Men stelt het voor alsof N Korea reageerde op die "Axis of Evil" uitspraak, maar ze reageerden op het niet naleven van het verdrag door de Bush administratie. Het was Bolton die Bush overtuigde om naleving van het 1994 Agreed Framework stop te zetten, omdat N Korea uranium verrijkte (het verdrag verbood enkel plutonium produktie, uranium verrijking werd niet vermeld). De VS had de keuze tussen onderhandelen over een uitbreiding van het verdrag, of de in het verdrag afgesproken technologische hulp (de bouw van een kerncentrale die niet gebruikt kon worden om weapons grade plutonium te produceren) stopzetten. It would also retroactively extend a reduction in the sentencing disparity between crack and powder cocaine signed into law in 2010, potentially affecting thousands of drug offenders serving lengthy sentences.
“We have the clearest path forward that we have had in years,” said Holly Harris, the executive director of the Justice Action Network, a bipartisan coalition arguing for an overhaul. “This would be the first time that these members have voted on a piece of legislation that turns away from the lock-’em-up-and-throw-away-the-keys policies of the 1990s. That is groundbreaking.”
Lawmakers and outside advocates involved in the push expect Mr. Trump to render his judgment on the package as soon as this week. Jared Kushner, the president’s son-in-law and the leading voice for the changes within the White House, is likely to brief Mr. Trump on the bill during a broader discussion of legislative priorities with top policy officials on Tuesday, according to one senior administration official, who was granted anonymity to discuss the plans. And at least two influential Republican senators were lobbying the president in its favor.SPOILERSenator Mitch McConnell of Kentucky, the majority leader, has told the senators he would bring the package up for a vote if they could show they had the support of at least 60 senators. Speaker Paul D. Ryan of Wisconsin, a vocal advocate of such changes, committed to putting the compromise on the House floor in a lame-duck session that begins on Tuesday if Mr. Trump endorses it and it can clear the Senate.
“Speaker Ryan has long advocated for criminal justice reform,” said AshLee Strong, a spokeswoman for Mr. Ryan. “The House passed legislation earlier this year, and we are hopeful the Senate will act so we can get a bill to the president’s desk.”
The support of the famously mercurial Mr. Trump is by no means guaranteed. But if they can secure an endorsement, senators say they can move quickly on the kind of bipartisan achievement that has eluded Mr. Trump — and bedeviled senators and outside advocates of the overhaul for years.
The effort has brought together an unlikely coalition of advocacy groups from the left and the right, including the billionaire conservatives Charles G. and David H. Koch and the American Civil Liberties Union. But with the arrival of the Trump administration and its return to tough-on-crime policies, many believed the chances of changing federal law were all but shot.
The bill, called the First Step Act, is more modest than the much-trumpeted set of changes that stalled in the Senate last term, but its provisions are still far-reaching and could win support across the ideological spectrum. It creates a suite of programs and incentives intended to reduce recidivism and prohibits the shackling of female inmates while pregnant, among other prison-focused measures.
Unlike in the 2015 proposal, the elimination of the “stacking” provision and the reduction of mandatory minimums for nonviolent offenders would not apply retroactively — a concession by Democrats that greatly narrows the impact of the changes for the current prison population.
The latest compromise was crafted by Senators Charles E. Grassley, Republican of Iowa; Richard J. Durbin, Democrat of Illinois; and Mike Lee, Republican of Utah, in conjunction with Mr. Kushner. Those senators won a promise from Mr. Trump in August that he would consider backing a bill during the lame-duck session. Mr. Grassley, the Judiciary Committee chairman, and another senior Republican on that committee, Lindsey Graham of South Carolina, have lobbied Mr. Trump in the months since.
If Mr. Trump supports the package, senators will still be up against a rapidly closing legislative window — Congress is set to break in mid-December — and certain opposition from conservative Republicans in both the Senate and the House.
Democrats could also throw up road blocks if liberals think they could get a better deal once Democrats take control of the House.
If Mr. Trump does not back the measure, lawmakers concede its chances of advancing this Congress are almost none.
But advocates of changes to the sentencing and prison laws see a path to passage. The Fraternal Order of Police, the country’s largest police organization, announced on Friday that it would support the bill. The National Sheriffs’ Association, another key constituency, appears to have dropped some of its objections after a meeting with Mr. Kushner late last week, the senior administration official said.
“We have a bill that will make our streets and neighborhoods safer, our police will be better protected and improve the ability of our criminal justice system to effectively rehabilitate offenders,” Chuck Canterbury, the police order’s president, said in a statement.
Lawmakers may have also gotten a boost with the departure of Jeff Sessions as attorney general last week. Mr. Sessions had used his post to order federal prosecutors to pursue the toughest possible charges and sentences for crime suspects, reversing Obama-era efforts to ease such penalties for some nonviolent drug offenders. And he vigorously opposed legislative compromise, going head to head not only with Mr. Grassley but also with Mr. Kushner.
Mr. Kushner has had several meetings with Matthew G. Whitaker, the new acting attorney general, who has signaled that he is open to the changes. The effort could be revived in the next Congress if he and allies are unable to succeed in the short term.
Mr. Kushner has also traveled with Vice President Mike Pence in recent days to brief the vice president on the latest developments, the administration official said.
If Mr. Trump offers his support this week, Mr. Grassley would introduce the bill within days. Mr. Durbin is then expected to endorse it and lobby fellow Democrats.
The senators believe they can win over most Democrats and, with cover from Mr. Trump, a large block of Republicans. But they fear outspoken conservative opponents to liberalizing sentencing laws, especially Senator Tom Cotton of Arkansas, could pull Mr. Trump out of their camp.
Then there is the House, which passed a prison bill that excluded any modifications to sentencing laws this year by an overwhelming margin. The addition of sentencing changes is likely to sweeten the deal for Democrats and turn off some Republicans. A Democratic strategy of delay until next year comes with substantial risks — Senate leaders and the White House could withdraw support. A spokesman for Representative Nancy Pelosi of California, the Democratic leader, declined to comment.

Er was een spoorlijn tussen Noord en Zuid-Korea geopend bijvoorbeeld, maar onder Bush is die weer gesloten. Bush vond dat NK bij 'Het as van het kwaad' hoorde. Iets wat ironisch meer kwaad dan goed heeft gedaan. Volgens mij is NK toen ook vol de nucleaire weg in geslagen.
Niet te vergeten dat Bush in feite een hele oorlog zonder reden had gestart.
Ik verduidelijk enkel wie verantwoordelijk was voor het falen van de overeenkomst. Daarna was er geen kans meer om N Korea te stoppen, niet nadat Bush hen samen met Irak en Iran als "Axis of Evil" bestempelde, en meteen daarna Irak binnenviel. Anti-Semitic hate crimes rose 37 percent in 2017. Anti-Islamic hate crimes declined 11 percent last year, with 273 such incidents, the data show.
The new FBI data comes less than a month after the worst anti-Semitic attack in U.S. history — a shooting at a Pittsburgh synagogue that killed 11 and wounded six.
The gunman in that attack has been charged with dozens of federal hate crimes, and that one incident alone accounted for nearly as many hate crime killings as were recorded all of last year in the United States: 15.
Jonathan A. Greenblatt, CEO of the Anti-Defamation League, said the report “provides further evidence that more must be done to address the divisive climate of hate in America. That begins with leaders from all walks of life and from all sectors of society forcefully condemning anti-Semitism, bigotry, and hate whenever it occurs.”
Nearly a year after the tax cut, economic growth has accelerated. Wage growth has not. Companies are buying back stock and business investment is a mixed bag.

But Republicans did not sell the law as a sugar-high stimulus. Ten months after the law took effect, that promised “supply-side” bump is harder to find than the sugar-high stimulus. It’s still early, but here’s what the numbers tell us so far:SPOILERThe Investment Bump
Proponents of the tax overhaul said it would supercharge the recent lackluster pace of business spending on long-term investments like buildings, factories, equipment and technology.
Such spending is crucial to keeping economic growth strong. And strong growth is central to Republican claims that the tax cuts would ultimately pay for themselves.
Capital spending did pick up steam earlier this year. For companies in the S&P 500, capital expenditures rose roughly 20 percent in the first half of 2018. Much of that was concentrated: The spending of just five companies — Google’s parent, Alphabet, and Facebook, Intel, Exxon Mobil and Goldman Sachs — accounted for roughly a third of the entire rise. Much of that spending went toward technology, including increased investment in data centers and computing, server and networking capacity.
For the full year, Goldman Sachs analysts expect that capital expenditures for companies in the S&P 500 will be up about 14 percent, to $715 billion. Research and development spending, another component of business investment, was expected to be up 12 percent, to $340 billion.
For the economy as a whole, the surge in business investment was a bit less impressive. It’s true that business spending on fixed investment — such as machinery, buildings and equipment — rose, jumping 11.5 percent and 8.7 percent during the first and second quarters. The first-quarter jump was the fastest for investment since 2011.
But that pace fizzled during the third quarter. Recently data showed third-quarter business investment rose at an annual pace of 0.8 percent. The last quarter of the year — traditionally a big one for capital spending — will fill out the picture, but that data won’t be released until early 2019.
It will likely take years to get a better sense of whether the law fundamentally reshaped American corporate investment. But there’s little clear evidence that it is drastically reshaping the way in which most companies invest and spend.
The results of a survey published in late October by the National Association for Business Economics showed that 81 percent of the 116 companies surveyed said they had not changed plans for investment or hiring because of the tax bill.
The Buyback Binge
Cheerleaders for the tax cut argued that the heart of the law — cutting and restructuring taxes for corporations — would give the economy a positive bump, giving companies incentives to invest more, hire more workers and pay higher wages.
Skeptics said that the money companies saved through tax cuts would merely increase corporate profits, rather than trickling down to workers.
JPMorgan Chase analysts estimate that in the first half of 2018, about $270 billion in corporate profits previously held overseas were repatriated to the United States and spent as a result of changes to the tax code. Some 46 percent of that, JPMorgan Chase analysts said, was spent on $124 billion in stock buybacks.
The flow of repatriated corporate cash is just one tributary in what has become a flood of payouts to shareholders, both as buybacks and dividends. Such payouts are expected to hit almost $1.3 trillion this year, up 28 percent from 2017, according to estimates from Goldman Sachs analysts.
Debts and Deficits
Supporters of the tax cuts repeatedly claimed the bill would increase economic growth enough to offset the decline in tax receipts. “I'm totally convinced this is a revenue-neutral bill,” said Senator Mitch McConnell of Kentucky, the Republican leader, when a preliminary version of the bill was approved in the Senate in December 2017.
Despite a remarkably strong economy, the fiscal health of the United States is deteriorating fast, as revenues have declined sharply. The federal budget deficit — the gap between what the government collects in revenues and what it spends — rose to $779 billion in the 2018 fiscal year, which ended Sept. 30. That was a 17 percent increase from the prior year.
It’s highly unusual for deficits and borrowing needs to grow this much during periods of prosperity. A broad variety of analysts attribute the widening deficit to the tax cuts (along with increased military and other domestic spending ushered in through a bill Mr. Trump signed earlier this year).
Corporate tax revenues are down one-third from a year ago. Federal revenues as a whole ran $200 billion behind the Congressional Budget Office’s forecast for the 2018 fiscal year — even though economic growth was faster than the C.B.O. expected. The nonpartisan Committee for a Responsible Federal Budget reports that nominal federal revenues are down by at least 3.6 percent since the tax cuts took effect.
The growing budget gap means the Treasury must borrow more to keep the government running. The Treasury expects to borrow a total of $1.338 trillion from global investors this calendar year. That would be 145 percent higher than the $546 billion the federal government borrowed last year. That would be the highest level of borrowing since 2010, when the American economy was struggling to recover from the great recession.
Bonus Announcements
Shortly after the tax law passed, hundreds of companies — from large multinationals to small manufacturers — announced that they would be using some of their windfall from the law to give one-time bonuses to employees. Others said they would raise minimum wages across the company, or expand worker benefits.
Mr. Trump and Republicans hailed those announcements as evidence that the law’s benefits were flowing substantially to workers. Americans for Tax Reform compiled a list of 750 companies, and growing, that said they would pass tax savings on to workers in some form.
Data from large public companies, however, suggest that most workers received relatively small shares of their employers’ corporate tax savings.
The nonprofit research group Just Capital, which is tracking 1,000 large public companies’ reports of how they are spending their tax cuts, calculates that the typical worker at one of those large companies has received about $225 this year in increased salary, a one-time bonus, or both, attributable to the new law.
Workers for those companies were more likely to see their wages rise if they lived in states where the minimum wage was relatively low — and where companies do not have to pay workers more to compensate for high housing costs. California workers at those companies saw an average benefit of about $160 each, which is less than half the average benefit for workers in Kentucky.
Many companies also said they would use tax savings to create jobs. But the Just Capital research finds that, since the tax cuts were passed, the 1,000 largest public companies have actually reduced employment, on balance. They have announced the elimination of nearly 140,000 jobs — which is almost double the 73,000 jobs they say they have created in that time. About half of those net losses came from companies in the restaurant and leisure industries, the analysis found.
The Wage Story
Nearly a year after the cuts were signed into law, wage growth has yet to pick up when accounting for inflation. In September, the Labor Department reported that inflation-adjusted wages had risen 0.5 percent from the year before. That’s a slower rate of growth than the economy itself experienced in September 2017, when it was 0.6 percent.
Growth has accelerated in nominal terms. Median wage growth was 3.5 percent in September, according to calculations by the Federal Reserve Bank of Atlanta, up from 3 percent in January, but still below its recent highs in 2016. Growth in the Employment Cost Index rose from 2.9 percent at the end of 2017 to 3 percent in the third quarter.
By Republicans’ own economic theories, it should take a while for corporate tax cuts to translate into higher worker pay. First, the cuts need to stimulate increased capital investments, which in turn raise worker productivity. More productive workers would then see their wages rise accordingly.
Productivity grew 3 percent in the second quarter of this year and 2.2 percent in the third — healthy numbers, which will need to continue apace to deliver the sort of long-term economic jolt Republicans promised.

First lady Melania Trump’s office has released a blistering statement about the top deputy to national security adviser John Bolton, saying Mira Ricardel “no longer deserves the honor” of serving the White House.
The eruption comes after a report by The Wall Street Journal that Trump has chosen to oust Ricardel from her position at the first lady’s request.
“It is the position of the Office of the First Lady that she no longer deserves the honor of serving in this White House,” Melania Trump’s communication director Stephanie Grisham told ABC News in remarks directed toward Ricardel.
The first lady’s staff clashed with Ricardel during a trip to Africa last month over plane seating.
Ricardel also denied requests from Melania Trump’s staff to use National Security Council (NSC) resources, people familiar with the matter told the Journal. The staff also reportedly told the president that they suspect Ricardel is the starter of unflattering stories about Melania and her team.
The NSC has declined to comment.
Ricardel — one of Bolton’s first senior-level hires after he became head of the NSC in April — has also tussled with Defense Secretary James Mattis and his staff over Pentagon appointments and policy coordination, according to those familiar with the clashes.
Those tensions, which began early in the Trump administration, gained wider attention earlier this fall.
Prior to the 2016 election, Ricardel was named head of Pentagon appointments on Trump’s transition team. At the time, she reportedly stopped Mattis from hiring certain officials over concerns about their party affiliation or their earlier support for Democratic presidential nominee Hillary Clinton.
It was “not a secret that when [Ricardel] was the head of personnel there was some disagreement about who should come in,” an administration official told The Hill last month.
Questions have also been raised over the level of coordination across government agencies to implement Trump’s agenda.
Ricardel’s primary duties at the NSC is interagency policy coordination between the council and the State Department and Pentagon, among other agencies, on major policy issues including the administration’s cyber strategy, the military’s role in Syria and responding to Iranian aggression.
“There are people across the interagency with varying degrees of frustration about the current coordination process . . . . given some of the issues that have lingered — cyber, Syria, Iran — big issues out there that require NSC leadership to coordinate,” the administration official said.
Should Ricardel be asked to leave the White House, Bolton will have lost another ally. Bolton’s longtime friend Fred Fleitz last month left his role as chief of staff and executive secretary for the NSC after serving only six months.
So far, Bolton has resisted White House chief of staff John Kelly, who has pushed for Bolton to replace Ricardel and has been looking for ways to force her out for weeks, officials told the Journal. Kelly reportedly cited the first lady’s concerns to Bolton two weeks ago.
Melania Trump and her staff also discussed the issue with the commander-in-chief during the administration’s trip to Paris earlier this week. Trump told his wife that he would remove Ricardel, White House officials said.

Maryland challenges legality of Whitaker’s appointment as acting U.S. attorney general

The legal challenge to Whitaker’s appointment comes as part of Maryland’s ongoing federal lawsuit that is trying to force the Trump administration to uphold a key provision of the Affordable Care Act.
“Who the attorney general is is at the core of this lawsuit,” Frosh said in an interview Tuesday.
“Aside from the constitutional issue, this guy, Mr. Whitaker, has extreme views and that’s dangerous in itself,” said Frosh, adding that he also expects any ruling in the state challenge to Whitaker’s role to be appealed.
Frosh was not required to notify Gov. Larry Hogan (R) about a motion in an existing case. Hogan spokeswoman Amelia Chasse said the governor’s office received no prior communication about the filing and declined to comment on it.SPOILERThe legal action over Whitaker, first reported by NPR, says his appointment violates the Appointments Clause of the Constitution, which requires “principal” senior officials, such as the attorney general, to be confirmed by the Senate. Whitaker, who served as Sessions’s chief of staff, is now supervising the investigation by special counsel Robert S. Mueller III. He has previously been critical of the Russia probe — when he was a political commentator and on Twitter.
In a letter to the committee’s chairman, Sen. Charles E. Grassley (R-Iowa), Feinstein said she wants Whitaker to assure lawmakers “he will take no action to restrict or otherwise interfere with” the probe.
Grassley said Tuesday that he takes no issue with comments from Whitaker that disparaged the Mueller investigation, “as long as he made them as a private citizen.”

Frosh’s office said Tuesday that any action Whitaker takes in the health-care case on behalf of the federal government would be invalid because Whitaker should not be serving as acting attorney general.
The filing, prepared jointly with the law firm Goldstein & Russell, asks U.S. District Judge Ellen L. Hollander, who has the health-care case, to quickly issue an injunction to replace Whitaker with Rosenstein.
Maryland lawyers filed the underlying lawsuit in September after Sessions told Congress that the Justice Department would not defend central provisions of the health-care act, including protections for people with preexisting conditions.
Now that Whitaker is serving as acting attorney general, he is in position to make decisions on behalf of the federal government, including in the health-care litigation.
“It is troubling, to say the least, that the President is attempting to fill a ‘vacancy’ he created himself with a ‘temporary’ appointment that might last for many months or years,” the filing from Frosh’s office said. “It is especially troubling that the temporary appointee has not been confirmed by the Senate for his underlying position; the President might reasonably be seen as appointing a loyalist in a way that deliberately circumvents the Senate’s constitutional advice-and-consent role.”

But since the election last week, Mr. Trump has tweeted about the caravan exactly once — to issue a proclamation preventing those who cross the border illegally from applying for asylum in the United States. There was little dispute, even before Election Day, that Mr. Trump was exploiting the caravan for political purposes. While the caravan has faded from television screens, the costs of Mr. Trump’s response to it have not. Nearly 6,000 active-duty troops remain deployed from the Gulf Coast to Southern California, where they are putting up tents and stringing concertina wire to face a ragtag band that is still not near the border.
“Now that the political utility of troops on the southern border to face a fictitious caravan invasion threat is over,” said Adm. James G. Stavridis, a former commander of the military’s Southern Command, “let’s hope the president will stand down the troops so they can be with their families — especially over the holidays.”
But some officials in the Defense Department worry that Mr. Trump could do the opposite — seek an exception to the Posse Comitatus Act, the 1878 law that prohibits the government from using active-duty troops to enforce laws inside the country’s borders.
As pure political calculation, analysts from both parties said that seizing on the caravan mobilized Republican voters, dramatizing immigration in a way that resonated with Mr. Trump’s political base. But it is far less clear that the dire warnings helped Republican candidates with independents or other late-deciding voters.SPOILERIn some places like Arizona, where the Democratic Senate candidate, Kyrsten Sinema, narrowly beat her Republican opponent, Martha McSally, analysts said the caravan might actually have backfired. David Axelrod, a former aide to President Barack Obama, said on Twitter, “The president’s calculated histrionics about the caravan, about which we have heard very little since Election Day, may have sunk the @GOP in AZ.”
In exit polls, voters who made up their minds in the last three days before the election said they voted for Democrats over Republicans 53 percent to 41 percent. That coincides with the period in which Mr. Trump redoubled his focus on the caravan, rejecting the advice of aides who wanted to air a commercial promoting the healthy economy.
Exit polls did not contain a specific question about the caravan. But they did show that voters who made up their minds in the final week of the campaign, before Mr. Trump’s last-minute push, chose Democrats over Republicans by a narrower tally: 49 percent to 48 percent.
Privately, Republican pollsters pointed to the fact that their party had picked up just three of 10 Senate seats held by Democrats as evidence of the ambiguous effect the caravan crusade had on Republicans.
At one campaign rally after another, Mr. Trump said the election came down to “the caravan, law and order, and common sense.” In Mesa, Ariz., on Oct. 19, he said: “You got some bad people in those groups. You got some tough people in those groups. And I’ll tell you what — this country doesn’t want them. O.K.? We don’t want them.”
A day earlier, he tweeted about the “assault on our country at our Southern Border, including the Criminal elements and DRUGS pouring in.”
Mr. Trump posted footage of an undocumented immigrant on trial for killing a police officer, and his campaign organization produced an ad featuring migrants trying to scale a wall to dramatize the stakes of the election.
“I’ve never before seen an American president, after going all over the country about this national crisis, then the day after an election shrug,” said Douglas Brinkley, a presidential historian at Rice University.
The closest parallel that Mr. Brinkley drew was to President Lyndon B. Johnson, who seized on — and mischaracterized — two murky encounters between American and North Vietnamese warships in the Gulf of Tonkin in 1964 as a pretext to accelerate America’s engagement in the Vietnam War. Still, he said, Mr. Trump’s response was of a different order.
“It was a dangerous form of xenophobia, aimed solely for electoral purposes and had nothing to do in the end with real national security,” Mr. Brinkley said.
For the troops, so far, it has mostly been an expensive field trip. The cost of the deployment is not known, but budget officials believe it could reach $200 million if all 15,000 troops that Mr. Trump pledged are ultimately sent.
Defense Secretary Jim Mattis said on Tuesday that the Pentagon was “capturing” the expenses daily and would update the public when he knew the total cost. On Wednesday, Mr. Mattis plans to meet with soldiers at Base Camp Donna, the forward operating base built over the last month near the Rio Grande.
Mr. Mattis said there had been no change to the mission; the troops were not receiving extra combat or hostile-fire pay. His visit, a defense official said, is meant to be low key and reminiscent of his days as a Marine general, when he could meet front-line troops with little fanfare.
Living conditions at Base Camp Donna are spare, but since its construction this month, the Army has added showers and a larger living area aside from the initial allotment of tents.
Defenders of Mr. Trump said the troops would take little notice of his sudden lack of emphasis on the caravan.
“Knowing the troops, knowing how busy they are, they’re not focused on him,” said Jack Keane, a retired four-star general who is a former vice chief of staff of the Army. “They’ve got a job to do.”
But other former military officers said the soldiers were well aware of the political motivation behind their mission. Lacking much else to do, they will quickly pick up on Mr. Trump’s loss of interest in the caravan, and it will add to their already depleted morale.
“Having spent months in the desert with nothing to do, at least we had scorpions to have scorpion fights with,” said John A. Nagl, a retired Army lieutenant colonel who served in Operation Desert Shield in 1990 and 1991.
“But we had a real mission,” he said. “These guys don’t have that.”

Keisler, a former acting attorney general in the Bush administration; two prominent conservative law professors, Jonathan H. Adler and Orin S. Kerr; and Lori S. Meyer, a lawyer who is married to Eugene B. Meyer, the president of the Federalist Society.
“We believe in the rule of law, the power of truth, the independence of the criminal justice system, the imperative of individual rights and the necessity of civil discourse,” the group said in a statement. “We believe these principles apply regardless of the party or persons in power.”SPOILERMr. Conway, who has long been a member of and contributor to the Federalist Society, said he had nothing but admiration for its work. But the timing of the announcement of the group’s formation, just before the Federalist Society convention, was not a coincidence, Professor Adler added. “This convention has become the most important meeting place for conservative and libertarian lawyers with an interest in politics,” he said. “You go fishing where the fish are.”
Mr. Keisler said it was urgent to have an open debate about the administration’s actions.
“It’s important that people from across the political spectrum speak out about the country’s commitment to the rule of law and the core values underlying it — that the criminal justice system should be nonpartisan and independent, that a free press and public criticism should be encouraged and not attacked,” he said. “These are values that might once have been thought so basic and universally accepted that they didn’t need defending, but that’s no longer clearly the case.”
Conservative critics of the Trump administration have been reluctant to speak out, Professor Kerr said, adding that the new group hopes to change that. “There are a lot of people who are concerned who are keeping quiet,” he said.
That silence may be rooted in careerism and fear of retaliation, Professor Adler said.
“This administration, in nominations, is not interested in people who have been critical of it,” Professor Adler said. “There is a belief that there is an element of vindictiveness in the administration that casts a shadow.”
Marisa C. Maleck, a former law clerk to Justice Clarence Thomas, said she hoped the group’s efforts would embolden conservative critics to speak out about Mr. Trump’s actions. “He’s been president for a while now,” she said, “and there hasn’t been anyone willing to put himself out there.”
In interviews, the group’s members said they did not speak with a single voice and had varying concerns about the administration’s policies.
They generally approved of Mr. Trump’s judicial choices, and they were particularly enthusiastic about his two appointees to the Supreme Court, Justices Neil M. Gorsuch and Brett M. Kavanaugh.
Leonard A. Leo, the Federalist Society’s executive vice president, has advised Mr. Trump on judicial nominations and worked on the confirmations of Justices Gorsuch and Kavanaugh. The society itself, its website says, does not take political positions or endorse nominees.
It did not take much prompting to elicit harsh critiques from members of the new group of Mr. Trump’s actions in other areas. Mr. Keisler, for instance, focused on criminal justice.
“The president has attacked the Justice Department for indictments of Republican congressmen on the stated ground that prosecutions would hurt Republican chances in the midterm elections, and he’s urged that the Justice Department investigate his political opponents,” Mr. Keisler said. “That’s a fundamentally wrong and very dangerous view of the criminal justice system, and people from both parties and across the political spectrum should condemn it.”
Ms. Meyer said she was worried about the administration’s casual attitude toward the truth.
“My particular concerns,” she said, “are all the disinformation and spin that comes out almost every day. It makes it impossible for any real dialogue to be had.”
Mr. Bellinger said he was worried about Mr. Trump’s attempts to undermine the country’s institutions. “Attacking the press and putting it in danger, attacking the Justice Department and discrediting it,” he said, “are not part of being a conservative lawyer.”
Mr. Ridge said he was concerned about attacks on the independence of judiciary. “Regardless of whether you’re a Republican or Democrat, liberal or conservative,” he said, “you embrace the rule of law.”
Professor Kerr summed up the new group’s basic point. “The rule of law has to come first,” he said. “Politics comes second.”

A senior Justice Department official who briefed reporters on the memo said DOJ lawyers told the White House a sufficiently senior Department official who received high enough pay would be eligible to take over as attorney general. The official declined to share more detail about the nature of the White House’s communications with the Department.
The Office of Legal Counsel (OLC) is simultaneously one of the most secretive and most powerful arms of the Justice Department. Its battalion of attorneys assess thorny legal issues and issues memos that govern government agencies. And most of the time, those decisions are secret.
In this case, though, OLC is going public with its memo determining that the Trump administration had the power to install Whitaker—the former chief of staff for Sessions—as acting AG. Whitaker’s appointment instantly drew criticism because of a host of comments he made as a TV pundit lambasting Special Counsel Robert Mueller.
Before being made the head of the Justice Department, Whitaker did not occupy a Senate-confirmed position. A sugar high — from tax cuts and other stimulus — is expected to wear off in the coming year, constricting economic growth.
President Donald Trump, already in a grumpy post-midterm mood, faces a growing list of economic problems that could irritate him even more next year. Chief among them is a withdrawal from the economy’s sugar high.
Fiscal stimulus from the GOP tax cuts is likely to start running out. The Federal Reserve is expected to keep bumping up interest rates. And few analysts expect a divided Congress — facing soaring deficits and with its eyes on 2020 — to join hands and pass a big infrastructure package or sweeping middle-class tax cuts to keep the fiscal juice flowing.
The collection of all these factors, coupled with jittery investors already worried about trade wars and a global slowdown, could deny Trump the kind of big economic growth numbers he loves to celebrate. And they could undercut one of the GOP’s biggest current arguments: You may not love what Trump says or does, but the Trump economy is awesome.
“The first punch will be the lag effect of rising interest rates. Rates work slowly, but they do work eventually,” said Ian Shepherdson, chief U.S. economist at Pantheon Macroeconomics. “And the second will be that by 2020, without a further package from Congress, the stimulus will be done. You put all these together and it’s a little like Wile E. Coyote running over the cliff. You look down, and the ground you thought was under you suddenly isn’t there anymore.”
The White House is well aware of the risks. Senior administration officials believe the big corporate tax cut will unleash a wave of sustainable growth in business spending that will keep the good numbers rolling — from job gains to higher wages — and keep producing GDP reports in the 3 percent territory that Trump loves, rather than the 2s or 1s that many economists expect.
But a prolonged business spending boom is no certainty, and some signals — including the third-quarter GDP report — suggest that capital investment is already slowing. So the White House is deeply engaged in efforts to boost growth through executive action, especially in the energy sector, by speeding the permitting process for natural gas pipelines and boosting the American shipping industry.
White House officials are not counting on a big infrastructure package or a deal on the kind of middle-class tax cut Trump promised at the end of the campaign.
“We’ve been noodling more on this middle-class tax cut, how to structure it, and even pay for it,” National Economic Council Director Larry Kudlow said in a recent interview in his West Wing office. “I don’t think the chances of that are very high, because the Democrats are going to go after the corporate tax and all that stuff.”
Kudlow also was not enthusiastic about agreement between the White House and Democrats, who will control the House of Representatives, on a deal in 2019 to spend significant federal money on infrastructure projects. “Anybody that thinks, you know, like this trillion-dollar [infrastructure spending] number, which is over 10 years — we don’t have that,” Kudlow said.
Kudlow said he still believed a “boom” in capital spending will continue in 2019 and 2020 and that he didn’t worry about numbers like the recent GDP report showing capital spending nearly stalling out at 0.8 percent growth in the third quarter.
But while Trump’s advisers remain bullish, many economists are now trimming their estimates for U.S. growth next year in part because of a reduction in the impact of the tax cuts and spending increases — more than $2 trillion worth — approved by Congress and signed by the president last year.
“I expect fiscal policy will still be stimulative in 2019, but not as stimulative as in 2018,” said Jim O’Sullivan, chief U.S. economist at High Frequency Economics. “In round numbers, fiscal stimulus is adding maybe three-quarters of a point to GDP growth in 2018, will add maybe half as much again in 2019 and be close to neutral in 2020.”
Deutsche Bank estimates that fiscal policy will remain mildly positive in 2019 but turn into a drag of about 0.3 percent on the economy by 2020. “You should expect GDP growth to slow as we get into the second half of 2019 and in particular in 2020,” said Torsten Slok, Deutsche’s chief international economist.
The decline in fiscal stimulus will come as the Fed, much to Trump’s displeasure, is likely to keep raising interest rates in 2019. The Fed is expected to hike rates again next month and several more times next year.
The central bank’s main goal is to slow economic growth enough to prevent a surge in inflation as the labor market gets tighter. The Fed could pause its interest-rate hikes if the decline in fiscal stimulus from Congress kills economic growth entirely. But by the time it does so, the unemployment rate could be rising again.
“I’d be quite surprised if unemployment is still falling by 2020, so Trump is very likely to be running against a backdrop of rising unemployment,” said Shepherdson. He added that it is unlikely that the Fed could “magically manage to stabilize everything and freeze it where it is now and make everyone happy forever more.”
Ordinarily in such a scenario, Congress might step in and take stimulative measures to ensure that any slowdown is short-lived through higher spending and tax reductions. But a combination of political and fiscal factors makes this difficult, if not impossible.
On the political side, Democrats have limited incentive to cut a deal with Trump on an infrastructure spending package. And Republicans in Congress are growing increasingly alarmed by the ballooning size of the federal budget deficit, which hit $779 billion in 2018 and is expected to top $1 trillion in 2019. So when the Fed is tightening, Congress may be unable to push the other way.
"We poured a bunch of stimulus into the economy at precisely the time it didn’t need it, and we are going to have to pay the price for that in the coming years,” said Maya MacGuineas, president of the Committee for a Responsible Federal Budget. “When the economy turns down, and by all accounts it will, we are likely to need to continue further stimulus. But because we are at such a higher debt position relative to normal, it’s going to be harder to borrow and do that.”
Senate Majority Leader Mitch McConnell (R-Ky.) on Wednesday flatly rejected the idea of doing a big infrastructure deal with Democrats. “Republicans are not interested in a $900 billion stimulus,” he told reporters.
Instead of debates about further stimulus, Congress could wind up stuck in bitter fights over funding the government and raising the debt limit. That could start next month if Trump demands more funding for his border wall as a part of a year-end bill to avoid a partial government shutdown on Dec. 8. The debt limit goes back into force in March, though Congress will likely have until summer to raise it before flirting with default.
Concern over waning stimulus and rising rates has some of Trump's advisers, including Kudlow, scrambling to avoid a round of auto tariffs on Europe and a trade war with China next year. Those concerns helped turn October into the worst month for the stock market since 2011.
All the potential economic headwinds have Kudlow and other White House advisers banking hard on the idea that businesses will plow their tax-cut money into new spending in 2019 and beyond. “This economic boom is great. I personally believe it’s going to continue for quite some time,” Kudlow said. “If we don’t get the capital expenditures, I’ll be wrong. But I think we will.”

The Trump administration is considering ways to remove an enemy of Turkish President Recep Tayyip Erdogan from the United States to appease Turkey over the murder of journalist Jamal Khashoggi, according to a report by NBC News.
Two senior U.S. officials and two other people briefed on the requests told NBC that administration officials last month asked federal law enforcement agencies — including the Justice Department and FBI — to look at legal ways to remove exiled Turkish cleric Fethullah Gulen.
The move would be an attempt to prompt Erdogan to take pressure off the Saudi government.
The White House reportedly sent directives to the Justice Department and FBI to reopen Turkey's case for Gulen’s extradition. The administration officials have also requested the Homeland Security Department provide information about his legal status.
The four people said that the White House wanted details about Gulen's residency status in the country. Gulen has a green card and has been living in Pennsylvania since the late 1990s, NBC reported.
U.S. officials and people briefed on the requests said career officials at the agencies pushed back at the White House requests.
“At first there were eye rolls, but once they realized it was a serious request, the career guys were furious,” a senior U.S. official involved in the process told NBC.

As you are no doubt aware, Democrats on the House Judiciary Committee have written over one hundred letters to the Trump Administration, including the Department of Justice and the FBI, concerning legitimate oversight matters that fall within our jurisdiction. To date, we have received no substantive response to these communications.
Between now and the end of the 115th Congress, I ask that you work with me and other Members of the Committee to address this backlog. Over the coming days, I expect to correspond with you on a number of our highest priority requests.
Today, I write with growing concern over President Trump’s repeated attacks on the integrity of Department of Justice and the FBI—including, but not limited to, his decision to fire former Attorney General Jeff Sessions, his frequent statements about ongoing criminal investigations, and his personal attacks on senior Department officials. The President’s behavior appears to be motivated by an urge to shield himself, his family, and his business interests from the ongoing work of the Department and the Bureau.
Over the course of the last Congress, in the absence of meaningful oversight, the problem has only worsened. The President has called the Special Counsel’s investigation a “witch hunt” at least 84 times this year.[1] He has identified the investigation as a significant threat to his Administration, stating that he wants it stopped.[2] He has threatened to fire Department officials for failing to “totally protect him” from ongoing legal proceedings.[3] He forced former Attorney General Sessions to resign and replaced him with an open critic of Special Counsel Mueller who was never confirmed by the United State Senate.[4] These actions are not normal, and they ignore the guidance of the White House Counsel, flout the Constitution, and undermine our federal law enforcement agencies.
The House Judiciary Committee has an obligation to examine these actions and assess their impact on both the operation of the Department and the fair administration of justice. Accordingly, I ask that you provide a complete response to each of the letters on this subject sent to you by some or all of the Members of this Committee, including each of the following:
A June 12, 2017 letter to Attorney General Jeff Sessions from all Committee Democrats, asking him to provide the Committee with information regarding his recusal from the Russian investigation and certain allegations about President Trump by former FBI Director James Comey.
A July 12, 2017 letter to Attorney General Jeff Sessions from all Committee Democrats and several other Members, requesting information about the abrupt settlement of United States v. Prevezon Holdings, Ltd.
A November 7, 2017 letter to Attorney General Jeff Sessions from all Committee Democrats, citing various inconsistencies in his past testimony before Congress and the Department’s failure to respond to Committee oversight requests.
A February 1, 2018 letter to FBI Director Wray from Ranking Member Nadler, asking that he brief the Committee prior to the release of the so-call “Nunes memo.”
A May 24, 2018 letter to FBI Director Wray and Deputy Attorney General Rod Rosenstein from Ranking Member Nadler, urging a criminal investigation into the alleged outing of an undercover asset who had been used to collect information for the FBI in the early stages of the Russia investigation.
The November 7, 2018 letters to FBI Director Wray and Acting Attorney General Whitaker from the ranking members of several committees of jurisdiction, calling for the preservation of all documents related to the Special Counsel’s investigation and the firing of former Attorney General Jeff Sessions.
A November 8, 2018 letter to Acting Attorney General Whitaker from all Committee Democrats, asking for clarity on his role, additional protections for the Special Counsel, and Mr. Whitaker’s recusal from supervision of the Special Counsel’s investigation and any related investigation.

WASHINGTON (Reuters) - Republican and Democratic U.S. senators introduced legislation on Thursday seeking to strike back at Saudi Arabia over the death of a Saudi journalist at a consulate in Turkey and for its role in Yemen’s devastating civil war.
If it were to become law, the bill would suspend weapon sales to Saudi Arabia and prohibit U.S. refueling of Saudi coalition aircraft for Riyadh’s campaign in Yemen against the Houthis, Shi’ite Muslim fighters that Yemen’s neighbors view as agents of Iran, the lawmakers said.
It also would impose sanctions on anyone blocking humanitarian access in Yemen and anyone supporting the Houthis in Yemen.
Sponsored by three Republican and three Democratic senators, the legislation reflects continued dissatisfaction in the U.S. Congress over the Yemen war, which has killed more than 10,000 people and created the world’s most urgent humanitarian crisis.
That frustration was exacerbated by the killing in October at the Saudi consulate in Istanbul of journalist Jamal Khashoggi, a U.S. resident who wrote for the Washington Post.
Senator Bob Menendez, the top Democrat on the Senate Foreign Relations Committee, said sanctions on 17 Saudis announced earlier on Thursday by President Donald Trump’s administration were not enough to ensure a credible investigation of Khashoggi’s death and an end to hostilities in Yemen.
“We are putting teeth behind these demands with regular oversight, sanctions and suspension of weapons sales and refueling support,” he said in a statement.
“This legislation is an important way to hold Saudi Arabia accountable for various acts in Yemen as well as the death of Jamal Khashoggi,” said Republican Senator Lindsey Graham, another sponsor.
The bill’s other sponsors include Republican Senators Todd Young and Susan Collins and Democrats Jack Reed and Jeanne Shaheen.

Joshua Stueve, a spokesman for the U.S. attorney's office in the Eastern District of Virginia said, "The court filing was made in error. That was not the intended name for this filing."
An FBI spokeswoman declined to comment.SPOILERFederal prosecutors in the Eastern District of Virginia have long been investigating Assange, and in the Trump administration had begun taking a second look at whether to charge members of the WikiLeaks organization for the 2010 leak of diplomatic cables and military documents that the anti-secrecy group published. Investigators also had explored whether WikiLeaks could face criminal liability for the more recent revelation of sensitive CIA cybertools.
Special counsel Robert S. Mueller III also has explored the publication by WikiLeaks of emails from the Democratic National Committee and the account of Hillary Clinton's then-campaign chairman, John D. Podesta. Officials have alleged that the emails were hacked by Russian spies and transferred to WikiLeaks.
Mueller also has been exploring, among other things, communications between the group and associates of President Trump, including political operative Roger Stone and commentator and conspiracy theorist Jerome Corsi.
In July, his office charged 12 Russian military spies with conspiring to hack DNC computers, stealing the organization's data and publishing the files in an effort to disrupt the election, and referred in an indictment to WikiLeaks, described only as "Organization 1," as the platform the Russians used to release the stolen emails.
A spokesman for the special counsel's office declined to comment.
It was not immediately clear what charges Assange would face. In the past, prosecutors had contemplated pursuing a case involving conspiracy, theft of government property or violating the Espionage Act. But whether to charge the WikiLeaks founder was hardly a foregone conclusion. In the Obama administration, the Justice Department had concluded that pursuing Assange would be akin to prosecuting a news organization. Then-Attorney General Jeff Sessions, though, had taken a more aggressive stance and vowed to crack down on all government leaks.
Barry J. Pollack, one of Assange's attorneys, said, "The only thing more irresponsible than charging a person for publishing truthful information would be to put in a public filing information that clearly was not intended for the public and without any notice to Mr. Assange. Obviously, I have no idea if he has actually been charged or for what, but the notion that the federal criminal charges could be brought based on the publication of truthful information is an incredibly dangerous precedent to set."
The filing in the Eastern District of Virginia came Aug. 22, in a case that combines national security and sex trafficking. Seitu Sulayman Kokayi, 29, was charged with enticing a 15-year-old girl to have sex with him and send him pornographic images of herself. But he was detained in part, according to the court filing, because he "has a substantial interest in terrorist acts."
His father-in-law, according to the filing, has been convicted of terrorist acts. The case involves previously classified information, according to government filings, and prosecutors plan to use information obtained under the Foreign Intelligence Surveillance Act. Kokayi was indicted last week and is set to be arraigned Friday morning.
The case had been sealed until early September, though by itself it attracted little notice. On Thursday evening, Seamus Hughes, deputy director of the Program on Extremism at George Washington University who is known for scrubbing court filings, joked about the apparent error on Twitter -- which first brought it to the attention of reporters.
Even if he is charged, Assange coming to the United States to face trial is no sure thing. Since June 2012, Assange has been living in the Ecuadoran Embassy, afraid that if he steps outside he will be arrested.
When he first sought asylum in the embassy, he was facing possible extradition to Sweden in a sex crimes case. He has argued that case was a pretext for what he predicted would be his arrest and extradition to the United States.
In the years since, the Swedish case has been closed, but Assange has said he cannot risk leaving the embassy because the United States would attempt to have him arrested and extradited for disclosures of U.S. government secrets. Throughout that time, the United States has refused to say whether there are any sealed charges against Assange.
If Assange were to leave the embassy and be arrested by British authorities, he would likely still fight extradition in the British courts.
