Tijdje terug heeft de Staat trouwens
gereageerd op Zellner's motie van maart 2019.
Paar interessante punten:
• In haar motie vertelde Zellner dat de Staat de botten uit de Manitowoc steengroeve van de hand heeft gedaan. Volgens Zellner is dit een overtreding, want, zo beweert Zellner, de wet zegt:

Wis. Stat. 968.205 imposes certain duties upon law enforcement agencies. At the most basic level, the State bears the duty to preserve all biological evidence collected during the course of an investigation that leads to a conviction.
De Staat toont aan dat dit helemaal niet klopt. Het betreffende
Statuut zegt namelijk iets anders:

Except as provided in sub. (3), if physical evidence that is in the possession of a law enforcement agency includes any biological material that was collected in connection with a criminal investigation that resulted in a criminal conviction, delinquency adjudication, or commitment under s. 971.17 or 980.06 and the biological material is from a victim of the offense that was the subject of the criminal investigation or may reasonably be used to incriminate or exculpate any person for the offense, the law enforcement agency shall preserve the physical evidence until every person in custody as a result of the conviction, adjudication, or commitment has reached his or her discharge date.
In tegenstelling wat Zellner beweert had Calumet de botten dus niet hoeven houden. Ze haalt het Statuut (expres?) verkeerd aan.
Niet de eerste keer dat Zellner zulk soort trucjes uithaalt. In een vorige motie beweerde Zellner dat Kratz ooit over de backup van de Dassey computer zei dat er "nothing of evidentiary value" op stond. Terwijl Kratz eigenlijk zei "nothing
much of evidentiary value".
In een andere motie schreef Zellner dat haar expert had gezegd dat er rode verf op kogel FL zat. De expert schreef echter dat hij niet zeker wist wat het was en dat verdere tests dit uit moesten wijzen.
Vraag me af waarom Zellner toch elke keer weer probeert zulk soort trucjes uit te halen.
• Verder had Zellner het ook nog over ANDE-Rapid DNA Identification... een test die ze wilde uitvoeren op de botten uit de steengroeve. Zellner beweert dat dit een geaccepteerde forensische technologie is. De Staat komt daarop met de volgende respons:

Although the Defendant correctly states that Rapid DNA analysis is allowed for testing
buccal swabs, he fails to mention that it is only the testing of buccal swabs that is approved by the
lawmakers. The Federal Rapid DNA Act of 2017 specifically stated that “[a]t present, Rapid DNA
technology can only be used for identification purposes, not crime scene analysis.” (Exhibit #5,
Excerpt House Report 115-117, 2). This technology is not approved for testing the samples that
the Defendant wants tested.
Het is geaccepteerd voor mondslijmanalyse, en dus helemaal niet (forensisch) toepasbaar op de manier zoals Zellner dat wil.
