Here's what happened. We spoke with Lance Spiegel, the lawyer who repped Jackson at the time. Spiegel says under the law, the Department of Children and Family Services must conduct a parental fitness investigation before parental rights are terminated and that didn't happen with Rowe.
So Rowe has never given up any of her parental rights. As a result, under California law, Rowe is now presumed to be the person who will get custody. The only way Rowe can be denied custody is if a court determines it would be "detrimental to the children."
As for whether Rowe will ask for custody .... our sources say you can bet on it. We're told if Rowe gets custody she will get "a huge amount of child support from Jackson's estate."

There are questions over whether Jackson's death may have involved medication.
Brian Oxman, a former attorney for the Jackson family who was with the family in the hospital emergency room on Thursday, told CNN he had been concerned about medications the pop star was taking.
"I talked to this family about it, I warned them. I said that Michael is overmedicating and that I did not want to see this kind of a case develop," Oxman told CNN's "American Morning" on Friday.
He referred to Anna Nicole Smith, the former model and reality TV show star who died of an overdose in 2007.

Oxman emphasized that he does not know what killed Jackson, and was not making accusations against any individual.

The night before he had complained of not feeling well, brother Marlon Jackson said.
He told CNN on Thursday about his conversation with Jackson's manager Frank Dileo. On Wednesday night, Jackson said he was not feeling well, so his doctor went to see him. "Frank said, 'Marlon, from last night to this morning, I don't know what happened.' When they got to him this morning, he wasn't breathing."
The troubled icon had been preparing for a comeback tour, aimed at extending his legendary career and helping to pay off hundreds of millions of dollars in debt.
Michael Jackson began his professional work at age 5, singing with his brothers before shooting to superstardom as a solo artist. He had numerous No. 1 hits, the best known being "Thriller."
"Thriller" was the best-selling album of all time, at an estimated 50 million copies worldwide.
After dominating the popular music scene for years, Jackson became reclusive and mired in scandals that included child molestation charges. He was acquitted after a highly publicized trial in Santa Maria, California, in March 2006.
Last year, Jackson announced a comeback tour that was to start in July. When some of the shows were postponed till next year, rumors spread that the entertainer was weak and suffering from skin cancer.
But Marlon Jackson said he last saw his younger brother at a May 14 family gathering and he "looked great."
"He was looking well. He was getting ready to go into rehearsals for his tour. I don't know what happened," Marlon Jackson said.
The most famous of Michael Jackson's eight siblings, Janet, issued a statement through her manager.
"Janet Jackson is grief-stricken and devastated at the sudden loss of her brother," said Kenneth Crear. "She is ... flying immediately to California to be with her family."
A large crowd gathered outside the hospital, while in New York a huge crowd gathered outside the Apollo Theater.

Producer Quincy Jones, who helped Jackson craft his hit albums "Off the Wall" and "Thriller," said, "I am absolutely devastated at this tragic and unexpected news.
"For Michael to be taken away from us so suddenly at such a young age, I just don't have the words," Jones added in a statement.
Jackson's music continues to be heard throughout the world "because he had it all -- talent, grace, professionalism and dedication," Jones said. He called Jackson a consummate entertainer, whose legacy will be felt around the world.
"I've lost my little brother today and part of my soul has gone with him," Jones said.
Berry Gordy, producer and founder of Motown Records, said Jackson's death was "like a bad dream."
"As a kid, Michael was always beyond his years. He was an innovator. He was a genius at what he did," Gordy said. "He had a knowingness about him. At 9 years old, when I first started working with him, he seemed to me like he had been here before. He was just so knowledgeable about life."
Jackson's former wife, Lisa Marie Presley, said she was "shocked and saddened" by his death.
"My heart goes out to his children and his family," she said.
Jackson is survived by his three children, Prince Michael I, Paris and Prince Michael II.

That person, whom I considered (at the risk of ridicule) very pure, still survived -- he was reading the poems of Rabindranath Tagore when we talked the last time, two weeks ago. Michael exemplified the paradox of many famous performers, being essentially shy, an introvert who would come to my house and spend most of the evening sitting by himself in a corner with his small children. I never saw less than a loving father when they were together (and wonder now, as anyone close to him would, what will happen to them in the aftermath).
Michael's reluctance to grow up was another part of the paradox. My children adored him, and in return he responded in a childlike way. He declared often, as former child stars do, that he was robbed of his childhood. Considering the monstrously exaggerated value our society places on celebrity, which was showered on Michael without stint, the public was callous to his very real personal pain. It became another tawdry piece of the tabloid Jacko, pictured as a weird changeling and as something far more sinister.
It's not my place to comment on the troubles Michael fell heir to from the past and then amplified by his misguided choices in life. He was surrounded by enablers, including a shameful plethora of M.D.s in Los Angeles and elsewhere who supplied him with prescription drugs. As many times as he would candidly confess that he had a problem, the conversation always ended with a deflection and denial. As I write this paragraph, the reports of drug abuse are spreading across the cable news channels. The instant I heard of his death this afternoon, I had a sinking feeling that prescription drugs would play a key part.
The closest we ever became, perhaps, was when Michael needed a book to sell primarily as a concert souvenir. It would contain pictures for his fans but there would also be a text consisting of short fables. I sat with him for hours while he dreamily wove Aesop-like tales about animals, mixed with words about music and his love of all things musical. This project became "Dancing the Dream" after I pulled the text together for him, acting strictly as a friend. It was this time together that convinced me of the modus vivendi Michael had devised for himself: to counter the tidal wave of stress that accompanies mega-stardom, he built a private retreat in a fantasy world where pink clouds veiled inner anguish and Peter Pan was a hero, not a pathology.
This compromise with reality gradually became unsustainable. He went to strange lengths to preserve it. Unbounded privilege became another toxic force in his undoing. What began as idiosyncrasy, shyness, and vulnerability was ravaged by obsessions over health, paranoia over security, and an isolation that grew more and more unhealthy. When Michael passed me the music for that last song, the one sitting by my bedside waiting for the right words, the procedure for getting the CD to me rivaled a CIA covert operation in its secrecy.
My memory of Michael Jackson will be as complex and confused as anyone's. His closest friends will close ranks and try to do everything in their power to insure that the good lives after him. Will we be successful in rescuing him after so many years of media distortion? No one can say. I only wanted to put some details on the record in his behalf. My son Gotham traveled with Michael as a roadie on his "Dangerous" tour when he was thirteen. Will it matter that Michael behaved with discipline and impeccable manners around my son? (It sends a shiver to recall something he told Gotham: "I don't want to go out like Marlon Brando. I want to go out like Elvis." Both icons were obsessions of this icon.)
His children's nanny and surrogate mother, Grace Rwamba, is like another daughter to me. I introduced her to Michael when she was eighteen, a beautiful, heartwarming girl from Rwanda who is now grown up. She kept an eye on him for me and would call me whenever he was down or running too close to the edge. How heartbreaking for Grace that no one's protective instincts and genuine love could avert this tragic day. An hour ago she was sobbing on the telephone from London. As a result, I couldn't help but write this brief remembrance in sadness. But when the shock subsides and a thousand public voices recount Michael's brilliant, joyous, embattled, enigmatic, bizarre trajectory, I hope the word "joyous" is the one that will rise from the ashes and shine as he once did

AMSTERDAM - Het ambulancepersoneel dat Michael Jackson's hielp, stelde vast dat de zanger al dood was, maar zijn eigen arts wilde daar niets van weten...
Michael's arts weigerde toestemming te geven om de zanger offcieel dood te verklaren, meldt TMZ.
Het ambulancepersoneel vond op de locatie sporen van lidocaïne, een middel dat soms gebruikt wordt om hartritmestoornissen te behandelen. Ook zou er al geruime tijd hartmassage zijn uitgevoerd. Men ging echter door met hartmassage, ondanks het feit dat de zanger al lang dood was... Eigenlijk had het ambulancepersoneel de lijkschouwer willen bellen.
Waarom de arts van Michael eiste dat de zanger toch naar het ziekenhuis werd gereden, is onduidelijk, meldt TMZ. De arts in kwestie wordt door de politie gezocht, maar is nog niet gevonden.

In het ziekenhuis zijn ze nog een uur doorgegaan. Wellicht hadden ze daar toch nog het idee dat er nog opties waren. Ik heb nul komma nul medische kennis, dus vergeef me als ik iets doms zeg. Demerol is a powerful painkiller similar to morphine. Jackson was reportedly addicted to the drug and took a fatal over dose of it.
Michael's lawyer, Brian Oxman, told CNN yesterday that the pop star resorted to medication in the run up to the O2 gigs to tide over pain from past injuries sustained, which included a burnt scalp and a broken vertebrae and leg.
Michael was treated for addiction to painkillers, including Demerol, at the Betty Ford Clinic.
According to TMZ, cops seized syringes and drugs, including Demerol, during a raid at his Neverland Ranch during the child molestation trial.
