Force India brought the legal action against Aerolab back in November last year after accusing the facility of copying elements from their own car onto the Lotus design, after both teams used the same facility to test their cars.
The Indian team left a scale model of their 2009 car in the facility after making use of the wind tunnel early last year, and the team are now seeking damages after the 2010 Lotus contained some very similar aerodynamic parts.
Aerolab called Lotus as a co-defendant in the case, with the company denying that it passed information from Force India to Lotus. The company also claimed to be pursuing Force India for "serious and persistent breaches of contract".
But Lotus have now been granted indemnity in the case, and a company spokesman have been quick to clarify that this confirms that Lotus are not being accused of anything over the incident.
"Lotus Racing has been joined as a co-defendant in civil proceedings which are principally between Force India and Aerolab/Fondtech," a spokesman for the team said yesterday.
"These proceedings do not allege any wrong doing on the part of Lotus Racing.
"Aerolab/Fondtech vigorously denies any wrong doing and has provided Lotus Racing with a full indemnity in relation to the claim."
Lotus have already begun work on their 2011 car after their 2010 machine proved to be uncompetitive.

It is now apparently a question of finalising contractual and legal issues before confirmation comes from the FIA in the coming days.
Although Pirelli had already appeared to have already secured the contract, Michelin’s Nick Shorrock addressed the team bosses in a FOTA meeting in Istanbul on Sunday morning. However rather than put anything new on the table, he merely reiterated what had been said in earlier proposals.
The biggest weakness in Michelin’s case was its insistence on making a significant cut in the number of sets of tyres available per driver per race weekend, whereas Pirelli has agreed to honour the numbers as supplied by Bridgestone in the current FIA Sporting Regulations.
”We don’t have enough as it is,” said one team boss. “To go to even less is crackers.”
Intriguingly when I asked Shorrock about the transition from grooved to slick F1 tyres, he made a virtue of Michelin’s Le Mans experience and the longevity of its sportscar rubber: “We’ve not been in F1, but we are very present in other disciplines, notably in endurance racing, and particularly in a couple of weeks we’ll be at Le Mans. That type of racing brings us enormous information.
“If you look over the last 10 years the durability of a Michelin tyre has increased by 35%, while car speeds have increased by 10%. So that’s something we know how to do, it’s our basic profession, to make a tyre that’s usable and safe in a competitive environment.”
Logic suggests that creating tyres with an extra long life – which would be needed to get the teams through practice and qualifying on fewer sets – would do little for the F1 show.

Voor hetzelfde geld waren ze er beiden gestuiterd en dat hadden op het eind van het seizoen dan wel eens hele dure punten geweest kunnen zijn.
Ik zeg niet direct dat Webber de schuldige is, maar hij had beter moeten weten en ruimte moeten laten imo

"Force India states these are very serious claims and therefore it would not be taking such action if it could not provide supportive evidence."
Both Force India and Lotus have used the aerodynamic engineering firm Aerolab for the design and development of their cars.
Force India has also clarified that separate legal action, between Aerolab and Force India over undue termination of contract, is ongoing.
The teams' statement added: "Additionally, Force India would like to clarify that any action between Aerolab and Force India for undue termination of contract is now being addressed by the courts.
"Force India confirms it paid approximately one million euros in autumn 2009 to secure the payment claimed by Aerolab and it is now for the competent courts to decide whether, indeed, this outstanding amount should be paid to Aerolab given the seriousness of these current allegations."
