TRIPOLI, May 2 (Reuters) - Crowds chanting support for Muammar Gaddafi gathered in Tripoli on Monday for the funeral of his son, killed in a NATO air strike that has raised questions about the West's role in the uprising against the Libyan leader.

Gaddafi's forces halted their bombardment of the port in the rebel-held city of Misrata after NATO air strikes but the port remained closed, a rebel spokesman said, thwarting efforts to bring supplies in by sea to the besieged city.

NATO planes also struck overnight on positions held by Libyan government forces near the rebel-held town of Zintan.

The developments highlighted the reliance of the faltering rebel movement on military backing from the West. But Saturday's NATO air raid on a Gaddafi compound, which the government says killed his 29-year-old son Saif al-Arab and three young grandchildren, added a new twist.

The announcement of the deaths triggered attacks by angry crowds on the British and French embassies and the U.S. diplomatic mission in Tripoli, and accusations from the Libyan officials that NATO had been trying to assassinate Gaddafi.

About 2,000 people carrying flags and pictures of Gaddafi turned out for the funeral. They pumped their fists in the air and vowed to avenge the death of Saif al-Arab.

"We are all with Gaddafi's Libya," read one placard.

Saif al-Arab's coffin, covered in flowers and wrapped in the green flag that has represented Libya since Gaddafi took power in a 1969 coup, was carried through the crowds to the grave at Hani cemetery in the Libyan capital.

Gaddafi did not appear to be at the funeral but Saif al-Islam, the most prominent of his seven sons, attended along with his elder half-brother Mohammed.

Saif al-Arab had no children but three of his nieces and nephews, all under three years old, were killed in Saturday's blast, the government says. They were the children of Saif al-Arab's siblings Hannibal, Aisha and Mohammed Gaddafi.

"We feel pain and sorrow for any bloodshed, even when Gaddafi's house was bombed last night. We feel pain for any blood that is shed unjustly," Abdel Jalil said.

"But the blood of Gaddafi's sons is not more precious than the blood of Libyan men and women," he added.

Abdel Jalil said Gaddafi was to blame for the civil war.

"He bombed our cities and villages with rocket launchers and planes. He shed blood and killed children ...," he said.

Abdel Jalil urged Gaddafi supporters to join the rebels.

"You must abandon him and you will live with us in peace and security. Anyone who abandons Muammar Gaddafi in these moments will have peace and security for him and his family and will live with us in prosperity in the future."

NATO maritime forces near the Libyan port of Misrata detected a number of small vessels earlier today and, when investigating suspicious activity, disrupted mine-laying operations by pro-Qadhafi forces designed to threaten the flow of humanitarian aid into Libya.

The sea-mines were being laid two to three kilometers offshore and in the approaches to Misrata by deliberately sinking the inflatable boats on which they were being carried. Three mines have been found and are being disposed of on site.

NATO warned the Misrata port authorities who temporarily closed the facility resulting in two humanitarian ship movements being cancelled.

Libyan leaders face arrest on war crimes charges

Gaddafi regime systematically opened fire on peaceful protests, says International Criminal Court prosecutor

The Gaddafi regime committed war crimes against Libyan pro-democracy demonstrations, opening fire "systematically" on peaceful protesters, according to a report issued by the prosecutor for the International Criminal Court (ICC), who will seek arrest warrants against Muammar Gaddafi and two other senior members of his regime later this month.

Addressing the UN security council in New York, the prosecutor, Luis Moreno-Ocampo, said he will ask judges at the court in The Hague for three warrants. He has not named his suspects but in his report to the UN security council on Wednesdayhe said they were the people who gave the orders for the alleged atrocities. The Guardian has learned from well-informed sources that Gaddafi will top the list, and that his brother-in-law and intelligence chief, Abdullah Senussi, is also likely to be included.

Other names in the frame include the leader's second oldest son Saif al-Islam and Mahmoud Al-Baghdadi, in effect, the nation's prime minister.

"It is indeed a characteristic of the situation in Libya that massive crimes are reportedly committed upon instruction of a few persons who control the organisations that execute the orders," Moreno-Ocampo said. He added that the arrests were a manner of urgency.

"Justice is on course today; however, if those who order the crimes are not stopped and arrested murder, persecution, systematic arrests, torture, killings, enforced disappearances and attacks against unarmed civilians will continue unabated" the prosecutor said.

In the course of a two-month preliminary investigation, Moreno-Ocampo's investigators found widespread evidence of crimes against humanity.

"Concerning the manner and nature of the crimes, the shooting at peaceful protesters was systematic, following the same modus operandi in multiple locations and executed through security forces. The persecution appears to be also systematic and implemented in different cities. War crimes are apparently committed as a matter of policy," the report said. Moreno-Ocampo said thousands of people had died since the beginning of the conflict.

As well as the use of live ammunition against unarmed demonstrators, the ICC investigation found evidence of a range of abuses including torture, systematic rape, the use of cluster munitions and other heavy weaponry in urban areas, the use of civilians as human shields and the blocking of humanitarian supplies.

"Civilians in Tripoli and other areas are reportedly subject to different forms of persecution because of their suspected association with the uprising," the report stated. "Systematic arrests, torture, killings, deportations, enforced disappearances and destruction of mosques have been reported in Tripoli, Al Zawiyah, Zintan and the area of the Nafousa mountains. The victims are allegedly civilians who participated in demonstrations or talked to international media, activists, journalists, as well as citizens of Egypt and Tunisia that were arrested and expelled en masse because of their perceived association with the popular uprising."

The ICC prosecutor's office is also looking into several reports that anti-government crowds attacked and killed "dozens" of immigrants from sub-Saharan Africa, who were suspected of being pro-Gaddafi mercenaries.

"A number of Sub-Saharan Africans were allegedly arrested by the new authorities in Benghazi and it is unclear whether they were innocent immigrant workers or prisoners of war," the report said.

The report was commissioned by the security council on 26 February when it referred the case to the ICC. The investigation is highly significant politically as Nato went to war in Libya on "humanitarian grounds", on the strength of security souncil resolution 1970 authorising "all necessary measures" to protect civilians. If the court approves the arrest warrants it will help insulate the alliance against international criticism of his prolonged campaign in Libya.

Moreno-Ocampo will present his first application for an arrest warrant to the ICC's pre-trial chamber, expected to convene in mid-May.

"It will focus on those most responsible for crimes against humanity committed in the territory of Libya since 15 February 2011," he told the security council.

If the judges grant his request, the question will be who should carry out the arrests. Moreno-Ocampo will say that if the Libyan government fails to act, the security council itself "should evaluate" how to do it. It is unclear whether Russia or China would veto the authorisation of Nato to carry out the arrests. That would most likely involve sending troops into Tripoli.

Muammar Gaddafi's forces bombard port in Misrata as humanitarian ship tries to evacuate foreign migrants

Muammar Gaddafi's forces have bombarded the port of the besieged city of Misrata while a humanitarian ship was evacuating hundreds of foreign migrants and injured Libyan civilians, killing up to five members of a migrant family.

The Red Star 1, a ferry chartered by the International Organisation for Migration, had been forced to wait outside Misrata for four days after loyalist troops planted sea mines and pounded the harbour with missiles.

The port controller has finally given the ship the go-ahead to dock following a lull in shelling. But as containers of food and medical supplies were being unloaded from the ship, up to a dozen missiles were fired into the area of the port where migrant workers were gathered.

Witnesses said one missile hit a Nigerian or Ghanaian family, killing at least two children and their mother. Others said that the father and a third child had also died.

Julius Chuks, a 35-year-old Nigerian welder, said: "When the attacks started, everyone just started running, though we did not know where to run to. We are very lucky to be alive."

The bombardment caused panic on the ship, with some of the crew keen to leave without boarding the migrant workers or injured people, fearing another missile attack.

Having somehow gained access to the port, dozens of Libyan families desperate to leave Misrata tried to force their way on to the ship, many of them successfully, causing rebel soldiers to fire in the air.

More than 800 migrants, most from sub-Saharan Africa, who have been waiting for weeks to leave Misrata, arrived soon after, packed into trucks. Many of them had been unable to even bring a suitcase along due to the chaos and rush that followed the shelling of their camp.

About 35 injured or critically ill Libyans were wheeled on to the car deck, where makeshift wards had been set up. Shortly after departure, the boat returned to the quay to unload one of the patients, after doctors on board judged would not survive the 20-hour sea voyage. About 100 African migrants were unable to board the ship due to a lack of space.

Finally, in the early afternoon, the Red Star left the port and set sail into the Mediterranean towards Benghazi, the rebel capital in eastern Libya.

"When we came to Misrata before, there was shelling, but this was the closest to the port," said Othman Belbeisi, the head of mission for the IOM, which has evacuated about 5,500 people from Libya's third biggest city since March.

"It was a very dangerous situation, and the captain wanted to leave when the attack started. But we had to take the risk of staying because it was impossible to leave behind the migrants and the medical cases."

Gaddafi, whose forces have been largely defeated in Misrata by the rebels' citizen army, has pledged to shut the port, saying it was being used to ferry in light weapons from Benghazi. But many people in Misrata believe that he is trying to starve them out, as the port is the city's lifeline, allowing in food and other basic goods.

On board the Red Star 1, some of the migrants spoke of their ordeals.

"When the fighting started in Misrata we had to stay indoors all the time," said Samuel Ampansa, a 28-year-old mason from Ghana.

"When I finally reached the camp at the port, conditions were bad. There was so much bombing, and we had to run like cats and dogs," he added.

The bombardment of the migrants' camp, like so many attacks in the war to date, exposed as a lie Gaddafi's claim that he is not targeting civilians. After two days during which the port had not been shelled, the attack appeared timed to coincide with the humanitarian ship's arrival.

Since the start of the evacuation of migrants early last month, around 15 have been killed by shells fired by Gaddafi's troops.

Despite the ongoing violence, many of the migrants on the ship were initially reluctant to leave Libya since they had endured difficult – and illegal – journeys through the Sahara desert just to get there in the first place.

Mabel Joseph, 27, who is four months pregnant, said she had only decided to return home when Libya's civil war reached the neighbourhood where she was staying a few weeks ago, leaving many dead. "I just made up to mind to leave at that time. I was making good money but I will not return. We regret ever coming to Misrata," she said.

Aslem Orubor, 28, a diesel mechanic from Nigeria, was on the boat with his wife, Maureen, and daughter Natasha, who is one. He said: "We were so scared for the two weeks we lived in the camp. Even our baby is affected by all the noise of the bombing."

Mamumuddin Bachuminia, 30, from Bangladesh, said Gaddafi's troops had ransacked his house, taking his mobile phone, television and his money. "Lots of people were killed. We need to go home," he said.

Salim el-Goumati, a 54-year-old Libyan man, reached the deck of the ship and burst into tears. Out of a small plastic bag, the only item he carried, he retrieved photos of two of his young children, aged eight and five. They were in Tripoli, with his wife and a third, smaller, child. He had not heard from them since the start of the revolution, he said. Now, his house had been destroyed by Gaddafi's missiles, and he had lost everything.

"Libyans are good people. But look what he [Gaddafi] has done to us."

Police officers in riot gear and armed with wooden staves have been manning fuel pumps at a petrol station in Tripoli as long queues of cars caused traffic chaos in western Libya, amid fears that the Gaddafi regime is running out of its most precious commodity.

Queues of vehicles, sometimes five or six deep, stretched up to half a kilometre from some petrol stations last week, most of which are shut behind makeshift barriers. Two men in a queue near the city of Zuwara said they had been waiting for five days in the hope of a fresh delivery.

At the few stations around the capital, where cars were inching forward, armed soldiers and police attempted to keep order as motorists and pedestrians carrying containers jostled to get served. Fights sometimes break out, according to locals.

The Libyan government has blamed the fuel crisis on its own "mismanagement of distribution". But deputy foreign minister Khaled Kaim also accused the international community of "trying to starve the Libyan people by cutting all supplies to 5.2 million people in the south and the west of the country".

The dearth of fuel is the most obvious sign of the economic impact of the crisis that has engulfed Libya for more than two months. But cigarette prices have doubled in the past month; bread is in short supply since Egyptian bakery workers fled the country; cash withdrawals from banks have been capped as the government faces a currency shortfall; many shops are shuttered as both supplies and customers dwindle.

Nato has confirmed that 18 warships are patrolling waters outside Tripoli's port to inspect cargo ships that could be carrying arms or other materials of potential military use to the regime. The sea embargo does not include deliveries of food, drugs or other basic needs, Nato said. However, the terms of UN resolution 1970 covers any product deemed by Nato intelligence as destined for the Libyan military that could be used to attack civilians. "This can include the interception of oil tankers," a spokesman said.

Trade with Libya's National Oil Corporation is banned under the UN embargo. However, in early April, the government circumvented sanctions when it imported fuel from Italy via Tunisia, transferring the load to a Libyan-owned ship outside the UN blacklist.

Despite being an oil-producing country, Libya has limited refining capacity and in normal times imports most of its gasoline. Consumer prices are heavily subsidised, and since the crisis began the government has slashed the cost of a litre. But low prices have little meaning when pumps are empty.

Libya's main refinery is in Tobruk, in the far east of the country and in rebel hands, along with a second refinery in Ras Lanuf. The government is trying to increase capacity at its third refinery in Zawiya, around 50km (30 miles) west of the capital.

The government is reluctant to discuss the fuel crisis, and journalists are instructed not to film petrol queues or interview people waiting in line. Unauthorised conversations reveal varied views about who is to blame for shortages. In Zuwara, 110km west of Tripoli, Tariq Dobroz, 35, one of those who had been waiting for a delivery for five days, said: "I'm angry. Before [the crisis], life was getting better. Now things are bad."

Local businessman Fawzi Aribi, 38, said: "If you lose money, benzine [fuel], food — you go crazy. Some are angry at the government, some are angry at the Europeans. Everybody has a different way of taking this."

In Tripoli's old city, a gold and silver trader bitterly listed his grievances: "Business is bad; benzine, it's finished; cigarette prices have doubled; food prices have risen." Asked if he blamed the west, he said elliptically: "No, other things," most likely referring to the Gadaffi regime.

A foreign diplomat in the capital said people in fuel queues were likely to turn their anger on the international alliance. "They are saying 'we're not involved in this yet we're being punished.'"

The regime's economic difficulties are exacerbated by problems over cash supply. Withdrawals from banks are limited to 1,000 dinars a month amid fears that currency supplies are running low. According to finance minister Abdulhafid Zlitni, Libyans are hoarding cash — common in times of uncertainty — while a consignment of currency printed under contract in the UK has been hit by sanctions. "It's our money, and we paid for it," he said.

The International Monetary Fund estimated in February that the Libyan regime had more than $100bn (£60bn) in foreign reserves. A significant proportion is believed to be beyond the reach of sanctions.

The government has encouraged shopkeepers to open, despite the lack of customers, to keep an appearance of normality, although in fact many shops in Tripoli and other cities are shuttered. The owner of a women's clothing store in Tripoli said he had been ordered to open his shop daily despite the fact that "I have no materials to sell".

Most restaurants and cafes are closed in the evenings. "People are scared to go out because of the shooting," said the shop owner, referring to the gunfire that echoes around the city after dusk, often accompanied by the sound of Nato warplanes and anti-aircraft fire.

Some officials are phlegmatic about UN sanctions, saying Libya has survived them before and will again now. "Just go back to history," said Zlitni. "When sanctions were imposed in the 1990s, Africans just broke them. We managed to take a lot of precautions and were able to avoid a lot of problems."

But the official message is, as ever, one of anger directed at Nato and the international alliance. The purpose of the blockade "is to try to force problems in cities and towns in the west", said Kaim.

"The motive of Nato is clear: attacking from the air, surrounding the country with warships, cutting supplies by sea, trying to starve the people.

"It's not moral, not legitimate and not acceptable ... But it's not strange. Hitler and Mussolini, both of them were democratically elected but they committed atrocities. Once again, we can see western leaders committing atrocities in Libya or somewhere else."

Onlangs verplaatste de confrontatie tussen de voor- en tegenstanders van Gaddafi zich al over de grens. De Tunesische autoriteiten reageerden furieus op de Libische confrontaties binnen hun landsgrenzen. Onder het Tunesische volk heerst sympathie met de Libische opstandelingen nadat ze zelf in januari hun president Zine El Abidine Ben Ali wegjoegen.

Daar deed ze haar verhaal aan journalisten: bij een checkpoint in de hoofdstad werd ze aangehouden en daarna werd ze naar eigen zeggen twee dagen lang door vijftien mannen mishandeld en verkracht.

Nadat al-Obaidi werd weggevoerd uit het hotel, werd ze volgens haar ouders vastgehouden in het hoofdkwartier van Moammar Gaddafi.

Op 5 april verkreeg zij opnieuw haar vrijheid, maar zou ze naar eigen zeggen nog lastig gevallen worden door veiligheidsdiensten.

Vandaag blijkt dat ze afgelopen donderdag gevlucht is naar Tunesië met de hulp van een gedeserteerde legerofficier. Met alleen een oog zichtbaar onder haar sluier reed zij met hem langs verschillende militaire checkpoints naar de grens van het buurland. Eenmaal over de grens hielpen Europese diplomaten haar om naar hoofdstad Tunis te reizen. Tegenover CNN doet ze haar verhaal:

Vliegtuigen van de NAVO hebben vandaag doelen in de Libische hoofdstad Tripoli onder vuur genomen. Vier locaties werden getroffen, waaronder volgens ooggetuigen een gebouw van de militaire inlichtingendienst. Dit meldt persbureau AP.

Een ander getroffen gebouw zou soms gebruikt worden door parlementsleden. Wat de andere twee gebombardeerde doelen zijn is niet duidelijk, maar een van de plekken lijkt een complex te zijn waar leden van de familie van de Libische leider Moammar Gaddafi wonen.

De NAVO heeft de strijd geïntensiveerd na kritiek dat de organisatie niet genoeg zou doen om de grip van Gaddafi op het land te breken. Volgens secretaris-generaal van de NAVO Anders Fogh Rasmussen is een ‘significant deel’ van Gaddafi’s militaire mogendheden echter uitgeschakeld. Op de luchtaanvallen van vandaag in Tripoli is nog niet gereageerd. Een anonieme functionaris van de organisatie zegt te hopen dat er vanmiddag meer gezegd kan worden tijdens een persconferentie.

De pers werd vandaag verboden in de buurt te komen van een gebouw dat vanmorgen is geraakt door een luchtaanval van de NAVO. Buurtbewoners zeggen dat het een gebouw is dat wordt gebruikt door de militaire inlichtingendiensten.

Wel werden journalisten geëscorteerd naar een beschadigd ziekenhuis dat beschadigd zou zijn door de luchtaanvallen. Een arts zei dat een vierjarig kind daarbij zwaargewond is geraakt, maar het kind mocht niet bezocht worden, omdat het op de intensive care zou liggen. Journalisten mogen niet zonder escorte van de regering hun hotel in Tripoli verlaten.

Italië: Kaddafi is een legitiem doelwit

De Italiaanse minister van Defensie, Ignazio La Russa, heeft gezegd dat de Libische leider Moammar Kadhafi een legitiem doelwit is als hij zich in een militair gebouw bevindt. Dat zei La Russa in een vraaggesprek met de Italiaanse krant Il Messaggero woensdag.

'Als Kadhafi bijvoorbeeld ergens is waar hij bevelen verstrekt om burgers te doden, is een inval gerechtvaardigd', aldus de minister. Over het lot van de Libische leider heeft hij weinig te zeggen. La Russa benadrukte dat militaire doelwitten niet worden beschoten vanwege de potentiële aanwezigheid van Kadhafi. Al dagen speculeren Italiaanse media over de mogelijke dood van Kadhafi.

Sinds eind april doet Italië mee met de luchtaanvallen onder leiding van de NAVO. Deze deelname leidde tot grote conflicten binnen de regeringscoalitie van premier Silvio Berlusconi.
