The FBI’s misbehavior was too much for the Justice Department.
On Thursday afternoon the Justice Department demolished what was left of its own prosecution of former National Security Adviser Michael Flynn. He had been awaiting sentencing for lying to FBI agents on his fourth day on the job.
In a motion to dismiss the case against him, U.S. Attorney Timothy Shea argued that the FBI had no basis under which to interview Flynn, that agents who interviewed him did not believe he lied, and that what he told those agents on Jan. 24, 2017, had no material effect on the bureau’s investigation into Russia’s interference in the 2016 presidential election.
“Mr. Flynn’s request that Russia avoid ‘escalating’ tensions in response to U.S. sanctions in an effort to mollify geopolitical tensions was consistent with him advocating for, not against, the interests of the United States,” Shea wrote. “At bottom, the arms-length communications gave no indication that Mr. Flynn was being ‘directed and controlled by … the Russian federation,’ much less in a manner that ‘threatened … national security.’”
These words are devastating to Flynn’s critics. The FBI had been ready to close the Flynn case in early January 2017, as a memo released last week makes clear. That memo found that the bureau turned up no “derogatory information” from classified government databases or confidential human sources.
Shea found the decision to continue with the case risible. “The FBI sidestepped a modest but critical protection that constrains the investigative reach of law enforcement: the predication threshold for investigating American citizens,” he wrote.
By keeping the investigation open, the FBI was able to secure an interview with Flynn without going through the proper channels at the White House. “The irregular procedure that preceded his interview, suggests that the FBI was eager to interview Mr. Flynn, irrespective of any underlying investigation,” Shea wrote. In other words, the FBI was more interested in catching Flynn in a lie than in investigating an actual crime.
Indeed, Shea undermines former FBI Deputy Director Andrew McCabe’s account of his phone call with Flynn to set up the interview. McCabe wrote in his 2019 memoir that he asked Flynn if he wanted a lawyer or the White House counsel to be present. Shea writes that McCabe “effectively discouraged Mr. Flynn from procuring counsel or even notifying the White House Counsel.”
All of this is important because almost a year after that interview, Flynn pleaded guilty to one count of making false statements to the FBI in a deal with Special Counsel Robert Mueller. In exchange for cooperation and a side agreement not to pursue charges against his son, the special counsel agreed to recommend a lenient sentence.
At the time, Flynn did not know about all the shortcuts, missteps and irregularities in the FBI’s investigation into him. What’s more, the FBI agents who interviewed him at the time did not even think he was lying. Shea writes: “The statements in question were not by their nature easily falsifiable. In his interview, Mr. Flynn offered either equivocal (‘I don’t know’) or indirect responses, or claimed to not remember the matter in question.”
As to why Flynn copped a plea: Flynn and his lawyers have never been provided with a transcript of his call with the Russian ambassador. It was not until late last year that Flynn was provided with much of the material that led the Justice Department to drop the prosecution. Flynn’s lawyers did not receive the January 2017 memo recommending the case be dropped until last week.
Instead, Flynn faced the full brunt of Special Counsel Robert Mueller. He was threatened with enforcement of the Foreign Agents Registration Act for minor omissions in his contract to represent a Turkish businessman who Flynn later admitted was standing in for the government of Turkey. In September a judge threw out the prosecution of his business partner in a separate case brought by the Justice Department. His son was also threatened with prosecution. After fighting the case for nearly a year, Flynn wanted the nightmare to be over.
What happened to Michael Flynn happens a lot in America’s criminal justice system, it’s true. It’s fair to ask why the Justice Department has decided to intervene in this case at this time. But it’s also fair to ask why, just before a new president took office and against its own investigators’ recommendation, the FBI’s leadership kept the case open without proper predication. Equality under the law is a bedrock American principle. So is the peaceful transfer of power.

Ik zie veel en toevallig ook hier weer dat er veel wordt gezegd "ja, maar Flynn bekende schuld". Er wordt dan weggelaten dat er geen juridische basis was om hem überhaupt te ondervragen, de FBI-agenten na het verhoor op 24 januari 2017 vonden dat hij niet had gelogen, de FBI (Lisa Page) de FD-302 van Micheal Flynn vervalste, openbaar aanklager Brandon van Grack hem chanteerde, Covington & Burling met de openbaar aanklagers tegen hem hadden samengespannen en een belangenconflict hadden. Miranda-rechten zijn Flynn ontzegt, Brady-materiaal en andere belangrijke informatie is achtergehouden dat invloed heeft gehad op zijn beslissing een plea deal overeen te komen.
Er is zoveel onrecht in deze zaak te duiden dat dismissal with prejudice de enige juiste uitkomst is. En ook niet vergeten dat de basis van dit debacle een telefoongesprek was met de Russische ambassadeur. De FBI had het juist het crimineel lekken moeten onderzoeken en niet Flynn over de inhoud van dit gesprek moeten ondervragen, want deze informatie is top-geheim en valt buiten de jurisdictie van FBI-agenten. Wat Flynn deed in zijn rol als National Security Advisor was het uitoefenen van diplomatie in het belang van de Verenigde Staten en verder niets onwettigs. Deze rechtszaak is een grote frace geweest net zoals heel het domme Rusland-onderzoek verspilde moeite is geweest.
Ik vergeet te vermelden dat Flynn vervold is op basis van de Logan Act. Gewoon verzonnen BS van een FBI die totaal irrationeel en buitensporig handelde.
Het mainstream narratief is nu dat Micheal Flynn valse verklaringen heeft afgelegd over de sancties. Alleen het probleem daarmee is dat het woord sanctie niet in de FD-302 van Peter Strzok voorkomt. In het stuk van Lawfareblog bijvoorbeeld wordt gesteld dat Flynn het advies gaf aan de Russen dat ze de sancties moesten negeren. Het probleem met dit narratief is, is dat een geen reactie van de Russen op de Amerikaanse sancties winst zou betekenen voor de Verenigde Staten. De sancties waren immers al opgelegd, de diplomaten het land uitgezet en de consulaten gesloten. De Amerikanen waren op hun beurt nog steeds in Rusland. Notice Lynch's word choice here, "I do not recall." For three years, our entire political system, every television show, every newspaper, all media outlets revolved around the hunt for Russian spies.
We were told again and again in order to justify this that collusion was the greatest crime ever committed in American history. It was a crime against the state, it undermined our democracy.
Yet, the Attorney General of the United States, a close friend of the President, Barack Obama's claims she, quote, " ... does not recall" if she ever received any evidence that any of it was true.

Then FBI lawyer Lisa Page, who neither attended the interview nor is an agent, edited it again, according to the DOJ evidence. And then that version of the 302 was never given to the court. The biggest, and perhaps most troubling discovery, according to DOJ officials and Flynn's lawyers, was the majority of the above evidence was withheld from the courts and Flynn's legal team for years despite repeated orders that all exculpatory Brady materials, i.e. evidence of innocence, be produced.
U.S. District Judge Emmet Sullivan must still decide whether to accept the Justice Department's request to dismiss the charges. And then the judge must decide whether the prosecutors and agents in the case should face punishment.
In the meantime, Flynn lost three years of his life, his job, and his home and endured crushing legal bills and public shame. That what makes this dirty dozen list so egregious to critics of this investigation.

Het is maar hoe selectief je er naar kijkt en wat je betrouwbaar denkt te vinden. Er is ook voldoende nieuws dat Trump wel degelijk wat te verbergen heeft. En dat Trump banden heeft met corrupte politici en zakenlui in de Russiche Federatie is wel bekend. Ik heb zojuist aangegeven dat veel officials uit de Obama-regering in televisieoptredens suggereerden of ronduit stelden dat leugens vertelden over Russia collusion. Dit heb ik van meet af aan afgewezen, omdat er simpelweg geen feitelijk bewijs daarvoor was. Het antwoord op jouw vraag is een ondubbelzinnige nee.
En ik begrijp de laatste vraag niet. Ik kan er wel over zeggen dat ruim drie jaar lang de suggestie is gewekt dat in welke vorm dan ook contact met Russen verdacht is of bewijs is van een geheime samenwerking en dat is simpelweg een verschrikkelijke manipulatieve manier gebleken om een narratief in stand te houden. En dat is volkomen laakbaar, imo.
