When President Obama announced a series of intelligence reforms last Friday he called for the creation of an independent advisory group made up of "outside experts" who will review controversial surveillance programs.
But based on a memorandum issued today by the White House, it's not clear how independent the effort will be. The president has directed the Director of National Intelligence, James Clapper, to establish the "review group" that will be responsible for issuing a report about how surveillance programs "impact our security, our privacy, and our foreign policy."
The review group is intended in part, as the president said last week, to "maintain the trust of the people" — so why did the president put a man at the center of the spying controversy in charge?

But according to two new articles from the Washington Post, not only has the agency violated the rules thousands of times in 2011 and 2012, the FISC says it’s forced to rely on the veracity of government reports for enforcement, severely limiting its ability to provide meaningful oversight to the programs.
According to a leaked top-secret audit prepared for NSA officials, the agency racked up 2,776 policy violations related to the collection and handling of legally protected communications in the 12 months before May 2012. The audit states that nearly all of the incidents were the result of errors committed either by the operator or the software, for example, failing to sufficiently narrow a search with appropriate delimiters, or the inability to get real-time information about a target's whereabouts. One such error led to the interception of a "large number" of phone calls originating in Washington when the area code 202 was mistaken for 20, the international dialing code for Egypt.
The report shows a sharp increase in the number of incidents between April 2011 and May 2012 related to Executive Order 12333, which lays out the roles and responsibilities of the various US intelligence agencies. An unnamed NSA official insisted that the total number of incidents was small when considered in context, saying "you look at a number in absolute terms that looks big, and when you look at it in relative terms, it looks a little different." The Post points out that the numbers revealed in the audit are only for the NSA’s Fort Meade headquarters, and would be significantly higher if they included other NSA units and collection centers.
The report lends credence to the idea that individual NSA analysts have significant latitude in their ability to query intelligence databases. At the same time, the audit's top secret classification underscores the gulf between the intelligence community’s public proclamations of rigor and restraint and what it acknowledges internally.
To top things off, the secret court charged with overseeing the NSA’s intelligence gathering says that it has to take the government at its word when it says that these violations are genuine mistakes. US District Judge Reggie Walton tells the Post that "the FISC is forced to rely upon the accuracy of information that is provided to the court… The FISC does not have the capacity to investigate issues of noncompliance." The response stands in stark contrast to the administration's insistence that the NSA's programs are strictly supervised by the FISC. "They’ve got lifetime tenure as federal judges, and they’re empowered to look over our shoulder at the executive branch to make sure that these programs aren’t being abused," said the president at a June press conference.

Inderdaad. Door informatie in gedeeltes naar buiten te brengen, wordt het moeilijk voor de overheid om daarop te reageren met de gebruikelijke spin. Ze lopen het risico dat de volgende onthulling weerlegt wat ze net daarvoor heel stellig hebben beweerd. De enige manier om comfortabel met deze leak strategie om te gaan, is eerlijk zijn.quote:

Dell appears to be where Snowden's collection stops, however. Though he'd worked for multiple contractors, Reuters is told that he hadn't gathered any documents prior to working for Dell.
Contractors' access to classified government documents has been a continued concern since Snowden's leaks began rolling out back in June. Many in the government are now moving to cut down on outside contractors or to at least limit what they can access. According to Reuters, NSA director General Keith Alexander is already taking drastic steps to do just that: last week he said that he'll be eliminating nearly 90 percent of the agency's around 1,000 system administrator positions — the very job that gave Snowden such broad access to classified information.

Ze 'demonstreren dat de NSA de schendingen van de voorschriften controleert, erkent, behandelt en rapporteert', luidt het in een mededeling.
De twee voornaamste critici van het spionageprogramma, de Democratische senatoren Ron Wyden en Mark Udall, omschrijven de nieuwe onthullingen daarentegen als 'enkel het topje van een grotere ijsberg'. De bevoegde NSA-directeur John DeLong bekrachtigde dat de fouten 'geen opzettelijke schendingen' zijn geweest. 'Niemand bij de NSA, niet ik of iemand anders, beschouwen dit als OK'.

The partner of the Guardian journalist who has written a series of stories revealing mass surveillance programmes by the US National Security Agency was held for almost nine hours on Sunday by UK authorities as he passed through London's Heathrow airport on his way home to Rio de Janeiro.
David Miranda, who lives with Glenn Greenwald, was returning from a trip to Berlin when he was stopped by officers at 8.30am and informed that he was to be questioned under schedule 7 of the Terrorism Act 2000. The controversial law, which applies only at airports, ports and border areas, allows officers to stop, search, question and detain individuals.
The 28-year-old was held for nine hours, the maximum the law allows before officers must release or formally arrest the individual. According to official figures, most examinations under schedule 7 – over 97% – last under an hour, and only one in 2,000 people detained are kept for more than six hours.
Miranda was released without charge, but officials confiscated electronics equipment including his mobile phone, laptop, camera, memory sticks, DVDs and games consoles

He told me that my partner, David Miranda, had been "detained" at the London airport "under Schedule 7 of the Terrorism Act of 2000."
David had spent the last week in Berlin, where he stayed with Laura Poitras, the US filmmaker who has worked with me extensively on the NSA stories. A Brazilian citizen, he was returning to our home in Rio de Janeiro this morning on British Airways, flying first to London and then on to Rio. When he arrived in London this morning, he was detained.
At the time the "security official" called me, David had been detained for 3 hours. The security official told me that they had the right to detain him for up to 9 hours in order to question him, at which point they could either arrest and charge him or ask a court to extend the question time. The official - who refused to give his name but would only identify himself by his number: 203654 - said David was not allowed to have a lawyer present, nor would they allow me to talk to him.
I immediately contacted the Guardian, which sent lawyers to the airport, as well various Brazilian officials I know. Within the hour, several senior Brazilian officials were engaged and expressing indignation over what was being done. The Guardian has the full story here.
Despite all that, five more hours went by and neither the Guardian's lawyers nor Brazilian officials, including the Ambassador to the UK in London, were able to obtain any information about David. We spent most of that time contemplating the charges he would likely face once the 9-hour period elapsed.
According to a document published by the UK government about Schedule 7 of the Terrorism Act, "fewer than 3 people in every 10,000 are examined as they pass through UK borders" (David was not entering the UK but only transiting through to Rio). Moreover, "most examinations, over 97%, last under an hour." An appendix to that document states that only .06% of all people detained are kept for more than 6 hours.
The stated purpose of this law, as the name suggests, is to question people about terrorism. The detention power, claims the UK government, is used "to determine whether that person is or has been involved in the commission, preparation or instigation of acts of terrorism."
But they obviously had zero suspicion that David was associated with a terrorist organization or involved in any terrorist plot. Instead, they spent their time interrogating him about the NSA reporting which Laura Poitras, the Guardian and I are doing, as well the content of the electronic products he was carrying. They completely abused their own terrorism law for reasons having nothing whatsoever to do with terrorism: a potent reminder of how often governments lie when they claim that they need powers to stop "the terrorists", and how dangerous it is to vest unchecked power with political officials in its name.
Worse, they kept David detained right up until the last minute: for the full 9 hours, something they very rarely do. Only at the last minute did they finally release him. We spent all day - as every hour passed - worried that he would be arrested and charged under a terrorism statute. This was obviously designed to send a message of intimidation to those of us working journalistically on reporting on the NSA and its British counterpart, the GCHQ.
Before letting him go, they seized numerous possessions of his, including his laptop, his cellphone, various video game consoles, DVDs, USB sticks, and other materials. They did not say when they would return any of it, or if they would.
This is obviously a rather profound escalation of their attacks on the news-gathering process and journalism. It's bad enough to prosecute and imprison sources. It's worse still to imprison journalists who report the truth. But to start detaining the family members and loved ones of journalists is simply despotic. Even the Mafia had ethical rules against targeting the family members of people they felt threatened by. But the UK puppets and their owners in the US national security state obviously are unconstrained by even those minimal scruples.
If the UK and US governments believe that tactics like this are going to deter or intimidate us in any way from continuing to report aggressively on what these documents reveal, they are beyond deluded. If anything, it will have only the opposite effect: to embolden us even further. Beyond that, every time the US and UK governments show their true character to the world - when they prevent the Bolivian President's plane from flying safely home, when they threaten journalists with prosecution, when they engage in behavior like what they did today - all they do is helpfully underscore why it's so dangerous to allow them to exercise vast, unchecked spying power in the dark.
David was unable to call me because his phone and laptop are now with UK authorities. So I don't yet know what they told him. But the Guardian's lawyer was able to speak with him immediately upon his release, and told me that, while a bit distressed from the ordeal, he was in very good spirits and quite defiant, and he asked the lawyer to convey that defiance to me. I already share it, as I'm certain US and UK authorities will soon see.

De Amerikaanse journalist Glenn Greenwald heeft vandaag gezworen dat hij juist meer geheimen over de inlichtingendiensten zal publiceren. Hij deed dat in een reactie op de actie van de Britse immigratiediensten, die zijn partner David Miranda gisteren 9 uur lang ondervroegen en zijn laptop, telefoon en usb-sticks in beslag namen.
Miranda was op Heathrow door de politie staande gehouden op grond van antiterrorismewetgeving. Miranda kwam uit Duitsland, waar hij had gesproken met Laura Poitras, een Amerikaanse documentairemaakster die met Greenwald aan het NSA-verhaal werkt.
De Britten zullen spijt krijgen van deze actie, zo waarschuwde Greenwald tegen verslaggevers op het vliegveld van Rio de Janeiro waar hij op zijn vriend wachtte. 'Ik zal vanaf nu veel agressiever zijn in mijn verslaggeving. Ik ga veel meer documenten publiceren, ook over Engeland. Ik heb veel documenten over Engelands spionagesysteem.' Volgens Greenwald tonen de inlichtingendiensten met de ondervraging van zijn partner hun ware gezicht en zal het ze verder in diskrediet brengen. 'Ik denk dat ze er spijt van zullen krijgen.'
Greenwald was de journalist die van klokkenluider Edward Snowden vele duizenden documenten in handen kreeg over Amerika's omvangrijke spionagesysteem Prism, dat is opgezet door de Amerikaanse inlichtingendienst NSA. Hij publiceerde al meerdere primeurs hierover via de Britse krant The Guardian. De Amerikanen zijn woest over het lekken van deze geheimen en proberen Snowden in handen te krijgen. Een tegenslag daarbij was het jaarlange asiel dat Snowden begin augustus van Rusland kreeg.
Intimidatie
Volgens Greenwald proberen de autoreiten journalisten te intimideren om zo te voorkomen dat meer geheimen op straat komen te liggen. 'Ze wilden onze journalistiek intimideren om te laten zien dat zij macht hebben en niet passief zullen toekijken, maar ons intensiever zullen aanvallen als wij doorgaan met het publiceren van hun geheimen.'
Ook in een opiniestuk op de site van de Guardian uit Greenwald zijn woede. Hij noemt de aanval op de journalistiek daar een 'diepe escalatie': 'Het is erg genoeg om bronnen te vervolgen en gevangen te nemen. Het is zelfs nog erger om journalisten die de waarheid vertellen gevangen te zetten. Maar om familieleden van journalisten gevangen te nemen is ronduit despotisch. Zelfs de maffia had ethische regels over het tot doelwit maken van familieleden van mensen door wie ze zich bedreigd voelden. Maar de Britse marionetten en hun eigenaren in de nationale veiligheidsstaat van de Verenigde Staten worden duidelijk zelfs door die minimale scrupules niet gehinderd.'
Volgens Miranda werd hij gisteren constant door zes agenten ondervraagd. Hij kreeg naar eigen zeggen zijn paspoort pas terug toen hij in de lounge van het vliegveld begon te schreeuwen.
Brazilië heeft gisteren een officiële verklaring uitgebracht waarin de regering zijn beklag doet over de behandeling van Miranda. Volgens de verklaring werden de anti-terrorisme wetten onder het mom waarvan Miranda werd aangehouden ten onrechte toegepast.
Vragen
Inmiddels heeft Labour-parlementslid Keith Vaz, voorzitter van de Lagerhuiscommissie voor binnenlandse zaken, vragen over de zaak gesteld. Hij wil weten op welke grond de politie Miranda heeft aangehouden. 'Alle feiten moeten snel boven tafel komen', zei Vaz tegen de BBC. 'Er ligt nu een klacht van meneer Greenwald en van de Braziliaanse regering - zij hebben gezegd bezorgd te zijn dat terreurwetgeving lijkt te zijn gebruikt voor iets wat niets met terrorisme te maken heeft - dus het moet opgehelderd worden, en snel ook.'
Het Britse ministerie van Binnenlandse Zaken had nog geen commentaar.
Schedule 7
Miranda werd staande gehouden en ondervraagd onder Schedule 7 van de Terrorism Act. De Britse regering zegt dat dit wetsonderdeel de autoriteiten moet helpen bepalen of mensen die de Britse grens oversteken betrokken zijn bij 'het plegen dan wel voorbereiden van, of aanzetten tot terreurdaden'. Een 'redelijke verdenking' is voor grensbewakers niet vereist om mensen maximaal negen uur te kunnen vasthouden en te ondervragen.
In de meeste gevallen waarin deze wet wordt gebruikt worden mensen minder dan een uur vastgehouden. In minder dan 0,1 procent van de gevallen blijft iemand langer dan zes uur in hechtenis.
De Britse burgerrechtenorganisatie Liberty heeft over Schedule 7 een rechtszaak aangespannen voor het Europese Hof voor de Rechten van de Mens. Een woordvoerder van premier David Cameron liet maandag weten dat Schedule 7 'een essentieel onderdeel is van de grensbeveiliging van het Verenigd Koninkrijk', maar dat het aan de politie is om te beslissen 'wanneer het nodig en binnen proportie is om deze bevoegdheden te gebruiken'.
