(zie p. 31, p.32.) Deze twee zaken worden in de skeleton argument uitgebreid behandeld. .Deze twee zaken worden ook besproken in een journalistiek document:

The Swedish government must now comply with the Human Rights Committees decision in the al-Zari case. The committee has indicated that monetary compensation for the petitioner is one appropriate remedy. Following the Agiza decision, Human Rights Watch communicated to the authorities in Sweden a detailed list of measures that would indicate compliance with that decision, including: granting monetary compensation; permitting a new application for asylum in Sweden; and legislative changes prohibiting the use of diplomatic assurances. To date, Sweden has failed to implement any of these recommendations.
Dit is dus, onder andere, reden om te verzetten tegen uitzetting naar zweden.Onderdeel van het gehele mensenrechten argument/bezwaar is inderdaad die van de doodstraf: (punt 98 in de skeleton argument)
It is submitted that there is a real risk that, if extradited to Sweden, the US will
seek his extradition and/or illegal rendition to the USA, where there will be a
real risk of him being detained at Guantanamo Bay or elsewhere, in conditions
which would breach Article 3 of the ECHR. Indeed, if Mr. Assange were
rendered to the USA, without assurances that the death penalty would not be
carried out, there is a real risk that he could be made subject to the death
penalty. It is well-known that prominent figures have implied, if not stated

Zweden heeft dus een zwak verleden op het gebied van uitleveren en er gaan stemmen in Amerika op voor de doodstraf. Die kans lijkt mij ook verschrikkelijk klein, en hoogst onlogisch en onverstandig voor het imago van de USA. Toch zou je een slecht advocaat zijn als je er geen rekening mee houdt. Zeker gezien de omstandigheden waarin private manning wordt vastgehouden, wat door velen als marteling wordt gezien. (

Dit argument van de doodstraf is echter maar een zeer klein onderdeel van het gehele argument. De 7 hoofdargumenten zijn:
(1) It is not accepted that the Swedish prosecutor is authorised to issue European Arrest Warrants (EAW).
(2) European arrest warrants should only be issued for the purposes of prosecution, and it has been made very clear that Mr. Assange is wanted for further questioning.
(3) There has been abuse of process: non-disclosure by the Swedish Prosecutor.
(4) There has been a further abuse of process: the conduct of the prosecution in Sweden.
(5) The offences alleged in the EAW are not of serious nature in the UK, as they must be to constitute extradition offences.
(6) Mr Assange reserves the right to argue extraneous considerations.(section 13 of the Act).
(7) Mr. Assange reserves the right to argue that his extradition may be incompatible with Articles 3, 6, 8 and 10 of the European Commission on Human Rights. (

Het doodstrafargument valt dus onder de 7e.
Je stelde
'Kortom, Assange' ego zal wel weer media aamdacht nodig hebben gehad.' Als je dat vol wil houden, zal je uit moeten leggen waarom deze argumenten geen enkele kans van slagen hebben bij een rechter. Je kan de advocaten immers niet verwijten dat ze elk mogelijk argument inzetten ter bescherming van hun client. DAt de media dat het interessantst vinden kan Assange ook niks aan doen. Zoals anderen ook al aangaven maakt hij zelf geen groot punt van zijn angst voor de doodstraf.
