Tevens was abortus juist de betere oplossing in China. Doordat het vaak niet mogelijk was (vanwege cultuur maar ook technische redenen) werden meisjes gewoon vermoord zodra ze geboren werden. Heb toch liever abortus dan dat mensen hun baby gewoon de rivier in gooien.

Welcome to Secret Identity, our regular column on identity and its role in politics and policy.
The debate over Brett Kavanaugh, President Trump’s nominee to replace Anthony Kennedy on the Supreme Court, is likely to be dominated by discussion about abortion as the court, if Kavanaugh is confirmed, would have five solidly conservative justices, which may mean it’s willing to strike down Roe v. Wade. And that discussion will likely be split by party: Almost all the Democrats you see on cable news and on the floor of the Senate will strongly defend abortion rights, while anti-abortion activists will be among Kavanaugh’s most prominent advocates, even if they don’t outright say they think he will vote to strike down Roe.
But the way the abortion debate plays out in national politics, particularly around judicial nominations, does not reflect how the broader public views this issue. The issue is not a 50/50 Democrat/Republican split, as the plurality of Americans consistently take the “pro-choice” position over the “pro-life” one. And the public, unlike political elites, is not completely divided along party lines on this issue. There is a large bloc of Republicans who support abortion rights. There is a smaller, but still sizable, group of Democrats who oppose abortion rights.
Yet we aren’t likely to hear those voices. Why not? Because they have been disempowered in each party. The politics of abortion are in some ways a story about party coalitions, and each party has a bloc that dominates how its party handles the issue (conservative Christians in the GOP, women’s rights activists among Democrats). Because of the power those blocs have, being anti-abortion rights has become a part of the identity of the Republican Party, even if its voters don’t all share that stance; similarly, the Democratic Party is the pro-abortion-rights party.
Let’s take a detailed look at how this dynamic plays out in each party.
Republicans
I don’t want to avoid the obvious — there is a partisan split on abortion. Pew Research Center polling conducted in 2017 found that about 75 percent of Democrats say abortion should be legal in all or most cases, compared to 34 percent of Republicans. But 34 percent ain’t nothing. And polls consistently find that about a third of Republicans say that abortion should be legal or agree with the Roe v. Wade decision.
Who are these people? Self-identified moderate and liberal Republicans, in many cases; a majority of this group thinks abortion should be legal in most cases, according to Pew.
But this bloc has virtually no power in the GOP. Of the 236 Republican members of the House of Representatives who voted on the bill, just two opposed a provision last year to ban abortions after 20 weeks. Both are now retiring, leading Politico to declare recently that the pro-choice wing of the party is basically dead in the House.
Daniel K. Williams, a historian at the University of West Georgia and author of the books “God’s Own Party: The Making of the Christian Right” and “Defenders of the Unborn: The Pro-Life Movement before Roe v. Wade,” argues two key factors help explain the shrinking ranks of the pro-abortion-rights bloc of the GOP on Capitol Hill. First, the party is increasingly weak at the congressional level in the Northeast, where some pro-abortion-rights Republicans had been able to win in the 1980s and 1990s. Second, the rise of the Christian right in the GOP and its emphasis on limiting abortion means that Christian conservative activists make sure anti-abortion candidates are elected in primaries and general elections, particularly to Senate seats, where they can then vote to confirm anti-abortion-rights judges.
It’s not just that the pro-abortion-rights bloc of the GOP can’t seem to gain much ground in electing members of Congress who share its views — this bloc doesn’t have much influence at the grassroots level either. Last month, Susan Bevan and Susan Cullman, leaders of a group called Republican Majority for Choice, announced that they would leave the GOP and that their group would cease operations, arguing there was no room for their cause in the current Republican Party, in part because there is a “hostility to women within the Republican culture.”
Another way to think about the dynamic that Bevan and Cullman are describing is that Republicans tend to be resistant to ideas linked to “identity politics” centered around gender (or race) but embrace those based on Christian faith. Anti-abortion Republicans tend to ground their arguments in part on religion.
“Ever since Reagan, they’ve been able to collapse pro-life with being a Christian,” said Marcia Chatelain, a historian at Georgetown University and an expert in social movements, referring to anti-abortion activists in the GOP.
But given that the plurality of Americans support abortion rights, Republicans with more liberal views on abortion aren’t alone. If the GOP moved to the left on this issue, it might help the party electorally. But in reality, softening the party’s position on abortion would be a huge risk, potentially weakening the GOP’s very fruitful alliance with white evangelicals, who exit polls suggest were more than 40 percent of the voters who backed Trump in 2016. We don’t know if abortion is the issue that keeps white evangelicals in the GOP camp, since they are conservative on other issues too. But I’m guessing Republican leaders would rather not experiment and test this proposition.
Add all that up, and here’s what you see: If the Republicans in the Senate reflected the views of the broader party, about 17 of them would be pushing to make sure Kavanaugh wouldn’t vote to strike down Roe. But in reality, Maine’s Susan Collins and Alaska’s Lisa Murkowski are the only Republicans who regularly oppose anti-abortion legislation in the Senate. Being two out of 51 Senate Republicans makes them a very small minority, and they will be under heavy pressure not to block Kavanaugh’s confirmation.
Democrats
There are fewer anti-abortion Democrats than there are pro-abortion-rights Republicans. About a fifth of Democrats say abortion should be illegal in most or all cases, according to Pew. Similarly, a Kaiser Family Foundation poll recently found that about 16 percent of Democrats would like to see Roe v. Wade overturned. Who are these Democrats? Many are people who describe themselves as moderate or conservative Democrats, or black Protestants.
But as with being pro-abortion-rights in the GOP, it’s hard to get elected to Congress as an anti-abortion-rights Democrat. Just three House Democrats and three Senate Democrats (Bob Casey of Pennsylvania, Joe Donnelly of Indiana and Joe Manchin of West Virginia) backed the bill banning abortions after 20 weeks.
What’s going on? It’s an inversion of the GOP’s narrative. There was once a larger bloc of anti-abortion-rights Democrats in Congress, but many of those members were from the South, and those seats are now largely occupied by Republicans as the Democrats’ strength has declined in that region. Also, as the Christian right made it a key GOP policy goal to reverse Roe v. Wade and limit abortions, pro-abortion-rights groups pushed the Democratic Party to make defending abortion rights more central to the party’s identity — so much so that the party inserted a provision into its 2016 platform that called for the government to overturn a ban on using federal funding to pay for abortions. The ban, called the Hyde Amendment, has been in place since the 1970s.
This leftward shift among Democrats has occurred as groups that promote women’s rights have gained more power in the party. While Republicans’ “identity politics” are based more on faith than gender, for Democrats it’s the other way around.
The number of Democratic women in Congress has surged in the last two decades, and now about a third of Democrats in Congress are female. Many of those women got support from the group Emily’s List, which supports female Democratic candidates, but only those who back abortion rights. Planned Parenthood, which provides reproductive health services, including abortions, is deeply enmeshed in Democratic politics. Its political action committee invests heavily to help the party win elections.
“The essential issue with abortion [among Democrats] is that it’s not about access to a perfectly legal health choice,” Chatelain said. “It’s about all of the issues around state rights, around privacy, about gender and the family, about wages, I think abortion has become a proxy for a number of very complicated issues. … It’s about so much more on the left.”
So, like the pro-abortion-rights Republicans, the anti-abortion Democrats are basically powerless in and out of Congress. But they are getting a slight acknowledgement in the Democratic campaign to defeat Kavanaugh’s nomination. The organizers of the anti-Kavanaugh campaign are urging senators to oppose the nomination, on the grounds that he might vote to strike down Roe and that he might vote to get rid of the Obamacare provision that bars insurers from denying people coverage if they have pre-existing conditions. A senator like Manchin may want to define his opposition to Kavanaugh more in terms of health policy than abortion.
But no matter Manchin’s rationale, Democratic activists will be furious if the senator votes to confirm Kavanaugh at a time when Roe may hang in the balance — and Republicans similarly will be very angry with Collins if she opposes Trump’s Supreme Court pick.

De peilingen uit 2016 waren uiteindelijk toch aardig nauwkeurig met de uitslag precies binnen de bandbreedte van de voorspellingen? Alleen de media legden de peilingen iets te veel binnen hun straatje uit?
Peilingen worden echter in de reguliere media vaak binair geïnterpreteerd. Een gemiddelde van 49% van de stemmen voor kandidaat A vs 51% voor kandidaat B? Dan voorspellen de peilingen dat kandidaat B wint. Dat is natuurlijk niet het geval, maar ik heb ook ergens het idee dat men in punditland graag 'data journalism' weer terug in hun hok schopt. Voor het soort alfa's dat doorgaans werkzaam is in de journalistiek is correcte interpretatie van statistische gegevens ook veel te moeilijk.
Natuurlijk zijn er ook individuele peilingen of staten waar de afwijking wel fors was, maar grosso modo waren de peilingen in 2016 niet bijzonder onnauwkeurig.
Naast de peilingen had je natuurlijk ook nog de voorspelmodellen die peilingen aggregeerden en daarbij een voorspelling deden over de 'kans op de overwinning' voor een kandidaat op basis van simulaties. Daar zaten er wel wat bij die erg overdreven met een kans van 99% dat Clinton zou winnen. FiveThirtyEight kwam op pakweg een 70/30 verdeling uit. Dat interpreteert de media dan weer als 'model zegt dat Clinton wint, Clinton wint niet, model helemaal fout'. Dat is waar het veelal mis gaat. Met een dergelijke denkwijze zou ik ver uit de buurt blijven van casino's.Volkorenbrood: "Geen quotes meer in jullie sigs gaarne."Nou moet ook wel gezegd worden dat de peilingen in met name Michigan, Pennsylvania en Wisconsin er wel veel naast zaten. RCP Average van bv. Wisconsin was Clinton +6.5. Dat werd Trump +0.7. Dat is wel significant.
Nationaal klopten de meeste peilingen gewoon; die hadden Clinton op een paar punten voorsprong en dat is ook de uiteindelijke uitslag geworden.

WASHINGTON — It is not every day that a potential constitutional showdown over a presidential subpoena coincides with a confirmation hearing for a crucial Supreme Court seat. Less likely yet is a nominee who has written extensively about the very question at the heart of the dispute.
But that novel historical moment is here.
“It is not at all far-fetched to think that the question of whether President Trump must respond to a subpoena could come before the Supreme Court shortly after the confirmation process,” said Walter Dellinger, who served as acting United States solicitor general in the Clinton administration.
Mr. Trump’s choice for the court, Judge Brett M. Kavanaugh, has expressed strong support for executive power, hostility to administrative agencies and support for gun rights and religious freedom.
Those are all conventional positions among conservative lawyers and judges. But there is one stance that sets Judge Kavanaugh apart, and it could not be more timely: his deep skepticism of the wisdom of forcing a sitting president to answer questions in criminal cases.
[spoiler] “I don’t know of any justice who has staked out as strong a position on presidential immunity even from questioning as Judge Kavanaugh has,” Mr. Dellinger said.
Robert S. Mueller III, the special counsel investigating Mr. Trump and his associates, raised the prospect of subpoenaing the president during a March meeting with his lead lawyer at the time, John Dowd. Mr. Trump’s lawyers responded that they were confident that they would prevail in a court fight over whether a sitting president could be required to comply with a subpoena.
If Mr. Mueller goes down that road, the dispute could quickly reach the Supreme Court. And if Judge Kavanaugh is on the court by then, it could thrust him into the middle of an issue he has been wrestling with for most of his adult life.
Some Democrats have called on Judge Kavanaugh to promise to recuse himself from Supreme Court cases involving Mr. Trump. But the fact that a nominee has written about a legal issue would not ordinarily require him to disqualify himself, said Stephen I. Vladeck, a law professor at the University of Texas.
“We don’t tend to demand recusal of judges because they’ve previously written about the substantive legal questions,” he said. “It’s more about whether there is an actual or apparent conflict of interest.”
Judge Kavanaugh worked under Kenneth W. Starr, the independent counsel who investigated President Bill Clinton. That experience, and later service as staff secretary to President George W. Bush, caused him to question the wisdom of criminal investigations of sitting presidents.
“I believe that the president should be excused from some of the burdens of ordinary citizenship while serving in office,” Judge Kavanaugh wrote in 2009 in the Minnesota Law Review. Among those burdens, he said, were responding to civil lawsuits and criminal charges.
He said Congress should consider imposing limits on such proceedings.
“Even the lesser burdens of a criminal investigation — including preparing for questioning by criminal investigators — are time-consuming and distracting,” Judge Kavanaugh wrote. “Like civil suits, criminal investigations take the president’s focus away from his or her responsibilities to the people. And a president who is concerned about an ongoing criminal investigation is almost inevitably going to do a worse job as president.”
Judge Kavanaugh said the proceedings could resume after a president left office and that impeachment remained an option before then.
Judge Kavanaugh was setting out his views on sound legislative policy and not what current law requires. Still, there is some reason to think he would not be inclined to force Mr. Trump to comply with a subpoena from Mr. Mueller.
But it is not at all clear that a Justice Kavanaugh would hold the crucial vote in such a clash, Professor Vladeck said. “I have a hard time seeing any scenario in which Kavanaugh would be the decisive vote on a question like this,” he said.
When confronted with similar questions in the past, the Supreme Court tried very hard to find consensus.
“On the issue of whether the president is categorically entitled to decline to respond to a grand jury subpoena,” Mr. Dellinger said, “we have two unanimous decisions very close to resolving the question.”
Those unanimous decisions ruled against Presidents Richard M. Nixon and Bill Clinton, with Nixon and Clinton appointees voting against the presidents who had placed them on the court.
Those precedents — and the unified courts that issued them — will be much on the mind of Chief Justice John G. Roberts Jr. should a Mueller subpoena dispute reach the court, said David Strauss, a law professor at the University of Chicago.
“The justices must understand that it would be a disaster for the court, as an institution, to divide 5-4 on the question whether Trump can ignore a subpoena, with two Trump appointees in the majority,” he said. “There will be enormous pressure on the chief justice — including, in fact especially, pressure from his own sense of his place in history — to deliver a unanimous court.”
Charles Fried, a law professor at Harvard who was solicitor general in the Reagan administration, said he had grave doubts about whether the current Supreme Court was capable of a unified decision.
“This is not then,” he said. “This is now. The court is polarized in a way that scares the bejesus out of me.”
In 1974, in United States v. Nixon, the Supreme Court unanimously ruled that President Nixon had to comply with a subpoena seeking tapes of his conversations in the Oval Office. Chief Justice Warren E. Burger, a Nixon appointee, wrote the decision.
“A lot of people think of U.S. v. Nixon as Burger’s finest hour,” Professor Strauss said.
The decision concerned evidence rather than testimony, and that could make a difference. On the one hand, the tapes were deeply revealing and embarrassing, while testimony is usually the product of intense preparation and may be subject to on-the-spot objections from the witness’s lawyers. On the other hand, testifying is not a task that can be delegated to underlings like the production of documents.
In 1997, the Supreme Court unanimously allowed a sexual harassment suit against Mr. Clinton to move forward while he was in office. Both of his appointees, Justices Ruth Bader Ginsburg and Stephen G. Breyer, voted against him.
Mr. Dellinger argued the case on behalf of the federal government, ending up on the losing end. He said the logic of the decision suggested that Mr. Trump would face an uphill fight in seeking to refuse to comply with a criminal subpoena. “In a criminal matter,” he said, “the case is stronger for requiring presidential testimony.”
Professor Strauss, who was on the legal team representing Mr. Clinton, agreed. “Anyone can bring a civil case,” he said. “A subpoena in a criminal case can be issued, by the prosecution, only when a high government official — in this instance, an appointee of the president’s own Justice Department — has decided it’s necessary.”
But Professor Fried said the leading precedents do not directly answer the questions that would be posed by a Mueller subpoena.
“Claims of privilege that have never been tested down to the wire might have considerable force,” he said.
The Supreme Court could also find a middle ground, saying that presidents do not have absolute immunity from subpoenas seeking testimony in criminal investigations but that prosecutors must make a detailed showing that they need the testimony. The court could issue a unanimous decision on what the standard is but differ on whether Mr. Mueller had met it.
The Supreme Court’s last decision on presidential power, upholding Mr. Trump’s travel ban, was decided by a 5-to-4 vote that divided along partisan lines, with the court’s Republican appointees in the majority. That suggests, though, that replacing Justice Anthony M. Kennedy, who was in the majority, with Judge Kavanaugh would not alter the balance of power on the court on such questions.
