The Rogatory Letter Saga

The Home Office in October 2007 raised some questions to Eurojust and the Letter was sent back to the Portugal, to the Public Prosecution Service.

The rogatory letter was then sent, a second time back to the Home Office, on the 7th January 2008 by the Public Prosecutor José Cunha de Magalhães e Menezes, the responsible for the administration of the inquest through the EU body, Eurojust.

In February 2008 the Public Prosecutor of the Portimão's court, Magalhães e Menezes as well as the team that conducted the investigations concerning Madeleine McCann were losing their patience with the delay of the British authorities in giving green light to the execution of the rogatory letter. "This is reaching unacceptable proportions. In a case like this, if there was cooperation, the rogatory letter would be fulfilled in less than a month. This is going on since October last year with the English returning the letter and making mere bureaucratic demands. We already sent a new rogatory more than two weeks ago and the only thing we have is the silence of the police and diplomatic authorities" and "Like this is difficult to make an investigation", concluded the source connected to the process.

The Forensics Delay

Almost at the end of April 2008 the Judiciary Police is still waiting the final report of the analyses of the biological evidences which were sent to the Forensic Science Service [FSS], a laboratory in Birmingham, England on August 2007. The same laboratory which was supposed to do DNA analyses in less than 36 hours. The remaining analyses done by the Instituto Nacional de Medicina Legal [INML] - National Institute of Legal Medicine were completed after 1 month.

The first results of the FSS analyses to the evidences taken from the McCanns' apartment in Praia da Luz, their hire car and other parts of the Mark Warner holiday complex, were inconclusive. A senior source close to the investigation reportedly said: "There is no reason to change the direction of the investigation and everything that has emerged indicates that it is focusing where it should. "This is a very complex case and forensics are rarely conclusive on their own, but the new material adds to the existing picture that has been built up by police and fills in a few more pieces of the jigsaw." Sources added that the tests raised more questions into the explanations offered by the McCanns for the original results, thought to have shown traces of Madeleine's blood in the family apartment and of her bodily fluids in the McCanns' hire car.

Almost a year after Maddie's disappearance, many questions remain without an answer, in a process in which the secrecy of justice was extended for a second time.

Ik hoop eigenlijk dat de PJ in alle stilte alle bewijs verzamelt en dan ineens met een afsluiting komt van deze zaak, dus gewoon een gag-order handhaaft totdat ze er daar uit zijn.
Ik denk dus dat er geen vertragig is maar echt totale stilte voor de storm, misschien is het wel een geval van de wens is de vader van de gedachte hoor.

Most people my age will remember running around freely when they were kids and getting up to all sorts of mischief with their mates.

Strange then that now we are parents we don’t afford our own children the same freedom and trust. We feel guilty if we let them on a bike without a crash helmet on.

Why this is so? Maybe it’s got something to do with the mass media where stories such as the abduction of Madeleine McCann are played over and over again in minute detail.

To cross phone data is now a team task directed by the director Guilhermino Encarnação and by the coordinator Paulo Rebelo.

Police and banks in silence

But apart from the phone calls the public prosecutor Magalhães e Menezes still waits the register of the bank transactions made by all people that dinned in the Tapas Bar. The objective is to know where the arguidos and the main witnesses were in the day the child disappeared.

"Although that request was made informally to the British police more than seven months ago and officially requested afterwards in the rogatory letter ( five months ago) the truth is that we did not have yet any reply", said to the 24 Horas a police source. Officially Encarnação and Paulo Rebelo are laconic about the case. None of them say anything because the process "is in secret of justice".

Amaral kan straks goed cashen, als eenmaal de Secrecy Law wordt opgeheven, ik gun 't hem ook nog. De Bristse pers heeft hem finaal de grond ingeboord, een aanklacht tegen een aantal kranten zou ook nog kunnen. De McCanns én hun vriendjes én iedereen daarom heen zijn nog niet van hem af, Amaral weet veel, heel veel...

'We would have loved to have spoken out really and just put the record straight, but believed that the investigation would be the best way of finding Madeleine if we co-operated with the police and complied by their rules and regulations.'


Her comments were made in the documentary Searching for Madeleine, which is due to be broadcast tonight on Radio 4.

Madeleine went missing from her family's holiday apartment in Praia da Luz, Portugal, on May 3 last year.

Although the McCanns remain arguidos - suspects - in their daughter's disappearance, they deny any wrongdoing.

Mrs Oldfield said: 'Anyone with an ounce of common sense would be able to see they couldn't have done it.'

Earlier this month, the McCanns accused Portuguese police of a 'blatant' attempt to smear them after transcripts from police interviews with the couple were leaked through journalist Nacho Abad, of Spanish television programme Ana Rosa Quintana.

On the day the couple, from Rothley, Leicestershire, were in Brussels to launch a bid for a Europe-wide missing-child alert system, it emerged that Madeleine had asked her mother the night before she disappeared: "Mum, why didn't you come when we were crying last night?".

Kate McCann told police of the conversation in her first interview after her daughter went missing.

She added: "Gerry and I talked about it for several minutes and decided to watch over the children more carefully at night."

On May 2, Mrs Oldfield was in the next-door flat - on the other side of Madeleine's wall - all evening and heard no crying.

The Tapas Seven - Mrs Oldfield and her husband Matthew, Jane Tanner, her partner Dr Russell O'Brien, David Payne, his wife Fiona, and her mother Dianne Webster - took it in turns to make regular, 20-minute checks on the children during the night.

After the leak, the McCanns urged the Portuguese Justice Ministry to launch an internal investigation into the disclosures.

At the time, the family's spokesman Clarence Mitchell said: "Kate and Gerry have been subjected to leaks and smears from day one and I'm afraid this has all the hallmarks of yet another poor attempt to influence the headlines on the very day that they are seeking to achieve some good in Europe."

His comments prompted an angry response from Portuguese police who said the claims were "baseless".

A spokesman for the PJ said: "The Policia Judiciaria regrets the baseless intervention of the spokesman above all at a moment when significant moves were being made in the investigation."

From within Portugal, the police are coming under pressure to make public the case files which, under judicial secrecy laws, currently remain closed.

Antonio Marinho e Pinto, President of the Portuguese Order of Lawyers, told the BBC: "There are strong reasons to fear that judicial secrecy is being used... to conceal the fact that the police have gone down a blind alley and don't have a way out."

Maar weet je, ik reageer daar niet eens meer op. Er is zoveel rubbish nu aan de gang, was al te verwachten. Ook de BBC heeft dat verhaal over die lekken. Iets wat nu wel bekend is dat die lek van onlangs in Spaanse hoek moet worden gezocht, wie zouden dat nou zijn???? Eén van de vele bronnen. When are you going to REALLY apologise for your incredible statement that the public prosecutor may have been "hasty" in making the McCanns arguidos? When are you going to stop mouthing platitudes about all avenues of investigation being open in the Madeleine McCann case? That is laughable. The investigation thus far has ruled out the possibility that Madeleine was abducted, and you know it. The reason this case hasn't already been solved is because, under political pressure, the PJ kept investigating that angle for so long.

I have enormous sympathy for them losing a child but I am getting fed up of them blaming everyone else for their misfortune.

I’m sorry, in any language that’s child neglect. So instead of touring Europe proposing amber alert systems, I would like them to clearly just send out one message to all parents: NEVER EVER MAKE OUR MISTAKE AND LEAVE YOUR CHILDREN ALONE IN A STRANGE HOTEL ROOM.

And, by the way, I’m not being heartless, just honest.

I am also fed up to the back teeth of the smears and counter smears from both camps, so why don’t the McCanns and the Tapas Seven just shut up, get on the plane, return to Portugal and do the police reconstruction? At the same time, why don’t the Portuguese plods stop spinning and start analysing and either charge them formally or remove their official suspect status?

It’s nearly a year since little Madeleine went missing and the focus needs to return to her, not the other characters in this sorry saga.

The CM discovered that the book is almost finished and contains explosive elements about the investigation concerning the disappearance of the British girl in Praia da Luz, Algarve, the 3rd of May last year.Apart from important data about what happened in that night in the Ocean Club, the "several manoeuvres of counter information" around the big media case of the last years will be revealed.

"It won't be something speculative but factual, with reports of someone who lived the case one hundred per cent", referred to the CM Paulo Santo, the defence lawyer of the PJ's inspector who is in the process of retirement. The lawyer of Gonçalo Amaral, hired to defend his image after the controversy regarding his removal from the coordination of Maddie's case, confirmed to the CM that there is already a publisher interested in the book.

"The fact that the retirement process is not yet fulfilled and the secrecy of justice that are in place at this moment stipulate the publishing of the book" said the lawyer of Gonçalo Amaral. The book will try to put an end to Maddie's case.

Het lijkt er wel op Suko, het tij is aan het keren en de mensen rond de McCanns lijken wel zonder mogelijkheden te zitten om alles wat krom is recht te praten, als je alles stript tot de naakte feiten zoals de bovenstaande schrijvers in jouw links doen wat blijft er dan over?
Een upper class stel dat de kinderen alleen heeft gelaten en rustig is gaan dineren terwijl op de één of andere manier hun oudste kind is weggelopen/meegenomen of erger is verdonkeremaand door de ouders zelf, al het andere wat er omheen is gepubliceerd is valse lucht, die mensen behoren onder toezicht gesteld te worden van child protective services en moeten hun ogen uit hun kop schamen vanwege hun gedrag, niet meer en niet minder.

Asked by interviewer Steve Kingstone whether he is convinced the police are still trying to find his daughter, Mr McCann replies: "I don't know because we don't have that information.

"Obviously we'd like to know. We'd like to know why the files are still secret almost a year on with a change in the penal code.

"We would like to know what is being done to find Madeleine.

"We'd like know who has been eliminated from the inquiry and on what grounds and what leads are still being followed.

"We've always said we want to leave no stone unturned and to do that we need to know which stones have already been overturned."

Mrs Oldfield, a member of the so-called "Tapas Seven" – the friends who were dining with the McCanns in Praia da Luz, Portugal, on the night of May 3 last year when Madeleine disappeared – also launched a furious attack on police in the programme.

"They leaked information and these rumours that have flown around for the past year – it is outrageous," she said.

"We were asked to comply with the Portuguese judicial secrecy laws (under) which we were made to understand that we could face two years in prison for speaking out.

"So, as a group, we have not said anything from day one.

"There have been all these rumours flying around and leaks from sources close to the PJ which we haven't been able to refute.

"We would have loved to have spoken out really and just put the record straight, but believed that the investigation would be the best way of finding Madeleine if we co-operated with the police and complied by their rules and regulations."

Her comments echo sentiments expressed by the McCanns' spokesman Clarence Mitchell earlier this month.

He accused police of a "blatant" attempt to smear them after transcripts from police interviews with the couple were leaked to foreign media, something the PJ expressly denied.

Mrs Oldfield also made a staunch defence of the couple against any suggestion they might have been involved in their daughter's disappearance.

She said: "I was there on the night – it was agonising.

The first anniversary of the disappearance of Madeleine McCann will be marked next week with a two-hour television documentary which is the highlight of a carefully stage-managed publicity offensive.

The fly-on-the wall documentary on ITV1 of Gerry and Kate McCann has been organised by Clarence Mitchell, their official spokesman. The Portuguese press first referred to him as the "man in the shadows" when he took the job full-time in Praia da Luz in September.

The newspapers were reporting the (as usual) private views of the Portuguese police that Mitchell, 47, had been sent in by Gordon Brown, no less - when he was Chancellor - to spy on the investigation, which had been portrayed in Britain as amateur and cack-handed.

But the Portuguese media were wrong on both counts. Mitchell would have had at best only a nodding acquaintance with junior ministers, let alone Mr Brown. As director of media monitoring at the Central Office of Information, he was a back room boy but has never been in the shadows of the police operation.

The former BBC television reporter has loved being centre stage before the cameras in an investigation that has transfixed the world's media. "He is on the TV much more than he ever was when he worked for the BBC," said one former colleague.

So much so that photographers regularly have to shout at Mitchell to get out of the way when they are taking pictures of the McCanns. He remains at his fixed point by their shoulder even during photo-shoots, bucking the trend of media minders who avoid being photographed at all costs.

Mitchell has become such a familiar figure in his open-necked pink shirts that he is recognised in the street and is stopped so often on the forecourts of petrol stations that he now jokes it is because he has forgotten to pay his bill.

After almost 30 years as a journalist, he knows what makes a story and has been extraordinarily successful in maintaining a strong interest in Madeleine.

When interest has faltered he has invariably constructed a story or recruited a big name - even the American First Lady, Laura Bush, is on-side - to a campaign driven by parents who accepted early on that the media was a necessary partner.

Nevertheless, the documentary next Wednesday has provoked controversy because ITV1 has scheduled it against the BBC's The Apprentice as part of its ratings war.

The move has led to the accusation that Mitchell has allowed the parents to be exploited by a commercial broadcaster.

The fact that Mentorn, the production company making the programme, has given £10,000 to the Find Madeleine fund has not diminished the fuss: the money will be more than recouped from syndication.

ITV1, with the help of Mitchell, has kept other media organisations from the McCanns during the five weeks of the access deal with Mentorn.

The company has secured unseen footage of Mrs McCann, 40, her husband, 39, and their three-year-old twins behind the door of their home in Rothley, Leics.

It includes Mrs McCann breaking down in tears as she recalls the night Madeleine went missing. But Mitchell will be undeterred by the barbs, believing the two-hour documentary the best way to ensure that the search for Madeleine goes global again. This is what he is paid to do.

He always wanted to be a journalist and after O-levels at Friern Barnet School, Finchley, where he was head boy, he joined the Barnet & Potters Bar Times and then a BBC training scheme.

In a varied career he covered the Soham murders and, for two years from 2003, the Iraq war.

He was also on the royal beat when he was known - not very imaginatively - as "Clarence House".

But it was as a presenter on various BBC news programmes that he hoped to make his career after years on the road. His spell doing hourly bulletins on News 24 is best remembered for him sleeping through a 3am slot, which had to be filled by a somewhat dishevelled producer.

He became close to the McCanns after being sent twice by the Foreign Office to look after them when there were 40 camera crews outside their Portuguese apartment.

As a father of three children, aged two to 11, he has gone through the same agonies as many other parents who feared it could have happened to them.

His £70,000 salary, equivalent to what he earned in the Civil Service, is being paid by the double-glazing magnate Brian Kennedy, who has bankrolled much of the McCann campaign.

Surrendering his Civil Service pension will be compensated by the future benefits of his role in helping to make Madeleine's the most heavily reported missing-person case in modern history.

Offers are coming in for book, broadcast, and lecture circuit opportunities when he returns to "ordinary life" - and even Mohamed Fayed is rumoured to be interested in hiring him.

Mitchell divides his time between his home in Bath, London, and Rothley and speaks to the McCanns every day. They are grateful to him for raising the profile of the search across Europe and North Africa, through visits to Morocco, Italy, Spain and Germany.

But the revelation that they were flying in a private jet was a bear trap that Mitchell should have spotted, and the couple flew home from a trip to Portugal on easyJet.

Mitchell was, as usual, only a few feet away from the couple when they met the Pope in St Peter's Square.

He was so overcome he reached out to grasp the papal hand and was rewarded with a blessing and a set of rosary beads from one of the priests in the Pontiff's retinue.

While calm in public, he has often blown up behind the scenes at reporters and is occasionally guilty of overdoing briefings.

In the last few weeks his public approach has changed, bluntly blaming the Portugese police for leaking statements from Mr and Mrs McCann that revealed Madeleine was left crying the night before she vanished.

Mitchell moved from the shadows to being branded a "manipulative liar" by the police and the row ensured once more that the McCanns returned to front pages across Europe. It was a job well done by the man at the centre of the story in his own right.

"I do not believe they are putting Madeleine at risk, I completely disagree with that," he said. "Whoever says that is absolutely foolish - it is the only way she is going to be found.

"The moment that Elizabeth was abducted, the only way we were going to find her was to get as many people as possible out looking for her.

Mr Smart said he had talked to a number of parents of missing children over the years and asked them if they think their child is still alive.Some said definitely yes, some weren't sure, while other were convinced they were dead.

"Gerry and especially Kate said, 'I do feel like she is out there'," he said.

"I think it is ridiculous that some of the stupid comments say she is not emotional enough. I have met her and talked to her on the phone.

"Kate is a wonderful mother and cares about her children and would do anything to bring Madeleine home."

Het is natuurlijk dieptriest dit verhaal. Maar er zijn natuurlijk verschillen. Elizabeth Smart is thuis ontvoerd, zij was toen 14jr. Madeleine McCann was nog geen 4jr, alleen met de twins van net 2jr. in een vreemde omgeving, avond aan avond. In een apartement wat niet was afgesloten en gelegen aan de openbare weg. Men willde geen oppas, geen 'vreemden' over de vloer, overdag maakte dat zeker niet uit, (waar de kids veelal werden gestald) waren dezelfde nanny's but never mind. Ook 's avonds naar de crèche brengen was kennelijk teveel moeite. Niets wijst op een ontvoering en de wisselende verklaringen in interviews en docu's duiden op betrokkenheid van de McCanns (en mogelijk anderen) wat betreft de vermissing/dood van Madeleine. Dáár gaat het om. Niet om ontvoeringen van tig andere veelal wat oudere kinderen. En wat weet die vader Smart eigenlijk van de achtergronden van dit drama. Alleen wat gesprekjes met de McCanns, nee...dan ben je goed ingelicht, not! Ik neem het hem niet kwalijk, genereert weer publiciteit, hij en z'n dochter ijveren voor een national sex offender registry bill en nog een aantal kwesties wat betreft ontvoerde en misbruikte kinderen. Maar als je je heel jonge kinderen gewoon alleen laat (up for the taking), je vervolgens niet direct de politie belt, zelf niet eens een poot uitsteekt om te zoeken, niet wenst mee te werken, integendeel, dan helpt daar echt geen Alert tegen. Ik zou bijna willlen stellen dat de McCanns schade hebben toegebracht in deze, ouders die weigeren kinderen bescherming (en nota bene zelf verdachten zijn) te bieden moeten verre van any Alert-campagnes blijven!

Voor de rest een ongelogelijk hoeveelheid crap in de bekende bladen, deels om weer gelden te genereren, deels om zelf weer in de publiciteit te komen, deels om hun onschuld te bewijzen, deels om het publiek te verwarren. Maar natuurlijk ook omdat ze bang zijn; bang voor boeken/docu's die straks uitkomen (Amaral en misschien ook Murat), bang misschien wat de resultaten zijn van de verhoren, bang voor de uitslag (volgens mij al bekend maar blijft nog ff in een la liggen) van het DNA-materiaal, bang dat het tij gaat keren > dat ze misschien voor lange lange tijd Arguido's blijven (als ze bv weigeren naar Portugal te gaan qua reconstructie) en kunnen dan niet zeggen/doen wat ze willen...maar eens zal de waarheid naar boven komen, zal misschien lang duren, maar ik geloof er wel in.

Inderdaad, dit is te groot om in de vergetelheid te verdwijnen of om onder het tapijt te stoppen, eens zal het toch uitkomen wat er nu precies is gebeurd, dit is zo'n zaak die altijd levendig gehouden zal worden juist omdat er zo'n heisa omheen is geweest, de langste adem zal winnen.

The parents of Madeleine McCann have again said they believe she is still alive almost a year after she went missing.

McCanns still holding out hopeThe youngster's parents, Kate and Gerry McCann, told a television documentary that they felt more confident about their daughter being found alive after a trip to the US.

At the end of last month the McCanns, from Rothley, Leicestershire, visited America to see how the country's Amber Alert system was used to track down missing children.

Mr McCann told the documentary: "We've spoken to a lot of people who said this is a country (America) that has more than two stereotypical kidnappings per week and of those only 40% to 50% end up being found dead and, most importantly of all, the younger the child, the less likelihood of serious harm.

"And these are people experienced in investigations saying 'I really believe she's out there', and I think, yes, there was a first time where I've thought, I really believe it."

Mr and Mrs McCann are still searching for Madeleine, who was three years old when she disappeared from their holiday apartment in Praia da Luz, Portugal, on May 3 last year.

During their visit to the US, the couple were filmed meeting Ed Smart, whose daughter Elizabeth was missing for nine months before being found alive and well.

Mr Smart campaigned to keep his daughter's case in the media until she was recognised in the street.

Madeleine missing since May 2007At the end of the trip, Mrs McCann said: "I feel more positive about the chances of Madeleine being out there and I feel more positive about the likelihood of being able to implement an Amber Alert system within Europe."

But while the couple have not given up hope of finding Madeleine, Mrs McCann said that some days remained "desperate".

In a conversation with Mr Smart filmed for the documentary, she said: "We're okay. Some good days and some desperate days still."

Mr McCann added: "We're bearing up really, still working away behind-the-scenes and keep plugging away and keep hoping for a breakthrough really."
