Legislation to ensure President Biden is on the ballot in Ohio appears to have stalled, adding new uncertainty to the weeks-long effort to resolve the issue.
The Republican and Democratic leaders of the Ohio House were each quoted Tuesday as saying lawmakers are unlikely to agree on such legislation. The GOP speaker of the House, Jason Stephens, said there is “just not the will” in the legislature, lamenting partisanship and infighting, according to the Ohio Capital Journal.
The issue first drew attention over a month ago, when Ohio’s Republican secretary of state, Frank LaRose, warned Democrats that Biden was at risk of missing the ballot because the Democratic National Convention falls after the state’s certification deadline. A similar situation also emerged in Alabama, but state lawmakers there passed a bill that moved their deadline back — and Gov. Kay Ivey (R) quickly signed it into law.
One remaining option in Ohio is that Democrats could sue to secure Biden’s place on the ballot. Dan Tierney, a spokesman for Ohio Gov. Mike DeWine (R), said the governor remains confident that “either legislatively or judicially,” Biden will be on the ballot.
Some Democrats have suggested “provisional” ballot certification, a method that officials in Washington state have indicated they will accept to address a similar conflict there. However, LaRose rejected that approach in a letter he sent Tuesday to the Ohio Democratic Party chair, Liz Walters, urging her to find a remedy that “upholds the law and serves in the best interest” of the voters.
Biden’s campaign expressed confidence he will be on the ballot in all 50 states, a sense it reiterated Tuesday.
“Election after election, states across the country have acted in line with the bipartisan consensus and taken the necessary steps to ensure the presidential nominees from both parties will be on the ballot,” Biden campaign spokesman Charles Lutvak said in a statement. “And this election is no different.”
