Nee, de huidige rechter wil meer informatie waarom het DoJ zijn zaak heeft teruggetrokken, de schuldig verklaring ligt nog steeds op tafel en de rechter wil weten of er nieuwe feiten zijn waarom hij die verklaring niet zou kunnen accepteren. Nou ja, het door jou aangehaalde verhaal suggereert dat Flynn voor eigen gewin een of andere deal heeft gemaakt met buitenlandse bedrijven om kerncentrales in de VS te bouwen waarvoor hij goedkeuring van Trump zou hebben.

Flynn zou niet berecht worden omdat hij een plea deal had gesloten met het Department of Justice (toen Barr daar nog geen Attorney General was) . Er moest alleen nog een vonnis vastgesteld worden door Judge Sullivan. Wat hij precies allemaal uitgevreten heeft is geclassificeerd natuurlijk maar hij zou alleen vervolgd worden wegens het liegen tegen de FBI in ruil voor medewerking. Wat de rechter nu doet is het besluit van Barr de zaak helemaal te laten vallen (hij had eerder al gepoogd een lagere straf te eisen) onderzoeken op juistheid.quote:

Die proberen ze nu te achterhalen want lekken is strafbaar. Maar nu gaat men zich afvragen wat Flynn allemaal nog meer uitgespookt heeft (behalve contacten met de Russen over het versoepelen van sancties opgelegd door Obama en lobbywerk voor Turkije, dat was al bekend) aan de hand van diezelfde lijst met namen

The Justice Department’s move to dismiss the prosecution of former national security adviser Michael Flynn does not need to be the end of the case — and it shouldn’t be. The Justice Department has made conflicting statements to the federal judge overseeing the case, Emmet G. Sullivan. He has the authority, the tools and the obligation to assess the credibility of the department’s stated reasons for abruptly reversing course.

het schijnt hier ook ongrondwettelijk te zijn maar iedereen ziet van kilometers afstand nog dat het in ieders belang is, de wet moet gewoon nog aangepast worden zodat het ook op papier klopt, maar je bent echt een faalhaas als je daar nu een punt van maakt 
met zo'n meerderheid voor kunnen ze misschien snel iets in stemming brengen om het alsnog te regelen

Op zich zit er wel iets redelijks in de ruling, het SC stelt dat de gouverneur dat niet alleen mag beslissen maar dat het door het Huis goedgekeurd moet worden. Op zich kan ik mij daar wel in vinden.quote:

Het probleem is dat het huis geen afspiegeling is van de bevolking in dit geval, want de Republikeinse meerderheid heeft geen alternatief plan en verschillende gelieerde groeperingen hebben al aangegeven dat 'alles nu open kan'.quote:

Overigens interessant dat de rechtbank een 5-2 conservatieve meerderheid heeft maar de stemming 4-3 was. Er was dus ook een conservatieve rechter het eens met de Gouverneur.
