bedrijven torenhoge boetes en kunnen de managers van die bedrijven wel in de gevangenis belanden.
Het zal me ook niet verbazen als er uiteindelijk een aanklacht vanwege sexueel misbruik wel voldoende bewijs zal opleveren. Al is dat verder gewoon een probleem van oude witte mannen met veel macht, die hun pik achterna lopen in het algemeen. |

Ik zal het eens vertalen, als het bewezen is dat ze gevoelige informatie heeft doorgespeeld naar Iran dan moet ze veroordeeld worden voor verraad en opgehangen worden.
De maximale straf voor verraad is de doodstraf. Het komt er letterlijk op neer dat hopen op de maximale straf voor een vermoedelijke verrader kan leiden tot een ban.
Mag je soms niet meer de hoop uitspreken voor een maximale straf? Welke regel is hier precies overtreden? Wat hier gebeurt is het uitschakelen van een politieke tegenstander door de progressieven achter Twitter. Een kwalijke zaak lijkt mij, als we 2 jaar lang hebben moeten vrezen voor Russische inmenging met wat Facebook ads dan lijkt mij dit veel kwalijker. |

Democrats contend that they have provided Trump with adequate due process, noting that in previous impeachments, the investigations were conducted primarily by prosecutors who faced no pushback. Republicans, they note, including several closely aligned with the White House, have been included in every witness interview and have been able to ask questions.
Wednesday’s hearing will be the first in a series the Judiciary Committee holds as it prepares to draft articles of impeachment against the president. House Democratic leaders are aiming to wrap up the impeachment process by the end of the year.
The House Intelligence Committee is expected to vote Tuesday evening to formally approve its report recommending that Trump be removed from office over allegations that he abused the power of his presidency to pressure a foreign leader to investigate his political rivals. The allegation is expected to form the core of any impeachment articles ultimately considered by the House.
Democrats are also wrestling with whether to add additional articles, and are strongly considering including an “obstruction of Congress” charge, citing Trump’s widespread efforts to stonewall congressional investigations, including the impeachment probe. They are also considering whether to fold in any of the evidence collected by special counsel Robert Mueller about Trump’s efforts to obstruct his probe of Russian interference in the 2016 election.

Vandaag weer een nieuwe poll dat Trump het prima doet bij niet-blanken.
Hillary verloor de verkiezing met 88% van de zwarten achter zich...niet meer dan 12% voor Trump dus, in 2016. Trump lijkt, na de drie polls, nu zo'n 30% achter zich te krijgen. Toch bijzonder, aangezien het zo'n racist is.

De Senate Intel Committee (olv de Republikeinen zelf) heeft het Oekraine-verhaal al eens eerder onderzocht. De conclusie was toen dat er geen bewijs was van inmenging in de verkiezingen van 2016.
Senate panel cleared Ukraine of election interference
Some Republican senators recently questioned whether Kyiv tried to sabotage Donald Trump’s campaign in 2016. But the GOP-led Intelligence Committee looked into the theory, and found scant evidence to support it.

But an interview that fall with the Democratic consultant at the heart of the accusation that Kyiv meddled, Alexandra Chalupa, was fruitless, a committee source said, and Republicans didn’t follow up or request any more witnesses related to the issue. SPOILER The Senate interview largely focused on a POLITICO article published in January 2017, according to a person with direct knowledge of the closed-door hearing, in which Chalupa was quoted as saying officials at the Ukrainian Embassy were "helpful" to her effort to raise the alarm about Trump’s campaign chairman Paul Manafort in 2016.
“If I asked a question, they would provide guidance, or if there was someone I needed to follow up with," she said at the time. She cautioned, however, that the embassy was “very careful” not to get involved politically because of the bipartisan support Ukraine has traditionally enjoyed from U.S. lawmakers. As the POLITICO article noted, there was “little evidence” of a “top-down effort” by the Ukraianian government to sabotage Trump’s campaign. And the article did not allege that Poroshenko “actively worked” for Clinton, as Kennedy claimed.
In her Senate testimony, Chalupa denied serving as an intermediary between the Ukrainian embassy and the DNC and said she had been targeted by a Russian active measures campaign. Intelligence officials have since briefed senators on Russia’s attempts to pin blame for the 2016 interference on Kyiv as part of a disinformation operation, according to a source familiar with the briefings, which were first reported by the New York Times.
Chalupa confirmed to POLITICO that she was questioned by the panel. A spokesperson for Burr declined to comment. A spokesperson for the ranking member, Mark Warner, pointed to Warner’s recent comments to PBS.
"I take very seriously the responsibility of, what I hear in classified settings needs to stay classified," Warner told the outlet. "But I think it is very clear to me, and this has been testified to by every leader of law enforcement, [and the] intelligence community, that there's been absolutely no validity to this crazy conspiracy theory that Ukraine was behind the 2016 intervention."
Senate Intelligence Committee member Angus King of Maine, an independent who caucuses with the Democrats, declined to comment on what the committee has or hasn't investigated.
But he said in an interview that he's "probably been to between 20-30 briefings and hearings on this subject of election interference in 2016, and I have never heard one word about any culpability on the part of Ukraine."
"It has never been mentioned in any of the briefings I've had on the Intelligence Committee," King said. He called the claims about Ukraine's interference in 2016 "unfortunate" because "it muddies the waters," and noted that Russia's attempts to blame Ukraine are not inconsistent with its standard disinformation tactics.
Chalupa, a Ukrainian-American activist who served as co-chair of the Democratic National Committee's Ethnic Council, has never been to Ukraine, and the DNC has said she conducted the Manafort research and outreach to the embassy on her own.
But she has been at the heart of efforts by Trump's allies to draw parallels between Russia's large-scale hacking and propaganda operation with the scattershot actions of a small cadre of Ukrainian bureaucrats who tried to expose Manafort's ties to Russia during the election.
Republicans have also pointed to an op-ed written by Ukraine's ambassador to the U.S., Valeriy Chaly, in August 2016 that criticized Trump's remark days earlier that he would be "looking into" recognizing Crimea as Russian territory.
In her testimony, Trump's former top Russia adviser Fiona Hill acknowledged Chaly's comments, but said she knew of "an awful lot of senior officials in many governments, including our allied governments" who had criticized Trump in 2016. And she called it "a fiction that the Ukrainian government was launching an effort to upend our election, upend our election to mess with our Democratic systems."
Asked whether a Ukrainian-American might have been interested in "injecting" negative information about Manafort into the press, Hill retorted that the same could be said of the Ukrainian-American operatives Lev Parnas and Igor Fruman, two associates of Trump's lawyer Rudy Giuliani "who were also trying to subvert our democracy and who managed to get one of our ambassadors sacked." (Parnas and Fruman helped launch a smear campaign that culminated last spring in the early recall of Marie Yovanovitch, the former U.S. ambassador to Ukraine.)
"I've learned in the last few days that there were some individual people in Ukraine who preferred Hillary Clinton to Donald Trump," King said in the interview, adding that that was "not surprising" given Trump's comments about Crimea. "But as near as I can tell, it was simply individuals expressing a preference," King said. "Not in any way, shape or form the kind of influence operation we saw from Russia in 2016."
GOP lawmakers have invoked Chalupa's name repeatedly throughout the impeachment inquiry--the House Intelligence Committee's top Republican, Devin Nunes, alone has mentioned her nearly a dozen times in his opening statements and questioning--to show that it was not unreasonable for Trump to demand that Ukrainian President Volodymyr Zelensky announce an investigation into the unsubstantiated allegations of Ukraine's interference in 2016. Trump also asked Zelensky to investigate Joe Biden and his son Hunter.
Those requests, which Hill described as "a political errand" at odds with official U.S. policy, are at the center of the ongoing impeachment inquiry.
Republicans have also pointed to the publication of the so-called black ledger outlining off-the-books payments Manafort received from Ukraine's pro-Russia Party of Regions as evidence of a Ukrainian interference plot. The revelation led Manafort to resign from the Trump campaign, which was already under scrutiny for its Russia ties.
But the ledger was released by an independent Ukrainian government agency, the National Anti-Corruption Bureau of Ukraine, and publicized by Sergii Leshchenko--a Ukrainian member of Parliament who, despite Senator Kennedy's claims that Poroshenko "worked" with Clinton in 2016, grew to oppose Poroshenko and accused him of launching a politically motivated investigation into the ledger's release to curry favor with Trump. That investigation was spearheaded by ousted Ukrainian prosecutor Yuriy Lutsenko.
Leshchenko recently described his motivations in publicizing the black ledger in an article for the Kyiv Post, an English-language newspaper in Ukraine. "On May 31, 2016, I gave a press conference and released the 22 pages [of the ledger] that I had," Leshchenko wrote. "Manafort was not mentioned there. His role became known only three months later, in August 2016, when the New York Times reported about it."
"In Ukraine, it was no secret to anyone that Manafort worked for Yanukovych and was generously paid," he continued. "And since Manafort at that time became the head of Trump's campaign, it was predictable enough that American journalists would dig for Manafort's name in Yanukovych's black ledger."
Ukraine's Sixth Administrative Court of Appeals canceled a court ruling in July that said Leshchenko and the head of NABU, Artem Sytnyk, had unlawfully interfered in the 2016 election by publicizing the fact that Manafort's name and signature appeared on the ledger, according to the Kyiv Post.
The Ukrainian lawmaker who initiated the court case alleging interference in the U.S., Boryslav Rozenblat, was himself under investigation on corruption charges when he filed the suit, raising questions about its legitimacy.
Trump's request to Zelensky to investigate Ukraine's election interference, however, invoked a debunked conspiracy theory that few Republicans have entertained--that the Democratic National Committee gave its server to a "Ukrainian company" to examine after it had been hacked, ostensibly in an effort to frame Russia for the attack.
In reality, the DNC hired CrowdStrike--a cybersecurity firm used by Democrats and Republicans that was co-founded by a Russian--to investigate, and the company shared the forensic evidence, which demonstrated Russia's involvement, with the FBI.
Trump's own former homeland security adviser, Tom Bossert, has described his fruitless attempts to convince the president that the Crowdstrike theory was bogus. "It's not only a conspiracy, it is completely debunked," Bossert told ABC in September. "And at this point I am deeply frustrated with what he and the legal team is doing and repeating that debunked theory to the president. It sticks in his mind when he hears it over and over again and for clarity here ... let me just again repeat that it has no validity."
Asked about CrowdStrike's work with the DNC and coordination with the FBI, Adam Hickey, the deputy assistant attorney general for the DOJ's National Security Division, told the House Judiciary Committee in October that "it's pretty common for us to work with a security vendor in connection with an investigation of a computer intrusion."
Asked by Rep. Debbie Lesko (R-Ariz.) "what other countries had shown an interest or tried to interfere in the 2016 election," Hickey replied, "based on what I've read, both from what the IC has put out and also investigations by Congress, what I've seen only refers to Russia, that I'm aware of."
The Senate Intelligence Committee concluded in a bipartisan report--after conducting "interviews of key individuals who have provided additional insights into these incidents--that Russia hacked the DNC, and agreed with the intelligence community's 2017 assessment that "Putin and the Russian Government aspired to help President-elect Trump's election chances when possible by discrediting Secretary Clinton."
Two volumes of the committee's final report, entitled "Russian Active Measures Campaigns and Interference in the 2016 U.S. Election," have been released so far, and neither address the theory that Ukraine interfered in the 2016 election.
In Volume 2, however, which focuses on Russia's use of social media to wage disinformation campaigns, the committee flagged another episode in which Russia sought to blame Ukraine for its own misconduct: specifically, the "menu of conspiracy theories and false narratives" Russia introduced in 2014 to account for the downing of Malaysian Airlines Flight 17.
Russia has repeatedly pointed the finger at Kyiv, despite the conclusion by a team of international investigators that the plane was destroyed by Russia-backed Ukrainian separatists--aided by three Russians close to Russian intelligence services--operating in separatist territory using Russia-provided weapons systems.

Judge Refuses To Delay Her Order For McGahn To Comply With Congressional Subpoena

U.S. District Judge Ketanji Brown Jackson denied Monday the administration's request for a stay. The administration has already asked an appeals court to put on hold her order from last week that McGahn testify. The appeals court has put the ruling on an administrative hold, and has scheduled briefing and oral arguments on the merits of the appeal.
On Monday, the judge said that the Justice Department could not "make a persuasive showing of irreparable harm in the absence of a colorable argument that McGahn's mere appearance before the Judiciary Committee would, in and of itself, be harmful."
She also brought up the House Judiciary Committee's emphasis, in opposing the stay request, on the possibility that McGahn could testify for the ongoing impeachment proceedings.
"[T]the Judiciary Committee would almost certainly lose the chance to question McGahn as part of the present impeachment inquiry if a stay order issues, which would unquestionably harm the ongoing investigation that the Judiciary Committee is conducting, and by extension, would also injure the public's interest in thorough and well-informed impeachment proceedings," she said.
The underlying lawsuit was filed in August, after McGahn blew off requests for his testimony dating back from last spring. The House Judiciary Committee subpoenaed the former White House counsel as part of its investigation into Trump for obstruction of special counsel Robert Mueller's Russia probe.
The Trump administration claimed that McGahn, as a former top advisor to the President, had absolute immunity that allowed the President to direct him to not show up for the compelled testimony.
Judge Jackson said last week that the President could not issue such a directive. The U.S. Court of Appeals for the D.C. Circuit said that the administrative stay would last "pending further order of" the appeals court. It has scheduled oral arguments for Jan. 3.

"The Democrats are trying to impeach a duly elected President based on the accusations and assumptions of unelected bureaucrats who disagreed with President Trump's policy initiatives and processes." SPOILER The delay in military aid
The report argues the president did nothing improper by withholding $391 million in military aid to Ukraine, and did not exert pressure on Ukrainian President Volodymyr Zelensky to investigate Joe and Hunter Biden, who had worked for the Ukrainian energy company Burisma. The Republicans say the president's decision to withhold the aid was the result of skepticism over Ukraine's commitment to combating corruption.
"The evidence shows that President Trump holds a deepseated, genuine, and reasonable skepticism of Ukraine due to its history of pervasive corruption," the report says. "Understood in this proper context, the President's initial hesitation to meet with President Zelensky or to provide U.S. taxpayer-funded security assistance to Ukraine without thoughtful review is entirely prudent."
But the report also asserts that the Ukrainians did not know about the delay in military aid until late August, when reports about the hold first emerged in the press.
"Although U.S. security assistance was temporarily paused, the U.S. government did not convey the pause to the Ukrainians because U.S. officials believed the pause would get worked out and, if publicized, may be mischaracterized as a shift in U.S. policy towards Ukraine," the report says. "U.S. officials said that the Ukrainian government in Kyiv never knew the aid was delayed until reading about it in the U.S. media."
Laura Cooper, a Pentagon official responsible for overseeing the Defense Department's portion of the aid package, testified that officials from the Ukrainian embassy were asking about the military aid weeks before it emerged publicly. The Republicans, however, say her testimony did not establish that senior Ukrainian officials knew about the delay before it was reported.
"Although this evidence suggests that Ukrainian officials in Washington were vaguely aware of an issue with the security assistance before August 28, the evidence does not show that the senior leadership of Ukrainian government in Kyiv was aware of the pause until late August," the report says.
The Republicans say the aid was released after "President Zelensky took decisive action demonstrating his commitment" to implementing reforms and fighting corruption.
"President Trump then released security assistance to Ukraine and met with President Zelensky in September 2019 — all without Ukraine taking any action to investigate President Trump's political rival," it says.
However, one U.S. official testified publicly that Zelensky was prepared to announce the investigations in an interview in early September, before the aid was released. Bill Taylor, the top U.S. ambassador in Ukraine, told lawmakers Zelensky's staff "was making plans" to announce the probes when the hold was lifted.
Investigations into 2016 and the Bidens
The Republican report closely echoes the president's own defense of his actions, namely that there was no "quid pro quo" with Ukraine and his July 25 call with Zelensky was entirely above board. The Republicans rely heavily on the White House summary of the call, in which Mr. Trump encouraged the Ukrainian leader to cooperate with a Justice Department probe into supposed Ukrainian interference in the 2016 campaign and Burisma, the company that employed Hunter Biden.
While arguing that the president did not pressure Zelensky to open the investigations, the Republicans also assert that doing so would not be improper.
"There is also nothing wrong with asking serious questions about the presence of Vice President Biden's son, Hunter Biden, on the board of directors of Burisma, a corrupt Ukrainian company, or about Ukraine's attempts to influence the 2016 presidential election," the report says.
"Publicly available — and irrefutable — evidence shows how senior Ukrainian government officials sought to influence the 2016 U.S. presidential election in opposition to President Trump's candidacy, and that some in the Ukrainian embassy in Washington worked with a Democrat operative to achieve that goal," it continues. "While Democrats reflexively dismiss these truths as conspiracy theories, the facts are indisputable and bear heavily on the Democrats' impeachment inquiry."
Republicans have cited a 2016 op-ed by the then-Ukrainian ambassador to the U.S. criticizing Mr. Trump for his stance on Crimea and statements from other Ukrainian officials as evidence of interference in the 2016 election. They have also highlighted contacts between a Democratic operative and Ukrainian officials regarding Paul Manafort, who stepped down as the Trump campaign chairman after the emergence of a so-called "black ledger" showing illicit payments he received for his work in Ukraine.
Democrats have argued that the seemingly scattershot opposition to Mr. Trump's candidacy from Ukrainian officials pales in comparison to the vast orchestrated effort by the Russian government to boost the Trump campaign while damaging Hillary Clinton.
Fiona Hill, the former top Russia adviser on the National Security Council, testified that claims of Ukrainian meddling constitute "a fictional narrative that has been perpetrated and propagated by the Russian security services themselves."

Papodopoulos’s alleged comments were key because they were made well before any public allegation that Russian intelligence operatives had hacked the Democratic National Committee.
The attorney general has privately contended that Horowitz does not have enough information to reach the conclusion the FBI had enough details in hand at the time to justify opening such a probe. He argues that other U.S. agencies, such as the CIA, may hold significant information that could alter Horowitz’s conclusion on that point, according to the people familiar with the matter who spoke on the condition of anonymity to discuss internal deliberations.
Barr has also praised the inspector general’s overall work on the matter, according to one person familiar with the matter. The inspector general operates independently of Justice Department leadership, so Barr cannot order Horowitz to change his findings.
But the prospect of the nation’s top law enforcement official suggesting the FBI may have wrongly opened an investigation into a presidential campaign, even after the inspector general announces they were justified in doing so, will probably generate more partisan battles over how the Justice Department and the FBI operate.
It is not unusual for an attorney general or the Justice Department to disagree with some of an inspector general’s findings. However, typically those disagreements occur because senior leaders at the department believe the inspector general has been too critical. In this case, Barr has conveyed to others his belief that Horowitz has not been critical enough, or is at least reaching a conclusion prematurely.
People familiar with the draft language of Horowitz’s report said while it is critical of some FBI employees, and found some systemic problems in surveillance procedures, it overall does not agree with Trump’s charge that the investigation was a “witch hunt” or a politically motivated attack on him first as a candidate and then as president.
Instead, the draft report found that the investigation was opened on a solid legal and factual footing, these people said.
Part of Barr’s reluctance to accept that finding is related to another investigation, one being conducted by Connecticut U.S. Attorney John Durham, into how intelligence agencies pursued allegations of Russian election tampering in 2016. Barr has traveled abroad to personally ask foreign officials to assist Durham in that work. Even as the inspector general’s review is ending, Durham’s investigation continues.
Barr’s disagreement with Horowitz will probably spark further criticism from Democrats, who have already accused Barr of using his position to protect the president and undermine federal law enforcement.
House Speaker Nancy Pelosi (D-Calif.) charged in September that Barr had “gone rogue.”
In recent weeks, Democrats have charged that Barr’s Justice Department was too quick to decide not to investigate Trump over his efforts to convince Ukraine’s president, Volodymyr Zelensky, to announce an investigation of Democratic presidential candidate Joe Biden. The Ukraine controversy has led to an impeachment inquiry.
Criticism of Barr previously centered on his handling of the Russia investigation. The case that began in 2016 was taken over in May 2017 by special counsel Robert S. Mueller III. After a nearly two-year investigation, Mueller filed a lengthy report of his findings to Barr, by which point he had charged 34 people with crimes, including 26 Russian nationals. Those charged and convicted included Trump’s former campaign chairman, former personal attorney, former deputy campaign chairman and former national security adviser.
After receiving the Mueller report, Barr released a short letter summing up its main points, including that there was insufficient evidence to accuse any Trump associates of conspiring with the Russians. Barr also said Mueller had made no determination about whether Trump had sought to obstruct the investigation, but Barr and his then-deputy concluded he had not.
When the full report was released, Democrats protested that Barr had improperly skewed the findings to be more favorable to Trump.
Barr has dismissed such criticism, and charged it is Democrats who are abusing legal procedures and standards in their quest to drive Trump out of the White House.
“In waging a scorched-earth, no-holds-barred war against this administration, it is the left that is engaged in shredding norms and undermining the rule of law,” Barr said in a speech earlier this month.
In his first months on the job this year, Barr made clear he had serious concerns about how the FBI had conducted the investigation into possible collusion between Trump associates and Russia.
The attorney general declared in April that the Trump campaign was spied on, though aides later said he used that term not in a pejorative sense but in the more general meaning of surveillance.
“I think spying on a political campaign is a big deal,” Barr told lawmakers. “I think spying did occur, but the question is whether it was adequately predicated and I’m not suggesting it wasn’t adequately predicated, but I need to explore that.” He also criticized former leaders of the FBI, saying, “I think there was probably a failure among a group of leaders there in the upper echelon.”
Current and former law enforcement officials have said that, when presented with information about a possible plot to undermine the U.S. election, they had a duty to investigate, and it would have been wrong not to have launched an investigation.
In the months since, Barr, through Durham, has pursued information related to a onetime associate of Papodopoulos, a European academic named Joseph Mifsud.
Mifsud was publicly linked to Russian interference efforts in late 2017, when Mueller revealed Papodopoulos had pleaded guilty to lying to the FBI about the details of his interactions with Mifsud.
Shortly after his name surfaced publicly, Mifsud told Italian media he did not work for Russia. “I never got any money from the Russians: my conscience is clear,” Mifsud told La Repubblica. “I am not a secret agent.”
Since then, the professor has disappeared from public life, leading to a host of theories about him and his whereabouts. While court papers filed in Mueller’s investigation suggested Mifsud operated in Russia’s interests, Papadopoulos, conservatives and conspiracy theorists have suggested he was working for Western intelligence agencies.

Sekulow has denied the claims.
According to the newly released transcripts, Cohen said Sekulow more or less shut him down when he offered more information on contacts with Russia regarding Trump Tower Moscow.
“Cohen said there were more communications with Russia and more communications with Trump than were reflected” in the written testimony to lawmakers, according to the memo. He said he specifically recalled telling Trump he had spoken to a “woman from the Kremlin who asked specific and great questions about Trump Tower Moscow.” He also said he told Trump that he was “waiting to hear back from them.”
Sekulow responded that it was “not necessary to elaborate or include those details because the transaction did not take place,” the memo reads. Sekulow kept pushing him, according to Cohen, urging him to “stay on message and not over elaborate.” He also told him he would be “protected” if he didn't go “rogue.”
Sekulow is also said to have told Cohen that it was “time to move on” and to avoid contradicting the president.
“Sekulow told Cohen ‘his client,’ referring to Trump, wanted Cohen to cooperate and appreciated him,” the memo states.

SPOILER Mr. Zelensky, whose government is still dependent on the Trump administration for aid and diplomatic backing, has said he did not learn of the aid freeze until before a meeting with Vice President Mike Pence on Sept. 1, though he has been vague about exactly when.
But according to testimony in the impeachment inquiry, Ukrainian diplomats in Washington knew there was a problem with the aid as early as July 25, the day Mr. Trump spoke with the Ukrainian president by phone and asked him to investigate his rivals.
In the interview, Ms. Zerkal, who said she resigned from her post last week to protest her government’s back channel diplomacy with both the Trump administration last summer and Russia this fall, provided an insider’s account of when senior officials in Kyiv learned of the freeze, and how they tried to keep the information from becoming public.
Her account is backed by Laura K. Cooper, the American deputy assistant secretary of defense for Russia, Ukraine and Eurasia, who said in Congressional testimony during the impeachment inquiry that Ukrainian diplomats knew about the aid freeze at least by July 25, when they began to question United States officials about it.
That was the same day Mr. Trump spoke by phone with Mr. Zelensky and asked the Ukrainian leader to do him the “favor” of investigating the activities of Mr. Biden and his son, Hunter Biden, as well as a discredited theory that Ukraine, not Russia, hacked into Democratic servers during the 2016 presidential election.
Ms. Zerkal says she became aware of the hold by July 30, a few days after Mr. Trump’s phone call with Mr. Zelensky.
She said she read a diplomatic cable from Ukrainian officials in Washington about the hold and asked for a meeting with a senior aide to Mr. Zelensky to discuss it on July 30. The cable had been sent the previous week, she said, but she could not confirm the precise date it had been transmitted.
The Ukrainian presidential administration was copied as a recipient of the cable from the embassy in Washington, she said, adding: “We received it simultaneously.”
Whether senior Ukrainian officials knew of the aid freeze before the July 25 phone call or not, the accounts of Ms. Zerkal and Ms. Cooper show that the Ukrainian government was aware of the hold on aid through several critical weeks in August as United States diplomats pressed Mr. Zelensky to make a public statement on the investigations.
Later, as the impeachment inquiry ramped up in the United States, Mr. Zelensky’s administration tried to squelch information that could embarrass or undercut Mr. Trump, Ms. Zerkal said.
At a meeting in September, Ms. Zerkal said, a senior aide to Mr. Zelensky told her to “keep silent” and avoid news media inquires on any topic.
The foreign minister appointed by Mr. Zelensky, Vadym Prystaiko, later blocked a planned visit to Washington by Ms. Zerkal in October, she said. His concern, she said, was that she would discuss information relevant to the impeachment proceedings — like when Ukraine learned military aid had been put on hold — with members of Congress.
Ms. Zerkal says she had arranged meetings with politicians from both parties, including Democratic Senators Robert Menendez of New Jersey and Chuck Schumer of New York, and Republican Senators Ron Johnson of Wisconsin and Ted Cruz of Texas, as well as with staff members of Speaker Nancy Pelosi.
The stated purpose of the meetings was to discuss American sanctions on Russia, but questions of when Ukraine became aware of the freeze on American aid could have come up.
“His main message to me was to keep silent, to not comment without permission,” Ms. Zerkal said of the aide to Mr. Zelensky, Andriy Yermak, who asked that she keep a low profile on all matters, not just those related to the United States. “They are in a very tricky situation and they understand this.”
Mr. Zelensky’s press office did not respond to questions about Ms. Zerkal’s account of how the government learned of the aid freeze or the reasons for canceling her trip to meet with members of Congress.
But Mr. Zelensky has insisted he wants to steer clear of the impeachment process and has signaled a desire for good relations with the Trump administration. Speaking in New York in September, he said he had not been pressured by Mr. Trump.
Later, at a news conference in October, Mr. Zelensky said he was not aware, at the time of his phone call with Mr. Trump on July 25, that military aid was frozen. On Saturday, he told journalists from Time magazine and three European publications, “look, I never talked to the president from the position of quid pro quo.”
But he also had pointed comments on the hold on aid. “We’re at war,” he said. “If you’re our strategic partner, then you can’t go blocking anything for us. I think that’s just about fairness. It’s not about quid pro quo.”
Ms. Zerkal’s account demonstrates just how hard, bordering on impossible, it is for Mr. Zelensky to avoid taking sides in the impeachment inquiry. If he is misleading people about his knowledge of the aid freeze, then he is damaging the Democrats’ case against Mr. Trump. If he admits knowing, he damages Mr. Trump’s case.
The Zelensky administration, Ms. Zerkal said, is most concerned about placating Mr. Trump, having decided that the impeachment inquiry will fail in the Senate and that Mr. Trump could be re-elected.
Indications had already been stacking up that Ukrainian officials knew well before the hold became public in August, first in a blog posted by the Atlantic Council on Aug. 14 and then in an article published by Politico on Aug. 28.
An associate of Mr. Trump’s personal lawyer Rudolph W. Giuliani, Lev Parnas, has said he warned of a possible aid freeze as early as May, though others who attended the same meeting have contested his account.
Army Lt. Col. Alexander Vindman, the top Ukraine specialist in the National Security Council, testified that he learned of a hold in early July. More United States officials became aware during a conference call on July 18, and the Office of Management and Budget put the hold in writing on July 25, shortly after Mr. Trump’s call with Mr. Zelensky.
Ms. Zerkal said she was alarmed to read of the freeze in late July. Ukraine is at war with Russian-backed separatists in two eastern provinces and considers the United States an ally.
“This information caught my attention,” she said. “Without your clear support and stance against Russian aggression we won’t be able, alone, to protect ourselves.”

“From all the evidence in its possession, CNN was well-aware that Parnas was a renowned liar, a fraudster, a hustler, an opportunist with delusions of grandeur, a man in financial in extremis laboring under the weight of a $500,000 civil judgment, and an indicted criminal defendant with a clear motive to lie,” the suit says.
The complain says all of Mr. Parnas‘ allegations to CNN came through his New York attorney, Joseph A. Bondy.
The Nunes suit says that on his overseas congressional trip from Nov. 30 to Dec. 3 2018 he visited two countries: Libya, and the city of Benghazi; and Malta, where he met with Prime Minister Joseph Muscat to “discuss security and intelligence issues related to Malta.” He also attended a repatriation ceremony for a fallen World War II Army Air Corps service member.
The court filing includes photographs of Mr. Nunes meeting officials in both countries.
“At no time during his visits to Libya or Malta did Plaintiff or his staff ever meet any Ukrainians or have any discussions with anyone about the Bidens,” the suit says.
After Mr. Nunes announced plans to sue CNN last month, Mr. Bondy told The Washington Times:
“I read Rep. Nunes‘ remarks with close care. I remind him that, in addition to a free press, one of the cornerstones of our democracy is that a person is presumed innocent unless and until — if ever — they are proven guilty by proof beyond a reasonable doubt. Mr. Parnas has been charged in New York with Federal Election Act violations, and his indictment is not a conviction.”
“His evidence and potential testimony is nonpartisan and not intended to be part of a battle between the left and the right, but rather an aid in the determination by our government of what is in the best interests of our nation,” Mr. Bondy said.
Mr Nunes portrays himself as congressman target by the liberal news media ever since to began investigating the role a Democratic Party dossier, sourced to the Kremlin. Democrats used the unverified anti-Trump charges during and after the campaign. Hillary Clinton agents delivered the dossier to the FBI which relied on it as a guide.

The Nunes suit says that on his overseas congressional trip from Nov. 30 to Dec. 3 2018 he visited two countries: Libya, and the city of Benghazi; and Malta, where he met with Prime Minister Joseph Muscat to “discuss security and intelligence issues related to Malta.” He also attended a repatriation ceremony for a fallen World War II Army Air Corps service member.
The court filing includes photographs of Mr. Nunes meeting officials in both countries.
“At no time during his visits to Libya or Malta did Plaintiff or his staff ever meet any Ukrainians or have any discussions with anyone about the Bidens,” the suit says.
After Mr. Nunes announced plans to sue CNN last month, Mr. Bondy told The Washington Times:
“I read Rep. Nunes‘ remarks with close care. I remind him that, in addition to a free press, one of the cornerstones of our democracy is that a person is presumed innocent unless and until — if ever — they are proven guilty by proof beyond a reasonable doubt. Mr. Parnas has been charged in New York with Federal Election Act violations, and his indictment is not a conviction.”
“His evidence and potential testimony is nonpartisan and not intended to be part of a battle between the left and the right, but rather an aid in the determination by our government of what is in the best interests of our nation,” Mr. Bondy said.
Mr Nunes portrays himself as congressman target by the liberal news media ever since to began investigating the role a Democratic Party dossier, sourced to the Kremlin. Democrats used the unverified anti-Trump charges during and after the campaign. Hillary Clinton agents delivered the dossier to the FBI which relied on it as a guide.

“It was obvious to everyone – including disgraceful CNN – that Parnas was a fraudster and a hustler,” the law suit says. “It was obvious that his lies were part of a thinly-veiled attempt to obstruct justice and to trick either the United States Attorney or House Intelligence Committee Chairman Adam Schiff into offering ‘immunity’ in return for ‘information’ about Plaintiff – a prominent United States Congressman and Ranking Member of the House Intelligence Committee.”
The law suit says Mr. Parnas made up other stories.
Mr. Parnas told CNN that after Mr. Giuliani introduced him to Mr. Trump at a White House Hanukkah party, he huddled privately with the president to discuss a mission to find dirt on Mr. Biden.
Mr. Giuliani says Mr. Parnas attended a one-minute photo op. There was no meeting.
For a public figure such as Mr. Nunes the bar is high for winning a libel suit. The plaintiff must show that not only was a story false but that the news organization knew it was wrong or “actual malice.”
Mr. Nunes says CNN should have known the Vienna tale was false.
“From all the evidence in its possession, CNN was well-aware that Parnas was a renowned liar, a fraudster, a hustler, an opportunist with delusions of grandeur, a man in financial in extremis laboring under the weight of a $500,000 civil judgment, and an indicted criminal defendant with a clear motive to lie,” the suit says.
The complain says all of Mr. Parnas‘ allegations to CNN came through his New York attorney, Joseph A. Bondy.
