After I, KELLY, read the declaration of the witness to him in Spanish, he explained that he would not sign it. He stated that he wouldn’t grant any further cooperation to the police.

Last Name : PENATA RAMOS
First Names : Carlos Alberto
Age : 26 years
Living at : Aruba - L.G. Smith Boulevard 546
to be heard as a witness for the case, of which he’ll be informed of. The judge-commissioner acknowledges Mrs. J. Driessen as the interpreter.
Additionally present:
the public prosecutor Mrs. K.P.J. Janssen
the lawyers A. Carlo and A.de Bie, counselors for suspect J. van der Sloot:
the lawyers R. Oomen and R. Offringa, counselors for suspect D. Kalpoe
the lawyer E. Zeppenfeldt, counselor for suspect S. Kalpoe, the suspects J. van der Sloot, D. Kalpoe and S. Kalpoe.
The witness declares that he is not related to any of the suspects and he currently isn’t nor has been employed by them. The witness states to tell the whole truth and nothing but the truth and subsequently gave the oath in accordance with the “Wetboek van Strafvordering van Aruba”
To questions of the judge-commissioner, the witness states the following:
I do not know Joran van der Sloot, Deepak Kalpoe and Satish Kalpoe.
1. Could you recall the statement that you made to the police on July 22nd 2005 about 19:25? Yes.
2. Did you then tell the truth? I have stated what I have seen.
3. The witness is being asked to prepare a situation sketch (production 1). The witness indicates where the car of the suspects was located and the route he drove.
4. Did you see the face of the driver when you passed by the car? Yes.
5. Did you recognize him during a photo confrontation? Yes, on the day that I made a statement to the police they showed me a photograph from a magazine. This is the only photograph that they’ve showed me.
6. Did you see the faces of the other persons in the car? Yes, the face of the person who sat besides the driver. When I approached the car, I saw in the cone of headlights, that the person besides the driver covered his head and face by his hands. I’ve recognized that person from his posture. You ask me how I have recognized the driver whilst he sat besides the man who covered his face? I have seen him in the (cone of the head-) lights of my “van” (pick-up truck). He slid himself a bit backwards.
7. Did also recognize Deepak Kalpoe? Yes, on that same photograph that the police showed me.
The witness is being shown 3 photo sets (productions no 2, 3, and 4). He is being asked to designate the persons who are assumed to be involved in this case.
Production no.2 . On this one the witness designates photo no 6, the driver of the car.
Production no.3. The witness designates photo no 6 and tells that this person was on the backseat. After the witness shows some doubt, he says that this person was not in the front seats.
Production no.4. The witness doesn’t recognize anybody from the photos.
To the questions of Mr. De Bie, Laywer of the suspect J. van der Sloot, the witness answers as follows:
I got out of bed and saw that on my watch it was 02:30. Before 03.00 I was at my work. I’m not sure what exactly the height of my 'van' is. When I encountered the car in question, it was on a dirt road. I had to brake and drive slowly to pass it. The headlights of my "van" shone on that car. The person besides the driver, kept his hand in front of his head and face. I saw how the driver slid backwards a little. You ask me how I’ve prepared for this interrogation. I have been nervous. I have "stress" from this case. This is the first time that something like this happens to me. I was on holidays. You ask me why I did not show up on the previous occasions. There are persons, who wanted to put pressure on me to make a statement. I have discussed the matter with my boss. I had booked my holidays and didn’t know I was searched for. I have been put under pressure by someone from Bubali, two inspectors and fat man. They wanted me to make a statement. The second time I wasn’t here. When I passed the car that evening, it was dark. The car was entirely illuminated by the headlights of my "van". The lights did not reflect in the car. You ask me why I have waited with making my statement. Two guards were arrested at first, who proved to be innocent. The person who worked at the Tattoo also didn’t know anything. A few days after the photo appeared in the Diario, I told it to my boss. Due to the attention that the case attracted, my boss said that I should wait for a while. I have almost lost my job.
To the questions from Mr. R. Oomen, Counsellor of suspect D. Kalpoe, the witness replies as follows:
I take care of the maintenance of the house, the yacht and ranch of Eric Mansur. I do this already 6 years. I earn the minimum wage of afl. 1.250. I live at the L.G. Smith Boulevard no 546. The house is owned by Eric Mansur. During the time the police looked for me, I was out fishing. I was together with my boss. There were also still 6 other yachts with us. We have fished in Bonaire and Curacao. Until yesterday I was on the boat. By having to come here immediately, my holiday has been wasted. You ask me if I knew that the police were looking for me. After I made a phone call, I learned I was being looked for. We left Saturday one week ago, probably August 6th. Nobody had told me that I had to show up as a witness. You ask me how long before my departure I received the call. I think that was on Thursday. The first interrogation took place at Bubali. Present were ‘a’ Luis and 2 police officers. The night when I saw the car, it was very dark. You point out to me that I have stated not to show up since I was afraid of the FBI and the DEA. I wasn’t afraid of them, but for the publicity. I didn’t want to appear on TV. You ask me whether I’ve been involved with the police before. No, however I have experienced a small incident on the street. With Eric and Carlo in my statement I refer to Eric Mansur and Carlo Mansur. You ask me with what they had persuaded me to make a statement. I was approached by the son of Carlo. There also was a family member of the girl with him. They said that the inspectors wanted to talk to me. I have made a statement and signed it. You ask me whether they were Americans. No, it was the inspector of the Diario. You ask me who called me. That was Eduardo Mansur, family of my boss. I have heard that it is the son of Jossy Mansur. I do not know him.
To the questions of the public prosecutor the witness answers as follows:
I have seen the car in the morning of May 30th from Sunday to Monday. On Monday night, after I returned from my work, I’ve told Lorena that I’d seen a car standing still besides the road when I passed. I cannot recall on which day I saw the photo of the persons in the newspaper. The photo, that the police showed me, is the same as the photo that appeared in the Diario. You ask me how could I know whether I had recognized the persons from the photo in the newspaper or that I had seen them that night. The first time I saw the photo in the Diario I was astonished and I told that to my colleagues. You explain me that I have recognized the persons from their body size and postures. You ask me how I could have looked inside the car from my van. In the curve I had pass over a sand hill which caused my van to tilt over a little bit. That’s why I could see inside the car. I have recognized the car from the rims, the color and the transparent screens. You ask me if I could designate the persons in the car. Yes.
Observation: the designation of these persons in the Council chamber does not occur. The counselors Oomen and Zeppenfeldt object against this, since the three suspects are the only ones present in Council chamber who would qualify to be designated.
On further questions from Mr. De Bie, the witness answers as follows: I have not heard from Eric Mansur nor from anyone else anything about the father of Joran van der Sloot.
On further questions from Mr. Oomen, the witness answers: The police has only shown me one grey car.
Read out loud in Spanish, persisted and signed.
CARLOS PENATA RAMOS (<- his signature, so he has signed this statement!)
The public prosecutor once more requests the suspect to designate persons. That request is rejected.
The lawyer Mr. E. Zeppenfeldt, Counsellor of suspect S. Kalpoe was offered the opportunity to pose questions to the witness. He had no questions.
The suspects Joran van der Sloot, Deepak Kalpoe and Satish Kalpoe were asked if they had any questions for the witness. They had no questions.
