Introduction
As the conflict in Syria continues now after entering its fifth year, reports have been received from civil society actors about increased child abductions and human trafficking for organ removal. This phenomenon which affects the most vulnerable has thus attracted the attention of the Protection Sector and its partners.
Although human trafficking, as defined in the “Protocol to Prevent, Suppress and Punish Trafficking in Persons”, includes exploitation for the removal of organs, there is little knowledge of what this phenomenon entails.1 During crises and war times, trafficking in human organs increase2 for several reasons such as, but not limited to, financial needs, absence of rule of law, lack of awareness in the culture of organs’ donation and the need of a person to implant an organ.
Transplanting organs could be performed either from a dead body to a living human which is morally and legally accepted under certain conditions in Syria such as ensuring that the transplant is not affecting the dignity of the corps or distorting the body and that the death report is issued by a committee of three doctors different from the doctors working on transplanting of the organ, as well as ensuring the validity of a written testament from the dead person or a written approval of the first degree family members.
Transplanting organs could be also performed from a living person to another which should be governed by the law in Syria under very specific conditions such as ensuring that the organ is not essential for life and that the written testament is valid. The committee of three doctors must guarantee that this operation is necessary for the recipient and that it will not affect the life of the donor who must be an adult presenting a full consent. As for minor siblings, it is limited to twins with the written approval of parents. In addition, the transplant must be with full consent of the recipient with no financial exchange3.
Trafficking in human organs could be done separately from trafficking in persons when the crime of selling and buying human organs is committed separately from the crime of trafficking in persons. Yet after issuing the Decree N. 3 for the year 2010 in Syria, most cases of trafficking in organs have been convicted due to the fact that trafficking in persons is considered as collective crimes with several aspects, and the highest penalty is therefore charged.
As criminal courts’ judges have a margin for personal interpretation of the law, they usually impose a higher penalty, which is mostly laid in the counter trafficking law due to the fact that they issue their judgment based on several crimes within their jurisdiction. The punishment is usually based on the severest crime, therefore, it is up to the criminal judge to decide on more than one crime and opt for the highest punishment by the law.

Ayatollah Khatami called on religious seminaries and intellectuals of the Muslim world to prevent continued crimes by the Saudi regime.
On Saturday, several Saudi rights activists warned Al Saud that Sheikh Nimr’s execution would set fire to Saudi Arabia.
“The Saudi people will ask for a halt in the execution of the death sentence (for Sheikh Nimr) by staging peaceful rallies and protests,” Sheikh Abbas al-Qatifi told FNA.
Stressing the strong opposition of Saudi Arabia’s Eastern province to the execution of the Shiite cleric, he said, “The case of Sheikh Nimr is a Saudi show played by the Saudi princes at the order of the US and the Zionist regime as part of a plot in the country and even other Islamic countries.”
Also in relevant remarks on Saturday, Abdolhadi al-Sattari, another Saudi rights activist, told FNA that the Saudi officials have resorted to terrorists to suppress the Shiites inside and outside Saudi Arabia.
He warned that the Eastern province’s people will take revenge for the blood of their martyrs.
Also other rights activists said that the Saudi youth have condemned plans to execute Sheikh Nimr and are preparing themselves for a big revolution against the country’s cruel rulers.
An informed Saudi source told FNA on Wednesday that Riyadh planned to execute Sheikh Nimr on May 14.
“The Saudi regime plans to execute Sheikh Nimr on the death anniversary of Nayef bin Abdullah, the former Saudi crown prince,” the source, who spoke on the condition of anonymity due to the sensitivity of his information, said.
The source said the Saudi rulers know that the move would engulf the monarchy in the flames of unrest and they might have to pay a heavy price for the execution of Sheikh Nimr, and they have prepared riot combat plans after consultations with several western security experts.
Nimr was attacked and arrested in the Qatif region in July 2012. His arrest sparked widespread protests in the kingdom leaving several people dead.
On October 15, 2014, Nimr was sentenced to death at the Specialized Criminal Court in Riyadh. In reaction to the sentence, people took to streets in the city of Qatif in Eastern Province to condemn the move.
Amnesty International has called the death sentence “appalling”, saying the verdict should be quashed.
Nimr was given the death sentence on charges of disturbing the kingdom’s security and making anti-government speeches.
He is the Imam of al-Awamiyya Mosque in Qatif and has spent most of his two-year detention in solitary confinement at the al-Ha’ir prison in Riyadh, according to Amnesty International.
Protesters have staged rallies worldwide to condemn the death sentence handed down to Sheikh Nimr, and have voiced solidarity with the dissident Saudi religious scholar.
There have been numerous demonstrations in Saudi Arabia’s oil-rich Eastern Province since 2011, with the protestors calling for political reform and an end to widespread discrimination. Several people have been killed and many others have been injured or arrested during the demonstrations.
The Persian Gulf monarchy has come under fire from international human rights organizations, which have criticized it for failing to address the rights situation in the kingdom. Critics say the country shows zero-tolerance toward dissent.
In January, Joe Stork, the deputy director of the Middle East and North Africa division for Human Right Watch, slammed Saudi Arabia’s crackdown on activists in the kingdom.
“Saudi Arabia should free imprisoned activists and take other concrete, visible steps to show the government is willing to improve its abysmal rights record,” Stork said.
Stork also questioned the election of Saudi Arabia as a member of the Human Rights Council in November last year, saying that Riyadh has a record of repression and its membership is not warranted.
Saudi Arabia is an absolute monarchy that does not allow any election.
quote:The testimonies of four public prosecutors, who were jailed last week for their role in the search of trucks allegedly carrying weapons to opposition groups in Syria, have revealed that some state officials had links with the extremist Islamic State of Iraq and the Levant (ISIL) and similar organizations operating in Syria, media reports said on Sunday.
Former Adana Chief Public Prosecutor Sleyman Bağrıyanık, former Adana Deputy Chief Public Prosecutor Ahmet Karaca, Adana prosecutors Aziz Takı and zcan Şişman and former Adana provincial gendarmerie commander Col. zkan okay were arrested on Thursday on charges of “attempting to topple or incapacitate the Turkish government through the use of force or coercion and exposing information regarding the security and political activities of the state.”
The trucks, which were found to belong to the National Intelligence Organization (MİT), were stopped by gendarmes in two separate incidents in the southern provinces of Hatay and Adana in January 2014 after prosecutors received tip-offs that they were carrying arms to Syria.
Although the government has claimed that the trucks were transporting humanitarian aid to the Turkmen community in Syria, opposition voices have continued to question why, if the operation was within the law, the minister and local authorities stepped in to prevent the trucks from being searched.
In his testimony, Şişman, who stopped the MİT trucks in Hatay, said investigations that were being carried out either by himself and the deputy chief prosecutor's office at that time coincidentally revealed that some state officials did not differentiate between a state duty, collecting intelligence and being involved in terrorism, and that they had unlawful relations with ISIL and similar organizations operating in Syria.
In his testimony, Şişman added that if the trucks were really carrying weapons to Syria, this cannot be described as a state secret. “A criminal action cannot be described as a state secret,” he said.
Referring to the search in Adana, the prosecutor said that missile warheads and rocket launcher warheads were found in one of the trucks there. Şişman said two of the individuals involved in the “crime” told him that they did this with the knowledge of the state and even that some state officials helped them.
Şişman said the same truck was found to have unloaded some ammunition at a border military post located in Reyhanlı's Bklmez village on Oct. 6-26, 2013, and that the ammunition had been taken across the border, adding that security footage proved this and that the ammunition was taken to a camp of the hardline militant group Ahrar al-Sham.
Prosecutor Bağrıyanık's testimony showed the unlawful interference of then Justice Minister Bekir Bozdağ in the incident. Bağrıyanık testified that he received a call from then-Justice Ministry Undersecretary Kenan İpek, telling him that he was not authorized to order a search of MİT trucks as it would run against article 26 of MİT law. İpek allegedly told Bağrıyanık that if a search was to take place, those making the search along with Bağrıyanık would be saddened and that this is not something he would like to happen.
The prosecutor said he later discussed the issue with deputy prosecutor Karaca who told him that the search not only wouldn't violate MİT law, but that an immediate search should be made in the case of the existence of evidence whose collection should not be delayed.
Bağrıyanık said the undersecretary called him several times regarding the same issue and he once gave the phone to the then-Justice Minister Bekir Bozdağ, who allegedly told Bağrıyanık that the search of the MİT trucks was unlawful and that he should immediately remove the prosecutor conducting the search.
The prosecutor said he did not abide by Bozdağ's order because the then-minister was not authorized to intervene in judicial proceedings.
In the meantime, the existence of security footage was revealed which shows the ammunition found in MİT trucks, and samples of the ammunition found in MİT trucks were taken. In addition, a report prepared by an expert detailed the type of ammunition found.
In his testimony, prosecutor Takı asked the trial judge under which law the ammunition on the trucks was being transported and to where. He said the weapons in question were transported in an illegal way. “On which legal grounds was this transportation being made? Is there a decision of the MGK [National Security Council], the Cabinet or an order from the then-prime minister? … Laws are obvious. Since when, was the transportation of weapons by MİT described as a state secret? Does MİT have a duty to transport weapons?” he asked.
The investigation carried out by prosecutor Şişman revealed that the vehicle escorting the MİT trucks was registered in the name of al-Qaeda member A. Demir. Şişman questioned how MİT officials could get on a vehicle belonging to an al-Qaeda member.

Talks during the meeting touched on the progress of Syrian-Iraqi relations and cooperation mechanisms, in addition to the overall situation in the region and the world, with the two sides stressing the need to exert all possible efforts to restore security and stability in the region and the world.
In a statement to SANA’s correspondent, Ambassador al-Dandah said that the meeting is part of the coordination between the two countries that face mutual challenges and confront a vicious terrorist attack, stressing the need for countries that are affected by terrorism to band together to deal with this scourge.
