Rule 26(a)(1)(A)(iii): Damages

13is $32,321,821.94. The United States seeks three times that amount, plus the maximum penalties allowed by the FCA, with respect to all claims paid on or after June 10, 2000. With respect to claims submitted from 1998 to June 10, 2000, and to the extent the United States prevails only on its common law fraud or breach of contract claims with respect to any period on or after June 10, 2000, the damages the United States seeks are the single damages described above, plus pre- and post-judgment interest. To the extent the United States prevails only on its unjust enrichment claims with respect to any time period, the damages the United States seeks are the amount by which the particular defendant was unjustly enriched, plus pre- and post-judgment interest. The United States will make the documents or other evidentiary material on which these computations are based available for inspection and copying, unless privileged or protected, pursuant to Rule 26(a)(1)(A)(iii) of the Federal Rules of Civil Procedure. The United States anticipates using experts to present evidence regarding its damages, including alternative measures of damages based upon the negative impact of the team’s doping on the USPS.
