The Odintsovo City Court sent for compulsory treatment 19-year-old activist Maxim Lypkan, accused of distributing “fakes” about the army (clause “e” of Part 2 of Article 207.3 of the Criminal Code). The case itself was dropped due to the defendant’s “insanity,” said OVD-Info lawyer Alan Kachmazov.

The prosecutor had previously demanded that Lypkan be placed in a psychiatric hospital and the case closed. According to the lawyer, four special forces in masks and with machine guns came to the announcement of the verdict. Since November, the trial has been closed to listeners and the press due to medical secrecy in the case materials. Until the verdict comes into force, the activist will be in the Moscow Regional Psychiatric Hospital named after V. I. Yakovenko.

Lypcan became the youngest accused under the article on “military fakes”. At the time of his arrest on February 21, 2023, he was 18 years old. Searches were carried out at his home, as well as at the apartments of his father and friend. On February 22, Lypkan was arrested by decision of the Khamovnichesky Court of Moscow.

Shortly before this, the activist applied for an anti-war rally called “The Year of Hell” on Lubyanka Square in Moscow. The mayor's office refused to approve the action. Lypcan also gave an interview to Radio Liberty, in which he called President Vladimir Putin a “war criminal” for the invasion of Ukraine.

Lypkan was in Moscow pre-trial detention center-2 from February to November 2023. The court then ordered the activist to be transferred to a psychiatric hospital until April 23, 2024.

This is not the first time that Russians who opposed the war have been declared “insane” and sent for compulsory treatment. On December 25, the court made a similar decision regarding 29-year-old resident of St. Petersburg Victoria Petrova - she was accused of spreading “fakes” about the army due to posts on social networks. One of the published videos contained a quote from a Ukrainian pediatrician about Putin allegedly having schizophrenia. Petrova will stay in a psychiatric hospital for six months, after which the period may be extended.

Also, because of anti-war posts on social networks and chats, compulsory psychiatric treatment was prescribed to Nizhny Novgorod resident Alexey Onoshkin, a deputy of a village in the Saratov region Oleg Nepein, environmental activist and animal rights activist Alexander Bakhtin, a resident of Vladikavkaz Teona Kelekhsaeva, and a resident of the Tver region Sergei Kolin. In a number of cases, treatment was prescribed along with time in prison.

From April to December 2023, human rights activists advised more than 1 thousand military personnel who tried to desert. More than half of them asked for help in the fall.

According to Mediazona’s calculations , in the year since the beginning of mobilization (from September 2022 to September 2023), military courts received 4,121 cases of unauthorized abandonment of duty, sentences were passed in 3,470 cases, and the vast majority of those who fled received suspended sentences.

Deserters mostly receive suspended sentences for trying to leave a unit, but this does not prevent them from participating in the war, says lawyer Maxim Grebenyuk. A suspended sentence can be sent back to the front, and the suspended sentence can be changed to a real one at any time, which allows commanders to keep unlucky deserters under control.

Fleeing abroad is one of the few ways to guarantee not returning to the front. But the problem is that most military personnel do not have foreign passports: in June, Russian President Vladimir Putin signed amendments to the law on the procedure for leaving and entering the country, according to which men are required to hand over their foreign passports within 5 days after receiving the summons. Those who manage to travel to neighboring countries using an internal passport (for example, to Kazakhstan) ultimately cannot travel to safer countries: documents are required for this.

Wat denk je dat Noord Korea zou doen bij een slappe reactie van ons op het gebruik van nukes? Of een Iran (al zegt die dat zij nog geen nuclaire wapens hebben).
