"That's why the national public prosecutor said that if this inquiry was launched now, maybe they would not have been made arguidos.
"Maybe that's why the inquiry happened then, why they were made arguidos eight days before the new laws came in."
The McCanns were declared suspects at a time when police were under increasing criticism.
The Policia Judiciaria claimed that forensic evidence proved Madeleine came to harm in her parents' holiday apartment in Praia da Luz.
But experts at the Forensic Science Service in Birmingham have since thrown doubt on this theory, saying the DNA samples were inconclusive.

Portuguese police have “little faith” that their British counterparts will be able to solve the mystery of Madeleine McCann’s disappearance in new interviews with her parents and their friends, it was claimed today.
Over the next few days Leicestershire police will be asked to interview Kate and Gerry McCann and the seven friends who dined with them on the night their daughter went missing, on behalf of the Portuguese authorities.

“Only the confrontation of all those involved in the case can shed any light upon the events of the May 3,” a high-ranking police source close to the investigation told the Portuguese newspaper 24 Horas.
But he expressed doubts that Leicestershire police could get the desired results, stating: “It will not be easy.”
The Portuguese investigators will only be allowed to sit in on the questioning and make some suggestions.
“It would be different if those involved were directly interrogated by our investigators and were targets of pressure,” said the source.
“But it is very unlikely that the Leicester police will question the statements of the people who will be interrogated.”
If the Portuguese team does not believe British police have answered all the questions, they may request members of the so-called Tapas Nine – the name given to Kate and Gerry McCann and the seven friends who dined with them on May 3 when Madeleine disappeared – return to the Algarve for further questioning.
Clarence Mitchell, the official spokesman for the McCanns, said: “It is a matter for Leicestershire police on their standards, but we have seen nothing has ever given us any cause for concern.

The "emotional and deeply sad" reunion was held at a hotel near Kate and Gerry McCanns' home in Rothley, Leicestershire around a fortnight ago. The Tapas Nine had wanted to keep the meeting secret but yesterday details of it were leaked by a source close to the McCanns.
"It was a private meeting in a hotel and was the first time that the group had collectively met since Madeleine's disappearance," said the source. "It was an opportunity for the group to discuss the events of the summer and to talk about what may happen next," the source continued. "They wanted to talk about possibly being interviewed by police again and what that may entail."
The willingness of the friends to meet dispels claims that some of them had fallen out with the couple and wanted to change their witness statements given to Portuguese police. "It was a show of solidarity under police claims that one or two had wanted to change their stories," said the source.
"That is just not the case and the meeting showed that. It was a meeting to express support by the friends and just to see each other again. They hadn't seen each other properly." But the meeting could anger Portuguese detectives who hope to travel to Britain to carry out interviews of the group in the coming days.
They believe that inconsistencies in original statements made by members of the Tapas Nine could hold the key to solving the mystery. Meanwhile a former Portuguese police chief said the McCanns should have been arrested as soon as their daughter disappeared for "abandoning" their children.
"When the parents told police that they went to dinner and left the children at home alone, they confessed to the crime of abandonment and should have been charged on that first day," said Paulo Pereira Cristovao in an interview with Portuguese daily newspaper 24 Horas. (zo is dat!)
"The penalty of abandonment is at least three years imprisonment," he stated reiterating previous calls for them to face prosecution for their actions. Mr Pereira Cristovao, 38, left the Policia Judiciaria (PJ) in September and now heads the Portuguese Association for Missing Children (APCD), which leads the hunt for missing children in Portugal.
When Madeleine disappeared on May 3 from the hotel apartment in Praia da Luz she became the ninth official missing child in the country but Mr Pereira Cristovao said her case would not be considered by the organisation. "I was asked what I thought about inviting the McCanns to the APCD. I said no, because they're suspects," said Mr Pereira Cristovao.

Bar Council chairman Timothy Dutton QC suggested in a speech in London that "British justiceî would have been more effective in discovering the truth about her disappearance. He said this was because UK police and lawyers would have used a "methodical approach" to establish facts and would "carefully test" evidence before reaching conclusions.

He added: "We're sure she was abducted and we are very, very close to finding those responsible." The claim caused an embarrassed Clarence Mitchell, the McCann's official spokesman, to brief the media that the private detective had simply got "carried away". The agency claims to have around 35 investigators working on the case and is being paid £50,000 a month by the Find Madeleine Fund.
Mr Marco also promised last month that he would find Madeleine, who disappeared on 3 May from a holiday apartment in Praia da Luz in the Algarve in Portugal, before Metodo 3's six-month contract runs out next March. Mr Marco said: "I have always said publicly Madeleine is alive. I have to believe it 100 per cent because I know how to look for living people, not dead ones. But I have no proof Madeleine is alive.
"We have proof of her movements after her kidnap and we know she was alive the day after her disappearance. We are not certain she left Portugal. "I talk of certainties because we know which group may have her or could have kidnapped her to then sell her on to others." He continued: "One of the things that makes us believe Madeleine is alive is that every day she's worth more to them. It's obviously not a kidnap carried out by professionals for economic reasons.
"A professional kidnapper would have done something with Madeleine by now. He would have given her back or left her." Metodo 3 has been criticised by Portuguese police as "small fry" and "irrelevant". Relatives of Robert Murat, who remains an official suspect in the case, have accused the agency of trying to frame him by pressuring witnesses into changing their statements.
In the interview with the Spanish newspaper-Metro, Mr Marco added: "It's the highest pressure case I've ever had to deal with, because of the press and because of my own family. "When I get home at night, my children ask me, 'Have you found Madeleine yet, daddy?'"
Dismissing the suggestion of any involvement by the McCanns, who were declared official suspects in their daughter's disappearance after she vanished from the Ocean Club apartment complex, he said: "You only have to spend five minutes with them to realise they've got nothing to do with this.
"To this day there's no proof of any traces of blood in the flat. In the boot of Gerry and Kate's hire car, so people say, there's traces of a tiny hair that could be Madeleine's. "But that would be completely logical and normal being the family's car."
