With a plea deal announced Friday in the second trial of former Trump campaign manager Paul Manafort, the possibility that President Trump will issue a pardon to prevent Manafort's future cooperation with special counsel Robert S. Mueller III warrants fresh attention.
Trump's supportive tweet about Manafort after his conviction in August on eight felony fraud counts, praising him for not cooperating with prosecutors, was widely interpreted as a hint of future presidential leniency. Trump has insisted on his "absolute" power to pardon even himself, and his lawyers in a secret January memo to Mueller asserted the president's complete control over federal investigations as the nation's chief law enforcement officer.
Trump and his team have tried to lay the groundwork for pardons to protect him from criminal charges. But can he use the pardon power in that way? Not in our reading of the law. A self-pardon, or a pardon that is self-protective and serves the same purpose as a self-pardon, would be an abuse of power that violates the Constitution and, as such, could warrant impeachment.
If the president can use the pardon power to protect himself from prosecution, it would effectively transform him into an authoritarian ruler, incapable of being limited by law or any other branches of government. In constitutional terms, using the pardon power in this way would appear to violate Article II, which requires the president to "take Care that the Laws be faithfully executed." To honor his oath of office, in other words, the president must act faithfully to "preserve, protect and defend the Constitution" to the best of his ability.
A president's first obligation is to the Constitution and its faithful enforcement — not to himself. He may not act, or fail to act, for corrupt or self-interested reasons. And he must enforce the laws Congress has enacted, not subvert those laws to his own interests or those of his cronies.
The president's powers — even seemingly unfettered ones, such as the power of the pardon — must be exercised within the parameters of other legal requirements derived from the Constitution or enacted by statute. To see this most clearly, consider a diverse group of people: the class of people who violated the Selective Service laws during the Vietnam War by burning their draft cards, fleeing to Canada, or through other, nonviolent acts of protest. President Jimmy Carter used the pardon power to grant clemency to everyone who had broken these laws in protesting the war — a merciful gesture by Carter, whatever your view on the merits of the conflict.
But what if, say, Carter had granted the same clemency but limited it to Caucasians and excluded all people of color. Or if he afforded clemency only to Catholics, but not to Protestants, Jews or Muslims. Americans would surely say that the pardon power could not be used in that way — and that using a lawful power to violate another law (in this case, the right to equal protection) would render the pardon itself illegitimate and unlawful.
The principle would also apply to self-protective pardons; the power itself cannot reasonably be read to allow its use to further violations of other laws — in Trump's case, that might mean laws against corruption, obstruction and conspiracy.
The Office of Legal Counsel, which sits in the Justice Department and provides the president with opinions on executive actions, has the view that the president cannot self-pardon. As part of the executive branch, the OLC is very much in favor of executive power.
But on the issue of self-pardons, the OLC has been more restrained. In a 1974 opinion, written four days before President Richard M. Nixon resigned, the head of OLC wrote that the president cannot pardon himself, under "the fundamental rule that no one may be a judge in his own case." That is a rare example of the executive branch articulating a limit on its own power, and it shows why a president's use of the pardon power for others to obstruct an investigation and to immunize himself from liability would be legally suspect.
The OLC's opinions are binding only for subordinates in the executive branch. A president is free to ignore them, as some presidents have. But if the president were to issue a self-protective pardon, as in the case of Manafort, that would be a novel, untested act that would run counter to the precept that in our country, nobody is above the law.

Ongeacht wat Trump er van vind moet dit natuurlijk uitgezocht gaan worden, maar dat zal in het huidige Amerika wel niet gebeuren.
Wat je ziet is dat Trump meer de 'baas' van het bedrijf Amerika is dan een politicus of bureaucraat. Dat wil zeggen dat hij iemand een vriendje met weinig tot geen kennis van zaken aanwijst die het probleem moet oplossen op basis van zijn aanwijzingen, maar dat hij verder niet heel diep de detail induikt. In de politiek werkt dat toch heel anders.

President Trump will announce $200 billion in tariffs on Chinese goods early next week, despite his administration's ongoing trade negotiations with Chinese officials.
The Wall Street Journal reported Saturday that Trump administration officials are prepared to make an official announcement as early as Monday or Tuesday.
A White House spokeswoman declined to comment to the Journal on a potential announcement, instead pointing to a Friday statement encouraging China to address trade issues with the U.S.
“The president has been clear that he and his administration will continue to take action to address China’s unfair trade practices. We encourage China to address the long standing concerns raised by the Unites States," the statement reads.
The news comes days after Trump met with top economic advisers to discuss trade moves against China. On Thursday, the president tweeted that increased pressure was having an effect on China's economy.
"They are under pressure to make a deal with us," Trump tweeted. "Our markets are surging, theirs are collapsing. We will soon be taking in Billions in Tariffs & making products at home. If we meet, we meet?"
Previous back-and-forth measures imposed by the two countries have totaled more than $50 billion in reciprocal measures, as China has retaliated against U.S.
Hundreds of billions more in tariffs have been proposed by Trump, but those measures have been delayed while officials determine a final list of products.
Last week, Trump threatened a third round of tariffs on another $267 billion of Chinese imports, covering more than total Chinese exports to the U.S.

Former GOP mega-donor Seth Klarman urged voters to support Democrats in the coming midterm elections and said in a recent interview that he believes “democracy is at stake.”
“One of the reasons I’m willing to come out of my shell and talk to you is because I think democracy is at stake,” Klarman said in an interview with The New York Times published on Saturday. “And maybe I’ll be able to convince some other people of that. And get them to support Democrats in 2018.”
Klarman, who was previously one of the biggest donors to the Republican Party in New England, told The Times he has donated $4.9 million to nearly 150 candidates.
Some of the Democratic candidates who have received Klarman's cash in this election cycle alone are Massachusetts Rep. Joe Kennedy III (D), Texas Senate candidate Rep. Beto O’Rourke and Sen. Kirsten Gillibrand (D-N.Y.), a potential presidential candidate. But, as Klarman puts it: “I’m not a Democrat.”
“We need to turn the House and Senate as a check on Donald Trump and his runaway presidency,” Klarman, who donated more than $2.9 million to Republicans in the 2016 election cycle, said.
The hedge funder said he feels “betrayed” by “spineless” Republicans who he says have been “profiles in cowardice.” Now, Klarman says the only option is to “act as a check and balance.”
“If one looks at my past giving, one might think that several million, 5 or 6 million, might be a lot in a cycle,” Klarman said. But he added that he is “stretching far beyond what I usually do” in the current cycle.
“By the election I think I’ll have spent between $18 and $20 million,” he continued, which would make him one of the top donors for the Democratic Party this year.
“Think of it this way,” Brendan Quinn of the Center for Responsive Politics told the Times. “As of August, George Soros has given $12 million. I have no way of knowing how much more he’ll contribute this cycle, but it’s entirely possible that Klarman could end up giving more than him.”
Klarman called the current state of Washington an “emergency” and suggested voters consider the price tag for democracy in the coming midterm elections. “It seems like the answer should be a huge amount,” Klarman said.
Klarman, who has a history of slamming President Trump, also accused Republicans of giving a huge tax cut “largely to rich people” and slammed them because they “were supposed to be the fiscally responsible party.”
“Whatever irresponsible fiscal things the Democrats do won’t be worse than what the Republicans have already done,” Klarman said.
Though Klarman said his interview with the Times “could conceivably upset a few of my clients,” he added that “it’s more important that I do what my conscience requires by speaking out.”
