http://www.anorak.co.uk/madeleine-mccann/185345.htmlquote:Madeleine McCann: Selling Books
MADDIE WATCH - Anorak’s at-a-glance guide to press coverage of Madeleine McCann
Madeleine McCann has become the benchmark for all mention of paedos and missing children in fact and fiction. After Ben Affleck’s film, the press now has books by Irvine Welsh and Catherine O’Flynn to conjure with…
DALLAS MORNING NEWS: “’What Was Lost’ by Catherine O’Flynn: Masterful mystery draws shivers with tale of missing girl”
It is no great surprise that in 2007, when Britain was obsessed with the Madeleine McCann case, a novel about a missing child should resonate with readers there. What Was Lost won Catherine O’Flynn the prestigious Costa First Novel Award and made her the British book trade’s “Newcomer of the Year.”
IRISH HERALD: “Maddie link put Welsh’s new book on hold”
TRAINSPOTTING author Irvine Welsh has revealed that he stopped writing his new book ‘Crime’ after Madeleine McCann went missing because of similarities between the case and the plotline of his story.
The writer said his book nearly didn’t happen because he was unnerved by the coincidence. His book tells the story of Detective Inspector Ray Lennox who goes to Florida to escape from a horrifying child murder case in Scotland.
But while there he ends up trying to save a young girl from a paedophile ring.
“When Madeleine McCann disappeared I just stopped writing ‘Crime’. It just seemed too horrible to go on,” said Welsh.
Madeleine McCann: The marketing tool…

Clarence Mitchell beweerd: "The spokesman for the family of Madeleine McCann has reversed a statement made in the early days of the search for the missing child. Speaking to RTE's 'Prime Time', Clarence Mitchell said she could "easily" have been kidnapped by an abductor who did not leave the trail of a break-in. However, in the early part of the hunt, friends and family members told journalists that the shutter on the apartment where the McCanns were staying had been broken. Mr Mitchell made his comments when questioned by a 'Prime Time' team in a report on the disappearance to be screened tomorrow. "There was no evidence of a break-in," said Mr Mitchell."
.Want wát meldde Clrence Mitchell ook al weer qua 7 juli, eerdere post:quote:Kate and Gerry Mccann have been boosted by a series of fresh leads In the hunt for missing daughter Madeleine.
They have been told of ‘several’ potential new sightings of the five year old, who vanished with out trace while on holiday in Portugal in May 07. It has led to a ‘widening and deepening’ of the private investigation into Madeleines disappearance.
Last night the familys spokesman Clarence Mitchell said Kate and Gerry remain hopeful that ‘a breakthrough’ is near. He said ‘following the documentary at the anniversary of Madeleines disappearance there were a lot of calls, which are still being followed up.
These include new information, potential sightings , although I cant go into any details. The privately funded probe into Maddie’s disappearance from the family’s holiday apartment in Praia de Luz on May 3, 2007 has become ‘wider and much more sophisticated’ according to sources.
Metodo 3 the Spanish agency which took on the investigation is being aided by other agencies across the globe. In addition, doctors Kate and Gerry, both 40, from Rothley, Leics. Hope their status as Arguidos or suspects - will be lifted in the next few weeks.
Police files on the case are due to be shared with third parties next month, which could signal an end to the suspicion which hung over the couple since last year. Last night Mr Mitchell said the Mccanns still believe Maddie is alive. He added ‘they continue to work on the assumption that Madeleine is being held somewhere. There is no evidence she has been hurt or killed’.
En verder:quote:"They will take whatever legal steps are necessary if there is information out there that can assist their private investigation into finding Madeleine. Beyond that I cannot make any comment."
Djeeeeeeeeeeeeeeeeeez, wat een zooi bagger weer, yek! Genoeg geteut weer voor vandaag...quote:"In recent months the couple have become increasingly frustrated at the slow progress of the Portuguese investigation, and they suspect that many possible sightings of Madeleine have not been followed up at all. If they are given access to the police files on reported sightings, each one will be looked into by private investigators retained by the couple. For the past year the McCanns have employed Metodo 3, a Barcelona-based detective agency, to carry out an investigation in parallel with the Portuguese police inquiry.
FROM the Anorak Forums - by AGW:
How The Madeleine McCann Story Was Hijacked By Web Trolls
One of the most bizarre and troubling aspects of of the Madeleine McCann story has been the way the coverage of the story has itself become the story.
Anorak is not a site which has ever been (or ever will be) dedicated to the alleged crimes of abduction and subsequent claim and counter-claim of deeper, darker deeds involving in turn a resident Englishman in the Portuguese holiday complex where the McCann family had been staying and then the parents and their friends themselves.
Right at the beginning of all this I had predicted it was a complex story which would run and run. I confess to being bemused by the the tale’s longevity. The Madeline McCann story has become Dianaeque in its telling and re-telling, worse it is on a par with the empty and drifting ship the Mary Celeste.
The story of a photogenic, pretty little white girl from a professional and middle-class background was sure to attract attention.
I had always expressed serious doubts about the wisdom of the parents’ determination to avoid clear police advice and follow their own route to infamy…because that it what it has become.
The story divided neatly pro and anti. Not pro and anti the hunt for a little girl or her remains but pro and anti the parents. It has become a love-hate story. Every day in Anorak there are those who praise or condemn, support or vilify.
Professional journalists have watched with increasing bemusement, bordering on horror, at the activities of sites created and devoted exclusively to the Madeleine McCann story. They have risen, flowered and been cut down. The same individuals, only the names have been changed to protect the guilty, have in their turn raged or praised as each site flourished and then fell by the wayside.
The same experts and lost souls appeared again and again, and yet again, during the brief existence of these sites. Sometimes only the keystrokes or style and use of phrases and words revealed their true identity. They took full advantage and became legends in their own lunch-times, master spies, superheroes CyberMan or DigiWoman each using the Internet’s basic anonymity to change gender, location and re-invent themselves as brilliantly clear thinkers, defenders of the faith and public morale and morals or, very sad solicitors posing as desperate housewives.
The 3 Arguidos site is probably the strongest of the allegedly Madeleine McCann dedicated sites. I have no access to it nor seek any since it regularly appears to be an outrageous vipers nest of sad people, many of whom have had brief cyber-existences here. It has attracted an interesting group of supporters and helpers and we should genuinely wish them well. They are the Jerry Springer end of the coverage.
The McCann story can not sustain sites like this and they have to diversify. Recruitment from sites such as ours is one way of doing it.
The Moderators here at Anorak have noted a recent surge of activity as the once-again revamped team at the 3As have become our new friends. Avid letter writers to Anorak and when gently challenged, retreat to vent their spleen within their own site. We had such an incursion yesterday.
We are aware the 3As site has suffered dreadful problems lately and we sympathise but do have our own course to run.
There is always a suspicion, often borne out by later scurrilous attacks, the new best friends have their own agenda. That’s fine we all do…and I do not intend to give the 3As site any further creditability by association with us.
It is worth passing on one of the alleged solicitor types in there tried to publish our editor’s telephone number. Why? It is freely available on this site and he is more than well-equipped to be happily entertained by the odd moronic or dirty phone call.
We remain secure in the knowledge of many things but among them are:
Anorak is the leading site of its genre
It has the most experienced and competent team of Moderators
Its writers are skilled and entertaining
It is growing and constantly evolving which is a healthy thing
It is often not a comfortable place to be but remains vibrant and exciting
Imitation and jealous rages remain the sincerest forms of flattery.
…and the headline to this piece? It is often forgotten that the very next line in that quotation is:

The investigators finished the Enquiry. The filing is the probable outcome.
2008 JUL 01 - 00h10m
Alexandra Serôdio
The Policia Judiciária (PJ) couldn’t find any guilty parts for the disappearance of Madeleine McCann last May the 3rd. The investigators have already finished the enquiry without reaching a conclusion. The probable outcome will be the “archiving”.
After almost 14 months that Madeleine disappeared from the room where she slept on the Ocean Club resort, in Praia da Luz (Lagos), the investigation declenched by the Judiciary didn’t allow to conclude if it was a kidnapping or a homicide. And it was also admitted that there was no evidence that related the three arguidos – Robert Murat, Kate and Gerry McCann – with the disappearance of the child.
As the JN was able to conclude with sources close to the process, the report from the investigators «only describes the facts that were proved and not proved». This means that it is not conclusive and doesn’t point at any direction – kidnapping, homicide or cadaver occultation.
Sources from the Republic’s General Prosecutor told the JN that, «for the moment, the process will wait for trânsito em julgado (N.T. it means that a certain amount of time must pass by until the timing for an appeal is extinguished) of a decision that the Portimão Criminal Court passed on about a means of proof, the reason why the enquiry in charge of the PJ was not considered as concluded and no report was sent to the Public Ministry». The same source clarified that the «secret of justice will be maintained until mid August of this year».
The JN knows that what is at stake is the decision to validate or not the copies of Kate McCann’s journal, that the PJ analyzed and to which it didn’t give any relevance for the process, that’s why they considered their job concluded.
This situation is criticized by a source close to the process: «The request was made in September last year and too much time has passed». The same source believes that based on this report of the PJ the decision will be the filing of Maddie’s case, which doesn’t mean that the process can’t be re-opened if meanwhile new evidence emerge.
From what was possible to find out, the process sent to the Portimão Court, last week, was returned again to the PJ because the Instruction Judge hasn’t validated the diary yet. Pedro Frias, the judge, didn’t ask any diligence from the investigators.
If the “archiving” is confirmed, as in other cases of missing persons, the police will keep alert to any new data. Maddie’s case may be re-opened if any new evidence or important proof is discovered.
Francisco Pagarete, lawyer of Robert Murat, said, yesterday, to the JN, that he knows nothing about the process. « Since we went to get Murat’s belongings, more than three months ago, we weren’t contacted anymore by the PJ», said the lawyer. About the possible filing of the process, Pagarete reminds that it is a «resolution that can happen with any case», assuring that he doesn’t know «what evidences were found or not».
The lawyer awaits the official document of the filing in order to know in concrete what are the reasons for that decision, in case that will be the one taken by the Portimão Judge. He assures that Murat is “quiet serene”. And he concluded «All the diligences of the PJ were accompanied and so we will know what will be in the files»
Carlos Pinto de Abreu, lawyer of the McCann, also awaits the decision. In case the process is archived, he says that he will study it «from the first to the last page» to do« what the (Maddie) parents always wanted, which is to understand what investigation was done and to keep on looking for the child».

8 ⤓ If the MP decides to lay charges (if enough INDICATIONS have been collected), then:
9 ⤓ The INSTRUCTION PHASE begins. This phase is OPTIONAL. The arguido has to request it. If not, it goes directly to trial.
10 ⤓ The instruction phase is LED by the instruction judge (vs. ⤘overseen⤙ as in the inquiry phase).

But in a statement the Portuguese Attorney General, Fernando Pinto Monteiro, denied the claims. The statement said police had handed over their final report but officials had made no decision on whether to halt the investigation." Ook de BBC moet enigszins het bericht aanpassen.quote:General State Prosecutor says that “Maddie Case” is still being evaluated
The General Prosecution Office has announced, this Tuesday, that the process of the so-called “Maddie case”, the English girl that disappeared in the Algarve, is still being evaluated, and no decision has been issued into the direction of an archiving.
In a communication, the General Prosecution Office refers that the final report from the Polícia Judiciária has been handed over and that it will “be the object of careful evaluation and pondering”.
“The Public Ministry will proceed to globally analyse and evaluate the entire process (which contains tens of volumes) in order to determine whether other diligences are to be demanded or the necessary and sufficient conditions have been gathered to close the inquiry and to elaborate the final dispatch”, the Prosecution Office refers.
Within the same note, the Prosecution Office also refers that the process remains under judicial secrecy until mid-August. Meanwhile, questioned by journalists, the Justice minister, Alberto Costa, did not want to comment on the matter, merely stating that “the process is under judicial secrecy”.
Just like the minister, the joint Director of the PJ, Pedro Carmo, did not wish to comment on the process, underlining that the PJ “is at the disposal” of the Public Ministry. Source: TSF Translation by Astro

Until this story broke, the McCanns had no case at all. "Please Miss, may we see the secret evidence weeks before we are allowed to?". Eh, no.
But now, they can play this story for all its worth. "As you know, your honour, the Portugese have given up on the case and are shelving it. Even if they haven't announced it officially, we all know it is true. Therefore we NEED the evidence so that we parents can continue in the search for Maddie. Every second counts so get them to hand it over, and we will take it from here."
Perhaps not... but the timing and the content are awfully coincidental, and awfully helpful to what was otherwise a pointless hearing next Monday...
PJ handed over yesterday the final report of the investigation, in which the whole investigation done since May of 2007 is specified in detail. The document does not present sufficient evidence to prosecute, but it is up to the Public Ministry to decide. Future can pass by further new investigations.
Friends of the McCanns might return to Portugal
The filing of the process Madeleine McCann, missing on the 3rd of May of 2007, is not a certainty. Most likely the Public Ministry will order the PJ to follow new investigative steps.
Yesterday, the Judiciary Police sent a final report where all the investigative steps and inquires done along this last month and a half are specified in detail, this report is now in the hands of the Public Ministry and is going to be object of "appreciation and careful consideration", as a source of the Public Prosecution Office (PGR) guaranteed yesterday in a notice sent to the editorial staffs [media].
The new possible steps may go through the reconstitution of the night of the disappearance, which implicates that the friends of the couple McCann and the McCann themselves are notified, again, to travel to Portugal. The report was marked by the incongruences between the statements of the friends of the couple on the night of the disappearance and the Public Ministry wants to find out the truth regarding those doubts.
In the same notice sent to the editorial staffs, the PGR equally guaranteed that the end of the secrecy of Justice of this case is going to take place on the 14th of August.
And this is the basic reason for this final report - called like that by the PGR but without this denomination by the PJ - to have been prepared and to be evaluated by the Public Ministry. The time is running out. There is little more than a month so that the process is within reach of any citizen. It is necessary to present results, some result. And what [result,] then?
The report, which totals in 19 volumes and thousands of documents "it does not indicate or equates the filing or accusation of the process", explained a source of the PJ contacted by the DN, which yesterday read the same report. The reason is very simple. Because it is up to the Public Ministry to decide for the accusation or for the filing of the process. The PJ 'just does' the investigation in the field and presents the collected data.
But a source connected with the process of investigation guaranteed to the DN that in that same document “there are no sufficient evidences for an accusation". Nevertheless, warns the source, this declaration is "a mere intuition, it is not guaranteed that an accusation won't follow".
The most probable path is, then, according to sources close to the process, contacted by the DN, to charge Kate and Gerry McCann of negligence. An opinion also shared by Paulo Cristovão, former PJ Inspector, who admits the possibility of negligence. “They had dinner leaving their children alone and for a futile reason, and that we know that happened ".
The fact is that, a year and two months after the British girl disappeared from Praia da Luz, in Portimão, there isn’t one absolute certainty. If the hypothesis is kidnap, death and who is responsible for what happened on that night. Yesterday, Kate and Gerry McCann demanded the access to the process of investigation, if the case is filed. In that case, "the priority must be the lifting of the couple's arguidos status”.

Mistake in the rogatory letter prevents interrogation of Irishman
In a report that was sent to the Public Ministry, the PJ admits that it does not have evidence to accuse Maddie’s parents and does not know what happened to the little girl. A case where Justice is revealed as ineffective, like other recent cases that we remember in these pages
Madeleine’s parents will remain arguidos and may still be accused over having left their children alone
An important witness was not officially heard by the Judiciária within the investigations into the disappearance of Madeleine McCann, 24Horas was able to establish. The PJ requested for the witness to be questioned, in the rogatory letter that was sent to England, but the Public Ministry and the special team that was created to investigate the case, headed by the superior coordinator Paulo Rebelo, forgot that the witness is Irish, and is not within the acting sphere of the British Home Office, the equivalent to the Portuguese Internal Affairs and Justice ministries.
“The Home Office controls all the information that is related with the English territory. Northern Ireland, Scotland and Wales are outside this cabinet’s control”, a source at Eurojust, the entity that helps European authorities when it is necessary to establish international contacts, explained to 24Horas. “If we are requested to speak to the British authorities, we have liaison officials that do just that. But it is necessary to specify what country the request is destined to. In the Maddie case, it was requested only from England”, the same source clarifies.
Case has not been archived
Neither the PJ nor the Public Ministry have requested the hearing of the Irishman who, in his first witness statement, early September last year, guaranteed to the PJ that he saw Gerry carry a child away in his arms on the evening of the disappearance, having clarified that he only remembered who it actually was after he saw on television how the missing child’s father carried Sean, one of her siblings, when they arrived at Birmingham airport.
The problem was that the hearing of this witness and of his family was requested to the English authorities, not the Irish. “It’s a mistake that may have cost the investigation dearly”, a source at the Public Ministry in Portimão admitted. The PJ knows very little about the disappearance of Madeleine McCann. It only holds a few witness statements that say that the child stopped being seen from 6 p.m. onwards, and the dogs’ smelling that detected cadaver odour in a car that was rented by the McCanns 25 days after Maddie disappeared.
Therefore, the Portuguese police hold no evidence that Madeleine’s parents killed her or concealed her body, as they suppose. According to a report that was sent to the Public Ministry this week, the PJ team, lead by superior coordinator Paulo Rebelo, did not manage to find an element to incriminate the McCanns. There is only the hypothesis of accusing them of exposure and abandonment of minors, crimes that may lead to a condemnation of between five and ten years in prison.
Thus the McCanns will stop being arguidos within the coming months, but they will gain access to the process from mid-August onwards.
Pinto Monteiro, the Republic’s General Prosecutor, manifested yesterday that the Maddie process is not over yet. “The Public Ministry will globally analyse and evaluate the entire process (which contains tens of volumes) in order to determine whether or not other diligences are requested or if the necessary and sufficient conditions have been gathered, in order to close the inquiry and to elaborate the final dispatch”, the Prosecutor’s Office refers in a statement.

Suspicion – PJ Investigators do not believe in abduction

The process awaits evidence to accuse, but Public Ministry maintains catalogue of violent crime and concealment of cadaver
The process about the disappearance of Maddie is recoiling into the archives of the Portimão Courthouse for now, through a decision from the Public Ministry, but it will remain classed by the appointed prosecutor, Magalhães e Menezes, as a case of qualified homicide and concealment of cadaver. Although the McCanns lose their arguido status, the archiving does not erase the PJ’s suspicions against the couple.
Until the moment when the judicial secrecy runs out, on the coming 14th, the investigation will not be able to reunite sufficient evidence for the Public Ministry to accuse the two main suspects in the case. The PJ was under no obligation to make a final report at this stage of the inquiry, but for reasons of process management, e largely due to the media impact of the case, it is forced to suggest an archiving of the process – which thus remains awaiting better evidence.
The convictions of the investigators about the events of that evening, in Praia da Luz, are maintained and the process can be reopened by the Public Ministry at any moment – as soon as any significant advance is made by the Judiciária.
At this stage, when the opening of the process for the parties is inevitable, a source at the PJ sees a positive side, as well as a negative one, to the ending of the judicial secrecy. “if on one hand the main suspects now will have access to all of the elements that exist in the investigation; on the other hand, publicity may bring forward new elements, like witness statements.”
The PJ and the Public Ministry based a considerable part of the investigation on the access to the 14 messages that Gerry sent during the hours before and after the crime, as well as on the localization of the girl’s father’s mobile phone during the evening of the 3rd of May 2007. Neither the court in Portimão nor the Appeals court in Évora accepted the evidence, although the Public Ministry insisted on the suspicions of a crime of homicide.

The former coordinator of the Polícia Judiciária (PJ) Gonçalo Amaral, understands that the indices that were collected in the Maddie case could have had “another interpretation and valuation” if they had been evaluated by “other magistrates at other courts”.
One day after abandoning the PJ, he admitted to CM that he was “already expecting” that the result would be the archiving. “It doesn’t shock me”, he told our newspaper, while he continues to believe that Madeleine McCann died inside the apartment in Praia da Luz, on the 3rd of May, a perception that he left very clear during a report that was broadcast by RTP.
“The insufficiency of some investigations depends upon the valuation that is made of the indices that have been collected. In this case, the interpretation could have been different”, adds the former inspector, who was removed from the case and asked for his retirement so he could “express his convictions”. Although the process is on its way to being archived, Gonçalo Amaral alerts that “this is not the end of the investigation and the process can still be reopened. Questioned by CM as to whether the book that he wrote about the case, which is soon to be published, may have that strength, he simply said “we never know”.
Misschien komt dat detectivebureau van Hogan weer in beeld: "The McCanns bring in cold-case detectives to investigate Madeleine's disappearance." januari 2008 Daily Mailquote:Wat snippers uit de Daily Mail
Kate and Gerry McCann have hired a new team of private investigators to examine police evidence when they are finally cleared. The couple are expected to have their 'suspect' status lifted in the coming weeks after detectives found no evidence linking them to the disappearance of their daughter Madeleine.
Lawyers acting for the McCanns will demand access to police files once the official Portuguese investigation is shelved. Sources close to the McCanns revealed that work done by Spanish detective agency Metodo 3 has been scaled back and a new Britain-based team has been assembled.
Metodo 3 was being paid £50,000 a month out of the Find Madeleine Fund, but in recent weeks this has been reduced to a retainer of about £8,000 a month. It was heavily criticised for a series of public pronouncements, including a promise by its boss to find Madeleine by last Christmas.
Details of the new team - and what they are being paid - are being kept under wraps. A source close to the McCanns said: 'There is a new team working on it, based primarily in the UK although there are elements working abroad.
'They don't want to be identified for operational reasons. If we get access to any official documentation - either from Portugal or Britain - it will be examined by them. 'Any active leads it is felt the police have not followed up properly or left open-ended, they would move on.'

"The definitive result of the tests leave no doubts for the Policia Judiciaria. The blood found in the McCanns' car is that of Madeleine as well as those samples detected in the flat," the paper said." "According to Correio Da Manha, the police case against the McCanns consisted of sniffer dogs and that traces of blood indicate the presence of the little girl's body behind a sofa and in the trunk of the car.
Naast commerciele belangen natuurlijk. Keep Madeleine alive, keep the stories coming.
En dan schrijft diezelfde Correio da Manha vandaag: "The existence of Madeleine's hairs in the boot of the car rented by the parents three weeks after the crime, near the substitute tyre, it’s considered as highly probable by the PJ. But the investigation was not able to prove that those traces belonged to the child: the hairs have no root ends, the CM established, and the final report of the laboratory of Birmingham – of the DNA mitochondrial tests - only guarantee that someone of Kate's lineage was inside the boot of the car."
If she is dead then she is dead but not by their hand." Hoe wreed. Dan zeg ik maar: "If they are innocent then they are innocent, but not through justice."
I was removed because of the direction the investigation was heading"
The former PJ inspector believes he was removed because he didn't wish to abandon the homicide theory. He maintains that Maddie is dead and the only reason there isn't more evidence is because he wasn't allowed to continue to the end of the investigation.

By Nick Britten
Last Updated: 4:00PM BST 02/07/2008
Gerry and Kate McCann have hired a new team of British detectives after the Spanish firm they employed failed to find Madeleine.
EDDIE MULHOLLAND
Gerry and Kate McCann speaking at the Ocean Club Resort in Portugal the night after Madeleine disappeared
The couple have been paying Spain-based Metodo 3 £50,000 a month for nine months but they have not located Madeleine's whereabouts or found out what has happened to her.
Now it is understood they have been placed in an £8,000 retainer while a new team has been assembled in London, primarily in the hope that the police files into the investigation will be released, giving them new clues to follow up.
The McCanns are expected to have their arguido status lifted in the coming weeks. When it is, their lawyers will demand access to the paperwork.
The files, thought to run to several boxes, will be passed to a team of private detectives to pour through looking for fresh leads. They are believed to contain no theory about what may have happened to the four-year-old, but may well throw up new leads.
Details about the new team, and what they are being paid, are being kept under wraps.
A source close to the McCanns said today: "There is a new team working on it, based primarily in the UK although there are elements working abroad.
"They don't want to be identified for operational reasons. If we get access to any official documentation - either from Portugal or Britain - it will be examined by them.
"Any active leads it is felt the police have not followed up properly or left open-ended, they would move on."
Friends and neighbours of Gerry and Kate McCann this morning vowed to stand by the couple and called for the Portuguese police to “leave them alone”.
After news emerged that Portuguese police are closing their inquiry into Madeleine's death, residents in Rothley, Leics, accused the police of bungling the investigation and called for the couple's status as suspects to be lifted immediately.
Mr McCann, 39, and his 40-year-old wife have been told they will know their fate by the middle of August.
Technically the public prosecutor could still press ahead with a prosecution but in the light of such lack of evidence and the police shelving their investigation it is virtually inconceivable.

Was the investigation's direction, homicide, disturbing the political power?" This case was more political than a police case.quote:Madeleine McCann: I am convinced she is dead, says former Portuguese police chief
The former Portuguese police chief who led the investigation into the disappearance of Madeleine McCann has said he is "convinced" she is dead.
Goncalo Amaral said: "I am convinced of it, yes," Mr Amaral, 48, was removed from the case last October after publicly criticising British police.
He said today: "I am not saying that the English police were under the command of the McCanns, but they were influenced, as we were. "In a way, we were all influenced by the campaign that they organised, according to which the girl was alive and had to be found."
Mr Amaral retired earlier this week, saying he wanted to have "freedom of expression" over the case. He described the decision to remove him from the investigation as "unjust and dangerous" and is expected to publish a book as soon as judicial secrecy restrictions are lifted, probably in mid-August.
Portuguese police have already closed their investigation. The final case report has been passed to the Portuguese authorities who are due to review the completed file and decide if further action is required.
Madeleine went missing in May 2007, days before her fourth birthday, from a holiday flat in the Portuguese resort of Praia da Luz as her parents dined at a nearby restaurant. The McCann family and the British media have strongly criticised the Portuguese judicial police's handling of the investigation and Amaral's lack of communication.
Amaral subsequently claimed that British police had "been investigating leads created and cultivated" by Madeleine's parents and had "forgotten that the couple are suspects in the death of their daughter."

----------------------------------------------------quote:The former Polícia Judiciária investigator criticized the PJ director and the Justice minister, on a interview, tonight, with TVI, a Portuguese channel. Asked if he believed that Madeleine was dead, Gonçalo Amaral said that he was “convinced” she was dead “based on the evidence collected”. When the journalist asked: “Was she killed, there (in the apartment)?”, the former PJ inspector said: “She died there”. About Madeleine's parents being named as formal suspects, Amaral spoke about “strong evidence” as the base for the decision and referred that “there was a common understanding”, between Portuguese and British police officers involved in the investigation, about the fact that Madeleine was dead.
“There was evidence, about two different crimes – which were referred by the defence lawyer, Pinto de Abreu, in a public statement – and it was hiding a body and a criminal simulation. That was the situation, when I left the investigation,” Mr. Amaral said. The former PJ inspector, who has a Law Degree from Lisbon University, mentioned the fact that “these kind of cases of disappearance, frequently bring with it other crimes, sometimes fake statements or physical abuse”.
There is no evidence that the PJ are leaking or spinning or whatever. The investigative phase of this case is ending, that is all. The rest is Clarrie rubbish. If the prosecuting judge comes to the conclusion that there is insufficient evidence of guilt he can either order the case be shelved pending the coming to light of new evidence in the future - files remain secret and arguido status remains in place - or he can send the files back to the PJ and order them to continue with the investigation. He can extend the secrecy of justice at intervals if he concludes this is necessary to the investigation. To suggest that the judiciary is playing silly games to somehow make themselves and the PJ look better is to misinterpret what is in fact going on. Public opinion is of no importance: the civil code system is aimed at getting at the truth of a case. IMO the recent 'leaks' in the Portuguese press did not originate from Portuguese sources; I think what we are seeing is an elaborate smokescreen of PR and misinformation to disguise from the public that the macs' holiday is no such thing and that they have been told to go back to Portugal."

DOGS DECISIVE FOR PJ
British animals [both] agreed on the scent of “indications” in various places and objects
The alerting of the British dogs specially trained to detect cadaver odor and human blood was decisive in making Kate and Gerry arguidos.
Faced with the coincidence of the alerting of both animals, which signaled the same locations and objects related to the McCanns, the authorities were obliged to admit a possible involvement of Kate and Gerry in the disappearance of their daughter and to make them arguidos in order to confront them with evidence which could result in their incrimination – for, as [merely] witnesses, they could not opt to remain silent.
According to what CM has discovered, in the final investigation report produced by the PJ the investigators explained that the animals only gave their detection signals in places and objects related to the McCanns: in the apartment where Madeleine disappeared (in the parent’s bedroom, the living room and next to a side window), in the back patio, the family’s car (rented 24 days after the girl disappeared), two pieces of Kate’s clothes and Maddie’s stuffed animal – the one Kate never released in the days following the disappearance.
In the McCann’s friend’s apartments, in the Luz village and in all the vehicles used by Robert Murat, the first to be made arguido, nothing was found by the dogs. Given these indications, reinforced by other detailed tests done in Portugal and England, the PJ interrogated Kate and Gerry and made them arguidos. The animals, Springer Spaniels, are heavily used in the UK in the search for missing people or homicide victims, with positive results.
KATE JUSTIFIES DEATH ODOR
Kate McCann didn’t negate the fact that her two pieces of clothes and the stuffed animal had been signaled by the English dogs trained to find cadaver odor and justified it by her profession. Madeleine’s mother alleged that as a doctor at the Leicester health center, she was present at six deaths directly before she came to Portugal on holiday, giving the same excuse for Madeleine’s stuffed animal, that was with her in the months after her daughter disappeared.
VESTIGES OF A CRIME

INVESTIGATION REVEALS ABDUCTION IMPOSSIBLE
Final report describes dozens of diligences and unravels incongruences in the theory proposed by Maddie's parents
Thirteen months after Madeleine disappeared, the PJ ended the investigation that continues to be marked by uncertainties. The final report, the CM today exclusively reveals, does not determine guilt but leaves new and strong doubts about the theory presented by the English child's parents. It describes in great detail the diligences done by the investigators – who tried, in every possible way, to confirm their hypothesis – and reveals that it was theoretically impossible to have happened. The witnesses don't make sense, especially not the way that one of the friends said she saw a man carrying a child almost an hour before the alert about the disappearance occurred. This would be Jane Tanner, who guarantees she surprised the unknown man in a street where Maddie's father and another witness also were. Both guarantee that they saw nothing, even though they were in the same line of sight. Tanner, who much later made a photofit of the supposed abductor, also said that the man carried the child in a horizontal position. The size of the window reveals that this could only have happened if the child were carried vertically.
Being that as it may, the PJ tried through all possible means to find who could have taken Maddie. They did dozens of diligences related to suspects of sexual abuse. Elements were collected about those registered that could have been on holidays in the Algarve during that time period, in order to verify if there could have been any connection with little Maddie.
In addition, all the other residents of the village were investigated. The PJ entered more than 400 houses surrounding the Ocean Club and found nothing. On the window where Kate guaranteed that Maddie was taken no vestiges of the girl were found. Only marks that confirmed the DNA of the girl's mother.
The PJ's final report shows the details of an investigation that reached unprecedented levels. A couple was investigated that had allegedly tried to abduct another child, a fine toothed comb was used to research the clues that Maddie had been seen at a gas station. A crematorium was searched and Maddie’s genetic profile was compared to that of a child’s body found on the coast of the United States.
The PJ investigated a supposed beggar and followed thousands of clues around the world. In vain. Nothing confirmed the proposed abduction theory.
Change of versions: Laboratory was no longer certain
ENGLISH RETREATED ON THE EXAMINATIONS
They said the vestiges were compatible with Maddie's DNA, then later denied it.
Dog's indications were not corroborated by science
It was the strangest about-face in the investigation. The first examinations done by the English laboratory, a pioneer in the analysis of biological vestiges, said it was probable that the residues collected in the McCann's car were compatible with Madeleine's genetic profile.
Months later – after the PJ had made the parents arguidos, according to the final report only because of indications that they had hidden the child's body – the laboratory ended up correcting their initial information. In the end, the examinations of the vestiges collected from the Renaul Scénic rented by the McCanns were not conclusive and it wasn’t even possible to determine the quality of the material, that is, to know whether it was bodily fluid or vestiges of blood.
This scientific alteration, still not completely clarified, ended up leading the investigation to a dead end. The utilisation of the dogs that detected cadaver odors and blood are not valid within the Portuguese judicial system and it was necessary to scientifically corroborate the dog's detections.
The PJ's decision to send the analyses to England was based on a question of credibility. The investigators didn't want the results to be disputed by the English, accepting therefore that the vestiges should be analysed in that country.
USELESS TRIP TO ENGLAND
In April of this year, Paulo Rebelo and two of the investigators for this process who were trying to understand the puzzle of Madeleine's disappearance went to Leicester to interview the British who spent holidays in Praia de Luz with the McCanns. From the final report, we now know that nothing conclusive was discovered from these interrogations.
The PJ maintained the same close collaboration with the local police, but from the depositions they brought nothing new. The McCann friends limited themselves to confirming what they had said in the earlier interviews and the PJ left with empty hands from that city just north of London.
OVER ONE HOUR CRYING
Pamela Fenn remembers hearing the child uncontrollably crying
Madeleine parents never contradicted that it was already a habit for their three children to be all alone inside the Praia da Luz apartment while they dined; a fact corroborated by several witness statements - the Oceans Club employees.
Although the parents defended themselves by stating that they visited the children every half an hour, every night, the witness statement of neighbour Pamela Fenn crumbled the McCann couple's version, when she guaranteed to the PJ that she had heard Maddie crying out loud for one hour and fifteen minutes, two nights before the crime. The British woman lives at the first floor, just above the apartment rented by the McCanns and she told to the inspectors, that on the night of the 1st of May, at 22:30, she heard a child crying, and by the sound it was Madeleine.
She guaranteed to the Judiciary Police that the child was uncontrollably crying for one hour and fifteen minutes, until the parents arrived. The neighbour heard the noise of the door at 23:45, when Kate and Gerry ended their usual gathering with their friends at the Tapas Bar – the Oceans Club restaurant at the pool side, where they had dinner daily. This testimony contradicts the daily routine of visits that the couple declared to have with their children – and the McCanns are not free from criticism by another British woman. Yvonne Martin, a British Social Care worker on holiday in Luz, who also blamed the McCanns negligent behaviour.

Ga we nog ernstig bestuderen maar nu al zie ik wat een ongelofelijk bull de kranten al die tijd hebben geschreven...quote:Maddie Case - Final Report – ‘CM’ exclusively reveals all the steps of the investigation
English combined depositions
The Polícia Judiciária apprehended a memo that was typed by the McCanns and their friends, which describes in detail what each one of them did on the evening of the disappearance
Article by: Eduardo Dâmaso/Tânia Laranjo
The Polícia Judiciária calls it a “typed report”. It was appended to the process with the number 886 and elaborated by the English before they were formally questioned by the Polícia Judiciária from Portimão after Madeleine’s disappearance.
For the authorities, the minute manner in which the description was made reveals that the group of English people intended to “remember the steps that they made on that evening”. They described the facts, temporally and spatially, and those were the details that they revealed to the investigators.
Everything in an absolutely coherent form, closing the door to emotion. It is never explained, for example, how the group, that also had their children asleep in their rooms within the resort, never followed the instinct of confirming whether they were safe, after Kate launched the alert over her daughter’s disappearance. They came looking for Maddie, but failed to check if their own children had been abducted.
This document is considered important and was taken into account in the final report, whose contents CM reveals in an exclusive. It is fundamental as far as it has removed any spontaneity from the depositions made by the English, including the McCanns, whose description of the hours prior to the disappearance were fundamental for the investigation.
The final report contains a comprehensive description of the routines and of the last moments when Madeleine was seen alive, in order to clarify doubts and to try to overcome apparent incongruities.
Gerry McCann guarantees that on that day – and contrary to what was usual – failed to accompany his friends during the afternoon snack at the beach area. Only the McCanns returned to their apartment earlier, as confirmed by the surveillance cameras at the restaurant where the friends were.
The father assured that they collected their children at the crèche at around 5 p.m. and that on that day they immediately went to their lodging with the children. At 7.30 p.m. they put them to bed, and around 8.30 p.m. they left for the Tapas bar, which is located near the resort’s swimming pool.
Around 9 p.m., Gerry guarantees that he went to check on his children: but he failed to enter Madeleine’s bedroom and only later gave importance to the fact that the door was more open than he had left it. The alert to the little girl’s disappearance was given at approximately 10 p.m., and one hour later the GNR was informed about the event. The English guarantee that they only alerted BBC at around 2 a.m.
Passional crime was equated
Apart from abduction, the PJ followed other leads. One of them was the possibility that a passional crime had taken place. In the final report, the investigators remember that they studied the possibility that the abduction was due to a vengeance against the parents. Nothing was discovered in that sense either, despite the fact that the life of the McCanns and the other English people was investigated.
Details
Several interrogations – In their final report, the PJ stresses that the English were comprehensively questioned in detail, on several occasions, with the purpose of collecting all the elements that were deemed relevant.
Testing details - From the analysis of the interrogations, the PJ mentions in their final report that there were “important details that were not fully understood and integrated”, which, according to the PJ, needed to be “tested and connected on the location of the event”.
Four questions that remained unanswered
In its final report, the PJ lists the four questions that it would like to see answered during the reconstitution of the facts. A diligence that was not made because some of the English refused to return to Portugal.
The first one concerns the real and effective proximity between Jane Tanner, Gerry McCann and Jeremy Wilkins (a witness that stood talking to Maddie’s father at around 9 p.m.). It is mentioned in the report that it is “unusual” that Gerry and Jeremy failed to see the alleged abductor that was seen by Tanner, given the fact that they were standing within the same small space.
Another question that the PJ wanted to clarify was the situation of the window to the bedroom where Maddie was sleeping. According to Kate, it was open, but it was important to verify whether there was a draft that would allow for the curtains to move.
The verification of the manner in which the children were checked upon also seemed important. If it was as intense as the witnesses stated, it made the entrance of an abductor almost impossible, who could only pass with the child in a vertical position, not a horizontal one, as Jane Tanner says she saw a man with a child.
Finally, the inspectors wanted to know exactly what happened between 5.30 p.m. and 10 p.m. – the time at which Maddie was seen last, and the moment when the alert to the disappearance was given.

Gonçalo Amaral tried the reconstitution shortly after the facts. Then it was Paulo Rebelo’s turn to suggest it. It was never done, because the English didn’t want it
Gerry and Kate’s versions failed to convince the investigators
Other notes:
PGR [State Prosecutor] | Read the report already – Pinto Monteiro said yesterday that he has already read the final report, but excused himself from advancing what will be the Public Ministry’s dispatch, in a case whose secrecy may end as soon as this month
Concluded | No diligences – The PJ makes no suggestions concerning the manner in which the Public Ministry should act. It only says that it does not see any further diligences that could be useful to the investigation
Nothing new | English
The PJ says that the diligences that were requested through a rogatory letter, brought nothing new to the investigation. Which means that what happened on the evening of the 3rd of May was not established Source: paper edition of Correio da Manhã, July 6, 2008
From todays news of the world.
Do people seriously think that Portuguese and British cops have kept the file on Maddie McCann open for more than a year in order to embarrass, humilliate and torture her perents Kate and Gerry? Hasn't it occurred to anyone (especially the McCanns) that this file has been left open and questions have continued to be asked because coppers (as inept as some of them have been) really want to find Maddie, preferably, alive?
Why should Kate and Gerry get an apology now the case files look like it's about to be closed? It has always been in their best interests to have it kept open so Maddie abductors (or killers) can be found. And by closing the file the police aren't saying anyone is guilty or innocent. They are simply saying they can't find or prove who took her. Yes the police have made stupid mistakes. But then so did Kate and Gerry by leaving their children alone in an unlocked apartment for five nights in a row while they went out eating and drinking with friends. And if the McCanns as rumors suggest are not going to be charged with neglect they ought to be grateful.
Because while those charges might not be brought very often in Britain they are routinely brought in other european countries, where society and the legal system seem to value kid safty more than we do. (if you think Britain cares about its children ask yourselves why convicted paedophiles are freed by courts to wander among our kids, when even they tell us thay can't be cured). The tragedy here isn't Kate and Gerry's hurt feelings over the investigation, it's that Maddie's still missing, and closing the file means her abductors have got away scot-free.

By Tom Peck and Robert Verkaik Monday, 7 July 2008
Four months after Gerry and Kate McCann won apologies and a £550,000 libel pay out from four newspapers for "grotesque and grossly defamatory" articles concerning the disappearance of their daughter, Madeleine, seven friends of the couple have employed the same lawyers to act against at least one national newspaper.
The Carter Ruck libel firm is advising the so-called "Tapas Seven" group who were with the McCanns on the evening of Madeleine's disappearance in May 2007 in the Portuguese resort of Praia da Luz. Matthew Oldfield, Rachel Oldfield, Russell O'Brien, Jane Tanner, David Payne, Fiona Payne and Diane Webster are in talks with the Carter Ruck partner Adam Tudor, with action expected within weeks.
Mr Tudor, who acted for the McCanns, yesterday commented: "I can confirm I and my firm are advising the seven friends." He declined to elaborate or specify which newspaper they were considering suing. At the centre of possible action would be suggestions that the friends kept a "pact of silence" in their dealings with police, and that they refused to take part in a reconstruction of the night Madeleine disappeared.
