Unfortunately, forensics was needed at the crime scene and that is now impossible to perform. However, upon review of transcripts & exhibits it appears additional forensics can be performed in the following areas:

1) Anthropology Forensics - Entry side of internal beveling, of Exhibit 394, should be measure to determine caliper of the gun used. The entry side appears measure 24/64ths (9.327mm) versus the bullet (Exhibit 277) measures 15/64ths (5.943mm). While a bullet will distort on impact, the size of Exhibit 394 seems beyond that of a .22.

2) Anthropology Forensics - Cut marks on the bones in the quarry (Exhibit 402 Tag 8675) and those of found in the pit (Exhibit 402 Tag 8318) should be further evaluated.

3) Ballistics Forensics - CERA (Cartridge Electrostatic Recovery Analysis) should be performed on the casings found in the garage (Exhibit 250) to determine whose prints were left via micro-etching. Additionally, the bullet (Exhibit 277) should be matched against the casings (Exhibit 250)

4) Ballistic Forensics - Exhibit 277 should be re-evaluated to explain its trajectory to under the compressor. The measurement, of 15/64, does not seem consistent with the bullet having hit a hard surface whereby it trajectory could be explained by ricocheting off a hard surface.

5) DNA Forensics – The series leaving out the hood latch, seems to have produced new evidence. The source of the DNA was not known, since no presumptive testing was done (Day 8 Page 94), but it’s now being said to have been sourced by “sweat”. It is known that DNA deposited by “sweat”, onto surface, degrades relatively quickly whereby; full profiles are typically obtainable within the first 2 weeks from deposit, thereafter partial profiles typically within 6 weeks. Given the hood latch swab produced a full profile and the swabbing of the latch took place outside of the lab on April 3rd (Day 6 Page 210), a source of “sweat” would indicate the deposit took place after March 19th, 2006. Avery was incarcerated as of November 9th, 2006, so it does not appear Avery would have been able to deposit his “sweat” in the timeframe needed to produce a full profile.

6) Digital Forensics – The cell tower numbers, within Ms. Halbach’s phone records (Exhibit 281), should be used to identify the phones location on the October 31st, 2005. Additionally, the phone number associated to the 2:41PM call Ms. Halbach made should be identified. Additionally, most companies use a monthly backup rotation cycle whereby the missing voice message from the 4:35pm call may be obtainable via off sight backups.

7) Digital Forensics – The car’s roof was not at all concealed and satellite imagery,of the junkyard, demonstrates the car should/could have been easily spotted by air. Identifying any/all imagery satellites, photographing the area between October 31st, 2005 and November 5th, 2005, should done as well as a review of their imagery history.

8) Digital Forensics - Photo analysis on the ignition switch photo (Exhibit 291) to investigate the two pressure areas, separated by an area without blood, left within the exhibit. Given the area is vertical to the ground, that pattern seems inconsistent. Thus, the photo analysis should be done to determine if pattern is consistent with a Q-Tip being used.

9) Digital Forensics – Pattern analysis should be done using the transcripts themselves to determine if any patterns materialize to which further investigation is needed in search of new evidence. As Example: Determine if there is a pattern between teams that searched and area and those that found evidence in those areas after the prior search. Identify if there is any inconsistencies/discrepancies between testimonies & physical evidence, whereby identifying where additional forensics is needed.

Avery's (ex-)advocaat gaf aan dat hij zich niet zozeer druk maakte om het gaatje bovenin het bloedbuisje, maar meer om het bloed wat tussen het glas en het rubber in zat. Dat zou volgens hem alleen kunnen ontstaan, wanneer het dopje van het buisje is afgehaald.
