WASHINGTON — Special Counsel Robert Mueller’s office and President Donald Trump’s legal team are now proceeding with strategies that presume a presidential interview will likely not take place as part of the Russia investigation, after months of talks between the two sides collapsed earlier this week, according to multiple people familiar with the matter.
On Monday Trump’s lawyers were discussing a possible interview with Mueller's team and had begun to hash out the final sticking points, including the timing, scope and length, according to people familiar with the discussions. One person familiar with the strategy said the president’s lawyers had over the weekend sought to expand his legal team to include individuals who would prepare him for an interview. Another person familiar with the matter, however, said preparations had not yet gone that far.
But the prospects for a presidential interview dramatically dimmed once the FBI raided the home, office and hotel room of Trump’s long-time personal lawyer, Michael Cohen on Monday, these people said. The president criticized the raid as out of bounds in Mueller’s investigation into Russia’s interference in the 2016 election and possible collusion with Trump aides.
The president’s lawyers wanted an interview to last only a few hours, according to one person familiar with the matter. Comey says he warned Trump an investigation might “create a narrative that we were investigating him personally,” the former top G-man writes.
The president replied that he “might be right” — but kept asking him to consider the idea, and said he would as well, according to Comey.
Comey said he privately wondered why Melania might think there was even a 1 percent chance the allegations were true, claiming there is “zero chance” his own wife would believe such a claim.

Comey reveals new details about his interactions with Trump and his own decision-making in handling the Hillary Clinton email investigation before the 2016 election. He casts Trump as a mafia boss-like figure who sought to blur the line between law enforcement and politics and tried to pressure him regarding his investigation into Russian election interference.
The book adheres closely to Comey's public testimony and written statements about his contacts with the president during the early days of the administration and his growing concern about the president's integrity. It also includes strikingly personal jabs at Trump that appear likely to irritate the president.
The 6-foot-8 Comey describes Trump as shorter than he expected with a "too long" tie and "bright white half-moons" under his eyes that he suggests came from tanning goggles. He also says he made a conscious effort to check the president's hand size, saying it was "smaller than mine, but did not seem unusually so."
The book, "A Higher Loyalty," is to be released next week. The Associated Press purchased a copy this week.
Trump fired Comey in May 2017, setting off a scramble at the Justice Department that led to the appointment of Robert Mueller as special counsel overseeing the Russia investigation. Mueller's probe has expanded to include whether Trump obstructed justice by firing Comey, an idea the president denies. Trump has assailed Comey as a "showboat" and a "liar."
Comey's account lands at a particularly sensitive moment for Trump and the White House. Officials there describe Trump as enraged over a recent FBI raid of his personal lawyer's home and office, raising the prospect that he could fire Deputy Attorney General Rod Rosenstein, who appointed Mueller, or try to shut down the probe on his own. The Republican National Committee is poised to lead the pushback effort against Comey, who is set to do a series of interviews to promote the book, by launching a website and supplying surrogates with talking points that question the former director's credibility.
Trump has said he fired Comey because of his handling of the FBI's investigation into his Clinton's email practices. Trump used the investigation as a cudgel in the campaign and repeatedly said Clinton should be jailed for using a personal email system while serving as secretary of state. Democrats, on the other hand, have accused Comey of politicizing the investigation, and Clinton herself has said it hurt her election prospects.
Comey writes that he regrets his approach and some of the wording he used in his July 2016 press conference in which he announced the decision not to prosecute Clinton. But he says he believes he did the right thing by going before the cameras and making his statement, noting that the Justice Department had done so in other high profile cases.
Every person on the investigative team, Comey writes, found that there was no prosecutable case against Clinton and that the FBI didn't find that she lied under its questioning.
He also reveals for the first time that the U.S. government had unverified classified information that he believes could have been used to cast doubt on Attorney General Loretta Lynch's independence in the Clinton probe. While Comey does not outline the details of the information — and says he didn't see indications of Lynch inappropriately influencing the investigation — he says it worried him that the material could be used to attack the integrity of the probe and the FBI's independence.
Comey's book will be heavily scrutinized by the president's legal team looking for any inconsistencies between it and his public testimony, under oath, before Congress. They will be looking to impeach Comey's credibility as a key witness in Mueller's obstruction investigation, which the president has cast as a political motivated witch hunt.
He provides new details of his firing. He writes that then-Homeland Security secretary John Kelly — now Trump's chief of staff — offered to quit out of a sense of disgust as to how Comey was dismissed, as well as his first encounter with Trump, a January 2017 briefing at Trump Tower in New York City. Kelly has been increasingly marginalized in the White House and the president has mused to confidantes about firing the chief of staff.
Comey also writes extensively about his first meeting with Trump after his election. Others in the meeting included Vice President Mike Pence, Trump's first chief of staff, Reince Priebus, Michael Flynn, who would become national security adviser, and incoming press secretary, Sean Spicer. Comey was also joined by NSA Director Mike Rogers, CIA Director John Brennan and DNI Director James Clapper.
After Clapper briefed the team on the intelligence community's findings of Russian election interference, Comey said he was taken aback by what the Trump team didn't ask.
"They were about to lead a country that had been attacked by a foreign adversary, yet they had no questions about what the future Russian threat might be," Comey writes. Instead, he writes, they launched into a strategy session about how to "spin what we'd just told them" for the public.

WASHINGTON (AP) — The Senate on Thursday confirmed a former coal industry lobbyist as the second-highest official at the Environmental Protection Agency, putting him next in line to run the agency if embattled administrator Scott Pruitt is forced out or resigns.
Senators approved Andrew Wheeler as the agency’s deputy administrator despite complaints from Democrats that Wheeler helped lead a fight by the coal industry to block regulations that protect Americans’ health and begin to address climate change.
The Senate confirmed Wheeler Thursday 53-45. Three Democrats — Heidi Heitkamp of North Dakota, Joe Donnelly of Indiana and Joe Manchin of West Virginia — joined with Republicans to support Wheeler.
Until his nomination by President Donald Trump last fall, Wheeler worked as a lobbyist with a client list that included Murray Energy, one of the nation’s largest coal mining companies. He accompanied Murray CEO Robert “Bob” Murray during a series of closed-door meetings to lobby the Trump administration to kill environmental regulations affecting coal mines.
“Andrew Wheeler’s coal credentials are without equal. He is, without question, a member of the coal industry’s Hall of Fame,” said Sen. Edward Markey, D-Mass.
“Sadly, I am concerned that Andrew Wheeler’s background means that he will never understand that saving coal is not the job of the EPA,” Markey added. “It is the EPA’s job to regulate coal to protect public health and the environment.”
Republicans countered that Wheeler, 53, is well-qualified to lead the agency, having worked at the EPA early in his career and serving as Republican staff chief of the Senate Environment Committee before becoming a lobbyist nine years ago.
Wyoming Sen. John Barrasso, chairman of the Senate environment panel, said Wheeler has demonstrated his commitment to sound environmental policies and has “exemplified excellence in his professional endeavors,” both in government and in the private sector.
In the style of his boss, Trump, Pruitt tweeted his approval soon after the Senate vote.
“Let me be the first to congratulate Andrew Wheeler as @EPA’s new deputy administrator. Andrew has spent his entire career advancing sound environmental policies & I look forward to working with him to implement President Trump’s environmental agenda,” Pruitt wrote.
Democratic Sen. Tom Udall of New Mexico had called for the vote to be delayed while lawmakers review Wheeler’s credentials, citing Pruitt’s uncertain status amid damaging ethics disclosures. His request was denied.
“The problem with the Wheeler nomination is if (Pruitt) goes tomorrow, Wheeler is in fact the administrator. And that’s a very, very serious problem,” Udall said Wednesday.
Sen. Ben Cardin, D-Md., said circumstances surrounding Wheeler have changed since the environment panel voted along party lines in February to advance Wheeler’s nomination. “With the cloud over Administrator Pruitt,” lawmakers are uncertain if they are voting on Wheeler to lead EPA or “be the deputy administrator,” Cardin said
Heitkamp, who faces a tough re-election in a state won easily by President Donald Trump, said she is confident Wheeler will “be open to working on issues important to North Dakota in a pragmatic and fair way. And I’ll hold him accountable to make sure he implements the mission of the EPA in a way that works for my state.”
Heitkamp and Manchin, who also faces a tough race in state Trump won easily, broke last year with their party’s leaders to vote in favor of confirming Pruitt, a former Oklahoma attorney general aligned with the oil and gas industry. Since arriving at EPA in February 2017, Pruitt has worked relentlessly to scrap, roll back and rewrite pollution regulations opposed by the fossil-fuel industry.
Maine Sen. Susan Collins, the sole Republican to oppose Pruitt, supported Wheeler’s nomination. “Mr. Wheeler has demonstrated that he understands the mission of the EPA and the role of Congress when it comes to oversight and accountability,” she said.
Senators asked Wheeler about the meeting with the Trump administration on behalf of Murray Energy during a November hearing. Wheeler acknowledged he attended but said he couldn’t remember any details.
Photos later emerged that showed Wheeler sitting at the table during an undisclosed meeting where Murray handed Energy Secretary Rick Perry a four-page “action plan” to revive the nation’s struggling coal industry. The Trump administration later carried out several of the recommended actions.
Like Pruitt, Wheeler has expressed public skepticism about the consensus of climate scientists that the continued burning of fossil fuels is the primary cause of global warming.
Environmental groups said the combination of Pruitt and Wheeler could prove devastating to the environment.
“Before the Trump administration, it would have been inconceivable that a coal and chemical industry lobbyist with a long history of hostility toward environmental policy would be the No. 2 at EPA,” said Ken Cook, president of the Environmental Working Group.

At the White House meeting on Thursday, Senator John Thune, Republican of South Dakota, questioned Mr. Trump about returning to the pact, arguing that the Trans-Pacific Partnership was the best way to put pressure on China.
Mr. Trump, who has put China’s “unfair” trade practices in his cross hairs, turned to Mr. Kudlow and Robert Lighthizer, his trade negotiator, and asked them to look into re-entering the agreement.
Rejoining the pact could be a significant change in fortune for many American industries that stood to benefit from the trade accord and for Republican lawmakers who supported it. The deal, which was negotiated by the Obama administration, was largely intended as a tool to prod China into making the type of economic changes that the United States and others have long wanted. Many economists say the best way to combat a rising China and pressure it to open its market is through multilateral trade deals like the Trans-Pacific Partnership, which create favorable trading terms for participants.
“The idea was to set a framework that eventually China would have to accommodate,” said David Autor, an economist at M.I.T.
Farmers would stand to benefit from new access to markets, especially Japan, if Mr. Trump rejoins the pact. For instance, ranchers in Australia can send beef to Japan under more favorable trade terms than those in the United States under the terms of the TPP.
Michael Miller, the chairman of U.S. Wheat Associates and a farmer in Washington, said rejoining the deal would allow his industry to compete on a level playing field with competitors in Australia and Canada, which both remained in the accord.
But rejoining it could be a complex task. The remaining countries, like Japan, moved ahead without the United States, and spent months renegotiating a pact before finally agreeing to a sweeping multinational deal this year. Mr. Trump, who has demanded that any such deal benefit the United States, is unlikely to rejoin the Trans-Pacific Partnership without further concessions for what he has criticized as a terrible agreement. That could complicate talks, since Japan maintains that it has already given all the concessions it could, said William A. Reinsch, a trade expert at the Center for Strategic and International Studies.
It is also unclear how serious Mr. Trump is about rejoining. In the past, the president has floated policies that appeared to run counter to his earlier positions, like cooperating with Democrats on legislation governing immigration and gun rights, then quickly abandoned them.
“What he tells people in a room to make them happy does not always translate into administration policy,” said Phil Levy, a senior fellow at the Chicago Council on Global Affairs.
In a statement, a deputy White House press secretary, Lindsay Walters, pushed back on the notion that Mr. Trump was reversing his promises.
The president had “kept his promise to end the TPP deal negotiated by the Obama administration because it was unfair to American workers and farmers,” she said. “The president has consistently said he would be open to a substantially better deal.”
But the White House is in somewhat of a box when it comes to prodding China to fall in line with global trade rules. The administration is trying to use tariffs to force Beijing to open its markets, but many of his supporters, including business groups and farmers, fear the fallout from an escalating trade war will be even more damaging. China has responded to Mr. Trump’s threat of tariffs on as much as $150 billion worth of its goods by placing its own tariffs on American pork, and threatening taxes on soybeans, sorghum, corn and beef.
Some advisers, including Mr. Kudlow, have indicated that those tariffs may never go into effect, and that they are mainly a prelude to negotiations with the Chinese, statements that have helped calm volatile stock markets. In a recent note to clients, the ratings agency Fitch said that the most likely outcome to the conflict remained a “negotiated solution” and that it was therefore not changing its primary economic forecast.
Mr. Kudlow, in the interview, said that farmers had “a legitimate concern” but added that it would be “at least two months before final decisions will be made.”
“I’m not here to say we won’t use tariffs — everything’s on the table in these negotiations — but I am here to say we don’t know yet,” he said.
Still, White House officials suggest that little to no progress has yet been made in bridging contentious gaps with the Chinese. Administration officials say that back-channel talks have occurred, but they would not characterize them as official negotiations. The Chinese appear impassable on some of the issues that the White House is most concerned about, including their subsidies to cutting-edge industries like robotics, aerospace and artificial intelligence.
The Trump administration says it has ordered the Agriculture Department to create a program to help farmers should the two nations find themselves in a trade war. Trade advisers say the department could draw on the financial resources of a program known as the Commodity Credit Corporation, which provides up to $30 billion to help shore up American farmers by buying their crops.
“Stay with us while we go through this difficult process,” Mr. Kudlow told farm state representatives during the meeting, according to a White House transcript. He added, “And at the end, if the worst case has come out as the president said, you will be helped. That’s a promise.”
But such a program would be time-consuming and costly and would come as the budget deficit continues to increase. Farmers say that Mr. Trump’s threats have already hurt them by causing the price of futures contracts to fall. They maintain that the easiest way to help them is to avoid a trade war with China in the first place.

"Hell hath no fury like an FBI director scorned," former Trump economic adviser Stephen Moore said on CNN.
CNN obtained a copy of the book and corroborated news reports about Comey's highly anticipated recounting of his time in the Trump administration.
In one staggering part of the book, "A Higher Loyalty," Comey said dealing with Trump reminded him of his days prosecuting Mafia kingpins with their "silent circle of assent."
"The boss in complete control. The loyalty oaths. The us-versus-them worldview. The lying about all things, large and small, in service to some code of loyalty that put the organization above morality and above the truth."
"What is happening now is not normal. ... It is not fake news. It is not okay," he writes, sketching a brutal, feudal world that seems incompatible with traditional perceptions of the presidency.
All presidents are vulnerable to tell-alls by disgruntled former insiders that expose the enmities, gaffes and scandals of their West Wings. Franklin Roosevelt, Dwight Eisenhower, George W. Bush and Bill Clinton all experienced indictments by disillusioned staffers.
Yet no commander in chief in modern memory has had to endure the humiliation heaped on Trump by Comey, who argues that the President saw the FBI as a personal investigative service bound to do his bidding.
How will Trump react?
The most immediate question now is how Trump, who typically rages over attacks on his image and lives a creed of swift retaliation, will respond to the former FBI director's portrayal of his "forest fire" of a presidency.
Besieged by scandals, fast-worsening legal entanglements and wrestling with a life and death decision on whether to launch military action in Syria, Trump is humiliated and under indescribable political pressure that may not be conducive to wise decision-making and seems sure to boil over on Twitter.
In a tsunami of bad news for the President just on Thursday, it was reported that the National Enquirer's parent company had paid off a doorman at one of his properties to keep quiet about a rumor that the President had sired an illegitimate child.
CNN has confirmed neither the story nor the rumor, but if true it would fit into a pattern of payoffs to people alleging transgressions in Trump's private life.
In yet another stunner, sources familiar with the matter said recordings that Trump attorney Michael Cohen often made of his telephone conversations likely have been scooped up in the FBI raid Monday on the attorney's apartment, office and hotel room.
CNN's Jim Acosta reported Thursday that the President had only just begun to cool off after the raid, which partly resulted from a referral to New York prosecutors from special counsel Robert Mueller.
But wall-to-wall news coverage of the leaks was likely to send Trump up the wall all over again, since there are few people he disdains more than Comey.
In an NBC interview last May, Trump blasted the former FBI chief as a "showboat" and a "grandstander." As recently as Monday, the President called Comey a liar and said he had been right to sack him. Trump has made no secret of his view of Comey as the epitome of a "deep state" effort to destroy him.
Like the furor over the book "Fire and Fury" by author Michael Wolf, published in January, this Trump headache will not fade soon.
Thursday's revelations were just the start of a week of pain for Trump, as Comey is about to embark on a media blitz, starting with an interview with George Stephanopoulos on ABC's "20/20" on Sunday. CNN's Jake Tapper will sit down with the former FBI director next Thursday.
It's not clear even that the Republican National Committee's plan to unleash a counterattack on "Lyin' Comey," exclusively revealed by CNN's Jeff Zeleny on Thursday, will be sufficient to rebut the hard-charging claims in the book.
Still Comey's willingness to write about salacious details of the Steele dossier, including the notorious claim that Trump watched prostitutes urinate in a Moscow hotel room -- accounts that have not been verified -- could bolster GOP arguments that he is going tabloid just to sell books.
Book to have a long half life
The book is sure to have long-term political and legal consequences.
Its publication on Tuesday is certain to thicken the intrigue over Russian election meddling, and the President's apparent lack of interest in making the Kremlin pay a price.
In the book, Comey recalls being struck that neither Trump nor his advisers asked top intelligence officials at a meeting in Trump Tower "about what the future Russian threat might be. Nor did they ask how the United States might prepare itself to meet that threat." Instead, the book says, they focused on "how they could spin what we'd just told them."
Potentially, Comey's assault could play into Trump's thinking as he mulls whether to seek to dismiss Deputy Attorney General Rod Rosenstein, perhaps as a precursor to shutting down Mueller himself.
It will certainly offer fodder for Democrats, who will argue in the midterm elections that Trump lacks the morals, intellect or temperament to be President. But there's little chance it will loosen Trump's unshakeable hold on his political support base, which tends to view such media storms as more proof that the establishment is biased against Trump.
Material in the book suggests, however, that Comey, who has already spoken to Mueller's investigators, will be a crucial witness as the special counsel considers whether the President obstructed justice.
In the book, Comey repeats his claim that Trump asked if he could go easy on former national security adviser Michael Flynn, which he revealed in congressional testimony last year. But he stops short of outlining an obstruction case against Trump:
"I have one perspective on the behavior I saw, which while disturbing and violating basic norms of ethical leadership, may fall short of being illegal."
Excerpts from the book also reflect just how deeply Comey's tenure resulted in the FBI being dragged into the center of America's poisonous politics, a process likely to be exacerbated by days of controversy over his book.
Those who find Comey a flawed messenger with a healthy sense of ego and a holier-than-thou belief in his own propriety may also find ammunition for their views in the book.
In one section, he criticizes Obama administration Attorney General Loretta Lynch as having a "tortured, half-out, half-in approach" to the Clinton email investigation, for which he was excoriated by Democrats.
Comey also writes that he was told by Barack Obama after the election that nothing that had happened had caused the then-President to question his integrity.
"Boy, were those words I needed to hear," he writes. "I felt a wave of emotion, almost to the verge of tears."
He wrote that he then told Obama, "I'm just trying to do the right thing."

Those people spoke on condition of anonymity to discuss the confidential details.
It was unclear how much prosecutors might have to reveal about the investigation in open court in the hearing scheduled for Friday.
Cohen has denied wrongdoing. Cohen's lawyer, Stephen Ryan, declined to comment to The Associated Press on Friday morning.
Trump has called the raids a "witch hunt," ''an attack on our country," and a violation of rules that ordinarily make attorney client communications confidential.
Those confidentiality rules can be set aside under certain circumstances if investigators have evidence that a crime has been committed.
Public corruption prosecutors in the U.S. attorney's office in Manhattan are trying to determine, according to one person familiar with the investigation, if there was any fraud related to payments to Karen McDougal, a former Playmate, and Stephanie Clifford, who performs under the name Stormy Daniels.
McDougal was paid $150,000 in the summer of 2016 by the parent company of the National Enquirer under an agreement that gave it the exclusive rights to her story, which it never published. Cohen said he paid Daniels $130,000 in exchange for her silence about her claim to have had a one-night-stand with Trump.
The White House has consistently said Trump denies either affair.

The barriers to a new pact are considerable. Many current members of the pact feel they already gave considerable ground to the United States to strike the original deal, particularly in sensitive areas like protections for pharmaceutical companies.
For its part, the Trump administration worries that the partnership will become a zero-tariff backdoor for Chinese goods into the American market. It worries that companies that have moved much of their supply chains to China could make components there, ship them to a member of the T.P.P. for assembly, then sell them in the United States tariff-free. It wants to toughen requirements for how much of the product is made within the T.P.P. country, which could make the goods less competitive.
Their worries focus largely on Vietnam, a member of the current version of the T.P.P. It has a large population, and a few big American companies, like Intel, have already invested heavily in setting up factories there that make products practically from scratch. But many other companies that are exporting goods from Vietnam rely heavily on imports from China. Vietnam’s huge garment industry, for example, relies greatly on fabric and accessories imported from China, according to garment manufacturing executives.
Vietnamese officials did not respond to requests for comment on Friday. Frederick Burke, managing partner for Vietnam at the American law firm Baker McKenzie, said that the Vietnamese government is “very aware of and focused on the issue of circumvention” in trade.
Renegotiating the Trans-Pacific Partnership, or TPP, may not be quick. Mr. Trump’s trade negotiators already have their hands full this spring trying to complete changes to the North American Free Trade Agreement. They need to decide whether to extend temporary exemptions from the president’s new tariffs on imported steel and aluminum. Above all, they are locked in a series of increasingly acrimonious trade spats with China.
China is making its own outreach efforts in the meantime. Wang Yi, its foreign minister, will travel to Tokyo on Sunday. China has played up free trade talks with Japan and with South Korea, which is not a member of the Trans-Pacific Partnership.Sheila A. The Trump administration “could walk right back in with the exact same deal from last year that they walked out of, and claim victory,” said Ms. Smith, who noted that the government of Mr. Abe “has been continuously and quietly encouraging the U.S. administration to take another look” at the pact.
One lingering question would be how China would react. The pact’s rules were designed in part to challenge China by encouraging members to loosen state support of their economies and relax trade rules — steps Beijing would have to take if it hoped to someday join the pact and enjoy its lower trade barriers.
China is not likely to be troubled by a United States move to join the Trans-Pacific Partnership as long as the Trump administration is doing so for strictly trade reasons, said He Weiwen, a former Commerce Ministry official and trade specialist who is now a senior fellow at the influential Center for China and Globalization in Beijing.
But the Chinese government is likely to be dismayed if the United States is reconsidering it as part of any revival of the Obama administration’s geopolitical pivot to Asia, or as part of any attempt to isolate China, Mr. He cautioned.
“That’s what we should be careful about,” he said.
Some current members of the pact greeted Mr. Trump’s comments on Thursday warmly. A spokeswoman for Singapore’s Ministry of Trade and Industry said it welcomed the American interest. “The TPP was designed to be an inclusive agreement, which is open to like-minded countries willing and able to meet its high standards,” the spokeswoman said.
Still, even American allies suggest a long road ahead if Mr. Trump moves forward.
“If the United States genuinely did wish to re-enter, that would trigger another process of engagement and negotiation,” Jacinda Ardern, the prime minister of New Zealand, said on television, adding that she still planned to go forward with the deal as-is. “It’s not just a matter of slotting into an existing deal.”

The deal, which hasn’t previously been reported, prohibits the Los Angeles woman from disclosing her alleged relationship with Mr. Broidy in exchange for $1.6 million to be paid to her over two years in quarterly installments, these people said. The first payment was due Dec. 1, according to one of the people.
“I acknowledge I had a consensual relationship with a Playboy Playmate,” Mr. Broidy said in a statement provided by a spokesman. “At the end of our relationship, this woman shared with me that she was pregnant. She alone decided that she did not want to continue with the pregnancy and I offered to help her financially during this difficult period.”

Mr. Cohen didn’t respond to requests for comment.
