LOS ANGELES (Zap2it.com) The journalist who reported the documentary "Living with Michael Jackson" is fighting a subpoena to testify in the child-molestation case against the pop star.
Martin Bashir, now a correspondent for ABC's "20/20," received broad access to Jackson for the 2003 documentary, which drew huge ratings both in the United Kingdom, where it first aired on ITV, and the United States, where 27 million people watched it on ABC. Jackson complained bitterly about how he was portrayed in the film, going so far as to give FOX unused footage of Bashir praising him for a special rebutting the documentary.
The prosecution in the Jackson case wants Bashir to testify about things he observed during the making of "Living with Michael Jackson," according to several news reports. Bashir, in a motion filed Tuesday (Jan. 18), maintains that California's shield law protects him from being forced to testify.
Bashir's motion says that the documentary "speaks for itself" and that ABC can verify any part of it introduced as evidence.
Prosecutors, however, believe Bashir can offer information about "[c]onversations with the defendant concerning his sleeping arrangements with children," including Jackson's accuser in the case.
Santa Barbara Superior Court Judge Rodney S. Melville will hear Bashir's motion Friday, Jan. 28. The trial is scheduled to begin Jan. 31.
Meanwhile, Melville has granted a request for the singer to appear on the Fox News Channel to respond to grand jury transcripts that were leaked to ABC News. Melville has imposed a gag order on participants in the case but will Jackson to read a court-approved statement responding to the leaked documents, which describe his alleged actions in rather graphic detail.

Ik word nog steeds niet zenuwachtig hoor.. ik wil er wel bij zeggen dat ik niet blind zal zijn voor als het werkelijk gebeurd is, maar de dingen die ik in de een na laatste post lees en de post daarvoor, zeggen me helemaal niets. Als je twee experts in een kamer zet, spreken ze elkaar altijd tegen. En die Engelsman, tja.. dit is dan toch een uitzondering en het is 25 jaar geleden een paar keer (?) gebeurd. Als het al waar is. Michael Jackson wants his nemeses Santa Barbara County DA, Tom 'Mad Dog' Sneddon, to personally try the case against him in open court, top legal sources tell the DRUDGE REPORT.
"Don't hide behind your office, Mr. Sneddon!" a top Jackson source challenged.
In a dramatic high-stakes move, Jackson wants Sneddon to personally make opening arguments, claiming the case "would never have been brought without [Sneddon's] 'vendetta.'"
"Let Mr. Sneddon live or die by his own sword," the top legal source explained.
Sneddon still tries cases himself in court. "I love trials, and it’s good to get out of the office and do something I enjoy so much," Sneddon says.

Los Angeles - On KFI Radio's 'John Ziegler Show' today, Geraldo Rivera, via phone from Iraq, stated to the Los Angeles broadcaster that he believes firmly that Michael Jackson is "stone cold innocent."
"Generally, Michael Jackson is being railroaded," Rivera told John Ziegler of KFI. "The case against him will be revealed, as you go forward in the days and weeks to come, to be so fatally flawed that you'll wonder why a sitting district attorney decided to even bring this case based on the evidence and the motivation of the complainant. Wait until you see the case against Jackson fall apart in the coming days and weeks..."
John Ziegler went on to ask him whether the case is poor or if Michael Jackson is innocent or both. Rivera replied: "I don't know Michael Jackson. I've spent some time with him recently.. he seems much more normal than anything I've ever read about him. But about this particular case, he is innocent. He is stone cold innocent. He never... Let me be unequivocal so there is no doubt about where I stand on this. After my own investigation and spending time with him, reviewing the state's case to the extent that it's available... and when you see the grand jury transcripts, you know that I know everything that Tom Sneddon, who's nickname is 'Mad Dog' up there there in Santa Barbara, has presented to that grand jury.
"Michael Jackson did not molest this kid. Period. The charges against him are fake. They have been created by grifters to cash in on a beleaguered, besieged guy who, because he is so unusual, is vulnerable to these kinds of charges.
"I predict in the coming days that Michael Jackson will say as much... that he will never again, ever ever, in his life allow himself to be vulnerable to these kinds of accusations again.

MICHAEL JACKSON's actor friend MARK LESTER intends to give evidence in defence of the singer at the THRILLER star's forthcoming child trial molestation trial.
Lester - famed for his role as OLIVER TWIST in the hit 1960's movie musical OLIVER! - befriended Jackson 25 years ago and is godfather to two of Jackson's children.
And he was at the superstar's Neverland Ranch home in Santa Barbara, California at the time the prosecution claims Jackson assaulted minors, so believes he can prove Jackson's innocence.
He says, "Michael is innocent. I could be called as a witness because of what I know. I saw things that could be helpful to his case. The allegations against him are complete and utter nonsense.
"I would totally trust my children with him. He is their godfather, why shouldn't I."

Hoorde zoiets dat er 750 mensen gekeurd worden door zowel de aanklagers als de verdedigers. Zodat er geen rare personen in de jury kunnen zitten.
Ik heb ergens gelezen dat er 300 kandidaten zijn en dat ze er maandag met 100 beginnen te horen. En in de daarop volgende dagen de rest. Wanneer de jury daadwerkelijk is samengesteld weet ik niet meer precies...

Volgens mij hebben 400 mensen een bericht ontvangen maar wordt er maar uit een paar honderd geselecteerd.

Een paar 'big blows' gisteren voor de aanklagers. De rechter heeft bepaald dat Gavin en zijn broertje gewoon in de publieke rechtszaal zijn verklaring moet afleggen. Sneddon en consorten wilden juist dat ze in een apart kamertje hun verklaring konden doen, met alleen een audio-feed naar de verslaggevers in de zaal. Dat gaat dus mooi niet door, want de lichaamstaal van Gavin zal natuurlijk een grote rol spelen in deze zaak, maar blijkbaar had Sneddon daar niet zoveel vertrouwen in.
Ook mag Gavin niet meer worden aangeduid als 'slachtoffer' ('victim') maar gewoon als aanklager.

Prosecutor Ron Zonen said the 50 print and video items that were seized in 2003 included graphic sexual material that was both heterosexual and homosexual in nature. The material also included nude photos of models who may have been 18 but looked much younger, he said.
The items will show Jackson had a "prurient interest" in boys or was intended for use to as "grooming material" to make children more accommodating to sexual advances, Zonen said.
Defense attorney Thomas Mesereau Jr. countered that all the materials seized were legal. In the case of the magazine with the prints, he said evidence will show Jackson took it away from his accuser and locked it up.

In the Michael Jackson (search) case a jury is about to be empanelled. This comes fresh on the heels of a damaging and destructive leak from the supposedly secret grand jury. These allegations, in my opinion, unfairly taint the jury pool and make it difficult for Jackson to have a fair trial.
In a world exclusive two weeks ago, I spoke to the King of Pop. Jackson is gagged and cannot speak about the allegations, the accusers or the leaks in specific terms, but he was allowed by the judge in the case to read a prepared statement.
In light of recent events concerning the case I thought I would show you the statement to give you a glimpse of a special "At Large with Geraldo Rivera," which will air next week. Here is what Michael said:
"Yes, in the last two weeks, a large amount of ugly, malicious information has been released into the media about me. Apparently, this information was leaked through transcripts in a grand jury proceeding where neither my lawyers nor I ever appeared. The information is disgusting and false.
"Years ago, I allowed a family to visit and spend time at Neverland. Neverland is my home. I allowed this family into my home because they told me their son was ill with cancer and needed my help.
"Through the years, I have helped thousands of children who were ill or in distress.
"These events have caused a nightmare for my family, my children and me. I never intend to place myself in so vulnerable a position again.
"I love my community and I have great faith in our justice system. Please keep an open mind and let me have my day in court. I deserve a fair trial like every other American citizen. I will be acquitted and vindicated when the truth is told."
I asked Michael if there was anything else he wanted to add. At first he said no, but later added, "I would just like for the public to keep my family and myself in their prayers. That would be very nice."
