ROMA, 8 luglio 2005 - Il Torino sarebbe fuori, condannato da debiti fiscali e previdenziali (Enpals), il Messina invece sarebbe in bilico. Queste le prime indiscrezioni che emergono dalla riunione della commissione di vigilanza sulle società di calcio (Covisoc) che sta esaminando i requisiti per l'iscrizione ai campionati. In serie B sarebbero compromesse le situazioni di Perugia e Salernitana, mentre è sanabile con poco quella del Treviso (carenze patrimoniali).
Pesante la situazione in serie C. Potrebbero essere più di 20 le società ritenute non in possesso dei requisiti per l'iscrizione. Oltre a Como e Venezia (fallite) emergono i nomi di Andria, Foggia, Reggiana, Spal, Benevento, Vis Pesaro, Torres, Sora, Teramo, Gela, Imolese, Latina, Pro Vasto e Rosetana e a questi se ne potrebbero aggiungere altri in serata. Simile a quella del Treviso, e quindi sanabile, la posizione del Lumezzane. In serata tutte le società non ritenute in regola riceveranno la comunicazione della Covisoc e quindi da domani scatteranno i termini per potere presentare entro il 12 luglio il ricorso alla Coavisoc che prenderà poi la sua decisione entro il 14, alla vigilia della riunione del consiglio federale.
Intanto è stato arrestato Luigi Gallo, l'ex presidente del Venezia, coinvolto nell'inchiesta sulla falsa fidejussione presentata dal Torino. Secondo quanto si è appreso, Gallo è stato preso in consegna dalla Guardia di Finanza a Genova, dove risiede. Nei suoi confronti la procura di Torino ha chiesto la cattura per il reato di truffa aggravata, ma non in concorso con i vertici del Torino calcio. In sostanza, sempre secondo quanto si è appreso, nel caso della falsa fidejussione il patron Franco Cimminelli e il presidente Attilio Romero sarebbero stati indotti in errore. La storia è quella della falsa fidejussione da 18 milioni di euro targata «Generali» che il Torino aveva presentato all'Agenzia per le Entrate a garanzia di pagamento di certe sue pendenze con l'erario. Il documento era fasullo, come ha accertato un primo rapido controllo da parte dei funzionari, e i vertici della società granata, quando sono stati interrogati, avevano detto che a fornirlo era stato Gallo. Il quale, subito dopo, aveva affermato di essere stato a sua volta raggirato da un broker, il cui nome era pronto a rivelare ai magistrati inquirenti.

Palermo striker Luca Toni is expected to be wearing the Fiorentina shirt by the end of next week.

Reports in Italy on Saturday suggest that a transfer is close after Palermo lowered their £11m asking price to £8.5m.

Although the Viola have still not met that demand, talks between Presidents Diego Delle Valle and Maurizio Zamparini, of Fiorentina and Palermo respectively, have opened the door for a switch.

It will now be up to Viola sporting director Pantaleo Corvino to successfully conclude negotiations.

"I will meet with Palermo to finalise everything but only if they accept our offer," he told the fiorentina.it website.

"We don’t intend to spend more than £7.5m for Toni. If they agree, we will then discuss a contract with the player which must also be reasonable."

The Stadio Franchi side have been looking for a new target man after also being linked with Bernardo Corradi of Valencia, Udinese forward Vincenzo Iaquinta and even Hernan Crespo of Chelsea.

Palermo, despite the fact that Toni has scored 50 goals in two seasons, are ready to sell after netting Andrea Caracciolo from Brescia.

They also seem to have their eyes on a new striker, Atalanta’s Stephen Makinwa, if the Italian international is released.

"We will meet Atalanta this week," said his agent Silvano Martina given that Palermo, Inter and Stuttgart have all made bids.

"Where does the player want to go? He will play his football where ever Atalanta decide he will."

Torino and Messina axed?

Torino and Messina are facing the risk of expulsion from Serie A because of the state of their finances.

Covisoc, the body who must ratify that all clubs have the funds necessary to be registered for the new season, have found problems with both outfits.

As it stands now, they are not part of the First Division but the pair have until July 12 to appeal against the initial decision.

A final verdict on whether the clubs can compete in the top-flight next term is expected on July 15.

Numerous other clubs in lower Divisions are facing similar problems, with Perugia and Salernitana risking demotion from Serie B. A total of 16 clubs are in trouble in Serie C.

Toni deal delayed

Luca Toni’s proposed move from Palermo to Fiorentina is on hold after the club’s failed to agree a fee.

The Azzurri international is surprisingly available for transfer, despite scoring 20 Serie A goals last season.

But the arrival of Andrea Caracciolo from Brescia and the expected signing of Atalanta’s Stephen Makinwa means that Palermo will be well covered should Toni exit.

“There are no negotiations and I don't have to sell Toni - he's a Palermo player and I will not negotiate further,” said Palermo director of sport Rino Foschi.

“Fiorentina have behaved badly and if they really want him they know what they must do. I won't sell him on their terms and I'm tired of this situation.”

The Rosanero are hoping to net around £9m for the former Brescia striker, while Fiorentina’s initial offer appears to be well short of the that figure.

Luca Toni has completed his move to Fiorentina after Palermo yesterday accepted a £7.2m bid for the striker.

The 28-year-old has put pen to paper on a Viola contract that will tie him to the outfit until June 2009.

Toni, a player who scored 20 League goals for the Sicilians last term, will net just over £1m-a-season.

The Italian Football Federation (FIGC) have today expelled Torino and Messina from Serie A due to their financial problems.

Whispers in Italy over the last few days had suggested that the pair did not meet the requirements needed to be registered for the new campaign, and the FIGC confirmed the news on Friday.

However, today’s decision is not final and all clubs who have been barred have three appeal processes that they could still pursue.

"I'm not optimistic but I'm realistic," stated Torino President Attilio Romero, whose side won promotion last term.

"I think that we have all of the tools in hand and all of the prerequisites to remain in Serie A."

Messina, who comfortably survived the drop last season, are also confident that they have the necessary paperwork to resolve their problems.

"I knew this decision was coming," said Messina President Pietro Franza. "But I want to underline that we have great faith in the bodies who we will now turn to.

"We are certain that we can continue with our adventure in Serie A."

Bologna, following their relegation, are in pole position to replace Messina should today’s judgement stand.

Torino’s supposed exit would allow Treviso, who finished fifth in Serie B, to take their place because Perugia – who lost to Toro in the Play-Off Final – have their own problems.

The Umbrian outfit and Salernitana are currently not registered for the Second Division, while a host of Serie C sides are in real trouble too.

It’s unclear at this stage when we will know the final line-ups of each Division and therefore the fixtures for the new campaign. Serie A is set to kick-off on August 28.

Il Tar del Lazio (III Sezione) è l'unico riconosciuto per i ricorsi sportivi dopo la sentenza della Cca. I tempi della sua riunione non sono ancora stati fissati.
Il Consiglio di stato è l'ultimo grado di giudizio amministrativo. Dopo il suo pronunciamento (la data non è stata ancora fissata), le squadre escluse non hanno ulteriori possibilità d'appello.
LODO PETRUCCI
Ecco come si accede al lodo Petrucci. L’art. 52, punto 6, dice: "In caso di non ammissione al campionato di A, B o C1 di una società che costituisce espressione della tradizione sportiva italiana e con un radicamento nel territorio di appartenenza comprovato da una continuativa partecipazione, anche in serie diverse ai campionati professionistici (dalla A alla C2) negli ultimi 10 anni, ovvero da una partecipazione per almeno 25 anni nell’ambito del calcio professionistico, la Figc, sentito il sindaco della città interessata, può attribuire ad altra società il titolo sportivo inferiore di una categoria rispetto a quello di pertinenza della società non ammessa". Alla nuova società non potrà partecipare chi ha ricoperto cariche sociali nella società non ammessa nè parenti di questi.

Genoa and Venezia charged

Genoa’s Serie A status is in serious doubt after they and Venezia were charged with sporting fraud.

The two clubs have been under investigation following Genoa’s win over the Laguna outfit on the last day of the season, which ensured the port side’s return to the top-flight.

The Italian Football Federation (FIGC) released a statement on Sunday which stated that Genoa chief Enrico Preziosi, his son Matteo and director Stefano Capozucca have been accused of "collaborating to achieve sporting fraud."

Venezia owner Franco Dal Cin, director general Michele Dal Cin and fellow director Giuseppe Pagliara – plus players Martin Lejsal and Massimo Borgobello – have also been charged.

The two clubs have also been charged with "direct responsibility" as part of the ongoing probe.

The enquiry was launched after allegations of match fixing regarding the 3-2 win over Venezia last term.

That after police acquired recordings of numerous telephone conversations between players and officials as evidence.

Both clubs deny any wrongdoing.

If found guilty, Genoa could be handed an array of punishments ranging from a fine, points deduction or possible exclusion from Serie A.

Inter have reportedly convinced Michael Ballack to leave Bayern Munich for the San Siro outfit in the summer of 2006.

The German international will be a free agent next July and he has already hinted that he is looking for a new club.

"I am very happy here but I think the time has arrived for me to try playing for a great European club," he recently stated. "It is a question of stimulus."

Stories in the peninsula on Monday morning claim that the Nerazzurri have already struck a deal with the central midfielder.

The former Bayer Leverkusen sensation, who has spent the last five years with Bayern, has been tempted by Inter’s three-year contract offer.

Ballack, who will be hoping to lead his country to World Cup glory next summer, has been linked with Inter in the past.

It is believed that Ballack has been targeted given that Juan Sebastian Veron has made no secret of his desire to return to Argentina in 12 months.

Nerazzurri fans will be hoping that Ballack can make as a big an impact as Lothar Matthaus. The legendary German helped the club win their last Scudetto in 1989.

The Sicilian outfit were kicked out of the Italian top flight after failing to convince the authorities that they could manage their debts.
That decision was made by the Italian Football Federation (FIGC), but their recent appeal was heard by the Italian Olympic Committee (CONI).

After the decision was made, Messina President Pietro Franza said: “It seems to me to be a absurd situation.”
However, the club still have the right to appeal to the Regional Administrative Courts (TAR).

Meanwhile, Torino are still awaiting their fate from the CONI, with a decision expected later.

Dopo il no al Messina arrivato in mattinata, è toccato dunque anche a Torino, Perugia e Salernitana, oltre alle altre sei società di serie C (Benevento, Torres, Imolese, Gela, Spal, Rosetana). Respinti anche i reclami (di diverso tipo) presentati da Orvietana, Val di Sangro e soprattutto Napoli che aveva richiesto la non accettazione della domanda di iscrizione di varie società non adempienti ai versamenti Inail. Per tutti questi club ora si apre un'altra strada: il ricorso al Tar, la cui udienza è fissata per il 2 agosto.

MILANO, 27 luglio 2005 - La speranza era l'ultima a morire. Incredibili quelle richieste della Procura per i vertici del Genoa e i tifosi tutti. Invece la Commissione Disciplinare non ha badato a spese e ha emesso una sentenza ancora più severa: sì retrocessione all'ultimo posto della classifica di serie B del 2004-2005, con conseguente retrocessione in C1, ma anche una penalizzazione di tre punti da scontare nella prossima stagione.
Bastasse questo: cinque anni di inibizione al presidente del Genoa Enrico Preziosi, al direttore generale genoano Stefano Capozucca, all'amministratore delegato del Venezia Franco Dal Cin, e al gm veneziano Giuseppe Pagliara. Per Enrico Preziosi e Franco Dal Cin, la Disciplinare oltre all'inibizione, ha proposto al Presidente federale la "preclusione alla permanenza in qualsiasi rango o categoria della Figc". La Procura aveva anche chiesto l'inibizione di quattro anni per Preziosi e Dal Cin; di tre e un mese per Capozucca, Michele Dal Cin, Giuseppe Pagliara; di sei mesi per Roberto Cravero, mentre fra i giocatori aveva chiesto la squalifica di tre anni e un mese per Massimo Borgobello, di un anno per Martin Lejsal e di sei mesi per Massimiliano Esposito.
In questo senso la mano è stata meno pesante. Massimiliano Esposito, all'epoca dei fatti tesserato per il Venezia, è stato prosciolto, mentre suoi due compagni, Lejsal e Borgobello sono stati squalificati rispettivamente per sei e cinque mesi.
"Il Genoa è la vittima sacrificale di una impostazione inquisitoria della vicenda". È il primo commento a caldo del difensore della società rossoblù, Alfredo Biondi, alla sentenza della Disciplinare. "Faremo appello in tutte le sedi - ha aggiunto Biondi - e mi auguro che si trovi la serenità necessaria a far valere le buone ragioni, sperando sempre che i giudici le raccolgano. Mi ero illuso che la meditazione prevalesse su un esame formale della questione. Questa vicenda è cominciata male ed è finita peggio".
Un ciclone devastante dalle consueguenze inimmaginabili. Mentre il presidente Enrico Preziosi, a comunicarlo è una nota della società rossoblu, ha presentato le sue dimissioni.

Genoa have been demoted to Serie C1 after the Italian Football League concluded their investigation into claims of match-fixing.

The charge related to Genoa’s 3-2 victory over Venezia on the last day of the Serie B season, which was enough to secure automatic promotion.
As a result, the Rossoblu will instead play next season in Serie C1.
To make matters worse, the League also imposed a three point deduction.

Club president Enrico Preziosi and general manager Stefano Capozucca were banned from the game for five years for their roles in the affair.
Venezia managing director Francesco Dal Cin was also given a five-year ban.

And Venezia’s 23-year-old Czech ‘keeper Martin Lejsal and 34-year-old striker Massimo Borgobello were given bans of five and six months for their part in the affair.

Both clubs have the right to appeal the decisions.

Genoa to appeal decision


Genoa have confirmed that they will be appealing the decision to demote them to Serie C1.

The Rossoblu discovered their fate after the enquiry into their alleged match-fixing case concluded earlier today.
They were also informed that they would have to start the new campaign with a three-point deduction.

“We will appeal to every court and I hope the judges listen to us,” Genoa lawyer Alfredo Biondi told gazzetta.it.
"I was hoping, but this case has started badly and finished worse.”

And Genoa President Enrico Preziosi, who received a five-year ban, confirmed his expected resignation from the club.
“Genoa Cricket and Football club announce that Enrico Preziosi has resigned as President of Genoa Cricket and Football club,” read a statement.

Further details of Genoa’s case have also been released by the League.

They investigated a ¤250,000 payment from Genoa to their opponents Venezia before the final Serie B game of the season on June 11 and said telephone taps showed it was aimed at "guaranteeing" the result.

Genoa won the game 3-2, thus securing promotion to Italy’s top flight for the first time in a decade.
Investigators listened to telephone taps of conversations between club officials and between the Venezia players Martin Lejsal and Massimo Borgobello.

The statement said that the phone taps of the players included the phrases "there is an agreement between the two clubs", "there is money involved, but it is not known who will take it" and "the club will take it".

Lazio have signed promising youngster Valon Behrami from Verona.

The Swiss midfielder was co-owned by Verona and Genoa, but the Biancocelesti have agreed to buy Verona’s share.

Behrami made 33 appearances in Serie B for Verona last season, netting three goals.

He also spent the 2003/04 season in the Second Division, making 24 appearances for Genoa.

The 20-year-old has signed a four-year deal and Lazio are expected to buy Genoa’s share during the January transfer window.

In other transfer news, Livorno have loaned Emmanuel Osei to Romanian side Politehnica Timisoara.

The draw for the First Round of the Coppa Italia has been made, with Torino, Perugia, Messina and Salernitana all missing.

The quartet have been omitted from the Italian Cup this season as they are currently not registered for any championship because of their financial difficulties.

This term’s Coppa will be loosely based on the English FA Cup. The first two rounds – which will start with 64 sides – will be straight knock-out games, with the lower Division clubs being handed the home advantage.

The remaining Serie A clubs (Inter, Juventus, Milan, Udinese, Sampdoria, Palermo, Roma and Lazio) will enter the competition at the last 16 stage where the tournament will revert to it’s classical format of two-legged encounters.

The Final is set for May 3 and May 11.

Juve monitor new Cafu

Italian champions Juventus are today being linked with Brazil’s attacking right-back Cicinho.

The Sao Paulo player is widely considered as Marcos Cafu’s heir in the national side and has caught the attention of numerous clubs.

Cicinho, who is on the verge of gaining EU status thanks to his Italian roots, recently impressed at the Confederations’ Cup in Germany.

It was believed that Milan would make a move for the defender but the Old Lady of Italian football have emerged as contenders on Friday.

Although he recently extended his contract with his South American club until 2008, he would consider a European switch – even if that is only likely to happen next summer.

Whispers suggest that any proposed deal would cost any interested party a total of £8m, with 40 per cent of that fee going directly to the player.

The Bianconeri are looking for a new right-back and have been linked with numerous players this summer.

Lazio’s Massimo Oddo has been associated, as has Portuguese international Miguel of Benfica.

Juventus’ current first choice right-sided defender is former Cagliari and Roma player Jonathan Zebina.

Milito walks out on Genoa

Genoa hitman Diego Milito has alerted clubs including Juve, Inter and Real Saragozza that he is looking for a move elsewhere.

“There has been terrible chaos here,” said the striker after his club was demoted to the Third Division. “We had earned our promotion to Serie A, but if the decision is confirmed then I cannot avoid leaving. I will not play in Serie C1.”

Genoa’s celebrations at their first promotion in a decade were short-lived, as they have been pushed down to Serie C and docked three points as a result of a match-fixing scandal. The last game of the season, a 3-2 win over Venezia, was shrouded in controversy and the Disciplinary Commission ruled that there had been irregularities.

Now Milito – who has scored 33 goals in two seasons – is ready to walk out on the club that brought him to Italy. He is already a target for Juventus, Inter and Real Saragozza.

“The Spaniards know I will make a decision over the next few days,” he told ‘AS’ newspaper. “It would be great to play alongside my brother Gabriel at Saragozza and their interest makes me proud. It’s not entirely up to me, though, as Inter are also in negotiations with Genoa. Before making any choices, I must find out where the Rossoblu will be playing next season.”

Genoa have appealed against the demotion and will know their fate before the calendars are drawn up on August 12.

Abbiati future in doubt

A number of Italian clubs are interested in signing new Genoa goalkeeper Christian Abbiati following their demotion.

The port club were thrown into the Third Division last week for alleged match-fixing which has now placed Abbiati’s loan switch from Milan into doubt.

Abbiati does want a first team shirt in order to win a place at the 2006 World Cup, but is unlikely to accept the prospect of Serie C football.

Should Genoa’s appeal against their punishment fail then Abbiati is expected to assess his options.

Serie A minnows Siena and Livorno have both been linked with the former Scudetto winner as they are looking for shot-stoppers.

Palermo could also make a move after they pulled out of a swoop to net Galatasaray’s Faryd Ali Mondragon.

The Colombian shot-stopper, 34, was expected to sign last week but the Sicilian outfit pulled out at the last minute.

Palermo already made an approach for Abbiati last summer but Milan refused to let the international custodian leave at the time.

Toro appeal rejected - Messina back in A!
The verdicts are in from the TAR tribunal and it’s not good news for Torino, Perugia, Salernitana and Napoli – but Messina are back in Serie A.

Messina’s appeal has been accepted and the Sicilian club is readmitted to the top flight after a lengthy legal battle. Theirs was always the most solid position out of all the bankruptcy-threatened sides and supported by the local council.


The Lazio tribunal examined appeals against financially troubled clubs’ exclusion from Serie A and B, but mainly reiterated the verdict given by the football authorities.


This means that Torino are still out of the top flight, while Perugia and Salernitana will not be allowed to register for Serie B.


"We remain confident," stated Granata President Attilio Romero. "We had already been working towards having the right paperwork for the State Counsel on August 9."


Torino registered for the Championship with a bank draft that later proved to be false. The club claimed it was the victim of fraud, but has so far been unable to find financial backing to cover their £27.5m debts


In all 16 motions were handed to the TAR today – five of which were from Napoli in a bid to highlight ‘irregularities’ in the accounts of Arezzo, Ascoli, Brescia, Pescara and Vicenza – but all were rejected. Benevento have also been excluded from Serie C1.


The situation is still in the air, however, as the clubs can all lodge one final appeal to the State Counsel on August 9 - before the fixture lists are drawn up on August 12.


That date could also prove decisive for Messina, as the FIGC will probably lodge their own appeal to the State Counsel in order to have Messina excluded from the top flight.


Football clubs in Italy must prove their financial stability before registering for the new season. If they fail to do so, they are excluded and pushed down a Division to start again under new ownership.

Toni dreams of Viola trident

Hitman Luca Toni talks about the new-look Fiorentina and the club assure fans that two more signings are on the way.

“I can play in any tactical system, with Valeri Bojinov and Giampaolo Pazzini or in a partnership with either of them,” noted the new arrival. “There are no problems in that sense and the Coach will be able to choose whoever is on top form at that time throughout the season.”

Toni was the Viola’s top choice centre-forward and completed a surprise £7m move from Palermo after netting 50 goals in two terms. He has proved successful during the summer tour, which saw three wins and a defeat.

“We have worked well in Japan and managed to practice some of our movements as a team, which is particularly important with so many new players” added Toni. “Now we must focus on preparing for the new season and getting a good start in the Coppa Italia against Lodigiani.”

The Stadio Artemio Franchi side has made many changes over the close season, but there are set to be more, according to President Andrea Della Valle.

“It’s a competitive squad, but we will sign another two reinforcements before the end of the summer,” said the patron. “The cherry on the cake was Toni and we’re close to being a great team.”

One of the potential candidates to join Fiorentina is Toni’s former Palermo teammate Cristian Zaccardo.

“I know him well and respect him as a player,” said the striker. “Zaccardo is also an Italian international and he’d make a fantastic signing. I’d be happy if he joined us, but clearly these decisions must be made by the clubs.”

Genoa await appeal verdict

On Sunday evening Genoa will know which Division they’ll be playing in this season and President Enrico Preziosi maintains he did not fix a match.

“I can’t take this waiting any more and just hope they decide as quickly as possible,” said the toy tycoon. “I was stupid, I admit that, but I did not buy that result.”

The Disciplinary Commission demoted Genoa to Serie C1 and docked three points after a match-fixing scandal. The final game of the Serie B season that saw their promotion was a 3-2 win over already-relegated Venezia, but a Lagunari director was caught leaving Preziosi’s office with a suitcase that contained £173,000 cash.

Telephone conversations between the Genoa patron and Venezia chief Franco Dal Cin were also used in evidence against them. Their appeal was held on Friday at the CAF (Federal Court of Appeal) and a verdict should be delivered between Sunday evening and Monday morning.

It was not a good start, as all of Genoa’s initial protests about the evidence used were rejected almost immediately.

Should Genoa’s demotion be confirmed, or even changed to place them in Serie B instead, Treviso will be promoted to the top flight in their place.

As with Messina last week, the fans are staging protests in the city around the Porto Antico district, burning their electoral roll cards and throwing them into the sea.

Anxiously awaiting their fate, Genoa have now launched accusations of a pre-meditated campaign against them and asked for the match-fixing trial to be scrapped.

The club has been demoted to Serie C1 and docked three points as a result of a match-fixing enquiry into the final game of the season, a 3-2 victory over Venezia that put them into the top flight.

Their appeal was heard by the CAF (Federal Court of Appeal) on Friday and a verdict is expected between this evening and Monday morning, but the entire situation could be plunged into uncertainty yet again.

“On Friday, while our lawyers were stating their case, some of the CAF judges were passing each other little notes than were then torn up and put in the bin,” accused President Enrico Preziosi in a dramatic Press Conference.

“This was all caught on camera and everyone noticed the odd behaviour. We fished the pieces out and put them back together again. The notes said, ‘Exclude from Serie B. The Federal Counsel will then assign them to either C1, C2 or the amateur Leagues.’ As you can see, the verdict was written before we even got the chance to state our case.”

Preziosi even photocopied the torn shreds of paper and passed them out to the members of the Press, demanding that the CAF trial be made null and void.

“We ask the sporting justice system to give dignity back to a trial that has certainly lost sight of its principles,” added lawyer Crippa. “We believe that the only course of action is to wipe out the entire procedure and start again.”

The evidence against Genoa piled up over the weeks since a Venezia general manager was caught leaving Preziosi’s office with a suitcase that contained £170,000 cash.

It was claimed this was an advance for Ruben Maldonado’s move, but the player knew nothing of the transfer. A series of telephone conversations between Preziosi and Venezia President Franco Dal Cin were also taped.

Genoa's appeal against their demotion to Serie C1, which was imposed following allegations of match-fixing, has been rejected.

The appeals commission of the Italian Football Federation has rejected all the appeals relating to the case and confirmed that all sanctions imposed against the club and officials would stand.

The Rossoblu, who have won nine Scudetti, gained promotion back to Serie A last season after a decade away.

However, last month they were sent down to Serie C1 after a probe into their 3-2 win over Venezia on the final day of the Serie B season.

The five-year bans handed out to club president Enrico Preziosi and general manager Stefano Capozucca also still stand.

Genoa will start next season with a three point penalty and they face further disciplinary action after more controversy on Sunday.

New season fixtures on hold

Thursday’s proposed formulation of the new season’s fixtures has been stopped as a result of Genoa’s on-going struggle to avoid demotion.

The calendars for the 2005-06 campaign were set to be published later this week, but that now looks unlikely to happen.

A Genoa tribunal court has successfully ordered the Italian Football Federation to suspend the composition of the fixtures.

The move comes just 24 hours after Genoa failed in their attempts to be re-instated into the Italian top-flight.

The port club were demoted to the Third Division earlier this summer, after the Serie B champions were found guilty of alleged match-fixing in the final game of last term against Venezia.

The Stadio Marassi outfit unsuccessfully appealed to the Federal Appeal Commission (CAF) on Monday which seemed to bring an end to the saga.

But the Italian season has been thrown into further chaos, with just 19 days to go before the scheduled start, as Genoa are now attempting to prove their innocence with the help of a civil court.

"There have been other situations in football in which different measures have been taken to that of Genoa," said Alessandro Repetto, President of the Genoa Province.

"Several come to mind, such as (Roma's Philippe) Mexes' case, and (Juve doctor Riccardo) Agricola's case.

"We hope that we can suspend the sporting sentence by taking our case to Genoa's tribunal."

It’s unclear at this stage what the Federation will do or when we will definitely know which sides will be playing in what Division next term.

Meanwhile, Genoa have been handed a one-game home stadium ban after their fans caused the abandonment of their Coppa Italia tie over the weekend.

Fans threw flares on to the pitch in protest at their demotion, resulting in Catanzaro being handed a 3-0 victory and safe passage to the next round.

Genoa force fixture list freeze

Genoa’s legal battle has forced the postponement of the Serie A and B fixture lists, but FIGC President Franco Carraro insists they belong in the Third Division.

“The 2005-06 campaign is set to kick off on August 28 and we will stick to that date,” announced Carraro this evening. “We have postponed the drawing up of the calendars in order to allow the courts to do their job in the best atmosphere.”


The fixture lists were originally set to be drawn on Thursday, but that meeting has been called off and the most optimistic suggestion for a reschedule is August 19 – just over a week before the season begins.


Genoa’s legal battle against their demotion to Serie C1 as a result of a match-fixing scandal has called in the civil courts and blocked any further procedures to begin a top flight campaign without them.


“Genoa’s decision to go to the civil courts has done serious damage on a sporting, moral and economic level to all of Italian football,” added an angry Carraro.


“We cannot delay the start of the season past August 28, as it would constitute a violation of the rules set out by the Government, the CONI (Italian Olympic Committee) and international football organisations.”


The FIGC had in theory protected itself from this sort of interference with the Urbani-Pescante ruling that stated the only courts with jurisdiction over sporting matters were the Lazio TAR tribunal, the CAF Federal Court of Appeal and the State Counsel. However, Genoa’s appeal to their local TAR has succeeded in at least temporarily halting their punishment following the match-fixing trial.


“The tribunal simply does not have jurisdiction over sporting matters,” added the FIGC chief. “Genoa’s case is one of sporting irregularities. It is the duty of the Federation to apply the laws of its own sport. It’s not a question of wanting to do this or not – there is no alternative. Rules must be respected. Genoa will be deferred to the Disciplinary Commission for taking this action and could earn another penalty, forcing them to start Serie C1 with a six-point deduction rather than three.”


There are now rumours that Genoa’s battle will force Serie A to expand to 21 teams, much as Serie B did when Catania staged a legal challenge through a succession of civil courts two summers ago.

“The Federation rules state that to change the format of a Division we need at least a year’s advance, so that is out of the question,” he answered.

Genoa is not the only problem at hand, as Reggina are also under investigation for paperwork they used to register for the new season. Bologna have launched an appeal and the Covisoc will meet on Thursday or Friday to discuss the matter.
