The Rogatory Letter Saga

The Home Office in October 2007 raised some questions to Eurojust and the Letter was sent back to the Portugal, to the Public Prosecution Service.

The rogatory letter was then sent, a second time back to the Home Office, on the 7th January 2008 by the Public Prosecutor José Cunha de Magalhães e Menezes, the responsible for the administration of the inquest through the EU body, Eurojust.

In February 2008 the Public Prosecutor of the Portimão's court, Magalhães e Menezes as well as the team that conducted the investigations concerning Madeleine McCann were losing their patience with the delay of the British authorities in giving green light to the execution of the rogatory letter. "This is reaching unacceptable proportions. In a case like this, if there was cooperation, the rogatory letter would be fulfilled in less than a month. This is going on since October last year with the English returning the letter and making mere bureaucratic demands. We already sent a new rogatory more than two weeks ago and the only thing we have is the silence of the police and diplomatic authorities" and "Like this is difficult to make an investigation", concluded the source connected to the process.

The Forensics Delay

Almost at the end of April 2008 the Judiciary Police is still waiting the final report of the analyses of the biological evidences which were sent to the Forensic Science Service [FSS], a laboratory in Birmingham, England on August 2007. The same laboratory which was supposed to do DNA analyses in less than 36 hours. The remaining analyses done by the Instituto Nacional de Medicina Legal [INML] - National Institute of Legal Medicine were completed after 1 month.

The first results of the FSS analyses to the evidences taken from the McCanns' apartment in Praia da Luz, their hire car and other parts of the Mark Warner holiday complex, were inconclusive. A senior source close to the investigation reportedly said: "There is no reason to change the direction of the investigation and everything that has emerged indicates that it is focusing where it should. "This is a very complex case and forensics are rarely conclusive on their own, but the new material adds to the existing picture that has been built up by police and fills in a few more pieces of the jigsaw." Sources added that the tests raised more questions into the explanations offered by the McCanns for the original results, thought to have shown traces of Madeleine's blood in the family apartment and of her bodily fluids in the McCanns' hire car.

Almost a year after Maddie's disappearance, many questions remain without an answer, in a process in which the secrecy of justice was extended for a second time.

Ik hoop eigenlijk dat de PJ in alle stilte alle bewijs verzamelt en dan ineens met een afsluiting komt van deze zaak, dus gewoon een gag-order handhaaft totdat ze er daar uit zijn.
Ik denk dus dat er geen vertragig is maar echt totale stilte voor de storm, misschien is het wel een geval van de wens is de vader van de gedachte hoor.

Most people my age will remember running around freely when they were kids and getting up to all sorts of mischief with their mates.

Strange then that now we are parents we don’t afford our own children the same freedom and trust. We feel guilty if we let them on a bike without a crash helmet on.

Why this is so? Maybe it’s got something to do with the mass media where stories such as the abduction of Madeleine McCann are played over and over again in minute detail.

To cross phone data is now a team task directed by the director Guilhermino Encarnação and by the coordinator Paulo Rebelo.

Police and banks in silence

But apart from the phone calls the public prosecutor Magalhães e Menezes still waits the register of the bank transactions made by all people that dinned in the Tapas Bar. The objective is to know where the arguidos and the main witnesses were in the day the child disappeared.

"Although that request was made informally to the British police more than seven months ago and officially requested afterwards in the rogatory letter ( five months ago) the truth is that we did not have yet any reply", said to the 24 Horas a police source. Officially Encarnação and Paulo Rebelo are laconic about the case. None of them say anything because the process "is in secret of justice".

Maar ja, patstelling dus, als je niks wil zeggen dat wordt men Arguido en vervolgens het recht op zwijgen. Amaral kan straks goed cashen, als eenmaal de Secrecy Law wordt opgeheven, ik gun 't hem ook nog. De Bristse pers heeft hem finaal de grond ingeboord, een aanklacht tegen een aantal kranten zou ook nog kunnen. De McCanns én hun vriendjes én iedereen daarom heen zijn nog niet van hem af, Amaral weet veel, heel veel...

'So, as a group, we have not said anything from day one. There have been all these rumours flying around and leaks from sources close to the PJ (Policia Judiciaria), which we haven't been able to refute.

'We would have loved to have spoken out really and just put the record straight, but believed that the investigation would be the best way of finding Madeleine if we co-operated with the police and complied by their rules and regulations.'


Her comments were made in the documentary Searching for Madeleine, which is due to be broadcast tonight on Radio 4.

Madeleine went missing from her family's holiday apartment in Praia da Luz, Portugal, on May 3 last year.

Although the McCanns remain arguidos - suspects - in their daughter's disappearance, they deny any wrongdoing.

Mrs Oldfield said: 'Anyone with an ounce of common sense would be able to see they couldn't have done it.'

Earlier this month, the McCanns accused Portuguese police of a 'blatant' attempt to smear them after transcripts from police interviews with the couple were leaked through journalist Nacho Abad, of Spanish television programme Ana Rosa Quintana.

On the day the couple, from Rothley, Leicestershire, were in Brussels to launch a bid for a Europe-wide missing-child alert system, it emerged that Madeleine had asked her mother the night before she disappeared: "Mum, why didn't you come when we were crying last night?".

Kate McCann told police of the conversation in her first interview after her daughter went missing.

She added: "Gerry and I talked about it for several minutes and decided to watch over the children more carefully at night."

On May 2, Mrs Oldfield was in the next-door flat - on the other side of Madeleine's wall - all evening and heard no crying.

The Tapas Seven - Mrs Oldfield and her husband Matthew, Jane Tanner, her partner Dr Russell O'Brien, David Payne, his wife Fiona, and her mother Dianne Webster - took it in turns to make regular, 20-minute checks on the children during the night.

After the leak, the McCanns urged the Portuguese Justice Ministry to launch an internal investigation into the disclosures.

At the time, the family's spokesman Clarence Mitchell said: "Kate and Gerry have been subjected to leaks and smears from day one and I'm afraid this has all the hallmarks of yet another poor attempt to influence the headlines on the very day that they are seeking to achieve some good in Europe."

His comments prompted an angry response from Portuguese police who said the claims were "baseless".

A spokesman for the PJ said: "The Policia Judiciaria regrets the baseless intervention of the spokesman above all at a moment when significant moves were being made in the investigation."

From within Portugal, the police are coming under pressure to make public the case files which, under judicial secrecy laws, currently remain closed.

Antonio Marinho e Pinto, President of the Portuguese Order of Lawyers, told the BBC: "There are strong reasons to fear that judicial secrecy is being used... to conceal the fact that the police have gone down a blind alley and don't have a way out."

Dat artikel over die listening-service (die er er niet was omdat de apartementen buiten de hekken gebouwd zijn, wel een oppasservice (zelf halen/brengen) en Nanniy's, in de prijs inbegrepen, wilde ze niet) staat er nog wel in de DM, is alleen verplaatst > hier dus. Maar weet je, ik reageer daar niet eens meer op. Er is zoveel rubbish nu aan de gang, was al te verwachten. Ook de BBC heeft dat verhaal over die lekken. Iets wat nu wel bekend is dat die lek van onlangs in Spaanse hoek moet worden gezocht, wie zouden dat nou zijn???? Eén van de vele bronnen. Het is werkelijk één massale aanval op het onderzoek én dus de PJ. When are you going to REALLY apologise for your incredible statement that the public prosecutor may have been "hasty" in making the McCanns arguidos? When are you going to stop mouthing platitudes about all avenues of investigation being open in the Madeleine McCann case? That is laughable. The investigation thus far has ruled out the possibility that Madeleine was abducted, and you know it. The reason this case hasn't already been solved is because, under political pressure, the PJ kept investigating that angle for so long.

I have enormous sympathy for them losing a child but I am getting fed up of them blaming everyone else for their misfortune.

I’m sorry, in any language that’s child neglect. So instead of touring Europe proposing amber alert systems, I would like them to clearly just send out one message to all parents: NEVER EVER MAKE OUR MISTAKE AND LEAVE YOUR CHILDREN ALONE IN A STRANGE HOTEL ROOM.

And, by the way, I’m not being heartless, just honest.

I am also fed up to the back teeth of the smears and counter smears from both camps, so why don’t the McCanns and the Tapas Seven just shut up, get on the plane, return to Portugal and do the police reconstruction? At the same time, why don’t the Portuguese plods stop spinning and start analysing and either charge them formally or remove their official suspect status?

It’s nearly a year since little Madeleine went missing and the focus needs to return to her, not the other characters in this sorry saga.

"It won't be something speculative but factual, with reports of someone who lived the case one hundred per cent", referred to the CM Paulo Santo, the defence lawyer of the PJ's inspector who is in the process of retirement. The lawyer of Gonçalo Amaral, hired to defend his image after the controversy regarding his removal from the coordination of Maddie's case, confirmed to the CM that there is already a publisher interested in the book.

"The fact that the retirement process is not yet fulfilled and the secrecy of justice that are in place at this moment stipulate the publishing of the book" said the lawyer of Gonçalo Amaral. The book will try to put an end to Maddie's case.

Het lijkt er wel op Suko, het tij is aan het keren en de mensen rond de McCanns lijken wel zonder mogelijkheden te zitten om alles wat krom is recht te praten, als je alles stript tot de naakte feiten zoals de bovenstaande schrijvers in jouw links doen wat blijft er dan over?
Een upper class stel dat de kinderen alleen heeft gelaten en rustig is gaan dineren terwijl op de één of andere manier hun oudste kind is weggelopen/meegenomen of erger is verdonkeremaand door de ouders zelf, al het andere wat er omheen is gepubliceerd is valse lucht, die mensen behoren onder toezicht gesteld te worden van child protective services en moeten hun ogen uit hun kop schamen vanwege hun gedrag, niet meer en niet minder.

Asked by interviewer Steve Kingstone whether he is convinced the police are still trying to find his daughter, Mr McCann replies: "I don't know because we don't have that information.

"Obviously we'd like to know. We'd like to know why the files are still secret almost a year on with a change in the penal code.

"We would like to know what is being done to find Madeleine.

"We'd like know who has been eliminated from the inquiry and on what grounds and what leads are still being followed.

"We've always said we want to leave no stone unturned and to do that we need to know which stones have already been overturned."

Mrs Oldfield, a member of the so-called "Tapas Seven" – the friends who were dining with the McCanns in Praia da Luz, Portugal, on the night of May 3 last year when Madeleine disappeared – also launched a furious attack on police in the programme.

"They leaked information and these rumours that have flown around for the past year – it is outrageous," she said.

"We were asked to comply with the Portuguese judicial secrecy laws (under) which we were made to understand that we could face two years in prison for speaking out.

"So, as a group, we have not said anything from day one.

"There have been all these rumours flying around and leaks from sources close to the PJ which we haven't been able to refute.

"We would have loved to have spoken out really and just put the record straight, but believed that the investigation would be the best way of finding Madeleine if we co-operated with the police and complied by their rules and regulations."

Her comments echo sentiments expressed by the McCanns' spokesman Clarence Mitchell earlier this month.

He accused police of a "blatant" attempt to smear them after transcripts from police interviews with the couple were leaked to foreign media, something the PJ expressly denied.

Mrs Oldfield also made a staunch defence of the couple against any suggestion they might have been involved in their daughter's disappearance.

She said: "I was there on the night – it was agonising.

The first anniversary of the disappearance of Madeleine McCann will be marked next week with a two-hour television documentary which is the highlight of a carefully stage-managed publicity offensive.

The fly-on-the wall documentary on ITV1 of Gerry and Kate McCann has been organised by Clarence Mitchell, their official spokesman. The Portuguese press first referred to him as the "man in the shadows" when he took the job full-time in Praia da Luz in September.

The newspapers were reporting the (as usual) private views of the Portuguese police that Mitchell, 47, had been sent in by Gordon Brown, no less - when he was Chancellor - to spy on the investigation, which had been portrayed in Britain as amateur and cack-handed.

But the Portuguese media were wrong on both counts. Mitchell would have had at best only a nodding acquaintance with junior ministers, let alone Mr Brown. As director of media monitoring at the Central Office of Information, he was a back room boy but has never been in the shadows of the police operation.

The former BBC television reporter has loved being centre stage before the cameras in an investigation that has transfixed the world's media. "He is on the TV much more than he ever was when he worked for the BBC," said one former colleague.

So much so that photographers regularly have to shout at Mitchell to get out of the way when they are taking pictures of the McCanns. He remains at his fixed point by their shoulder even during photo-shoots, bucking the trend of media minders who avoid being photographed at all costs.

Mitchell has become such a familiar figure in his open-necked pink shirts that he is recognised in the street and is stopped so often on the forecourts of petrol stations that he now jokes it is because he has forgotten to pay his bill.

After almost 30 years as a journalist, he knows what makes a story and has been extraordinarily successful in maintaining a strong interest in Madeleine.

When interest has faltered he has invariably constructed a story or recruited a big name - even the American First Lady, Laura Bush, is on-side - to a campaign driven by parents who accepted early on that the media was a necessary partner.

Nevertheless, the documentary next Wednesday has provoked controversy because ITV1 has scheduled it against the BBC's The Apprentice as part of its ratings war.

The move has led to the accusation that Mitchell has allowed the parents to be exploited by a commercial broadcaster.

The fact that Mentorn, the production company making the programme, has given £10,000 to the Find Madeleine fund has not diminished the fuss: the money will be more than recouped from syndication.

ITV1, with the help of Mitchell, has kept other media organisations from the McCanns during the five weeks of the access deal with Mentorn.

The company has secured unseen footage of Mrs McCann, 40, her husband, 39, and their three-year-old twins behind the door of their home in Rothley, Leics.

It includes Mrs McCann breaking down in tears as she recalls the night Madeleine went missing. But Mitchell will be undeterred by the barbs, believing the two-hour documentary the best way to ensure that the search for Madeleine goes global again. This is what he is paid to do.

He always wanted to be a journalist and after O-levels at Friern Barnet School, Finchley, where he was head boy, he joined the Barnet & Potters Bar Times and then a BBC training scheme.

In a varied career he covered the Soham murders and, for two years from 2003, the Iraq war.

He was also on the royal beat when he was known - not very imaginatively - as "Clarence House".

But it was as a presenter on various BBC news programmes that he hoped to make his career after years on the road. His spell doing hourly bulletins on News 24 is best remembered for him sleeping through a 3am slot, which had to be filled by a somewhat dishevelled producer.

He became close to the McCanns after being sent twice by the Foreign Office to look after them when there were 40 camera crews outside their Portuguese apartment.

As a father of three children, aged two to 11, he has gone through the same agonies as many other parents who feared it could have happened to them.

His £70,000 salary, equivalent to what he earned in the Civil Service, is being paid by the double-glazing magnate Brian Kennedy, who has bankrolled much of the McCann campaign.

Surrendering his Civil Service pension will be compensated by the future benefits of his role in helping to make Madeleine's the most heavily reported missing-person case in modern history.

Offers are coming in for book, broadcast, and lecture circuit opportunities when he returns to "ordinary life" - and even Mohamed Fayed is rumoured to be interested in hiring him.

Mitchell divides his time between his home in Bath, London, and Rothley and speaks to the McCanns every day. They are grateful to him for raising the profile of the search across Europe and North Africa, through visits to Morocco, Italy, Spain and Germany.

But the revelation that they were flying in a private jet was a bear trap that Mitchell should have spotted, and the couple flew home from a trip to Portugal on easyJet.

Mitchell was, as usual, only a few feet away from the couple when they met the Pope in St Peter's Square.

He was so overcome he reached out to grasp the papal hand and was rewarded with a blessing and a set of rosary beads from one of the priests in the Pontiff's retinue.

While calm in public, he has often blown up behind the scenes at reporters and is occasionally guilty of overdoing briefings.

In the last few weeks his public approach has changed, bluntly blaming the Portugese police for leaking statements from Mr and Mrs McCann that revealed Madeleine was left crying the night before she vanished.

Mitchell moved from the shadows to being branded a "manipulative liar" by the police and the row ensured once more that the McCanns returned to front pages across Europe. It was a job well done by the man at the centre of the story in his own right.

"I think they are doing amazingly well under the circumstances, they are very positive," he said.

"There is no question in my mind that they didn't have anything to do with Madeleine's disappearance.

"I do not believe they are putting Madeleine at risk, I completely disagree with that," he said. "Whoever says that is absolutely foolish - it is the only way she is going to be found.

"The moment that Elizabeth was abducted, the only way we were going to find her was to get as many people as possible out looking for her.

You just don't know what to do and even though you are doing everything you possibly can, it never seems enough. I certainly empathise with what they are going through. I certainly see a lot of myself, it takes you right back to that time."

Mr Smart said he had talked to a number of parents of missing children over the years and asked them if they think their child is still alive.Some said definitely yes, some weren't sure, while other were convinced they were dead.

"Gerry and especially Kate said, 'I do feel like she is out there'," he said.

"I think it is ridiculous that some of the stupid comments say she is not emotional enough. I have met her and talked to her on the phone.

"Kate is a wonderful mother and cares about her children and would do anything to bring Madeleine home."

Dáár gaat het om. Niet om ontvoeringen van tig andere veelal wat oudere kinderen. En wat weet die vader Smart eigenlijk van de achtergronden van dit drama. Alleen wat gesprekjes met de McCanns, nee...dan ben je goed ingelicht, not! Ik neem het hem niet kwalijk, genereert weer publiciteit, hij en z'n dochter ijveren voor een national sex offender registry bill en nog een aantal kwesties wat betreft ontvoerde en misbruikte kinderen. Maar als je je heel jonge kinderen gewoon alleen laat (up for the taking), je vervolgens niet direct de politie belt, zelf niet eens een poot uitsteekt om te zoeken, niet wenst mee te werken, integendeel, dan helpt daar echt geen Alert tegen. Ik zou bijna willlen stellen dat de McCanns schade hebben toegebracht in deze, ouders die weigeren kinderen bescherming (en nota bene zelf verdachten zijn) te bieden moeten verre van any Alert-campagnes blijven!

Maar natuurlijk ook omdat ze bang zijn; bang voor boeken/docu's die straks uitkomen (Amaral en misschien ook Murat), bang misschien wat de resultaten zijn van de verhoren, bang voor de uitslag (volgens mij al bekend maar blijft nog ff in een la liggen) van het DNA-materiaal, bang dat het tij gaat keren > dat ze misschien voor lange lange tijd Arguido's blijven (als ze bv weigeren naar Portugal te gaan qua reconstructie) en kunnen dan niet zeggen/doen wat ze willen...maar eens zal de waarheid naar boven komen, zal misschien lang duren, maar ik geloof er wel in.

Inderdaad, dit is te groot om in de vergetelheid te verdwijnen of om onder het tapijt te stoppen, eens zal het toch uitkomen wat er nu precies is gebeurd, dit is zo'n zaak die altijd levendig gehouden zal worden juist omdat er zo'n heisa omheen is geweest, de langste adem zal winnen.

McCanns still holding out hopeThe youngster's parents, Kate and Gerry McCann, told a television documentary that they felt more confident about their daughter being found alive after a trip to the US.

At the end of last month the McCanns, from Rothley, Leicestershire, visited America to see how the country's Amber Alert system was used to track down missing children.

Mr McCann told the documentary: "We've spoken to a lot of people who said this is a country (America) that has more than two stereotypical kidnappings per week and of those only 40% to 50% end up being found dead and, most importantly of all, the younger the child, the less likelihood of serious harm.

"And these are people experienced in investigations saying 'I really believe she's out there', and I think, yes, there was a first time where I've thought, I really believe it."

Mr and Mrs McCann are still searching for Madeleine, who was three years old when she disappeared from their holiday apartment in Praia da Luz, Portugal, on May 3 last year.

During their visit to the US, the couple were filmed meeting Ed Smart, whose daughter Elizabeth was missing for nine months before being found alive and well.

Mr Smart campaigned to keep his daughter's case in the media until she was recognised in the street.

Madeleine missing since May 2007At the end of the trip, Mrs McCann said: "I feel more positive about the chances of Madeleine being out there and I feel more positive about the likelihood of being able to implement an Amber Alert system within Europe."

But while the couple have not given up hope of finding Madeleine, Mrs McCann said that some days remained "desperate".

In a conversation with Mr Smart filmed for the documentary, she said: "We're okay. Some good days and some desperate days still."

Mr McCann added: "We're bearing up really, still working away behind-the-scenes and keep plugging away and keep hoping for a breakthrough really."

But it is understood that Metodo 3, the Spanish-based private detective agency working for the McCanns, is also looking into the matter.

Clarence Mitchell, the couple’s spokesman, said: “Metodo 3 the investigative arm will study the details of this particular attempted abduction and will review it in liaison with the police.”

He played down the significance of the latest claim saying it could be completely unrelated to Madeleine’s disappearance from the McCanns’ holiday apartment in Praia da Luz on May 3 last year.

But he added: “The man in the vehicle appears on the face of it to match or be close to our description of the man that Gail Cooper saw… that’s why it is of interest.

“Kate and Gerry still believe in the absence of any evidence to the contrary that she’s still alive.

“Incidents like this give them hope in the sense that it could be a potential lead.”

The couple are preparing to mark the first anniversary of Madeleine’s disappearance this weekend.

The Dutch girl’s father – who does not want to be named – told Sky News that his daughter had been walking back from a supermarket when she was followed by a man in a black 4x4 which stopped in front of her.

“He then grabbed her but my daughter fought him,” he is quoted as saying.

“Another car arrived and he drove off.”

Hoi Kahaarin, inderdaad...wat een walgelijke zooi crap en voorlopig is het publiek daar nog niet van af, waarom kopen die Britten eigenlijk die vette nonsens??? Het is dan toch een kwestie van vraag en aanbod, zolang de kranten Madeleine op de frontpage houden (of breeduit in de middenpagina's), tot zolang zal het publiek de kiosken niet achteloos voorbij lopen...Overigens geloof ik die bijna ontvoering voor geen meter, zoiets kan iedereen verzinnen, niet te checken dus ongeloofwaardig en heeft wederom niets met een alleen gelaten 3-jarige peuter te maken.

To all a big Thank you, Muchissimas Gracias e Muito Obrigada. Uiteindelijk gaat het over een zogenaamd gesprek tussen twee Portugese inspecteurs, afgewisseld met commentaar van Carlos Anjos and Moita Flores. Niets is minder waar, die twee inspecteurs zijn bedachte karakters uit het boek van Paulo Pereira Cristovão....en ook nog een zogenaamd 'vers' interview met Amaral maar dateert uit sept. 2007, edoch dat blijken citaten uit genoemd boek.

Yesterday, a controversial article was published in the Spanish newspaper El Mundo, which many considered to have ridiculed the Portuguese police. The article also contained quotes attributed to Gonçalo Amaral which were picked up and reported by the Daily Mail today.

The journalist Anibal Malvar quoted a conversation between two Portuguese inspectors: João Tavares and Francisco Meireles, in which they described the "Portuguese cops" virtue of "improvisation".

Malvar affirms that this conversation was heard when they met on the 23rd of April 2008: 'The Journalist parks the car in the same place where Tavares and Meireles waited for him'.

However, the two inspectors Malvar quotes, João Tavares and Francisco Meireles, are fictional characters from a book entitled 'A Estrela de Madeleine', by Paulo Pereira Cristóvão. The words he reports hearing are actually sentences that the characters speak in the novel.

The following section of Malvar's article, in Spanish, is a word-for-word copy of Chapter 9, page 63 of Paulo Cristóvão's book:

«No podemos perder nunca nuestra intuición de policías, cojones. Tenemos que seguir siendo mañosos... no somos noruegos, ni finlandeses, cojones. Somos portugas, y la bofia portuga se revuelve, improvisa, se fía de la intuición, se ayuda de los CSI, eso es cierto, pero también podemos andar por ahí como angelitos con batitas blancas, debidamente esterilizados, engominados y comiendo hojitas de lechuga porque son más saludables. La malta fuma, le gusta comer y beber unas copas».(...)

Malvar then goes on to report what he heard from João Tavares:

«La pequeña, infelizmente para nosotros y sobre todo para ella, ya no está en el mundo de los vivos. Incluso, si alguien la tuviera en su poder, ¿la iba a mantener viva sabiendo que es la niña más buscada del mundo? Yo creo que no. La publicidad desmesurada que le dieron [los padres, desde la primera noche] a su rostro y su iris especial fueron su condenación. El resto es palabrería, compañero. Murió y que Dios cuide de ella, porque era una inocente que cayó en un mundo de bestias puras». Lo dice Joao Tavares.

The section above translates as: 'The little Girl, unfortunately for us and specially for her, is not in the world of the living anymore. Actually, if someone had her would they keep her alive knowing she is the most sought after girl in the world? I don't think so. The huge publicity given by the parents, since the first night, to her face and eye in particular was her condemnation. The rest is words, mate. She died and may God take care of her, because she was an innocent girl who fell in a world of pure beasts. Said João Tavares.'

This particular section, above, seems to be a mix of comments made by Carlos Anjos and Moita Flores, which do not appear in the book 'A Estrela de Madeleine', however the journalist affirms that he is listening to João Tavares - a fictional character!

Gonçalo Amaral's alleged interviews

Also, in this El Mundo article, Malvar reuses and adds some words to an alleged 'interview' with Gonçalo Amaral. However, Malvar's interview was originally published back in September 2007, and he has pasted it into the new article giving the impression that Mr Amaral is still following the investigation. Mr Amaral is forbidden to comment by the Portuguese secrecy code of Justice.

In this 'new' interview, Malvar also affirms he was the first to get an interview with Gonçalo Amaral. Malvar adds that in order to get that interview he promised to keep Gonçalo Amaral as an anonymous source, but now, because he is going to retire, he considers that fact is no longer relevant.

However, an ethical journalist must honour an agreement not to use the name of a source unless the source explicitly agrees to release him from any promise of confidentiality. A reporter should never assume that a change in the interviewee's circumstances justifies release of their name, as Malvar has done in saying that it is alright for him to use Amaral's name because Amaral is about to retire from the PJ.

The right to keep professional secrecy is a right of a journalist, but it is also an obligation which guarantess the confidentiality of the sources of information.

Aníbal Malvar also appears to have added a few more words to Gonçalo Amaral's statement.

Paulo Santos, Amaral's lawyer said today to Lusa News Agency: "Those statements are a complete lie. Gonçalo Amaral never told the journalist anything. They seem to be citations that were collected from the book about Maddie, which was written by former PJ inspector Paulo Cristóvão", he referred.

Sergey Malinka's silver Audi saloon was destroyed in an arson attack in the early hours outside his home in Praia da Luz, southern Portugal.

Next to it was the Portuguese word "fala" ("talk") daubed crudely in red paint on the pavement.

The Russian IT expert, who designed a website for Mr Murat, came to attention last year when police searched his home and seized computers two weeks after Madeleine vanished.

Portuguese police also investigated telephone calls between him and Mr Murat on the night she disappeared.

Mr Murat's lawyer Francisco Pagarete told Sky News Online he had no idea why the incident happened, or the motives behind it, and said his client had not been subjected to any threats or attacks himself.

Mr Pagarete said his client had received threats and hate mail in the early days of the investigation "but not fortunately now".

He added: "This has nothing to do with Robert, we don't know who did it. With this incident, he has nothing to worry about."

The blast took place 30 yards from Mr Malinka's home in a small cul-de-sac, damaging an Opel Zafira parked next to it.

Mr Malinka was unavailable for comment when Sky News Online tried to contact him in Praia da Luz.

But he told the Portuguese daily newspaper Correio da Manhã he does not understand the message left on the pavement and is "tired" of the Madeleine case.

"I don't know what to do anymore," he said. "I go to church every week, I pay my taxes, I don't deserve this. I want to be left alone.

Dat herkauwen en uitkauwen is begonnen toen Clarrie zich er mee ging bemoeien, evenals al die mooie sightings, analyses en tearjerk verhalen, hij heeft zeker meegeholpen de hype levendig te houden, alle vermiste kinderen uit de verre omgeving waren natuurlijk gelinkt aan de Maddy zaak en alle ouders konden rekenen op sympathie en medeleven van de McCanns, dat wil zeggen totdat hun verhalen uitgemolken waren, dan konden ze niet eens meer op berichten in de pers rekenen want alles stond vol met Maddy verhalen.

Natuurlijk hadden ze snel genoeg door dat dit niet licht werd bevonden in Portugal, de verontwaardiging was uit de eerste krantenartikelen te scheppen, en terecht, maar dat nu wordt beweerd dat Kate daar aan gedacht heeft ondanks de paniek en stress vlak na de verdwijning, dat klopt imho niet, ik denk dat een raadsman/adviseur/medewerker van de Britse ambassade oid daar aan heeft gedacht.
Vandaar ook die snelle aftocht naar GB, eerst hadden ze geroepen dat ze in PDL zouden blijven tot ze was gevonden en opeens kwam de mededeling dat ze weer thuis waren met de tweeling, iets klopt er niet met de beweringen dan.

Heel natuurlijke reactie, je oudste is weg en je maakt je daar druk om.
Dat blijven veel bloggers e.d. zich afvragen, je laat heel jonge kids elke avond in een vreemd land alleen, in een onafgesloten apartement buiten de security-gates en aan de openbare weg. Nu ik hier toch nog ff ben, Metodo 3, dat louche Spaanse detectivebureautje, blijft ook nog 'actief', altijd goed voor nieuwe sightings én verhaaltjes verzinnen om de Portugese politie te belasteren...lekken verzinnen, vermiste kindjes linken aan Madeleine etc etc.

Francisco Marco introduced as a 35 year old lawyer and private investigator.

Q: Do you continue to affirm categorically that Madeleine is still alive?

A: Affirm categorically? I have to think so categorically. If ‘one’ wants to look for a person ‘one’ has to continue thinking that that person is still alive. When ‘one’ arrives at one’s office, talks to that person’s family, has daily meetings about the case ‘one’ has to think that the person is still alive. If not it’s very difficult to do one’s job properly.

Q: But do you have any proof that she is still alive?

A: We have proof and from the beginning it has been filtered that there are ‘materials’ which indicate that she is still alive.

Q: I remember an interview you gave to La Vanguardia (a Barcelona newspaper) in which you promised to buy (name of reporter) dinner if Madeleine hadn’t been found by April 30. That’s tomorrow.

A: Tomorrow, that’s right.

Q: It will be difficult I suppose thatby tomorrow…..

A: Very difficult.

Q: Where is Madeleine being looked for at this point in time?

A: She has been looked for all over the world. A lot of Maddies have appeared in many places and we have been following up all these sightings one by one and place by place, in more than 25 to 30 countries.

Q: You say that she has been stolen (robar), not kidnapped (segrestar). What is the difference exactly between stealing (robar) and kidnapping (segrestar)?

A: It’s just a legal difference but not exactly between those two terms. Kidnapped (segrestar) means simply taking away someone’s freedom whereas kidnapped (raptar) has a more sexual connotation. (Note both verbs translate as kidnapped in English)

Q: But no-one has asked for any ransom for her.

A: Because it’s not a kidnapping for money.


Short break – Francisco Marco reintroduced as one of the best private investigators in Europe at the present time.

Q: How is it that the parents came to you being British themselves and this happening in Portugal?

A: That is quite understandable. We are on the Iberian peninsula, it’s very difficult to investigate in Portugal as Portuguese legislation does not allow investigations to take place in parallel with police investigations. There was a lot of talk of North Africa, especially at the beginning, and they had to find someone who could coordinate all this. We are one of the biggest agencies in Europe, our staff are bilingual and can work anywhere in the world.

Q: Did you accept their request immediately? Did you not have to think about it?

A: Yes, a lot. The owner of our agency (female) had over 10 hours of interviews with the parents, and once we had investigated certain documentation and were sure that the parents were not involved then we accepted the case.

Q: Had you followed this case much during the 6 months before they came to you?

A: We had followed it like anyone else did last summer. It was difficult not to with the coverage. I have always said that one of the problems of this case is that the yellow press got hold of it and the whole case ‘went wild’.

Q: Have you spoken personally to the parents?

A: Yes

Q. And do you believe they are innocent or do you have to believe it?

A: Absolutely, absolutely

Q: Why?

A: For many reasons that I cannot tell and also from personal conviction after speaking five minutes with the mother and seeing how they treat their other children. But I also have a lot of documentation which indicate trails and move the parents far away from suspicion.

Q: When you accepted the case did you set a date to resolve it?

A: No. Initially we had a contract for 6 months and just two weeks ago it was renewed for another 6 months.


They then talk about the Austrian case, 23 years, the possibility that Madeleine's case could go unresolved for as long and to generalise about the disappearance of children.

Q: But what is not ‘usual’ is that the parents of a missing child go as far as contacting the Pope and involving famous people like David Beckham etc. Do you think this media strategy was a good idea or if you had been involved at the beginning would you have advised them not to go down that road?

A: I probably wouldn’t have entered into such huge media coverage – it just got out of hand. But I think it also got out of hand for the parents too…….they were in a foreign country, didn’t speak the language, so their first reaction when their child disappeared was to contact people and the media in England. Also there was a lack of news at that time, a lovely child had gone missing, the parents were media-attractive – maybe if the parents had been ugly the coverage wouldn’t have been as high.

Q: You mean that if the parents had been ugly they wouldn’t have had all this media coverage?

A: You should ask yourself that, not me.

Q: But you made the statement.

A: Yes but you are the media. It’s not the same to be showing images of a blonde lady and a child with light-coloured eyes as showing an ugly man in Austria. After 5 minutes your viewers would tire of looking at the ugly man.

They then return to talk about the case in Austria and other issues, including his new book (which happens to have an eye on the front cover!).

Q: Do you believe that in these next six months you will find Madeleine McCann

A. I don’t believe anything about this case. It’s a strange case. To bet on a date would mean that the British press would immediately take this up so I cannot say

Zo, zo, King & Queen McConn waren net pakweg een kwartiertje op de BBC en zoals verwacht stelde het geen moer voor. Mensen konden per email sinds gisteren vragen sturen. Over het alleen laten van de kids wilde Kate niet ingaan, dat had ze al zo vaak verteld. Gaan ze naar de reconstructie in Praia da Luz? Dat is nog niet duidelijk maar ze zien er zelf geen heil in en is voor Kate te pijnlijk zel Gerry. Bovendien hebbben hun vrienden al alles verteld tijdens de verhoren van onlangs, én was een vriend na de vermissing 10 dagen in PDL gebleven, dat moest eigenlijk wel voldoende zijn. Verder wat gebep hoe de twins hiermee omgaan en natuurlijk het alertsysteem te berde brengen. Wel vond ik Kate in dit live gebeuren twijfelachtig/ontwijkend eigenlijk, something to hide, sure! Afijn, ze zijn nog tig keer op diverse zenders te zien waaronder vanmiddag op Sky. Oja, dat nieuwe nummer wat men kan bellen is niet van de politie zoals de indruk wordt gewekt, maar idd, van Retardo 3 (Metodo 3). En verder interesseert het mij geen bal dat ze het publiek telkens oproepen, het is zo belangrijk voor hun dat wij ons concentreren op Madeleine...Why? Voor mij en vele anderen is dat meisje allang al niet meer onder de levenden. Het enige wat telt is waarheidsvinding, een ordinaire Who Dunnit-verhaal en wie zitten er nog meer in dit geldmakende complot?

Puntje nog, het is ook niet toevallig dat PM Gordon Brown (heeft vaak gebeld met de McConns en z'n broer is vriend van Gerry) en z'n Labour-partij heel slecht gaat, vandaag gemeenteraadsverkiezingen en de Polls zijn vernietigend. Niet alleen vanwege onaangename nieuwe belasting-regels voor de lage inkomens maar natuurlijk ook vanwege die overweldigende bescherming van de McConns. Mensen zijn echt niet achterlijk....

En over die docu van de McConns gisteravond op ITV schrijft Beachy heel raak:

Ladies and gentlemen, where are your journalistic ethics, your training, your COMMON SENSE!

ITV allowed Kate McCann tonight to go on and on multiple times about how they would have taken the kiddies to the Millennium restaurant if ONLY they had had a buggy. There are pictures all over the internet of them pushing buggies whilst in Praia da Luz, at least one of which, it appears, was taken on 4 May. Didn't take them too long to find a way to get a buggy when they wanted one, did it, ITV? There is also a press report from a British paper that has been out there for months quoting a shopkeeper in Sagres, Portugal, where the McCanns took their children on a little getaway from PDL, who says they had a buggy when they were there on 30 April. I found it last night in about 30 seconds by googling "pictures of McCanns with baby buggy." How can ANY journo worth his salt not CHECK these things?????????????????????????? And more to the point, if you are going to give the McCanns two hours of airtime, not ask them a meaningful question about such an obvious inconsistency every now and then?

The newspapers are no better. Of course, we have dear old Anibal Malvar down in Spain saying he not only interviewed fictional PJ inspectors for El Mundo, he also watched them park their car, but the way things are going I should not be surprised to hear UK newspapers do that or worse any day. After all, some of them, uncritical as ever, re-ran Malvar's lies.

No one is willing to ask the hard questions. No one, in fact, is willing to ask ANY questions designed to elicit any real information, that I can see. Whilst you have the McCanns right there in front of you, why not ask them to clarify the changed stories about whether the apartment was locked or unlocked, about whether the shutters appeared to have been "jemmied" or not, about what Gerry saw when he checked on the children, what they did - hour by hour - on their last day with Madeleine on 3 May, whether or not Gerry saw Jane Tanner on her alleged trip past him at 9.15, how many dead people Kate would be called on to pronounce in an average month as a part-time locum GP, etc., etc., etc., etc., etc., etc, etc. etc. They would probably say that the secrecy laws prevent it, but the secrecy laws do not seem to prevent them from saying anything else they want to say, and if came to that, it would be an easy enough matter to point out leaks to British news organisations that obviously came from Team McCann because they consist of things that only the tapas 9 would know, such as the report that a "friend of the McCanns" suddenly remembering that bundleman was not heading towards Baptista's market at all, but towards Murat's house. Any investigative journo worth his/her salt would have no trouble pointing out to them that it is laughable to claim that what they were doing on the afternoon of 3 May, say, is covered by the secrecy laws, but the only sighting of the alleged "abductor" is not.

I yet have hope that there will be justice for Madeleine, as this case is in the hands of the PJ. I have no hopes whatsoever that the honour and credibility of the British media will ever recover. As a matter of fact, I think we are lucky that we are not still in WWII: If we were, the Beeb would probably be opening with the first few notes of "Do It To Me One More Time" instead of Beethoven's Fifth!
