Israeli high court bans use of 'human shields'

JERUSALEM (Reuters) - Israel's army must stop using Palestinian civilians as "human shields" in operations against suspected Palestinian militants, the Israeli Supreme Court ruled on Thursday. Palestinian and Israeli human-rights watchdog groups had sought the ruling. The court's decision that the practice is illegal under international law hardened a temporary injunction issued in 2002.

"The army has no right to use civilians as human shields ... It is cruel and barbaric," Supreme Court Justice Aharon Barak wrote in a 20-page judgment. Israeli troops conducting raids against wanted militants have used Palestinian non-combatants to knock on doors or enter homes of suspects. In several cases, the practice resulted in injury or death of the human shields.

An army spokesman declined comment on the ruling. Rights groups said the army had repeatedly violated the earlier injunction because it left leeway for field commanders to press Palestinian civilians into service with their consent by persuading them their lives would not be endangered. "I am concerned that when an army unit comes at night, no one would refuse to cooperate out of fear," Barak wrote. "Ninety-nine times out of 100, it is not free will."

INTERNATIONAL LAW

Deputy state prosecutor Shai Nitzan said the ruling mainly addressed the issue of whether soldiers could possibly use Palestinian civilians as shields with their reasoned consent. "The high court judged the restrictions (contained in the 2002 injunction) insufficient and decided to rule for additional restrictions. It is now not possible to use citizens (as shields) even with their agreement," Nitzan told Israel Radio.

"This is correct and in keeping with international law within the specific context of what it dealt with." Rights activists deplored the "shields" practice, giving an example of a 13-year-old Palestinian boy caught on film in 2004 tied to the hood of an army jeep during rock-throwing protests by Palestinians in a West Bank village.

"The true test of (Thursday's ban) will be implementation. It is not just enough to issue a ruling. There has to be a very strict process of implementation," said Sarit Michaeli, spokeswoman for leading Israeli human rights watchdog B'Tselem. "It is crucial that the army brief all soldiers on the issue which is the only way to eliminate any illegal behavior."

The Israeli army says it has never deliberately put Palestinian civilians in harm's way during its operations to contain a Palestinian uprising since 2000. It says Palestinian militants have put civilians in danger by routinely using them as cover in teeming urban neighborhoods.

IDF Thwarts Three stabbing attacks in the Nablus Area

A Palestinian woman wielding a knife arrived Tuesday (4.10) at the Hawara security crossing, south of Nablus. The Palestinian stabbed a female solider in the face wounding her lightly. The soldier received initial medical treatment at the scene, and was taken to a hospital for further treatment.

The force manning the crossing opened fire at the woman, fearing the she would attack additional soldiers. The Palestinian woman, who was severely wounded, received initial medical treatment at the scene by the Red Crescent and later died as a result of the fire.

Wednesday (5.10), an 18 year old Palestinian arrived at Beit Furik security crossing, southeast of Nablus, armed with a knife, and attempted to stab a female solider, the soldier moved away quickly and was not wounded in the attack.

The commander of the force manning the crossing, fearing the attacker would stab additional soldiers, opened fire at him. The attacker was not hurt, but a Palestinian man who was standing near him was lightly wounded from shrapnel. An IDF force gave the man initial medical treatment at the scene, and a short while later he was evacuated by Red Crescent personnel to a hospital in Nablus for further medical treatment. The attacker was detained and will be questioned by the Israeli police.

This is the third stabbing attack in the Nablus area since the beginning of the week. These attacks follows an additional stabbing attack that was thwarted last Sunday at the Beit IBA crossing, North of Nablus.

Palestinian sources: Intelligence official snatched, shot in Gaza

A senior member of the Palestinian general intelligence service was abducted and shot by unknown gunmen in the Gaza Strip, Palestinian sources said Friday.

According to the sources, Sami Ajour, who is also a Fatah member, was snatched Thursday and later dumped in the street in the northern Gaza town of Beit Lahiya with serious gunshot wounds.

The sources said that the ensuing abduction of three Hamas officials in the West Bank late Thursday had been carried out by Fatah members in response to the kidnapping.

But a previously unknown Palestinian group said earlier Friday that it was behind the kidnappings of the Hamas members, accusing the militant group of putting itself above the law.

Kidnappings among rival Palestinian groups have been on the increase in recent months, as Palestinian Authority Chairman Mahmoud Abbas' efforts to restore law and order have achieved only partial success.

Palestinian security officials confirmed the kidnappings of local Hamas leaders Bassem Abeido in Hebron, Hassan Safi in Bethlehem and Professor Riad Abdel Karim al-Raz in Tul Karem. The three men were abducted by gunmen late Thursday.

A group calling itself the Omar bin al-Khatab Brigades claimed responsibility for the abductions.

"This is a response to Hamas' violations and disregard for law and order and their attacks on security institutions and Palestinian leaders," the group said in a leaflet. "We warn Hamas and ask them to stop their policy and learn their lessons. This is our first response."

Al-Raz, a prominent university professor, was released early Friday, hours after he was snatched from his West Bank home.

The professor, who heads the engineering department at A-Najah University, was freed with a torn shirt and black eye. He said he had no idea who kidnapped him or what they wanted.

"People came and took me by force. They didn't treat me well, and then they apologized and told he I would be taken home," he said.

Asked whether he thought the kidnappers were affiliated with Fatah, which is competing with Hamas in upcoming parliamentary elections, al-Raz said: "I'm not sure myself who they are."

The Al-Aqsa Martyrs' Brigades, a militant group affiliated with Fatah, denied involvement.

According to al-Raz's wife, gunmen firing in the air pounded on the door of their home in the West Bank city of Tul Karm late Thursday, then escaped with him.

Also Friday, the Israel Defense Forces arrested another A-Najah professor who is running in the parliamentary elections. Professor Nasser Shaer, a former member of Hamas, is running as an independent candidate.

Israel has rounded up hundreds of suspected Islamic militants in recent weeks, including dozens of Hamas political candidates.

Palestinian police launch major West Bank crackdown
Palestinian police went door-to-door early Friday in the West Bank town of Yatta, arresting 30 suspected criminals in one of the biggest moves toward restoring law and order in the chaos-ridden Palestinian territories.
More than 200 policemen participated in Friday's arrest raid, searching for drug and arms dealers and other wanted criminals, said Ahmed Rabai, the Hebron-area police chief. Village residents said they could not recall such a heavy crackdown by Palestinian police.

Police raided the village before dawn, surrounded homes and called on suspects to surrender. Homes were searched and illegal weapons were confiscated.

"This campaign was ordered by political leaders to enforce law and order and to bring justice to normal Palestinians and make the Palestinian people feel safe," Rabai said. "This campaign will continue not only in Yatta town, but also in other villages and in the city of Hebron itself."

Israëls grote bouwoffensief tegen de Palestijnen

Het vredesproces tussen Israël en de Palestijnen ligt stil. Intussen is Israël hard aan het bouwen in zijn nederzettingen op de bezette Westelijke Jordaanoever en aan de veiligheidsmuur eromheen die het karakter van een grens krijgt.

OOST-JERUZALEM, 15 OKT. Dag na dag zagen leraren en leerlingen van de middelbare jongensschool van Anata de Israëlische afscheidingsmuur dichterbij komen. Maar dat het schoolplein in tweeën gekliefd zou worden, was toch een pijnlijke verrassing. Precies op de gele middenlijn van het volleybalveld, rechts van het vier verdiepingen tellende schoolgebouw, zijn de acht meter hoge betonnen kolossen geplaatst.

Het doel is het honderden jaren oude Anata, dat voor de helft binnen de gemeentelijke grens van Jeruzalem ligt, af te snijden van de heilige stad en vooral van de pal tegenover de school liggende Israëlische nederzetting Pisgat Ze'ev. Het schoolplein is sinds begin deze week onbruikbaar en de omgeving opeens gevaarlijk. Soldaten bewaken de bouwvakkers en de machinisten van de hijskranen die blokken beton overeind takelen. Wie te dicht bij komt, loopt het risico te worden beschoten met traangas of rubberkogels.

Schooldirecteur Youssef Elayan klaagt over het constante gedreun van pneumatische boren, zware vrachtwagens en plotsklaps donkere klaslokalen. ,,De muur blokkeert de zon. We worden stap voor stap opgesloten in een gevangenis'', zegt Elayan emotieloos.

De muur op het schoolplein is maar een detail in het grote bouwoffensief van Israël op de bezette Westelijke Jordaanoever, een offensief dat gepaard gaat met onteigeningen, afsluitingen en procedures. Maar het is natuurlijk een drama in de belevenis van de 15.000 inwoners van Anata, die, net als 90.000 andere Arabische bewoners van Oost-Jeruzalemse buitenwijken, door de muur worden afgesloten van de grootsteedse voorzieningen, van hun werk, families en de Aqsamoskee in de Oude Stad.

,,We proberen dit nog tegen te houden door in beroep te gaan bij het Israëlische Hooggerechtshof. Dan komt de apartheidsmuur misschien een paar meter verderop te liggen. Maar ach, wat kan het de wereld nog schelen? Bush, Chirac, Blair, Schröder, Amerika, Europa, zij laten Sharon allemaal zijn gang gaan. Hij gaat gewoon door met de uitvoering van zijn masterplan'', zeggen Elayan en het lerarenkorps dat zich in zijn werkkamer heeft verzameld.

Dat is geen Palestijnse retoriek, maar de nieuwe realiteit in Anata, waar de muur, net als elders op de Westelijke Jordaanoever, het karakter krijgt van een nationale grens. Voor 97 procent bestaat de afscheiding uit een elektronisch hekwerk met militaire wegen, prikkeldraad en diepe greppels en voor 3 procent (van de 655 kilometer) uit een muur van beton. Kostprijs: 3,4 miljard dollar. Om succesvol terroristen tegen te houden, argumenteert Israël.

Maar volgens de meest recente rapporten van Israëlische en internationale organisaties heeft de afscheiding als voornaamste functie een reeks nederzettingenblokken (Alfe Menashe, Qedumim/Ariel, Modi'in Illit, Givat Ze'ev, Pisgat Ze'ev, Ma'aleh Adumim, Gilo/Har Homa en Gush Etzion) aan Israël toe te voegen. Of, zoals de Israëlische commentator Akiva Eldar van Ha'aretz het pleegt te noemen: ,,Bouwen, annexeren, usurperen. Feiten op de grond in beton gieten en voorzien van een dakje met rode pannen. Daar gaat het in wezen om. En Hamas is niet te beroerd een aardig handje mee te helpen.''

In toespraken en interviews ter gelegenheid van Rosh Hashana, het joodse nieuwjaar, en Yom Kippur, Grote Verzoendag, maakten premier Sharon en minister van Defensie Mofaz daar ook geen geheim van. ,,De greep op groot en verenigd Jeruzalem zal verder versterkt worden. Dat geldt ook voor de Jordaanvallei en de Hoogvlakte van Golan én de grote nederzettingenblokken die, ook na onderhandelingen over een permanente status, tot het land van Israël zullen behoren'', aldus Sharon op een receptie van Likud in Tel Aviv. Na de ontruiming van de nederzettingen in de Gazastrook zullen er geen concessies gedaan worden, zei Sharon, die in een machtsstrijd is verwikkeld met oud-premier Netanyahu. Oud-stafchef Mofaz voegde daar in gesprek met Yediot Ahronot aan toe niet te verwachten dat er de komende twee jaar een vredesverdrag met de Palestijnen gesloten zal worden. Alle tijd dus voor het bouwoffensief.

Het feit dat de Palestijnse leider Abbas, die door Sharon volgens de Israëlische commentator Aluf Benn behandeld wordt als ,,deurmat'', geen greep krijgt op de militante islamitische organisaties, komt Sharon goed uit. Met een verwijzing naar de Routekaart voor de Vrede eist hij éérst ontmanteling van de terreurgroepen voordat hij aanschuift aan een onderhandelingstafel.

Ter onderstreping van de woorden van Mofaz werd deze week opnieuw een ontmoeting tussen Abbas en Sharon uitgesteld, omdat Israël niets wenst te geven en de Palestijn zichzelf een afgang wilde besparen. Het optimisme na de ontruiming van de nederzettingen in de Gazastrook twee maanden geleden over 'een nieuwe kans' en 'een historische doorbraak' is verdampt. Alleen de cementmolens, ijzervlechters en timmerlieden gaan door.

De op hun websites gepubliceerde september/oktoberrapporten van organisaties als het Jeruzalem Instituut van Israël, de mensenrechtenorganisatie Bt'selem en de Washingtonse denktank Foundation for Middle East Peace bevestigen het beeld dat ontstaat tijdens bezoeken aan Ma'aleh Adumin, Ariel en Gush Etzion. ,,Onder het mom van veiligheid wordt de afscheidingsbarrière, die op een aantal plaatsen diep in de Westelijke Jordaanoever snijdt, gebruikt om de uitbreiding van de nederzettingen voort te zetten'', aldus Bt'selem.

In de tien grootste nederzettingen zijn alleen al dit jaar 3.500 bouwprojecten (appartementengebouwen en bungalows) gestart. Illustratief zijn de cijfers over de bevolkingsaanwas in de nederzettingen. De bevolking in de tien grootste nederzettingen is tussen 1994 en eind 2004 gestegen met 100 procent van 69.660 tot 139.603. In totaal wonen er op de bezette Westelijke Jordaanoever 234.487 kolonisten. Als de inwoners van Jeruzalemse wijken als French Hill, Pisgat Ze'ev en Ramot, worden meegerekend, stijgt dat aantal tot 406.900, op 2,3 miljoen Palestijnen. Israël heeft deze wijken na 1967 geannexeerd en geïntegreerd, maar volgens internationaal recht gaat het om illegale nederzettingen.

Intensief gebouwd wordt er in Ma'aleh Adumim, het kroonjuweel van de kolonistenbeweging ten oosten van Jeruzalem, het ultraorthodoxe Modi'in Illit en in en rondom Ariel dat in het hart van de Westelijke Jordaanoever ligt. De logica van het tracé van de afscheiding, dat hier sterk afwijkt van de grens, de Groene Lijn, tussen Israël en de Westelijke Jordaanoever, wordt bepaald door de ligging van nederzettingen, niet door Palestijnse boeren, schoolhoofden of de geïsoleerde bewoners van het afgeknepen Qalqilya. Het inwoneraantal van een nederzetting als Modi'in Illit is in tien jaar met 345 procent (van 6.150 tot 27.386) gegroeid. Al dergelijke 'gemeenschappen', zoals deze nederzettingen worden genoemd, komen aan de westelijke, dus Israëlische zijde van de afscheidingsbarrière te liggen.

Misschien, zo speculeerde de Israëlische pers, is premier Sharon bereid een aantal geïsoleerde nederzettingen aan de andere kant van de muur op te geven. Reken er niet op, antwoordde de premier tijdens de nieuwjaarsreceptie. En dan zijn er nog de 203 zelfs volgens Israëlische definities illegale nederzettingen. Dat zijn de outposts die Sharon tijdens een bijkomst met president Bush in Texas beloofd heeft te zullen opruimen. Is niet gebeurd en 'Israëls beste vriend' is niet in de positie om Sharon tot actie te dwingen.

Nederzettingen, groot en klein, legaal of illegaal, zijn met elkaar verbonden door een uitstekend wegennet. Verboden voor Palestijnen, enkele uitzonderingen voor een beperkt aantal taxi's, ambulances en vrachtwagens daargelaten. Nederzettingen en alleen voor Israëliërs toegankelijke wegen versnipperen de Westelijke Jordaanoever. Voor de Palestijnen, opgesloten in enclaves rondom de steden, is in het verkavelde land ongeveer 15 procent van het oude Britse Mandaatgebied Palestina overgebleven, Gaza meegerekend, maar zonder Oost-Jeruzalem. Geen Palestijnse leider, hoe gematigd ook, kan akkoord gaan met het Israëlische voorstel om in deze omringde enclaves een miniatuurstaatje te vestigen. De Palestijnen, die nederzetting na nederzetting en de muur met speciale, zogeheten 'internationale doorgangsposten' zien oprijzen, realiseren daarom dat ook na 'de bevrijding van Gaza' een eigen staat met Oost-Jeruzalem als hoofdstad een wensdroom blijft. Intussen groeit Hamas aan kracht en macht.

Een olijfboom voor een dode kolonist

,,Het is alsof je je kind verliest'', jammert Mahfuz Abu al Nasr. Dertig van zijn olijfbomen zijn vernietigd door joodse kolonisten, als vergelding voor de dood van drie van hen.
De bomen waren ruim tien jaar oud, ze waren zo groot als een huis. Mahfuz had ze jaar na jaar zien groeien. Nu liggen ze geknakt op de grond, nadat de kolonisten ze met elektrische zaagmachines te lijf gingen.

Het is niet de eerste keer dat militante kolonisten zijn boomgaard vernielen. Hun aanvallen kosten Mahfuz jaarlijks 5.000 kilo olijven en 180 liter olie. Deze keer hadden de kolonisten de bomen vernietigd op zeker 70 verschillende Palestijnse velden.

Ook Ja'far Eshtiyya, die lid is van de gemeenteraad van Salem, in het oosten van Nablus, vertelt dat een tiental kolonisten de olijfbomen in verschillende velden in brand heeft gestoken. ,,In het gebied patrouilleert het Israëlische leger, maar ze hebben niets ondernomen om de kolonisten te stoppen'', klaagt hij. Volgens een cameraman die in het gebied werkt, komen de kolonisten regelmatig de velden vernietigen. Het is een techniek om de Palestijnen het leven zuur of zelfs onmogelijk te maken.

En of ze nu een klacht indienen of niet, het maakt niets uit. ,,De overheid neemt ons niet ernstig. Dit is de zesde keer dat we bij de politie een klacht indienen, maar er is nog nog niets gebeurd'', zegt één van de gedupeerde Palestijnen.

Soldiers from the Haruv battalion staging a routine arrest of wanted Palestinian fugitives nabbed 10 kilograms of explosives in a West Bank village Saturday and then made a dramatic discovery.

"The wife of the one of the fugitives held her baby with two hands and held a bag with a hand grenade underneath its shirt to hide it from the soldiers," said Lt.-Col. Arik Chen, commander of the battalion.

The pre-dawn raid in the village of Atzira Shamaliyeh north of Nablus ended peacefully after soldiers quickly separated the live hand grenade from the mother and baby.

"She didn´t have much to say," Chen told Army radio.

Chen said his force had staged the raid on five separate houses after a tip off that members of Fatah and the Popular Front for the Liberation of Palestine were hiding weapons there.

"After we cordoned off the houses we deployed to start searching them. In one house we found a suitcase in a closets that contained 10 kilograms of TAPT explosives," Chen said. "It looked like a totally innocent bag until you opened it."

"We didn´t expect this quantity of explosives," he added.

At that moment, Chen said, the behavior of the wife of the suspected terrorist started behaving in an unusual manner and held her six- month baby in a way that raised their suspicions.

"We examined her all the while she held on to the baby and we detected that underneath the baby, or inside its clothes really, was a bag with a hand grenade," Chen said. "Right next to the back of the baby!"

In the dramatic moments that followed Chen said they didn´t know if the hand grenade was set to go off or not. The first thing they did was separate the mother and child from the hand grenade.

It was later added to the suitcase of explosives which sappers later detonated inside the house since there were concerns it may have been booby-trapped. The blast totally destroyed the house, Chen said.

News agencies identified the woman as Aziza Jawabra and quoted her as admitting she knew the grenade was near her baby son, but didn´t know it was in the pocket of the jacket.

A total of five suspected terrorists were apprehended and brought in for questioning.

The raid came a day after IDF troops shot dead one Palestinian gunman and mortally wounded another late Friday in the village of Anabta near Tulkarum. The army said the Palestinians had opened fire on an IDF patrol and the soldiers returned fire.

When sweeping the village the IDF troops identified one of the dead men, who was clutching a hunting rifle. The second Palestinian wounded in the incident was evacuated to a Palestinian hospital and later died of his wounds.

Meanwhile, a spokesman for a Palestinian terror group made unprecedented threats against Prime Minister Ariel Sharon on Saturday.

"The Palestinians will do everything in their power to hurt Israeli Prime Minister Ariel Sharon, rip his heart out and erase the smile off his face and his people´s face, just as he is erasing the smiles of our people when he murders our women and our children," Popular Resistance Committees´ spokesman Mahmoud Abed Al-al told ABC Australia, Army Radio reported.

According to the spokesman, "[Israel] should be expecting surprises. If the need arises, any place in Israel could become a target for us. I want to turn Sharon´s life into hell on earth since he has turned the lives of the Palestinians into hell."

Al-al also took responsibility for the recent firing of a Kassam rocket at Sharon´s private Sycamore Ranch near Ofakim. The rocket was found not far from the grave of Sharon´s wife, Lili. The spokesman also claimed that the Palestinians have managed to transfer to the West Bank the know-how and technology of making Kassam rockets.

A suicide bomber exploded in the open air market in the coastal city of Hadera a little before 4 P.M. Wednesday afternoon, killing five people and wounding some 30 others.

The suicide bomber who carried out the attack was identified as a 20-year-old resident of the West Bank town of Qabatiyeh. The bomber's name, Hassan Abu Zeid, was announced over a bullhorn in Qabatiyeh, residents said. Israel Radio reported he was released about one month ago from Israeli prison.

The six members of the Fatah-linked Aksa Martyrs Brigades register the information and move on, talking about their own "resistance" against Israel.

The world may have thought otherwise, but in the warrens of Gaza's refugee camps the war against Israel is very much still on. The Palestinian Authority announced on Sunday that it planned to disarm the Brigades and absorb its members into the PA security forces, but these gunmen seem anything but ready to disarm.

The IDF and Gaza-based terrorist groups had exchanged frequent fire since Israel quit the Gaza Strip six weeks ago. But over the past week, the groups amplified their rallying cries against Israel and even the Palestinian Authority. Hamas publicly reiterated its dreams of creating an Islamic state between the Jordan and the sea, and Islamic Jihad pressed forward with terrorist attacks and vowed more.

The Aksa Martyrs Brigades would not be outdone. In an interview in an orchard, Hassan Abu Ali, the group's commander here, claimed that the brigades have developed a new rocket, the Aksa-3. These rockets have a maximum range of 17 km., he tells The Jerusalem Post.



The IDF would not comment directly, but outgoing OC Southern Command Maj.-Gen. Dan Harel was quoted on Thursday saying that "Ashkelon [nine km. from the northernmost edge of Gaza] is already within range... It is now not a question of range, but of deterrence."

What had started with stones, then moved on to guns and suicide bombers, has graduated to rockets, the wave of the future, claimed Abu Ali. He said his group had recently tested an unarmed prototype of the Aksa-3 along the Gaza beach.

Often, launching the missiles is more costly than dispatching suicide bombers, Abu Ali said. More of his men have been hospitalized unleashing the erratic rockets than Israelis on the receiving end. And dozens more have been killed in Israeli reprisals.

Palestinian mortarmen have yet to target Ashkelon, and given the likely Israeli response, might never do so. During the interview, an F-16 swooped low, breaking the sound barrier with a jarring boom. The militiamen shifted uneasily in their plastic chairs.

They would happily retire, said the group's Gaza spokesman, who identified himself as Abu Mustafa, once Israel leaves all of the West Bank and Jerusalem. "Retaliation will come from Gaza if the West Bank is attacked," he said. "[Palestine] is one homeland."

Echoing the complaints of many Palestinians, Abu Mustafa dubbed Israel's much-lauded withdrawal a "trick" that has turned Gaza into "a large prison, with no way in or out."

Palestinian public opinion supports the retirement of all gunmen not under PA command. A poll conducted by the Palestinian Center for Public Opinion showed that more than 80 percent opposed the blatant use of force by "militants," what the poll called security chaos and "the multi-authority society."

PCPO director Dr. Nabil Kukali observed that "all these groups want to get across their mujahideen bona fides" before the January 25 Palestinian Legislative Council elections. While the terrorist groups grandstand, the Palestinian street remains silent. Kukali said that to "protect themselves they haven't demanded that this activity cease."

A brainchild of jailed Fatah leader Marwan Barghouti and others, the Aksa Martyrs Brigades were Fatah's answer to Hamas and Islamic Jihad. But Israel's incursions into the West Bank and Gaza knocked out the group's infrastructure, often leaving smaller factions not only to fend for themselves but, more dangerously, make their own decisions.

Today, they might pose the biggest challenge to PA Chairman Mahmoud Abbas. If Abbas cannot control his party's own militia, Gazans ask, how can he control anything else?

Explaining his group's periodic mutinies against the PA, Abu Ali noted that "conventional sit-ins and flag waving no longer work, so the [fighters] have chosen other ways" to catch their leader's attention. In Gaza, Khan Yunis specifically, disgruntled gunmen are in the habit of taking Western hostages when they want to remind the PA that they remain jobless.

Through various types of protest, some 40 percent of Fatah gunmen secured jobs with the PA, said Abu Mustafa proudly. Pollster Kukali agreed that the single most important issue right now for all Palestinians is not fighting Israel "but finding work."

Everyone in Gaza seems to condemn the kidnappings, but then explain that the men need jobs.

Col. Ali Rahajan of the PA Preventive Security Service, currently tasked with security in the former settlements, said that "everything is being done to create a sense of security," and that the "kidnappings will not happen again."

But winning the loyalty of the militiamen may not be as easy as doling out the NIS 1,600 monthly salary allotted to PA policemen.

"If Abu Mazen [Abbas] ensures our involvement in the PA, and ensures our rights, then we are with Abu Mazen," Abu Mustafa said. Those rights, he noted almost as a caveat, are the right to carry arms and fight Israel when they see fit.

Sensitive to the public's fatigue and the effects of the IDF's constant pressure, the brigades have issued a leaflet explaining their reasons for firing rockets. According to Abu Ali, the leaflet explains the necessity "of terrorizing an entire city like Sderot." Otherwise, the people "might misunderstand us," he said.

GAZA, Nov 2 (Reuters) - Palestinian construction magnate Mahmoud el-Farah wishes he could buy his cement direct from Turkey now that Israeli troops have left the Gaza Strip.

However, all imports and exports still have to go through Israel because of its concern that militants could smuggle in weapons -- a cause of continued frustration for Gaza businesses and a threat to the economic gains from the Israeli withdrawal.

"Sometimes we have items sitting at the Israeli port for six months," Farah complained, describing the delays to which he and other Gaza businessmen have become resigned.

The immediate worry for Gaza is the coming harvest.

It will be augmented this year by produce from greenhouses abandoned by evacuated Jewish settlers, who built a thriving business in Gaza supplying fruit and vegetables to Europe.

Foreign donors bought the greenhouses from the settlers and they were quickly replanted by the Palestinians with tomatoes and peppers, set to ripen over the coming weeks.

The greenhouses alone have created an extra 3,000 jobs and will provide estimated additional annual revenue of $50 million. But to reap the rewards, about 150 trucks a day must bring the crops out of Gaza.

Otherwise, the harvest is likely to go to waste.

Family of boy killed by IDF donates his organs for peace

The family of Ahmed al-Khatib, a 12 year old fatally shot last week by Israeli troops who mistook his toy gun for a real rifle, have donated his organs at a Haifa hospital "for the sake of peace between peoples."

The boy died of his wounds on Saturday.
Dr. Tzvi Ben-Yishai, a spokesman for Rambam Medical Center in Haifa, where Khatib had been treated, said that the boy's parents decided to donate his organs "to bring hearts closer and bring peace closer."

The boy's uncle, Jamal Khatib, confirmed that the family had donated the organs.

The Thursday shooting incident occurred when soldiers entered the Jenin refugee camp as part of an ongoing operation to arrest Islamic Jihad operatives.
Shots were fired at the soldiers from the western part of the camp, and bullets hit one of their jeeps. According to Palestinian sources, Islamic Jihad and Fatah gunmen both participated in the exchange of fire, and teenagers threw rocks at the jeeps.

The soldiers thought they saw an armed man some 130 meters away, and one of the soldiers fired, hitting the suspected gunman in the head. A Palestinian ambulance picked up the wounded suspect, but when the soldiers approached the site, they found a plastic gun.

The IDF Spokesman's Office distributed photographs of the toy to show how real it looked.

Khatib was taken to the hospital in Ramallah, but when the seriousness of his condition became clear, the Palestinian Authority arranged to have him transferred to Israel.
Palestinian sources said Khatib was apparently not one of the boys who had been throwing rocks at the soldiers.

An Israeli army officer who fired the entire magazine of his automatic rifle into a 13-year-old Palestinian girl and then said he would have done the same even if she had been three years old was acquitted on all charges by a military court yesterday.

The soldier, who has only been identified as "Captain R", was charged with relatively minor offences for the killing of Iman al-Hams who was shot 17 times as she ventured near an Israeli army post near Rafah refugee camp in Gaza a year ago.

The manner of Iman's killing, and the revelation of a tape recording in which the captain is warned that she was just a child who was "scared to death", made the shooting one of the most controversial since the Palestinian intifada erupted five years ago even though hundreds of other children have also died.

After the verdict, Iman's father, Samir al-Hams, said the army never intended to hold the soldier accountable.

"They did not charge him with Iman's murder, only with small offences, and now they say he is innocent of those even though he shot my daughter so many times," he said. "This was the cold-blooded murder of a girl. The soldier murdered her once and the court has murdered her again.

Arsenal will start next week with the twin aims of building momentum in the Champions League and building bridges between young Jews and Arabs in Israel.

While the spotlight will be on their Group B game against Thun in Switzerland, the north London club will officially unveil five soccer schools across Israel as part of a wider 'Arsenal in the Community' program.

Towns and cities in a dozen countries, ranging from Soweto in South Africa to the eastern Ukraine area still reeling from the effects of the Chernobyl nuclear accident in 1986, have already benefited from the initiative.

Alan Sefton, head of the program, told Reuters the schools' launch on Monday would follow an earlier move to help reconciliation in northern Israel.

Drawing on the Arsenal brand and the worldwide popularity of the Premier League, Sefton said: "We feel we can do a lot of good using that opportunity in these places.

"We can bring people together and do good. It might be social good, like in Soweto, making places better to live in, creating role models and creating trainers - or in other places it might be bringing people together in the Arab-Jewish world."

Arsenal's involvement in Israel began at the request of the Misgav regional council in a previously untroubled area of Galilee which was hit by the intifada five years ago.

Israeli security forces shot dead 13 Israeli Arabs in October 2000 when they tried to quell demonstrations in the north in support of a Palestinian uprising that had grown violent.

In the aftermath, football has proved to be a way of reaching out to the Jewish and Arab communities.

"There were riots and people were a bit shocked it could happen in northern Israel -- this wasn't the West Bank," Sefton said.

"There were two ways the authorities could approach it -- either they could re-trench and everyone would go back into their own shell or we could try and improve the community relations.

Training trainers

"We did a program that was very successful," said Sefton, whose club's task was to pass on coaching skills by 'training the trainers'.

It was then expanded to include other Jewish and Arab towns and villages, as part of a summertime "Football for Peace (F4P)" program led by sports lecturers from Brighton University in southern England.

The F4P camp in July of this year brought together more than 200 coaches, 50 of them from Europe, and 1,000 children aged 10 to 14, drawn from 18 Arab and Jewish communities in Galilee.

Teams in the event, which is backed by the British Council, are mixed and each one has a European, Arab and Jewish coach.

Arsenal are now trying to take that further by encouraging more frequent training camps, mixing coaching and competitions for the participants.

"We believe football opens up people of different classes, social groups, races and nationalities," said Sefton, whose has a long-term vision for the club's programs.

"We'd like to see a thriving football community playing under the Arsenal banner with everyone, in a way, playing together. And in the Misgav area, it is working.

"The mayor of the Misgav has told us it is probably the only scheme where Jews and Arabs mix on equal terms and come together on a regular basis."

That will also be the philosophy of the soccer schools, a scheme involving Arsenal-trained coaches which is being put together by Amnon Raz, head of Israel's coaches' association.

Mixed team

Though the official launch is on Monday, Raz said the schools had been operating since the start of the season.

"There has been full cooperation and tremendous interest from the local authorities, both Jewish and Arab," Raz told Reuters. "They have shown great interest."

Players who stand out will be picked for a mixed Arab and Jewish team for next year's edition of the annual Arsenal International Soccer Festival in August in Surrey, south of London.

The festival brings together youth teams from around the world for matches and coaching under an Arsenal umbrella.

Israel is not the only Middle East country attracting the club's interest and Sefton said it was "totally irrelevant" that he and several Arsenal directors were Jewish.

The club has a soccer school in Egypt and is having talks with parties in Jordan and Dubai, home to the club's main sponsors Emirates airline, while an Iraqi team played at last year's Arsenal festival.

Closer to home, Arsenal organize similar bridge-building projects in London, with primary schools from Jewish and Muslim areas presenting their religious festivals to each other and then playing football together.

"That's one of the reasons why we're involved in this," Sefton said of the Israel initiative.

"Football can divide -- but we don't want it to focus on divisions and tribalism. We focus on things that can bring people together. Religion can and does divide -- but there are also many common threads in religion.

"We think there's more common interest in those who love football than the reverse."

A confidential Foreign Office document accuses Israel of rushing to annex the Arab area of Jerusalem, using illegal Jewish settlement construction and the vast West Bank barrier, in a move to prevent it becoming a Palestinian capital.
In an unusually frank insight into British assessments of Israeli intentions, the document says that Ariel Sharon's government is jeopardising the prospect of a peace agreement by trying to put the future of Arab East Jerusalem beyond negotiation and risks driving Palestinians living in the city into radical groups. The document, obtained by the Guardian, was presented to an EU council of ministers meeting chaired by the foreign secretary, Jack Straw, on Monday with recommendations to counter the Israeli policy, including recognition of Palestinian political activities in East Jerusalem.

But the council put the issue on hold until next month under pressure from Italy, according to sources, which Israel considers its most reliable EU ally.

Israel has described a recommendation for moving EU meetings with the Palestinian Authority from Ramallah to East Jerusalem in recognition of the Arab claim as "negative occurrence". It claims the eastern part of Jerusalem it occupied in the 1967 war is part of its "indivisible capital". Almost all governments maintain embassies in Tel Aviv because they do not recognise the Israeli claim.

The document, drawn up by the British consulate in East Jerusalem as part of the UK's presidency of the EU, says Israeli policies are designed to prevent Jerusalem from becoming a Palestinian capital, particularly settlement expansion in and around the city. It says Mr Sharon's plan to link Jerusalem with the large Ma'ale Adumim settlement in the West Bank by building thousands of new homes "threatens to complete the encircling of the city by Jewish settlements, dividing the West Bank into two separate geographical areas".

It adds: "Israeli activities in Jerusalem are in violation of both its Roadmap (peace plan) obligations and international law."

The Foreign Office also concludes that the vast concrete barrier, which Israel asserts is a security measure, is being used to expropriate Arab land in and around the city. "This de facto annexation of Palestinian land will be irreversible without very large-scale forced evacuations of settlers and the re-routing of the barrier."

The document says stringent Israeli controls on the movement of Palestinians in and out of the city are an attempt to restrict Arab population growth. "When the barrier is completed, Israel will control all access to East Jerusalem, cutting off its Palestinian satellite cities of Bethlehem and Ramallah, and the West Bank beyond. This will have serious ... consequences for the Palestinians," it says.

"Israel's main motivation is almost certainly demographic ... the Jerusalem master plan has an explicit goal to keep the proportion of Palestinian Jerusalemites at no more than 30% of the total." All of this, the document says, greatly reduces the prospects of a two-state solution because a core demand of the Palestinians is for sovereignty over the east of the city.

"Palestinians are deeply alarmed about East Jerusalem," the document says. "They fear that Israel will 'get away with it', under the cover of disengagement. Israeli measures also risk radicalising the hitherto relatively quiescent Palestinian population of East Jerusalem."

The Israeli foreign ministry spokesman, Mark Regev, said: "Israel believes that Jerusalem should remain the united capital of Israel. At the same time Israel has committed itself that Jerusalem is one of those final status issues."

Sharon has made clear following a Gaza withdrawal in September that Israel plans to keep large West Bank settlement blocs, but has said that some isolated enclaves would have to be removed under any future peace agreement.

Een eerste grootschalige militaire operatie staat volgens Israëlische media op stapel in de Gazastrook, maar ook op de Westoever gaan er acties komen. Militaire bronnen zeiden tegen het dagblad Haaretz dat de operaties „enkele weken en mogelijk zelfs een maand” gaan duren. Het verwoesten van huizen was overigens eerder juist stilgelegd na aanhoudende kritiek van onder meer mensenrechtengroepen.

Palestijnse oogst uit joodse kassen
GAZA Palestijnse boeren hebben hun eerste oogst binnengehaald uit kassen die van joodse kolonisten in de Gaza- strook waren. De acht ton groente is verkocht aan Israëlische handelaars.

Deze maand worden nog duizenden tonnen paprika's, kerstomaatjes en aardbeien uitgevoerd naar Europese en andere markten.

Warnings Come True: Kassam Fired near Afula

Fatah said it fired a Kassam rocket last night at a town near Afula in the Jezreel Valley. The terrorists have long threatened that after Gaza, they would concentrate on attacking northern Samaria.


The Al-Aksa Brigades, the military arm of Fatah, released an announcement that on Sunday evening, a Jenin-1 Kassam rocket was fired towards an Israeli community west of Jenin. The given explanation was that the rocket was fired in response to the recent liquidation of Fatah and Islamic Jihad "activists" by Israel.

Fatah is the Palestinian Authority organization headed by PA Chairman Mahmoud Abbas.

Former IDF Intelligence analyst Yonatan D. HaLevy reports that the Palestinian terrorist organizations have been working fervently over the past number of years to build a rocket-firing infrastructure in the northern Shomron. Hamas terrorists Said Awad and Kayis Adwan built a rocket factory in Shechem four years ago, and succeeded in firing several rockets from Tul Karem to Kfar Yonah. Their efforts were laid to waste in the spring of 2002, when Israel initiated Operation Defensive Shield, killed the two terrorists and many others, and destroyed the manufacturing infrastructure.

In March of this year, the IDF and the Shabak (General Security Service) discovered another Kassam manufacturing operation, in the Jenin region. The Hamas facility was hidden in a secret room 15 feet below a metal works shop, and contained seven pipe bombs, chemicals and explosives - and a completed Kassam rocket, as well as others in various stages of preparation.

The factory was located in the village of Yamoun, which came under full PA control after Israel's unilateral withdrawal last summer.

Following this summer's withdrawal/expulsion from Gaza, the terrorist organizations openly announced their intention to relocate the bulk of their terrorist efforts to the northern Shomron, from where they could fire rockets at central Israel. Two months ago, an IDF force arrested three terrorists were arrested in the Negev, near Mitzpeh Ramon. The three rocket experts had been sent from Gaza to begin the Kassam-producing efforts in Jenin, and infiltrated into Israel with the help of Egyptian policemen. They were found with technical manuals and explosives produced by Hizbullah on their person.

Security experts warned throughout the months before Sharon implemented his Disengagement Plan that the northern Shomron was likely to become even more dangerous than Gaza. The Shomron area that has now come under full PA control is some 700 square kilometers (270 square miles), approximately double that of the entire Gaza Strip.

General Security Service Chief Avi Dichter - who has since joined Sharon's Kadima party - said that the area would become “Fatah-land."

Volgens getuigen losten soldaten die de grens bewaakten 's nachts en 's morgens vanuit hun tanks nu en dan willekeurige schoten, omdat ze door de dichte mist niet konden zien of er Palestijnen waren die Israël probeerden binnen de dringen.

Suicide accounts for 1/2 of IDF fatalities in 2005

The army has issued tighter restrictions on soldiers' weapons because 33 soldiers committed suicide this year, said Brig.-Gen. Avi Zimer on Wednesday.

Soldiers in noncombat units will no longer be armed when on leave as part of the army's efforts to reduce the availability of weapons to soldiers, Zimer told the Knesset's Foreign Affaris and Defense Committee.

He added that the army was also seeking to increase awareness of suicidal issues and educate soldiers on the dangers of mental distress.

Zimer gave the information as part of the IDF's annual fatalities report. The number of suicides accounted for half of the 66 fatalities in the 2005 report, marking a jump from 2004 of 28 suicides.

Thirty-three Israel Defense Force soldiers committed suicide since the beginning of 2005, the chief of the IDF manpower headquarters, Brigadier-General Avi Zimer, told the Knesset Foreign Affairs and Defense Committee on Wednesday.

The head of the IDF's manpower division, General Eliezar Stern, said during the meeting that to combat this wave of suicides, it was recently decided that officers and non-commissioned officers in rear units will be armed. Additionally, soldiers in rear units will be prohibited to carry weapons while on leave.

These steps join other measures taken by the IDF on the matter, including reducing the number of weapons in soldiers' hands when there is a fear the guns will be used to end their own lives.
