Hoe werkt een impeachmentprocedure?
Een afzettingsprocedure kun je niet zomaar beginnen. Er moet sprake zijn van een serieuze schending van de wet. Artikel II van de Amerikaanse grondwet formuleert het zo:
“The President, Vice President, and all civil Officers of the United States shall be removed from Office on Impeachment for, and conviction of, Treason, Bribery, or other High Crimes and Misdemeanors.”
Het Congres fungeert bij een afzettingsprocedure als een soort rechtbank, waarbij het Huis van Afgevaardigden de rol van aanklager heeft en de Senaat de rol van rechtbankjury. Leden van het Congres kunnen een afzettingsprocedure initiëren, maar de aanzet kan in theorie ook van buiten het Congres komen.
De commissie-Justitiële Zaken van het Huis van Afgevaardigden (en in sommige gevallen ook de House Committee on Rules) buigt zich over het verzoek. Veel van het voorwerk en het onderzoek vindt in deze commissie plaats. Als de commissie oordeelt dat Trump de wet heeft overtreden, dan stellen ze de zogeheten Articles of Impeachment op. In wezen is dit de formulering van de aanklacht: wat heeft de president precies fout gedaan? De commissie stuurt een aanbeveling naar het hele Huis van Afgevaardigden.
De procedure bestaat vervolgens uit twee fases. De eerste is de impeachment zelf. Het Huis van Afgevaardigden moet oordelen of de overtreding van de wet zwaar genoeg is voor afzetting van de president. Een simpele meerderheid voldoet. Nadat het Huis van Afgevaardigden voor impeachment heeft gestemd, selecteert het een aantal ‘managers’. Die fungeren als aanklagers die de zaak presenteren aan de Senaat. Een impeachment is niet hetzelfde als een afzetting. Alleen de Senaat kan de president daadwerkelijk afzetten.
In de Senaat begint dan ook de tweede fase: trial. De opperrechter van het Supreme Court leidt deze procedure en de senatoren worden beëdigd als juryleden. Zij beslissen uiteindelijk of impeachment ook daadwerkelijk tot afzetting leidt. Voor afzetting is een tweederde meerderheid vereist. Als de Senaat voor afzetting stemt, dan moet de president onmiddellijk aftreden. De uitspraak is niet aanvechtbaar via de rechter. Wel kan de afgezette president in aanmerking komen voor strafrechtelijke vervolging.
In de Amerikaanse geschiedenis is nog nooit een presidentiële afzettingsprocedure met succes afgerond. Wel stemde een meerderheid van het Huis van Afgevaardigden twee keer voor een impeachment van een president (Andrew Johnson in 1868 en Bill Clinton in 1998). Het kwam in beide gevallen niet tot een daadwerkelijke afzetting, omdat er niet genoeg steun was in de Senaat. Tegen Nixon werden tijdens het Watergate-schandaal Articles of Impeachment opgesteld, maar het kwam niet tot een afzetting, omdat Nixon uit eigen beweging aftrad.

Dat aantal donatoren gaat ook helemaal niet om het financieren van de campagne maar om het meten van steun. Daarbij polls kun je toch gewoon kopen? Fox news heeft een poll, super betrouwbaar natuurlijk dat als instrument om te bepalen wie mee mogen doen aan verkiezingsdebatten. Lijkt me theoretisch mogelijk voor Bloomberg als hij een paar miljard heeft om gewoon alle pollbedrijven over te nemen. Daarbij lijkt het me nogal zuur stel je haalt 0,1% te weinig om mee te doen in polls die toch een redelijke foumarge hebben. |

Pelosi is saying that because she doesn’t want to appear to be on a “witch hunt” or to be trying to drag this into election season. But Pelosi is intent on waiting until the case is “ironclad.” First, the Ukraine investigation is not done yet. House Intel is preparing a report on its investigation. Judiciary will not get that report until December. Meanwhile, more Ukraine evidence comes out hourly. The Ukraine investigation is ongoing. But that’s not all. Remember when the House adopted resolutions for the impeachment proceedings in October? Were those called “The Ukraine Investigation Resolutions”? No, they were called “Directing Certain Committees to Continue Their Ongoing Investigations.” And it was *SIX* committees! House Intelligence, FinServ, Foreign Affairs, Judiciary, Oversight, and Ways & Means *ALL* were “directed to continue their ongoing investigations as part of the existing House of Representatives inquiry into whether sufficient grounds exist...to impeach Donald John Trump.” And guess what? That’s exactly what they’ve been doing since January. Nothing has changed. The investigations continue on *all* fronts. Let’s take a look at some of the hottest investigations and where they stand, because you’ll quickly see this is *NOT* just about Ukraine... Let’s start with Judiciary, because we’ve already gotten word that they are on the verge of opening their own impeachment hearings on obstruction of the Mueller investigation. Judiciary is involved in two lawsuits to get what they need for those hearings, and they will win. First, DC District Court will rule Monday (11/25) in the McGahn case and will find that Trump’s claim of “absolute immunity” is bogus. Trump will lose and McGahn will have to choose whether to stand in defiance of both a Congressional subpoena and a court order while DOJ appeals. Second, the DC District Court already has ruled in favor of Judiciary that DOJ must turn over the redacted and withheld Mueller grand jury materials. That’s being appealed, with arguments in mid December. The case may end up at SCOTUS, where Judiciary will prevail. Note: Not much of Volume II of the Mueller Report on obstruction was redacted, so Judiciary can proceed with a McGahn hearing now. But they’re after more than that: the redacted Volume I materials show that Trump lied to Mueller. And Judiciary is going to get it. So Judiciary is going to be having hearings on both obstruction of justice and then likely another round of hearings on Trump perjury. That’s going to take a while and likely won’t conclude until, say, February. The Senate won’t get the case before then. No chance. Next, the Oversight Committee. They won their case to enforce a subpoena against Trump’s accountants (Mazars) to get Trump’s tax records. Trump filed with SCOTUS to “stay” the subpoena. SCOTUS likely ruled on that yesterday (11/22) and we will learn its ruling on Monday. If SCOTUS denies the stay, Oversight will have Trump’s tax records next week. But even if they grant the stay, Oversight asked for accelerated briefing and Trump agreed to that, so we should expect that case to be resolved by March at the latest. Ultimately, Trump will lose. Once Oversight gets Trump’s tax records, it quickly will find he’s a tax fraud and a money launderer. Hearings will be announced and will take months. There is no chance the Senate gets the case before this is done. I repeat: NO CHANCE! ZERO. NONE. Both House Intel and Financial Services also are suing to get Trump’s banking records from Deutsche Bank. That case will be decided any day now and Trump will lose and will have to seek another emergency stay from SCOTUS, which he also will lose. Note: Depending on how much material comes from Mazars, the House may not even need the Deutsche Bank documents. But if they do find they need them, they will wait to get them before sending the case to the Senate. Guaranteed. In short, this whole thing is far from over. Trump is fighting a war on all fronts and losing all of them. The Senate won’t get the case until the war is won and the House has everything it needs to guarantee conviction. And they will get it. We will win and Trump will lose. My personal belief is there won’t be a Senate trial. The result will be obvious and Trump will be forced out, cut a deal, or pull a Hitler and die by suicide. Het Horowitz report dat in December komt gaat enkel over de FISA applicatie.
En wat bedoel je met "later voegde hij hier aan toe" ?. Het gaat om 1 en dezelfde persconferentie en serie van vragen en antwoorden dat weet je toch neem ik aan ?
Maar goed. Ik vraag me af of je nog een zaak kan maken als enkel de meeting in ruil voor de mededeling overblijft. Lijkt mij niet te kwalificeren als bribery daar een meeting geen item of value is lijkt mij. Tevens is die mededeling er nooit gekomen en heeft er gewoon een meeting plaatsgevonden, weliswaar niet in the White House maar wel in NY. Dus als dat de zaak moet worden waar je een president voor wil afzetten dan vraag ik me af hoeveel steun je daarvoor van het volk kan verwachten (in het senaat zal het sowieso kansloos zijn). Ik denk een heel stuk minder als wanneer je wel hard kan maken dat de steun ingehouden is in ruil voor het heropenen van onderzoeken maar Burisma. En vooralsnog is dat nog niet gelukt.

Je doelt denk ik op Horowitz, niet Morowitz In mijn beleving ging dat om hetzelfde onderzoek, maar dat blijkt inderdaad niet zo te zijn, hoewel er wel samenhang tussen zit. Doet verder niet echt wat af aan wat er staat natuurlijk, maar dat was idd inaccuraat.
Met voegde er later aan toe bedoelde ik dat het later in de persconferentie erbij kwam toen journalisten door vroegen.
Die meeting is wel waardevol voor Oekraine uiteraard, maar belangrijker is een aankondiging van een neponderzoek door een ander staatshoofd proberen te fabriceren wat in mijn ogen echt not done is. Die meeting in het Witte Huis met POTUS voor het oog van de wereld (en niet te vergeten zijn eigen bevolking) was juist uitermate belangrijk voor de positie van Zelensky. Het zou vooral een sterk signaal afgegeven hebben richting Putin: de president van de Verenigde Staten staat achter de militaire steun voor Oekraine. Dat bezoek werd tegengehouden omdat Trump eerst in ruil een toezegging wilde van een onderzoek naar de Bidens en het (voor Trump) allerbelangrijkste: een publieke aankondiging daarvan bij CNN.
Een grotere waarde (thing of value) kan je in deze situatie niet bedenken lijkt me.
En zoals ook zo vaak is uitgelegd in politieke analyses zou het achteraf erkennen van Zelensky dat hij wel degelijk onder druk stond op dezelfde manier een signaal afgegeven hebben van zwakte, vooral ook richting zijn eigen bevolking. Wie wil er nou een president die zich laat chanteren in een volkomen politiek beladen partisan onderzoek. Om nog maar niet te spreken over de gevolgen dat dat gehad zou hebben voor de relatie met Trump. Vandaar zijn ontkenning ervan.

Parnas' associate, Fruman, has not cooperated with the committee.
Parnas, a Ukraine-born, American businessman, was subpoenaed last month by House committees at the same time as Fruman. The two men had previously announced through their attorney at the time that they would not be complying with the subpoena.
Separate from the House impeachment probe, Parnas and Fruman were arrested earlier this fall at the Dulles International Airport just outside of Washington, with one-way international tickets, and charged in a criminal campaign finance case in the Southern District of New York. Accused of allegedly circumventing campaign finance laws against straw donations and foreign contributions, Parnas and Fruman pleaded not guilty.
According to the indictment, Parnas sought then-Ukraine Ambassador Marie Yovanovitch’s ouster earlier this year along with his efforts to get Ukrainian officials to investigate the president’s political rival, matters that have repeatedly emerged in the House impeachment inquiry.
Giuliani’s relationship with Parnas and Fruman is the subject of a criminal investigation in the Southern District of New York, that case will have its next court date early next month.

Bud Cummins Tried To Interest US Law Enforcement In Ukraine Dirt On Bidens In 2018
quote: As far back as October 2018, a former U.S. attorney acting on behalf of Ukrainian interests tried to get federal law enforcement to bite on bogus political dirt about the Bidens and on whether Paul Manafort’s notorious Black Ledger was a forgery. Bud Cummins, a former U.S. attorney in Arkansas, emailed the U.S. attorney for the Southern District of New York relaying a request for a meeting on the same topics into which President Trump would later demand Ukraine conduct investigations. TPM has been investigating Cummins’ role in attempting to serve as an intermediary between certain Ukrainian interests and federal law enforcement. Cummins’ involvement has not been previously reported. However, Rudy Giuliani sent a letter on Saturday to Senate Judiciary Committee Chair Lindsey Graham (R-SC) claiming that a former U.S. attorney was ready to provide emails and memoranda about an attempt to get the FBI to investigate Biden and the list of Manafort bribes, called the Black Ledger. Cummins confirmed to TPM Sunday morning that Giuliani’s letter was referring to him. SPOILER The meeting proposed by Cummins would have been between Ukraine's then-prosecutor general, Yuriy Lutsenko, and Manhattan U.S. Attorney Geoffrey Berman. Lutsenko waged a campaign to push out Marie Yovanovitch, the then-U.S. ambassador in Kyiv, in part by spreading the same allegations that he had sent to Cummins. Lutsenko has emerged as the figure who also channeled dirt to Giuliani as it made its way into the U.S. media ecosystem.
The email proposing the meeting, which Cummins said he sent on Oct. 4, 2018, laid out allegations about Hunter Biden and his work for Burisma, and that the Black Ledger was falsified, Cummins told TPM in a phone interview.
Cummins said that he received the information about Hunter Biden and Manafort from two intermediaries of Lutsenko in September 2018.
"The information I gave to them was a request to meet with Lutsenko," Cummins said, adding that he had a brief phone call with Berman and sent three follow-up emails after the information was sent.
Speaking over the phone Sunday morning, Cummins expressed to TPM a mixture of dismay that Berman broke off contact and mild embarrassment at having dealt with Ukrainians whose motivations he admitted he did not understand. Cummins added that when he sent the email to Berman he "wasn't advocating for the legitimacy of any of this."
"At the time, I didn't know a whole lot about Ukraine. I didn't make any real attempt to vet this." He added "I didn't care, that wasn't my job" in a discussion of what may have been motivating Lutsenko.
Lutsenko and a spokesperson for Lutsenko didn't immediately return requests for comment. Berman's office declined to comment.
Cummins told TPM that he had tried to signal to Berman that he was not vouching for the credibility of the allegations themselves. He said that he suggested to Berman that Lutsenko could "delegate some investigators to meet with some line [prosecutors] in his office," referring to Berman.
Cummins called the lack of response from the Manhattan federal prosecutor a "breathtaking double standard," given how the Mueller investigation "targeted" President Trump.
A former U.S. Attorney for the Eastern District of Arkansas, Cummins was one the federal prosecutors fired by the George W. Bush administration during the U.S. attorneys scandal. A New York Times editorial at the time described Cummins as "one of the most distinguished lawyers in Arkansas" who is "respected by Republicans and Democrats alike." Cummins was pushed out of office in favor of a deputy to Karl Rove.
In 2016, Cummins served as chair of Donald Trump's campaign in Arkansas, then as a Trump whip at the 2016 Republican National Convention in Cleveland. He went on to serve on the Trump administration transition team.
Cummins said that he believed that "mistrust of the FBI" was what led the Ukrainians to seek a back channel to the Justice Department. He said that his Ukrainian interlocutors -- who he declined to name -- apparently went to him because they believed the "FBI in Ukraine had either wittingly or unwittingly become the pawns of the ambassador and secretary of state and vice president, and they cannot be trusted."
Cummins declined to say if his actions were related to work for any particular client. Public records show he previously registered as a lobbyist for former Prime Minister of Ukraine Yulia Tymoshenko.
Cummins likened the request to being approached by a woman who had had her purse stolen in Central Park, and then taking her to a police officer. "I was trying to report a crime," he said.
Giuliani claimed in his letter to Graham that while Marie Yovanovitch was ambassador to Ukraine, "visas were denied to many who possessed evidence of Democrat, embassy and Biden corruption. Some witnesses went even so far as to hire a lawyer and as far back as October 2018, presented the United States Attorney's office with their information about Ukrainian falsified information to affect the 2016 election and the exercise of influence by Joe Biden, in exchange for payments to Hunter Biden and Devon Archer. This lawyer was suspiciously never contacted again."
"Now," Giuliani continued in his letter to Graham, "he is willing to share with you memoranda and e-mail. I would add that he also is a well respected former United States Attorney."
Cummins told TPM he spoke to Giuliani by phone in the last few days, and that while he is not prepared to approach Congress on his own he would comply with any subpoena issued by the Senate.

Will the House vote for impeachment? While it is not impossible that the Democrat-led House will decide not to impeach the president, it is incredibly difficult to imagine that scenario playing out in reality.
Democratic leadership has put its weight behind impeachment, and managed to pass its resolution formalizing the inquiry process by a clear majority of 232 votes in favor to 196 against at the end of October.
Barring a massive change in the political landscape, you should expect the House to vote for Trump's impeachment.
What happens next? If the House votes to impeach President Trump, then he will face a trial in the Republican-held Senate. After the trial, senators will vote on whether or not to convict the commander-in-chief and remove him from office.
Although GOP senators have had their differences with Trump of late, namely over his decision to withdraw U.S. troops from Kurdish-controlled Syria, there appears to be little appetite for his impeachment, let alone his conviction and removal from office.
A two-thirds majority of votes in the Senate is required for a president to be convicted and removed from office. In this case, that outcome is highly unlikely.

Een of andere roddelcolumnist, die Trump al jaren kent en naar eigen zeggen moest huilen van geluk toen hij wordt verkozen, bombardeerde The Donald tot koning van de quid pro quo. Hij vertelde in geuren en kleuren dat Trump's hele manier van denken is geënt op 'voor wat, hoort wat'. Quid pro quo is voor deze president als ademen, een automatisme, zo verklaarde de columnist.

Trump’s actions raise concern about role in military justice
quote: WASHINGTON (AP) — Defense Secretary Mark Esper declared that President Donald Trump ordered him to stop a disciplinary review of a Navy SEAL accused of battlefield misconduct, an intervention that raised questions about America’s commitment to international standards for battlefield ethics. Esper’s comments Monday were the latest twist in the case of Chief Petty Officer Edward Gallagher, which led to a conflict between Trump and armed services leaders over military discipline. The dispute peaked over the weekend with the firing of Navy Secretary Richard V. Spencer. Gallagher was acquitted of murder in the stabbing death of an Islamic State militant captive but convicted by a military jury of posing with the corpse while in Iraq in 2017. Esper initially favored allowing the Navy to proceed with a peer-review board which could have resulted in Gallagher losing his SEAL status, but he said he was obliged to follow Trump’s order. Still, Esper also directed the Pentagon’s legal office to review how service members are educated in the laws of armed conflict and trained to wartime behavioral standards. “I can control what I can control,” Esper told reporters when asked whether Trump sent the right message to U.S. troops by intervening to stop the Gallagher review. “The president is the commander in chief. He has every right, authority and privilege to do what he wants to do.” SPOILER In yet another twist to the Gallagher saga, Esper also made an extraordinary accusation against Spencer.
Esper said Spencer had gone behind his back last week to propose a secret deal with the White House in which Spencer would fix the outcome of the Gallagher review. Esper said this was a violation of the military chain of command and said Spencer acknowledged his misstep.
Through a Navy spokesman, Spencer declined requests for comment on Esper’s allegation. However, in a letter to Trump on Sunday he said he could not in good conscience follow an order that he believed would undermine the principle of good order and discipline in the military — suggesting he had been ordered to stop the peer-review process for Gallagher.
Trump began to get involved in the Gallagher case in the spring after Bernard Kerik, a former business partner to his personal lawyer Rudy Giuliani, became an advocate for the family and made appearances in conservative media.
The SEAL also changed his defense team to include Marc Mukasey, a lawyer for the Trump real estate company.
The president has tweeted in support of Gallagher, praising the sailor’s service and saying the case was “handled very badly from the beginning.”
Earlier this month, Trump restored Gallagher’s rank, which had been reduced in his military jury conviction.
Trump also pardoned two soldiers — a former Army special forces soldier set to stand trial next year in the killing of a suspected Afghan bombmaker in 2010 and an Army officer who had been convicted of murder for ordering his soldiers to fire on three unarmed Afghan men in 2012, killing two.
Beyond the Spencer firing, the Gallagher case has raised questions about the appropriate role of a U.S. president in matters of military justice. Esper said Trump had a constitutional right to intervene, but others worry that such actions undermine the credibility of American claims to be a leader in ethical and lawful behavior on the battlefield.
“What concerns me the most is the chilling effect this will have on special forces’ willingness to report when they see illegal behavior,” James Stavridis, a retired Navy admiral, said in an email to The Associated Press. “That is tragic because in the end what separates us from our opponents on the battlefield is our willingness to follow the rule of law.”
Sen. Jack Reed, the ranking Democrat on the Senate Armed Services Committee and an Army veteran, accused Trump of “inappropriate involvement” in the military justice system.
“The White House’s handling of this matter erodes the basic command structure of the military and the basic function of the Uniform Code of Military Justice,” Reed said.
Carl Tobias, a law professor at the University of Richmond School of Law, said Trump’s action undercut the military.
“We want to be a standard for the world in terms of rule of law,” he said. “I’m concerned that it undermines our own military; it undermines our standing in the world.”
Trump has said Gallagher was treated unfairly by the Navy.
“I think what I’m doing is sticking up for our armed forces,” he said Monday. “There’s never been a president who is going to stick up for them and has like I have.”
Last week Trump tweeted that Gallagher must be allowed to retire as a SEAL, regardless of the Navy’s intention to review his standing in the elite force. Esper’s comments Monday revealed that on Sunday Trump had given the defense secretary a direct order to make this happen.
Even before receiving that order, however, Esper had decided the Gallagher process should be stopped. He said his rationale was that, “given the events of the last few days,” it was no longer possible for Gallagher to get a fair shake.
“As professional as they are,” he said of the Navy review board members, “no matter what they would decide, they would be criticized from many sides, which would further drag this issue on, dividing the institution. I want the SEALs and the Navy to move beyond this now, fully focused on their warfighting mission.”
In announcing Sunday that he had dismissed Spencer, Esper said he acted after learning of Spencer’s secret plan to “guarantee” in advance the outcome of the review board that was to convene next week.
Spencer had “proposed a deal whereby if the president allowed the Navy to handle the case, he would guarantee that Eddie Gallagher would be restored to rank, allowed to retain his Trident and permitted to retire,” Esper said Monday.
This was “completely contrary” to what Esper and the rest of the Pentagon leadership had agreed to, he said, and contrary to Spencer’s public position that the Navy disciplinary process should be allowed to play out with no interference.
Esper said he had previously advocated for allowing the Navy review to go forward. But when Trump gave him a “verbal instruction” to stop the process, he did so.
Esper did not say explicitly that he disagreed with Trump’s order.
Once Trump gave the order, Esper said he responded, “Roger. I got it.”

Bill would strip Kentucky governor’s power to name state Transportation Secretary
quote: LOUISVILLE, Ky. (WDRB) – State Senate leaders are backing a bill that would limit the governor’s power to name a Kentucky Transportation Cabinet secretary, essentially shifting that role to a citizen board nominated by influential business and government groups. The newly created board would develop the first draft of the state’s two-year road budget and base it on an “objective scoring system.” The governor’s administration now creates the plan sent to legislators. Among other duties, the nine-member Kentucky Transportation Board would compile a list of candidates for Transportation Secretary, then send the names to the governor. He or she would choose from that list. The bill also would make the Transportation Secretary subject to Senate confirmation – the only cabinet leader in a governor’s administration with that requirement. The measure is sponsored by three Republicans in the GOP-controlled legislature – Sen. Jimmy Higdon; vice chair of the Senate Transportation Committee; committee chair Sen. Ernie Harris; and Senate President Robert Stivers. It was prefiled on Nov. 5, the day Democratic Gov.-elect Andy Beshear defeated incumbent Republican Gov. Matt Bevin. SPOILER Higdon said the timing was coincidental. “It’s not directed at (anyone),” he said. “We had no idea who the governor would be when that was filed.”
Instead, he said the proposal is an effort to insulate the state's transportation spending process from the politics that for years have held sway over road projects. It's modelled after a similar approach in Virginia, where an independent board oversees transportation projects, he added.
A governor still would have some influence over the Kentucky board’s makeup. But first, the Kentucky Association of Counties, the Kentucky League of Cities and the Kentucky Chamber of Commerce would nominate one person from each of the state’s six Congressional districts as potential members, as well as three at-large candidates.
The governor then would appoint the nine members from the list of candidates, with no more than five board members of the same political party. Louisville’s Congressional district would have one member; the bill would also require that one of the at-large members represent an area with more than 50,000 people.
The Senate would ultimately confirm the board members.
To qualify as a member, citizens would need five years of experience in “transportation, construction, finance, law, environmental issues, management, or engineering,” the bill says. No one with a financial interest in any Transportation Cabinet contract could serve on the board.
The board would prioritize projects for the two key documents that govern how Kentucky spends transportation dollars: The two-year road construction budget and a six-year plan meant to gauge priorities in the years ahead.
Higdon said that system would effectively mirror a Transportation Cabinet program called SHIFT, which uses a formula to rank projects that based on factors that include safety, congestion and economic development. There are 17 Louisville-area projects on the list for lawmakers to consider when they start meeting in January.
“Everybody has input into SHIFT,” Higdon said. “It starts at the local level and makes its way up to the Department of Transportation and over to the General Assembly. The bill puts SHIFT into statute. It etches that into stone now.”
Louisville transportation advocate Jackie Cobb said the bill gives “exceptional amount of power” to the three lobbying organizations. All three were among the top 10 spenders seeking to influence Kentucky lawmakers during the first half of the year, according to the Kentucky Legislative Ethics Commission.
Among other concerns, Cobb questioned whether the proposed board would have adequate representation from urban areas. And she noted that the criteria the board would use to rank projects “glaringly omits environmental impact.”
“That -- on its own -- should make this legislation disqualifying,” she said in an email.
The board would determine the qualifications for Transportation Secretary, oversee the search for candidates and choose three to send to the governor. The governor then could select one of those candidates, or ask the board to submit three new people from which to choose.
Higdon said that approach is similar to how the Kentucky Economic Development Partnership board selects the secretary of the Kentucky Cabinet for Economic Development. However, the governor also serves on the board that recommends candidates for that office.
“We’ve tried to take some of the politics out of those positions by having an independent board that hires and fires,” he said.
But the proposed bill raises questions about the legislature’s potential role in confirming a position like a cabinet secretary, regardless of which party controls the governor’s mansion, said Sen. Morgan McGarvey, a Louisville Democrat and Senate Minority Floor Leader.
“The cabinet secretaries are part of the executive branch, and they report to the executive branch and not the legislative branch,” McGarvey said.
The Kentucky Chamber of Commerce has pushed for a state gas-tax increase and additional transportation funding. Ashli Watts, the chamber’s president and CEO, said she believes the Senate bill would couple well with broader infrastructure legislation.
“We appreciate being at the table and having a voice in infrastructure, which is critical to any kind of business or economic development,” she said.

Welke "vermoedelijke" inmenging vanuit Oekraine? Er is juist een aantal getuigen vanuit de Nationale Security Council geweest die dit nadrukkelijk hebben benoemd als Russische propaganda. Wat losse individuen die een opiniestuk schrijven is natuurlijk niet zozeer iets vanuit de Oekrainse overheid of vergelijkbaar met de miljoenen die Rusland spendeerde + het hacken van emails en voter rolls.

A Game-Changing Provision in the House Impeachment Resolution
quote: The House of Representatives adopted a resolution today to guide their continuing impeachment inquiry. That resolution sets out basic procedures governing, for example, how witnesses will be called and questioned as well as how written materials will be obtained. An important part of that resolution deserves special attention. The provision is not just a significant inclusion but a wise one, as well. It may, at some point in the process, become a game changer. The House Resolution incorporates by reference procedures adopted by the Judiciary Committee that will be entered into the Congressional Record. Those procedures are contained in an accompanying document, which has this key language: “Should the President unlawfully refuse to make witnesses available for testimony to, or to produce documents requested by, the investigative committees . . . in furtherance of the investigations described in the first section of [this resolution], the chair shall have the discretion to impose appropriate remedies, including by denying specific requests by the President or his counsel under these procedures to call or question witnesses.”This is, in effect, a discretionary measure that would keep President Donald Trump’s lawyers from participating in the impeachment process if the Trump White House continues to refuse to produce documents and bar witnesses from testifying. The provision is smart, important, and possibly even alters the current balance of power between Congress and the White House. This provision recognizes that the White House should not be permitted to participate in the process only on its own terms. If the White House wants to participate in full, then it has an obligation to respond to legitimate requests for witnesses and documents from the House. To understand the value of this provision, it is important to recognize the limitations and drawbacks of the other responses that the House has available to it, at least in theory, to address noncompliance by the Trump White House in the face of the impeachment inquiry. What are those other options? SPOILER First, the House could hold in civil contempt those who, after being subpoenaed, fail to testify or provide materials. Such a finding is then enforced in the courts. Here, the courts simply will not move fast enough to resolve the legal issues and facilitate the impeachment process. We have already seen the White House use the courts repeatedly to slow down a number of investigations by the House and others, like New York authorities, seeking to review President Trump’s conduct.
Second, the House could punish President Trump himself by making obstruction of the House’s impeachment inquiry a separate charge of impeachment. Chairman Adam Schiff has referenced that possibility. Such a course is completely worth taking if the recalcitrance continues. That option, however, does not carry much independent force. There is good reason to think the House will include obstruction charges anyway due to a variety of other actions the White House has already taken including the intimidation of the whistleblower and other witnesses. What’s more, the Senate is unlikely to convict the President of the obstruction charge unless it also convicts of the more serious abuse of office charge. For these reasons, this path will not cause the White House to reconsider its refusal to cooperate because the more important battle will be over whether he abused his office by pressuring a foreign government to benefit him personally by investigating a political opponent.
Third, the House could refer individuals who refuse to provide documents or testify in response to subpoenas for criminal contempt prosecutions. That path should undoubtedly be pursued, perhaps at the same time that the House votes on articles of impeachment. This path puts the responsibility squarely on the individual who is refusing in the face of a subpoena to comply. The punishment will not be on the White House or on President Trump but on the individual who is refusing. This course can be enormously effective, particularly against Administration lawyers who need to worry about losing their bar licenses. Other individuals may care about the damage to their personal and professional reputations having been found in criminal contempt by Congress. Under the statutory scheme, such criminal contempt findings are referred to the Department of Justice for prosecution. President Trump’s own Justice Department of course will not prosecute any criminal contempt findings referred by the Democrat-led House. Subpoenaed witnesses must remember, however, that there might be a very different Justice Department making prosecution decisions starting in January 2021 if President Trump is not re-elected. The statute of limitations will not have run.
This fact is what makes White House Counsel Pat Cipollone’s letter to the House of a few weeks ago so unwise and ultimately ineffective. A witness can resist a Congressional subpoena only if the witness has a valid privilege against testifying. Mr. Cipollone’s claim that the process is unfair so the White House will not make witnesses available is a public relations statement, but does not amount to a legal privilege. That is the reason that numerous current and former government officials have complied with their subpoenas and testified as required by the law. Witnesses, including numerous current government officials, began testifying before the House Intelligence Committee within days of Mr. Cipollone’s letter.
While some witnesses have testified, many have not, and numerous document requests to the White House and the Office of Management and Budget have not been answered. Punishing the White House’s noncompliance with nonparticipation in this impeachment inquiry itself makes good sense. Sanctions such as what the draft resolution contemplates are quite common in civil litigation where one side abuses the discovery process. Their impact is immediate, which makes their deterrent effect powerful.
Republicans will surely complain if House makes good on this provision’s threat; but the Trump Administration has the ability to get out from under this constraint if it simply provides appropriate witnesses and documents to allow the House get to the bottom of the issues it is investigating in the course of fulfilling its constitutionally authorized role to consider impeachment. Adding this provision to the House resolution and the accompanying judiciary Committee procedures document was wise, and the House Judiciary Chair should not hesitate to use it.

The illegality of the funding hold is important to the impeachment inquiry, as it adds further weight to the case that Trump abused his authority as president to pressure Ukraine to interfere in the 2020 U.S. election.
It shows that the Trump White House created an irregular budgetary process to match its irregular foreign policy process with respect to Ukraine. The illegality of the hold also undermines the claim that Trump was concerned about Ukrainian corruption, since he was willing to break U.S. law to keep the money frozen. Finally, it shows that it was not policy or legal concerns that led to the money being released, but rather the fear of getting caught.
While this violation of budgetary laws is not the most significant attack on the rule of law related to Trump’s Ukrainian extortion campaign, it is an important part of the broader case for impeachment.

Trouwens, de verklaringen van die OMB-lui zijn wellicht nog wel het meest schadelijk voor Trump tot nu toe. Het verhaal dat Trump 'iets in het nieuws' gehoord had over hulp aan Oekraïne en daarom rücksichtlos opdracht gaf om de hulp 'on hold' te zetten is heel erg plausibel. Als dat waar is dan is er al een aanklacht: dat was namelijk al meteen illegaal.
