In bepaalde karakteristieken is Trump een beter mens dan andere machtige mensen in de VS, en in andere opzichten is hij slechter.
Wat ik me afvraag, is waar die angst (geprojecteerd als haat), vandaan komt. Waar ben je nou echt zo bang voor met 4 jaar Trump? Waar zijn de media en Democraten nou echt zo bang voor? Waarom moest hij zo snel mogelijk worden verwijderd? Dat lijken me relevante vragen als meer wil dan alleen symptoombestrijding. Welke plannen zijn in het water gevallen met de verkiezing van Trump?

SPOILER Mr. Trump has been considering creating an immigration “czar” post for months, with Mr. Cuccinelli and Kris Kobach, the former Kansas secretary of state, as his top choices. But Mr. Kobach was always seen within the White House as unlikely to get the role, and he put off Mr. Trump and some of his advisers with a list of ten “requirements” he had for the job, including access to a government jet 24 hours a day, weekends off with his family in Kansas, and a promise to be nominated for Mr. McAleenan’s job by November if he wanted it.
Other questions remain about how Mr. Cuccinelli will navigate relationships within the administration at a time when Mr. Trump’s son-in-law, Jared Kushner, and his senior adviser, Stephen Miller, are jockeying for influence on immigration policy. Mr. Miller, whose positions are more aligned with Mr. Cuccinelli’s than Mr. Kushner’s on the issue, is said to be supportive of the choice.
Mr. McAleenan, who was named acting secretary for Homeland Security after the resignation of Kirstjen Nielsen, is known as a stern career law enforcement official who has respect from both Democrats and Republicans. He previously served as commissioner of Customs and Border Protection.
While he carried out Mr. Trump’s “zero-tolerance” policy, which led to family separations, he has also backed aid to Central American countries and has acknowledged many of migrants are fleeing gang violence and poverty. Rather than describing migrants as criminals on his television appearances, he has frequently emphasized his fear that more migrant children will die in federal custody. Three migrant children have died in the custody of Customs and Border Protection since December.

This is the textbook definition of obstruction of justice, and McGahn's testimony threatens to expose this to millions of Americans across the country who haven't read the Mueller report.
The White House previously invoked executive privilege in an effort to prevent McGahn from producing documents to Congress. Now the White House -- perhaps recognizing that its executive privilege invocation would likely fail on the legal merits -- has changed tack and instead made an even broader claim that Congress cannot ever compel testimony from a senior adviser to the President.
This is nuts. The White House is relying on a brand new memo from the Office of Legal Counsel claiming that, as an absolute matter of separation of powers and executive branch autonomy, Congress cannot force the President's senior advisers to testify.
Notably, the memo cites not a single court decision to support this novel proposition. The memo does begrudgingly note in passing that the only court opinion on the matter, a 2008 decision relating to testimony from former White House Counsel Harriet Miers, actually reaches the opposite conclusion: Senior advisers to the President are not immune from compelled congressional testimony.
Of course, there is also extensive precedent against the White House's position. Senior advisers to presidents of both parties have testified in Congress routinely -- and over many decades. The White House's new position would effectively put an end to that longstanding and not particularly controversial practice, or at least give the executive branch a hook on which to selectively prevent some advisers from testifying.
Most fundamentally, the White House's position further threatens the balance of powers between the White House and Congress. If Trump gets his way on this, then the congressional power to conduct oversight is all but doomed.
Trump's game here is to throw the kitchen sink at the problem and, at a minimum, delay McGahn's testimony. If Congress is serious about hearing from McGahn, then it needs to skip the ceremonial contempt votes, take the issue to court and insist on an expedited ruling from a judge. (And if Monday's expedited ruling from a DC District Court judge, ordering Trump's accounting firm to turn over financial records to the House Oversight Committee is any indication, several judges may be willing to take swift action.)
Anything short of that plays right into Trump's hands.

Confidential draft IRS memo says tax returns must be given to Congress unless president invokes executive privilege

The memo contradicts the Trump administration’s justification for denying lawmakers’ request for President Trump’s tax returns, exposing fissures in the executive branch. Trump has refused to turn over his tax returns but has not invoked executive privilege. Treasury Secretary Steven Mnuchin has instead denied the returns by arguing there is no legislative purpose for demanding them. But, according to the IRS memo, which has not been previously reported, the disclosure of tax returns to the committee “is mandatory, requiring the Secretary to disclose returns, and return information, requested by the tax-writing Chairs.” The 10-page document says the law “does not allow the Secretary to exercise discretion in disclosing the information provided the statutory conditions are met” and directly rejects the reason that Mnuchin has cited for witholding the information.“[T]he Secretary’s obligation to disclose return and return information would not be affected by the failure of a tax writing committee ... to state a reason for the request,” it says. It adds that the “only basis the agency’s refusal to comply with a committee’s subpoena would be the invocation of the doctrine of executive privilege.” The memo is the first sign of potential dissent within the administration over its approach to the tax returns issue. The IRS said the memo, titled “Congressional Access to Returns and Return Information,” was a draft document authored by a lawyer in the Office of Chief Counsel and did not represent the agency’s “official position.” The memo is stamped “DRAFT,” it is not signed, and it doesn’t reference Trump. The agency says the memo was prepared last fall. At the time, Democrats were making clear they would likely seek copies of Trump’s tax returns under a 1924 law that states that the IRS “shall” turn over tax returns to Congress. The agency says IRS Commissioner Charles Rettig and current chief counsel Michael Desmond, who took over in February, were not familiar with it until a Washington Post inquiry this week. Mnuchin has criticized the demands as harassment that could be directed against any political enemy, arguing Congress lacks a “legitimate legislative purpose” in seeking the documents.
Breaking with precedent, Trump has refused to provide tax returns, saying without evidence they are under audit.
Mnuchin and other senior staff members never reviewed the IRS memo, according to a Treasury spokesman. But the spokesman said it did not undermine the department’s argument that handing over the president’s tax returns would run afoul of the Constitution’s mandate that information given to Congress must pertain to legislative issues.
The spokesman said the secretary is following a legal analysis from the Justice Department that he “may not produce the requested private tax return information.” Both agencies have denied requests for copies of the Justice Department’s advice to Treasury.
Some legal experts said the memo provides further evidence that the Trump administration is using shaky legal foundations to withhold the tax returns.
“The memo is clear in its interpretation of the law that the IRS shall furnish this information,” said William Lowrance, who served for about two decades as an attorney in the IRS chief counsel’s office and reviewed the memo at the request of The Post.
Daniel Hemel, a professor at the University of Chicago Law School who also reviewed the memo for The Post, said the document suggests a split over Trump’s returns between career staffers at the IRS and political appointees at that agency and the Treasury Department.
“The memo writer’s interpretation is that the IRS has no wiggle room on this,” Hemel said. “Mnuchin is saying the House Ways and Means Committee has not asserted a legitimate legislative purpose. The memo says they don’t have to assert a legitimate legislative purpose — or any purpose at all.”
The administration has resisted a range of House inquiries, although a federal judge on Monday ruled the president’s accounting firm must turn over his financial records to Congress.
Treasury Department officials said there had been extensive discussions about the tax return issue, with one official saying the issue put the agency in a difficult spot because Trump has predetermined the outcome — and Mnuchin is a Trump ally who was the finance chair of his 2016 campaign.
“The decision has been made,” this official said, speaking on the condition of anonymity to discuss private conversations. “Now it’s up to us to try to justify it.”
Trump has told advisers he will battle the issue to the Supreme Court, according to people familiar with the matter. Trump recently has argued that the tax returns were an issue in the 2016 election, but he won anyway — so they should no longer be an issue.
Last week, Mnuchin told a Senate panel that Treasury Department lawyers held an early discussion about disclosing the tax returns long before Democrats officially demanded the documents in April. He did not reveal details of that deliberation or say what, if any, legal memos he had reviewed.
Some legal experts have held that the law is clear in giving Congress the power to compel the provision of the returns. But other former government lawyers, including two who served in the Reagan and George H.W. Bush administrations, have argued that the law is unconstitutional and could lead to widespread abuses of taxpayer privacy for political aims.
The IRS memo describes how and why Congress has the authority to access tax returns, explaining the origin of the provision and how it has been interpreted over the decades.
It highlights the special powers given to three committees for compelling tax returns: the House Ways and Means Committee, the Senate Finance Committee and the Joint Committee on Taxation. Other congressional committees, the memo emphasizes, do not have the same authority to compel returns.
When it comes to the Ways and Means Committee, the obligation to divulge the returns “would not be affected by the failure” to give a reason for the request. By contrast, other committees “must include a purpose for their request for returns and return information when seeking access,” the memo states.
“One potential basis” for refusing the returns, the memo states, would be if the administration invoked the doctrine of executive privilege.
But the IRS memo notes that executive privilege is most often invoked to protect information, such as opinions and recommendations, submitted as part of formulating policies and decisions. It even says the law “might be read to preclude a claim of executive privilege,” meaning the law could be interpreted as saying executive privilege cannot be invoked to deny a subpoena.
Earlier this month, the nonpartisan congressional Research Service published a review of Section 6103 that found the code “evinces no substantive limitations” on the Ways and Means Committee’s authority to receive the tax returns.
But, the CRS report added, the committee’s authority “arguably is subject to the same legal limitations that generally attach to Congress’ use of other compulsory investigative tools,” including the need to serve some “legislative purpose” and not breach constitutional rights.

Tillerson’s arrival at the Capitol was handled with extreme secrecy. No media advisories or press releases were sent out announcing his appearance. And he took a little noticed route into the building in order to avoid being seen by members of the media. SPOILER Tillerson reached out to the committee and expressed a willingness to meet, a committee aide said. In a more than six hour meeting, he told members and staffers that the Trump administration actively avoided confronting Russia about allegations of interference in the election in an effort to develop a solid relationship with the Kremlin, a committee aide told The Daily Beast.
Tillerson also told members and aides that he had tried to establish a formal and disciplined interagency process at the State Department whereby the president could receive informed briefings on sensitive foreign policy matters, the aide said. That effort never manifested, Tillerson told the committee, in part because of the president’s management style, but also because of interference from other aides.
Tillerson told the committee that the president’s son-in-law, Jared Kushner at times impeded his ability to effectively communicate and introduce to President Trump policy proposals developed by State Department experts on major foreign affairs matters across the globe, not just in the Middle East. Kushner, a White House advisor, has publicly focused much of his international efforts on the Middle East and is set to unveil a Middle East peace plan in the coming weeks.
Tillerson had a notoriously prickly relationship with the president, reportedly calling him a “moron” in private. But he was present during critical moments of the administration, including Trump’s 2017 private meeting with Russian President Vladimir Putin in Hamburg, Germany.
Since leaving his post, he has rarely made public appearances, save for speaking at a panel in Houston in December. During that appearance, he said there was “no question” Russia interfered in the 2016 presidential election.
"So often, the president would say here's what I want to do and here's how I want to do it and I would have to say to him, Mr. President I understand what you want to do but you can't do it that way. It violates the law," Tillerson said.
Tillerson’s interview by House Foreign Affairs Committee Chairman Eliot Engel (D-NY) and ranking member Michael McCaul (R-TX) comes a month after Special Counsel Robert Mueller published his report on Russian interference in the 2016 presidential election. Since then, top Democrats on the Hill have demanded that Attorney General Bill Barr and Mueller answer questions related to the report and its publication. Barr has declined to testify before the House, citing the insistence of the committee that staff lawyers be allowed to conduct some of the questioning. Mueller is reportedly in negotiations to testify, though the Department of Justice had previously not agreed on a date for him to do so.
On Tuesday, CNN reported that Mueller’s team had expressed reluctance about the possibility of a testimony taking place in public for fear that it would appear political.

“Congress has a responsibility for making the laws that govern this,” Carson said. “If in fact you want to explain to the American citizens who have been on the wait list for several years . . . why we should continue to support families who are not here legally, I would be happy to join you in explaining that.”
Current rules bar undocumented immigrants from receiving federal housing subsidies but allow families of mixed-immigration status to live together as long as one person — such as a child born in the United States — is eligible.
Carson acknowledged that undocumented immigrant parents do not get housing subsidies. HUD-subsidized rent is prorated to cover only eligible residents. But, he wondered, “How do you prorate a roof over somebody’s head?”
“The concept of prorating makes no sense in this context,” Carson said. “I call it giving aid and assistance to people who are here illegally.”
Rep. Maxine Waters (D-CA), chairwoman of the House Financial Services Committee, said she is “troubled by Secretary Carson’s recent cruel proposal to terminate housing benefits for families with mixed immigration status.”
“Prorated rental assistance allows mixed-immigration status families to remain together while exclusively subsidizing only those family members with eligible status,” Waters said. “The Trump Administration’s proposal puts mixed-status families at risk of being evicted, separated, and left homeless.”
Democrats are considering legislation to block the proposal.
HUD’s analysis of the proposal, pushed by White House senior policy adviser Stephen Miller, found that the new rule would displace more than 55,000 children who are legal U.S. residents or citizens.
The HUD analysis, written by career staff, concluded the proposal would increase costs for the federal government and reduce the number of families served — contrary to the Trump administration’s stated goal of moving more families off the years-long waiting lists for housing assistance.
“Mr. Secretary, the 'D' in HUD does not stand for deportation,” said Rep. Carolyn B. Maloney (D-NY), adding that affordable housing for Americans should not come as a result of “throwing other Americans out into the street.”
Carson told a Democratic senator last week that the motivation behind the Trump administration’s plan to inventory all immigrants living in public housing is to build pressure on Congress to pass comprehensive immigration reform and pointed out that no one will actually be evicted for 18 months, according to the senator who spoke on the condition of anonymity to relay a private conversation. When the senator responded that President Trump is unlikely to sign a comprehensive immigration plan, Carson replied: “The thinking on that may be changing.”

House Speaker Nancy Pelosi (D-Calif.) has resisted such calls for impeachment, even as pressure builds to take some action. Schiff’s decision to accept the Justice Department’s efforts to accommodate his requests provides her with a potential off-ramp to avoid calls for impeachment, at least in the near future, as the Intelligence Committee determines whether the Justice Department is satisfying its demands.
Both the House Intelligence and Judiciary committees have been making the case to Barr that they should be able to view the full contents of Mueller’s report, plus certain underlying materials. Barr has argued that it would be illegal for him to deliver the full redacted materials to the Judiciary Committee as requested, because it would require releasing grand jury information that cannot be disclosed without a court order. He has rejected House Democrats’ entreaties to join them in making an appeal to a judge to release those materials.
But Schiff made his case for seeing the same materials on the grounds that the Mueller report deals with counterintelligence matters — and the Intelligence Committee has a legal right to view materials pertaining to counterintelligence, whether they originated with a grand jury or not. Rep. Devin Nunes (Calif.), the committee’s top Republican, had joined Schiff in letters to Barr making the case for such access, although he did not sign on to the eventual subpoena that Schiff issued earlier this month.
“The Department has repeatedly acknowledged the Committee’s legitimate oversight interest in these materials,” Schiff said in a statement Wednesday. “I look forward to, and expect, continued compliance by the Department so we can do our vital oversight work.”

Michael Cohen Filings Show 950 Messages With Russian Oligarch's Cousin

The communications between Cohen and Andrew Intrater, the chief executive officer of Columbus Nova LCC, began on the day of Donald Trump's election, according to a U.S. search-and-seizure warrant filed in Washington on Aug. 7, 2017, and unsealed on Wednesday.
Citing public records and news reports, the government said Columbus Nova is an investment management firm controlled by Renova Group, which is itself controlled by Viktor Vekselberg, a wealthy Russian citizen. Intrater, an American, is a cousin of Vekselberg.
Columbus Nova has denied that it's an arm of Renova Group. On Wednesday, a spokesman for the firm dismissed the significance of the filing: "OMG breaking news: two people who were working together talked on the phone and texted each other. Scroll down to the next story where Bloomberg reports on water being wet!"
According to the government's filing, "Telephone records related to Cohen's cellular telephone show that on or about Nov. 8, 2016, the day of the presidential election, a telephone registered to Cohen exchanged the first in a series of text messages with the CEO of Columbus Nova."
The relationship between Cohen and Columbus Nova has been previously reported, with news reports indicating that the U.S. firm invested about $500,000 with Cohen after the election. The full extent of the contacts between Cohen and Intrater hasn't been reported.
The search warrant applications show that federal authorities were investigating Cohen for matters including violations of the Foreign Agents Registration Act. Cohen wasn't charged with FARA violations.
He pleaded guilty to tax evasion, making false statements to a bank, lying to Congress, and campaign finance violations. He's now serving a three-year sentence in a federal prison in Otisville, New York.
