Whatever comes of this meeting — even if Trump does, in fact, gain some concessions from Putin, and even if Putin does not get what he wants out of Trump — that storyline will remain operative. The known facts have now established it beyond any reasonable doubt, and the only alternative interpretations of that now-established basic bargain that make any sense are actually more nefarious than that one.

In Helsinki today, Trump and Putin spoke to reporters before entering their private meeting. Trump predicted that “I think we will end up having an extraordinary relationship,” adding that “getting along with Russia is a good thing, not a bad thing.” But as The Post’s write-up puts it: “Trump did not mention Russia’s interference in the 2016 presidential campaign as one of the topics to be discussed.”

On Friday, special counsel Robert S. Mueller III indicted a dozen Russian military intelligence officials in an extraordinary and wide-ranging set of cyberattacks on Hillary Clinton’s campaign and Democratic National Committee officials, alleging a detailed plot to sabotage the election that established the clearest connection yet to the Russian government. Yet not only did Trump fail to say he’d bring up Russian sabotage of our election with Putin, he also tweeted this:

In blaming only previous U.S. leadership and the current Mueller probe for bad relations with Russia — and not Russia’s attack on our democracy, which is particularly galling, now that this attack has been described in great new detail — Trump is not merely spinning in a way that benefits himself. He’s also giving a gift to Putin, by signaling that he will continue to do all he can to delegitimize efforts to establish the full truth about Russian interference, which in turn telegraphs that Russia can continue such efforts in the future (which U.S. intelligence officials have warned will happen in the 2018 elections). In a sense, by doing this, Trump is colluding with such efforts right now.

It has been widely pointed out that Putin benefits from today’s meeting simply because it is happening. As the New York Times puts it, the meeting will be a “success” if it takes place “without any major friction,” which would provide “a symbolic end to Western efforts to isolate Russia over its actions against Ukraine in 2014.” On top of this, of course, all the other actions Trump is taking to destabilize the Western international order — the escalating trade wars, the attacks on NATO that are obviously designed to weaken it — also benefit Putin.

But the point I want to make here is that, even if you do not view those steps by Trump as a kind of reward to Putin for helping swing the election, since they could be motivated by all sorts of other things, it is unavoidably clear — based on the new information and Trumpian conduct we’ve seen in the past few days — that Trump’s ongoing treatment of Russian electoral interference in particular is essentially a reward for doing just that. Even if Trump does end up taking a tougher line with Russia on international affairs, that point stands, as long as he continues to dismiss the seriousness of the sabotage itself.

Alternatively, even if you think Trump should be trying for smoother relations with Russia, he could (and should) pair such an effort with genuine condemnation of Russian interference and a serious effort to ward it off in the future, since, after all, what’s at stake is our democracy. Indeed, as the Lawfare team points out, Mueller’s indictment basically reveals that Putin has been lying to Trump all along about the scale and scope of Russia’s sabotage effort.

But Trump is now shrugging at that confirmed lying, and he’s still not taking this act of sabotage at all seriously. Remember, Trump himself called on Russia to hack Clinton’s emails. And according to a tally by ThinkProgress, Trump publicly drew attention to the material leaked by WikiLeaks — which received it from Russia, according to the Mueller indictment — more than 100 times during the campaign. We don’t know how much influence this sabotage had. But as Democratic strategist Simon Rosenberg points out, beyond how many votes were directly moved, the DNC was badly disabled by the cyber subterfuge at a critical moment, which had to have had some kind of serious impact.

Trump, who himself used the material funneled through WikiLeaks by Russia as a weapon, is in effect now rewarding Russian efforts to supply it, by refusing to treat this sabotage as a crime against our political system. You can, of course, adopt far worse interpretations of what Trump is giving to Putin as part of this basic bargain, and of his motives for doing so. But even if you don’t, this one is now inescapable.

In addition to calling the European Union a "foe" of the U.S. and criticizing British Prime Minister Theresa May for her handling of Brexit, Mr. Trump slammed fellow NATO countries for not contributing more towards defense spending.

On "CBS This Morning" Monday, Ian Bremmer, president of the Eurasia Group and a CBS News senior global affairs contributor, said that backstage at the NATO meeting there were elements that were even more eyebrow-raising than reports have suggested.

"One is that emergency session where they asked the Georgian and Ukrainian presidents to leave in the middle of their presentation. Apparently Trump said, 'OK, we're done with you now,'" Bremmer said.

"Trump was very frustrated; he wasn't getting commitments from other leaders to spend more. Many of them said, 'Well, we have to ask our parliaments. We have a process; we can't just tell you we're going to spend more, we have a legal process.' Trump turns around to the Turkish president, Recep Erdogan, and says, 'Except for Erdogan over here. He does things the right way,' and then actually fist-bumps the Turkish president."

It was a startling gesture of support for the increasingly authoritarian Turkish leader, who recently won another term and is widely expected to continue consolidating his power.

"If you want to talk about to what extent the allies are comfortable with Trump as a person, a strongman leader, what we saw at the G-20. at that second meeting, what we see now with NATO and the Putin meeting, this is a very visible suggestion," Bremmer said.

"Which would make a fist bump unattractive and disturbing to people - it's a universal sign of 'Way to go, good job,'" said co-host Gayle King.

Bremmer agreed that heralding a strongman leader like Erdogan, who has initiated purges internally against critics and who has no effective domestic opposition, would make other European leaders nervous. "Turkey is hardly a liberal democracy at this point," he said.

Bremmer also spoke to Mr. Trump's announcement at the end of the NATO talks when he took credit for an increase in allies' defense spending despite no announcement of increase.

"Apparently the Dutch prime minister, Mark Rutte, was the last person to intervene at the summit," said Bremmer. "Before Trump had his press conference he said [to the president], 'Look, you're really frustrated. Why don't you just take a victory lap? Say that the allies have been spending $32 billion more since you became president. Take credit for it.' That's the last thing Trump heard before he left the meeting."

While Mr. Trump has been lambasting U.S. allies, he has also been praising Russian President Putin, congratulating him for hosting the World Cup tournament.

On Monday, before sitting down for their private one-on-one meeting, the two men spoke to the press. "We have discussions on everything from trade to military, to missiles, to nuclear, to China. We'll be talking a little bit about China, our mutual friend President Xi," Mr. Trump said. "We have great opportunities together as two countries that frankly we have not been getting along very well for the last number of years.

"I think we'll end up having an extraordinary relationship," he predicted.

Mr. Trump added that the fact the U.S. and Russia share a commonality in being nuclear powers is "not a good thing; that's a bad thing."

King asked Bremmer, "What do you make of the comments the two men made, President Putin and President Trump, before they sat down together?"

"I think [it's] interesting that Trump specifically talked about China, talked about China up there a bit more than any other thing he mentioned," Bremmer replied.

"He did not mention Russian meddling [in the U.S. election]," said King.

On Sunday, President Donald Trump stated he “hadn’t thought of” pressing Vladimir Putin to extradite the dozen Russian nationals indicted earlier that week by Special Counsel Robert Mueller. When asked why not, National Security Adviser John Bolton gave a response that sounded legalistic: it would be “pretty silly” for President Trump to request the Russian fugitives’ extradition, he contended, because the United States lacks an extradition treaty with Russia and Russian law forbids extradition of its own nationals. Both should know better. Their comments suggest not that the Administration lacks legal options, but that it has no political will to seriously seek custody of the Russian fugitives. (Just Security).

Trump and Bolton’s comments fail—perhaps deliberately—to acknowledge the myriad legal options typically available to the U.S. government in what I call “foreign affairs prosecutions,” or criminal cases in which the executive branch is engaging its prosecutorial power and foreign affairs power at the same time. Such cases have proliferated in recent years due to the rise of transnational crime, which has in turn triggered legal adaptations to U.S. criminal law and procedure to close impunity gaps. Examples include the cases of corrupt FIFA officials, Mexican drug lord Joaquin “El Chapo” Guzman Loera, and Edward Snowden.

The Russian hacking case involves a very typical issue arising in foreign affairs prosecutions, namely, obtaining custody of fugitives abroad. The relevant part of the U.S. federal code (18 U.S.C. § 3181) requires a bilateral extradition treaty in order for the United States to extradite a fugitive to another country. When the United States is seeking a fugitive from abroad, however, the United States may request that the country extradite pursuant to its domestic law, which may not have such a treaty requirement. In this particular case, the United States does not have an extradition treaty with Russia, and the Russian Constitution appears to foreclose extradition of its nationals.

But this is only part of the story. In their Helsinki meeting, President Trump can—and should—press Vladimir Putin to support criminal accountability for the indicted Russian hackers on at least four fronts:

First, President Trump should insist that, if Putin is indeed concerned about illegal actions against the Democratic National Committee by agents supposedly not connected to the Russian state, the Russian government take any other action available under Russian law to transfer these fugitives to the United States. He should not accept Putin’s excuse that the Russian constitution legally bars the formal extradition of every requested Russian, as other measures to facilitate cooperative transfer outside the scope of an extradition treaty may be available to the Russian government. By comparison, the Brazilian Constitution also formally prohibits the extradition of its nationals, but contains exceptions for crimes committed before a Brazilian citizen is naturalized or cases of narcotics or other drug trafficking. Additionally, based on past experiences involving Russia and the United Kingdom, an act of the Russian Parliament could potentially overcome the constitutional hurdle. President Trump should explore any and all such avenues.

Second, if Putin is genuinely concerned about these crimes, President Trump should push for the Russian government to investigate and prosecute the twelve defendants within Russia itself. Customarily, the Department of Justice will request that such prosecution occur in cases where extradition or other transfer is unavailable. While a second-best option, it preserves the U.S. prosecutorial interest in ensuring that those who have committed such transnational crimes are held criminally accountable.

Third, President Trump should tell Putin that the U.S. government has or will put out Interpol Red Notices for the Russian fugitives. That action would mean any indicted Russian national crossing a third-party national border would, at a minimum, be detained for a certain number of hours; other countries may use the Red Notice as domestic legal authority to arrest the fugitive. The U.S. could then follow with a request for provisional arrest (reserved for cases of urgency) and/or extradition from the country where the suspect is detained. This method has succeeded in the past, despite Kremlin interference, for example, in obtaining the extradition of a Russian national from Thailand to face justice in the Southern District of New York.

Finally, the Trump Administration is well aware that other legal avenues are theoretically available should Putin fail to take meaningful steps to investigate, prosecute, or surrender the suspects. Although such avenues carry much more problematic consequences for U.S. foreign policy and individual rights, if the Administration wanted to get tough with Putin, Trump or Bolton could publicly signal that these options are legally available. In theory, the U.S. government could lure the Russian nationals to a third-party state that would then extradite, expel, or deport them to the United States. Even more dramatically—and undesirably for a number of reasons—U.S. law enforcement could also abduct Russian nationals and bring them to the United States for prosecution. The situation would be broadly analogous to the facts in the Supreme Court case of United States v. Alvarez-Machain, in which U.S. law enforcement abducted a Mexican national accused of participating in the torture and killing of a DEA agent. The Supreme Court famously held that the abduction did not violate the U.S.-Mexico extradition treaty, and thus a U.S. court could assert personal jurisdiction over the fugitive under the Ker–Frisbie doctrine. Presumably the Trump Administration understands that this drastic option is available under domestic law. In the present case, given the absence of a U.S.-Russia extradition treaty, a U.S. federal court would be virtually guaranteed to accept jurisdiction over the defendants, although there would be serious claims that state sovereignty had been infringed. And yet, ironically, violations of state sovereignty are what the Russian hacking scandal is about in the first place. Indeed, although it is beyond the scope of this comment, the United States may be able to claim that certain enforcement actions are lawful acts of reprisal, that is, countermeasures taken in response to past and ongoing Russian violations of international law.

In sum, Trump’s and Bolton’s comments are a misdirection. Most likely, they are using false notions of international law to hide their obvious political unwillingness to do what government officials would logically do if they were genuinely eager to get to the bottom of Russian hacking. Bolton plainly dissembled when suggesting that international or domestic law somehow legally bars Trump from pressing Putin regarding the surrender of the dozen Russian nationals indicted last week. Bolton’s assertion of legal inability reads like a transparent excuse to justify Trump’s political unwillingness to further U.S. prosecutorial interests and to protect the integrity of U.S. democratic elections. If Putin seriously wanted to help the United States get to the bottom of interference in the 2016 U.S. election—and if Trump seriously wanted to press him to do it—there are several legal avenues that both could pursue. Given the gravity of the charges, Trump should vigorously press Putin to explore all of those avenues. His failure to do so in Helsinki would provide yet more fuel for the growing suspicion that the real reason he is dragging his feet on confronting Putin is that they share a common interest in not wanting Special Counsel Mueller’s investigation to succeed—whether or not it reached the question of collusion—and that is astounding.

We’re going to have to consider the implications of the fact that after everything we’ve learned, Trump takes the word of a hostile dictator who murders his political enemies over that of Americans intelligence agencies and the American Justice Department. But in the wake of the latest indictment special counsel Robert S. Mueller III handed down on Friday, charging a group of Russian intelligence officials with intervening in the 2016 election in order to assist Trump’s campaign, we need to realize that there’s an element of this story that has been widely overlooked, one that may be almost as important in the long run as what went on with the Trump campaign.

While we’re all (properly) asking how deep the Trump campaign’s collusion with the Russians went, we should also be taking a good hard look into the collusion that apparently took place between the Russians and others in the Republican Party, not to help Trump, but to help Republicans running for Congress.

Why exactly the Russian government thought it was important to their own goals that the GOP retain its congressional majority isn’t clear, but according to Mueller, they did. And at least some Republicans were happy to get the assistance.

Let’s begin with what we already knew something about. Much of the attention in 2016 went to the hacks into the email systems of Clinton campaign chair John Podesta and the Democratic National Committee, in which the Russians were able to obtain emails showing that people within the party had a preference for Hillary Clinton winning the presidential nomination. Those emails were then passed to Wikileaks, which was eager to release them during the Democratic convention to sow dissension between supporters of Clinton and Bernie Sanders. According to the indictment, Wikileaks sent a message to the Russians on July 6, 2016, reading, “if you have anything hillary related we want it in the next tweo [sic] days prefable [sic] because the DNC [Democratic National Convention] is approaching and she will solidify bernie supporters behind her after.”

What got much less attention was the fact that the Russians also hacked into the system of the Democratic Congressional Campaign Committee, the arm of the party devoted to getting Democrats elected to the House. As the New York Times reported in December 2016, the Russians, using the “Guccifer 2.0” persona, released caches of documents from the DCCC to reporters and bloggers around the country in order to embarrass Democratic candidates. As one candidate said, “Our entire internal strategy plan was made public, and suddenly all this material was out there and could be used against me.”

As the reporters noted, “The seats that Guccifer 2.0 targeted in the document dumps were hardly random: They were some of the most competitive House races in the country.” This is one of the most curious parts of this whole story. How did a bunch of Russian intelligence operatives choose which candidates to target? For instance, former Nebraska congressman Brad Ashford — hardly a household name even in America, let alone in Russia — announced on Friday that his campaign’s emails had been hacked in 2016, likely by the Russians, which he didn’t reveal at the time. He lost his reelection race.

In addition, information from the stolen emails was used by the Congressional Leadership Fund, a PAC with close ties to Speaker of the House Paul Ryan, in order to criticize Democrats.

But one of the most striking revelations in the indictment is this:

On or about August 15, 2016, the Conspirators, posing as Guccifer 2.0, received a request for stolen documents from a candidate for the U.S. Congress. The Conspirators responded using the Guccifer 2.0 persona and sent the candidate stolen documents related to the candidate’s opponent.

We don’t know who that candidate is, but suspicion has centered around a group of Republican members of Congress from Florida. In 2017, the Wall Street Journal reported that a campaign consultant for one of those members, Rep. Brian Mast, said “I did adjust some voting targets based on some data I saw from the leaks.” The Mast campaign has issued denials that it used any hacked data.

Presumably, Mueller will reveal at some point who the congressional candidate was who requested, and received, stolen documents from the Russians. If that candidate is a current member of Congress, their constituents might like to know before casting their votes in November.

When it comes to Republicans, we’re faced with two related issues. First, there are members of their party who actively benefited from Russian manipulation of our election, and even sought out help that turned out to come from Russia, whether they fully understood it at the time. Second, much of the rest of their party is now arguing that it’s really no big deal if the Russians manipulate American elections, so long as the GOP is the one that benefits.

And today we got the extraordinary spectacle of the president of the United States standing alongside the Russian dictator, saying he takes that dictator at his word and belittling the investigation into Russia’s attack on American democracy. Which led the former director of the CIA to tweet this:

Whether you agree with Brennan’s invocation of treason, his last question is one we still don’t have an answer to.

We all know how eager the Trump campaign was to work with the Russian government when the campaign believed the Russians had dirt on Hillary Clinton to share. But just as we’ve seen so many times before, Donald Trump’s naked corruption is merely a more unapologetic version of what’s happening within the Republican Party. So the question now is: Is this still going on? Are any Republican candidates currently receiving information obtained through Russian hacking about their opponents?

We can certainly hope not, but it isn’t something we should take for granted. Nothing they have said or done would lead us to believe they’d have any qualms about getting more Russian help if they thought they could get away with it.

Just a few years ago, Maria Butina owned a furniture store in Siberia. Now she’s wheeling and dealing with D.C. think-tankers, Republican strategists, and a Russian bank chief with alleged mob connections.

Depending on the audience, Butina has presented herself as a Russian central bank staffer, a leading gun rights advocate, a “representative of the Russian Federation,” a Washington, D.C., graduate student, a journalist, and a connection between Team Trump and Russia. She used each role to help her gain more high-level contacts in the nation’s capital.

It’s another chapter in what’s becoming a familiar story in Washington: Kremlin-connected operators building bridges to the GOP.

Ever since U.S. intelligence services concluded that Russia was meddling in the American presidential elections, Team Trump’s ties to Russia have been highly scrutinized. The president’s national security adviser, Michael Flynn, resigned because he misled his bosses about his contacts with the Russian government; and his former campaign manager, Paul Manafort, also resigned due to questions about his relationship with Russia.

Butina’s relationships, formed with Washington’s conservative society through her fierce advocacy for firearms—one conference described her as the “public face of gun rights in the Russian Federation”—provide a previously unreported link between the Russian government and the Republican Party.

Two of Butina’s friendships in particular have raised eyebrows. She started a business with Paul Erickson, a decades-long Republican Party activist. And she served as a special assistant to the deputy governor of Russia’s central bank, Alexander Torshin, a former Russian senator belonging to Vladimir Putin’s political party with alleged ties to the Russian mob world.

On Nov. 12, 2016, shortly after the election of President Donald Trump, Butina held a birthday party at Cafe Deluxe near American University, where she attends graduate school classes.

The event was a costume party attended by Trump campaign aides and Erickson, who told guests that he was on the Trump presidential transition team. She dressed as Russian Empress Alexandra while Erickson was dressed as Rasputin.

As chilled vodka flowed through an ice sculpture—a bottle imprinted with the Soviet hammer and sickle—she took some time to brag. She brazenly claimed that she had been part of the Trump campaign’s communications with Russia, two individuals who were present said. On other occasions, in one of her graduate classes, she repeated this claim.

“She said so in my class. And she said so several times in the last semester,” Svetlana Savranskaya, Butina’s former American University professor and a staffer at the National Security Archive, told The Daily Beast. “She is a former journalist, so she keeps up her connections in Russia. And she also works and [claims to] keep connections with a member of the Russian Duma.”

Erickson and Butina have been seen in public frequently, at the invitation-only Freedom Ball after Trump’s inauguration; and holding court at Russia House, a Russian-themed bar in Washington, D.C.’s Dupont Circle. At one such gathering in the fall of 2016 Erickson bragged that he was advising the Trump transition team, according to two sources who were present; he is also said to have told a story about introducing Mikhail Kalashnikov, inventor of the AK-47, to former NRA president David Keene. (Kalashnikov allegedly inspired the creation of “The Right to Bear Arms,” Butina’s gun rights group.)

The two appear to have gotten close: Erickson formed a limited liability corporation with Butina in February 2016, according to the South Dakota secretary of state. It is unclear what this organization, Bridges, LLC, actually does. (Despite living in Washington, D.C., Butina has a cellphone number with a South Dakota area code.)

As a former board member of the American Conservative Union—an influential conservative group that puts on the annual Conservative Political Action Conference—Erickson has a formidable network of contacts on the right. For example, he served on the American Conservative Union board with Becky Norton Dunlop, a senior Trump transition team official.

The White House did not comment on whether Erickson served on or advised the Trump transition team.

Erickson has been active within Republican and conservatives circles for decades, first appearing on the national stage as treasurer of the College Republicans in 1984. A 1992 Los Angeles Times report identifies him as the national political director for Pat Buchanan’s presidential campaign, while a more recent report gives him a more senior title.

“Erickson had participated in every GOP presidential primary campaign since 1980 and was Pat Buchanan’s presidential campaign manager in 1992,” an article in Forbes in December 2016 reads. “He is a sort of ‘secret master of the political universe’ known almost exclusively to the cognoscenti.”

Erickson was an adviser to the Mitt Romney campaign, a former board member of the ACU, a 2012 Mitt Romney delegate, and an attendee at the Trump inaugural address. He’s also identified in a USA Today obituary as a “friend and ally” of the late Breitbart News founder Andrew Breitbart.

During this time, Butina was building a reputation as a gun rights champion in Russia. She helped create “The Right to Bear Arms," her group advocating for Russian gun owners, in 2011.

“We protect gun rights in Russia, and people who are gun owners and in a situation of self-defense,” Butina told Townhall, a conservative news site, in May 2014, after she attended the annual NRA Women’s Leadership Luncheon in Indianapolis.

That fall, Butina’s group hosted Erickson at its Moscow headquarters. The event advertised Erickson as a veteran of six presidential campaigns who had worked in the Reagan White House.

But Erickson isn’t Butina’s only well-connected friend. She is also close with Torshin, a former Russian lawmaker. Torshin was the deputy speaker of Russia’s parliament for more than a decade, and spent time on Russia’s powerful National Anti-Terrorism Committee, a state body that includes the director of the FSB and the ministers of defense, interior, and foreign affairs.

When Torshin was a deputy governor of Russia’s central bank, Butina served as his aide, according to an archived version of her personal website, which went offline around the time she moved to Washington, D.C., in the fall of 2016. The former Russian senator has tweeted about her frequently, posting photos of her on the social media network.

Torshin and Butina are both passionate defenders of gun owners’ rights. Both are lifetime members of the NRA (the only two Russians he knew to be lifetime members, Torshin once tweeted). The two attended the NRA’s annual meeting in 2014 as a special guests of then-NRA president David Keene.

“We are a young organization. We are three years old. And we invited David Keene. He made a speech at our annual meeting. And so it’s like an answer from one side,” Butina told Townhall. “The next side is the life member of our organization. He is our Russian senator. His name is Senator Alexander Torshin. He is a life member of NRA too, and he’s usually a participant of such events, and every annual meeting of NRA. But now the situation between (our) two countries is very difficult. And we have to go here together with Senator Torshin. He is a great gun lover, he supports our organization and he’s a friend of the NRA.”

As Butina mentioned, 2014 was a difficult time for U.S.-Russian relations. After the takeover of Crimea and the invasion of eastern Ukraine, the Obama administration slapped sanctions on Russian banks and Putin’s inner circle.

It was also a period of recovery for Torshin. The year before, in 2013, Spanish authorities completed a three-year probe into Russian mob activity in their country. In their confidential report they alleged that Torshin helped a Russian mob syndicate in Moscow launder money through banks and properties in Spain. This accusation is based in part on recordings of phone conversations Torshin had with an alleged Russian mobster in 2012 and 2013. Bloomberg News broke news of this confidential report in 2016, although Torshin denied the allegations. Torshin did not respond to a list of questions from The Daily Beast.

Torshin’s assets have skyrocketed over the last few years, according to Transparency International, a watchdog organization that tracks the net worth of Russian officials.

“One of Torshin’s superiors at the bank between 1995 and 1998, former First Deputy Governor Sergey Aleksashenko, said Torshin may have returned to his old post at the behest of the Federal Security Service, or FSB, with which he appears to have longstanding ties,” Bloomberg reported. “Aleksashenko, a former head of Merrill Lynch in Moscow, is now a senior fellow at the Brookings Institution in Washington.”

Despite his ties to Russia, Torshin is still welcome in conservative circles. In May 2016, he returned to the NRA’s annual convention and shared a dinner table with Donald Trump Jr., according to the same Bloomberg report.

Neither Erickson nor Butina responded to multiple Daily Beast requests for comment through emails, texts, and phone calls. Neither responded to a list of detailed questions regarding this article.

But ultimately, the Torshin-Butina-Erickson link serves as another set of relationships between influential Russian figures and Washington power players—just as the FBI and several Senate committees examine Moscow’s impact on the American political scene. Just this week, The New York Times reported on a back-channel proposal that described a way to lift sanctions against Russia while ending the conflict in Ukraine, delivered to the White House through Trump’s lawyer Michael Cohen.

One thing that’s clear: Trump himself is beginning to back away, at least in public, from any perceived connections to Russia.

On July 11, 2015—more than a year before she began her studies at American University—Butina was in Las Vegas at an early rally for Trump’s embryonic presidential campaign. During a question-and-answer session, she asked Trump about Russian sanctions.

“I’m from Russia. My question will be about foreign politics,” Butina said, glancing at prepared notes. “If you will be elected as president, what will be your foreign politics especially in the relationships with my country? Do you want to continue the policy of sanctions that are damaging [to] both economies? Or [do you] have any other ideas?”

“I know Putin, and I’ll tell you what, we’ll get along with Putin,” Trump said in his response to Butina. “I would get along very nicely with Putin, I mean, where we have the strength. I don’t think you’d need the sanctions. I think we would get along very, very well.”

These days, with revelations about Russia’s interference in the American presidential elections mounting, Trump gives a very different answer. “I don’t know Putin,” he tweeted earlier this month.

“I have nothing to do with Russia,” Trump added in a Feb. 16 press conference. “Haven’t made a phone call to Russia in years. Don’t speak to people from Russia. Not that I wouldn’t. I just have nobody to speak to.”

Much speculation has centered on one particular meeting that took place among Erik Prince, founder of the security company Blackwater; Kirill Dmitriev, the director of one of Russia's sovereign wealth funds; and Crown Prince Mohammed Bin Zayed Al-Nahyan, the effective ruler of the United Arab Emirates, also known as "MBZ."

Participants of other meetings that week in January, which focused generally on Syria, energy and sanctions, hailed from Russia, Saudi Arabia, the United Arab Emirates, Israel and the U.S., according to three people with knowledge of the meetings.

All three requested to remain anonymous because they feared retribution from their respective governments. The presence of several other Russians raises questions about Kremlin influence in the meetings.

Several of the meetings focused on the lifting of Russian sanctions to facilitate trade, the sources said.

It's unclear how many representatives from each country attended the meetings, some of which were informal conversations over dinner. But new information points to more than 10 Russians, some linked to the Kremlin, participating in discussions.

NJ Advance Media reported in May that an aircraft linked to the Russian government landed in the Seychelles the day before Prince allegedly met with Dmitriev, which raised questions about the scope of the meetings and whether sanctions were a topic of conversation.

The Russian plane in question departed from Moscow, stopped in Dubai, and landed in the Seychelles at 4:21 p.m. Jan. 10, 2017, according to the Seychelles Civil Aviation Authority -- one day before Prince arrived on the island. The plane carried six passengers, including flight crew.

The passengers stayed at the Four Seasons Hotel -- the scene for the meetings that week in January.

Two individuals familiar with the aircraft's purchasing history said the aircraft is owned by Andrei Skoch, a Russian billionaire who made his fortune in the mining business and is now a deputy in the Russian State Duma, the country's legislative body. Skoch is currently under U.S. sanctions.

That same plane flew to Dubai later in the day on Jan. 10. It returned to the island days later and departed Jan. 19 with a total of 16 passengers. The World Economic Forum began Jan. 20 in Switzerland.

Two individuals with knowledge of the meetings in the Seychelles said several of the individuals who flew out on Jan. 19 participated directly in meetings that focused on international trade and sanctions.

The plane that carried the Russians to the island in January returned in March around the same time as George Nader -- the Lebanese-American businessman cooperating with Mueller who helped broker the meeting between Prince and Dmitriev.

The Russian plane left the island in March with 20 passengers and flew back to Vnukovo International Airport in Moscow.

Other individuals on the island the same week as Prince in January 2017 included Alexander Mashkevitch, an alleged financier of Bayrock, an investment vehicle linked to Trump; and Sheikh Abdulrahman Khalid BinMahfouz, according to flight records. BinMahfouz's father, before his death, was a billionaire and the former chairman of Saudi Arabia's first private bank.

Special Counsel Robert Mueller and his Justice Department/FBI team deserve congratulations for doing their job of figuring out in concrete detail what the Russians did in the 2016 election campaign and telling the American people about it—now in an indictment and perhaps later, and in more detail, in a report. Last week’s indictment might also portend, as the Lawfare crew implied, a tightening of the criminal-conspiracy noose to include Americans, perhaps some with connections to the Trump campaign. The indictment also represents an extraordinary assertion of Justice Department power and independence. President Trump never stops complaining about the DOJ “witch hunt,” but his subordinates in the Potemkin unitary executive branch keep proving him wrong. The president didn’t even have the de facto authority to delay Rod Rosenstein’s announcement from the maximum embarrassment it caused him on the dawn of his summit with Vladimir Putin. With each new concrete revelation contrary to the president’s wishes and representations, Rosenstein’s and Mueller’s effective power grows vis-a-vis the president.

But behind the indictment, and the congratulatory reaction to it, lie some uncomfortable unanswered questions about blowback toward U.S. officials, reciprocal interference by the United States in other nations political affairs, the lack of preparation for renewed electoral interference in this country, and U.S. journalists’ publication of stolen U.S. government information. These questions have heightened significance and more difficult answers in light of President Trump’s astounding performance Monday in Helsinki.

1. Blowback

I have been critical of the Justice Department’s “indict and shame” strategy in the past, and I noted the downsides of Mueller’s first indictment. I agree that indictments can serve useful goals, as David Kris noted in the best account of law enforcement as a counterintelligence tool. And Mueller’s “speaking indictment” certainly serves the very important goal of telling the American people what happened in 2016. I continue to think, however, that as a substitute for other responses to serious cyberintrusions, indictments on balance signal weakness.

What I want to focus on here is how this highest-profile-yet indictment of foreign officials for breaking into computers in the United States raises questions about reciprocity and blowback. As the Snowden documents and David Sanger’s great new book and other books make plain, and as U.S. officials are wont to brag, the U.S. intelligence services break into computers and computer networks abroad at an astounding rate, certainly on a greater scale than any other intelligence service in the world. Every one of these intrusions in another country violates that country’s criminal laws prohibiting unauthorized computer access and damage, no less than the Russian violations of U.S. laws outlined in Mueller’s indictment. This is not a claim about the relative moral merits of the two countries’ cyber intrusions; it is simply a claim that each side unequivocally breaks the laws of the other in its cyber-espionage activities.

How will the United States respond when Russia and China and Iran start naming and indicting U.S. officials? Maybe the United States thinks its concealment techniques are so good that the type of detailed attribution it made against the Russians is infeasible. (The Shadow Brokers threatened to reveal the identities of specific NSA operators, and in fact might have done so, so even if the National Security Agency is great at concealment as a matter of tradecraft that is no protection against an insider threat.) Maybe Russia and China and Iran won’t bother indicting U.S. officials unless and until the indictments actually materialize into a trial, which they likely never will. But what is the answer in principle? And what is the U.S. policy (if any) that is being communicated to military and civilian operators who face this threat? What is the U.S. government response to former NSA official Jake Williams, who worked in Tailored Access Operations and who presumably spoke for many others at NSA when he said that “charging military/gov hackers is dumb and WILL eventually hurt the US”?

2. Interference and Reciprocity

The Mueller indictment was greeted by outrage anew—outrage that is reaching new heights after President Trump’s Russia-friendly press conference. But is there a principled basis on which the United States can object to the Russian interference? Recall that President Obama boasted that U.S. offensive cyber capacities were the greatest in the world. Sanger reports that “the United States remains the world’s stealthiest, most skillful cyberpower.” Then consider:


• The wide array of U.S. cyber intrusions abroad revealed by Snowden.
• Olympic Games, the operation against Iranian centrifuges that Michael Hayden compared in significance to the use of nuclear weapons in August 1945.
• The Shadow Broker leaks of many of the NSA’s offensive tools and what the NSA was doing with those tools.
• The U.S. Internet Freedom program, which (among other things) provides cyber tools and training to activists in authoritarian nations with the aim of achieving political change there.
• U.S. officials assisting and urging U.S. social media giants such as Twitter to help activists bring down foreign governments.

This is but a bit of the public evidence—surely a tiny sliver of the overall evidence—of U.S. “interferences” abroad using offensive cyber tools of various sorts. These interferences are why the United States, along with Russia, is widely viewed as one of the world’s most dangerous cyber bullies (if not the most dangerous), and not just by authoritarian states. The U.S. interferences don’t in any moral sense “justify” what Russia did in 2016, though they might have—as Sanger and I and others have suggested—invited or encouraged them. Nor do U.S. cyber interferences abroad in any way impact Mueller’s work, which is to find out what Russia did so the United States can hold the relevant actors responsible to the extent possible and, hopefully, do better the next time.

But U.S. interferences abroad do raise the question: What is the U.S. objection in principle if others do to us as we do to them? The Mueller indictment at bottom accuses the named Russians of hacking into computers in the United States, stealing information, and using that information in public to Russia’s advantage. Similarly, the United States uses the masses of digital information it steals to its advantage in every element of its international relations, including to influence foreign political outcomes.

It is no response to say that the United States doesn’t meddle in foreign elections, because it has in the past—at least as recently as Bill Clinton’s intervention in the Russian presidential election of 1996 and possibly as recently as the Hillary Clinton State Department’s alleged intervention in Russia’s 2011 legislative elections. And during the Cold War the United States intervened in numerous foreign elections, more than twice as often as the Soviet Union. Intelligence history expert Loch Johnson told Scott Shane that the 2016 Russia electoral interference is “the cyber-age version of standard United States practice for decades, whenever American officials were worried about a foreign vote.” The CIA’s former chief of Russia operations, Steven L. Hall, told Shane: “If you ask an intelligence officer, did the Russians break the rules or do something bizarre, the answer is no, not at all.” Hall added that “the United States ‘absolutely’ has carried out such election influence operations historically, and I hope we keep doing it.”

Johnson and Hall argued to Shane that “Russian and American interferences in elections have not been morally equivalent,” since “American interventions have generally been aimed at helping non-authoritarian candidates challenge dictators or otherwise promoting democracy,” while “Russia has more often intervened to disrupt democracy or promote authoritarian rule.” This is descriptively true in general (but not always), comforting to Americans and perhaps of moral relevance. But it won’t influence Putin or other adversaries, and it cuts no ice in international relations generally. Nor is there any relevant distinction in international law. International law almost certainly does not regulate cyber theft, and certainly not in a way that distinguishes what other nations increasingly do to us via cyber theft from what we do to them via cyber theft. It definitely doesn’t distinguish between interferences in foreign nations and their elections to promote democracy and similar interferences that seek to disrupt democracy. Nor does it pick out doxing for particular disapprobation. We can draw distinctions between what the Russians do and what we do from a moral and motivational perspective, and maybe in some factual details, but these differences don’t matter to our adversaries under any shared normative framework.

These are not intended as “gotcha” or “whataboutism” points. Americans are right to be shocked and angry by the revelations in the Mueller indictment, and the government must do everything in its power to ensure that American voters choose leaders without foreign interference. The question is what the United States should do about the unacceptable operations in 2016. So far, it hasn't done much. As I have long argued, I think the United States’ failure to look in the mirror is a large part of the problem. This is a difficult and painful thing to say the same day the president of the United States stood next to Putin, discredited U.S. intelligence agencies, and said “we’re all to blame” for the poor state of U.S.-Russia relations. I am certainly not blaming U.S. intelligence agencies, which don’t control U.S. strategic decisions, for anything. But the reality is that the United States government engages in substantially similar behavior to that which the Russians used to cause us great harm.

This reality has strategic implications for, among other things, the ability to develop bilateral or multilateral international norms as a constraint on the forms of interference the United States abhors. But we are not talking about this reality in the United States. Maybe it’s myopia; maybe it’s fear of charges of moral equivalency. But we’re not talking about it. If as a nation we want to take seriously the threat before us, we should ask whether and how our own actions sparked or invited what we now face and what that implies for our efforts to redress these interferences. To understand this predicament and to have a strategic conversation with allies and adversaries alike, we need an honest, pragmatic assessment of our own conduct that doesn’t fall back on “it’s okay when we do it” justifications. Such assertions, however right as a moral matter, won’t change the behavior of adversaries or improve the U.S. position, and might be a hurdle to both.

Being honest with ourselves is especially important in a world where our adversaries accurately view cyber tools as a relatively inexpensive and hugely effective way to achieve advantage over the United States. I have offered some thoughts (here and here) on how self-candor might lead to progress. Here is another suggestion. The U.S. government has not, to the best of my knowledge, formally or informally claimed that Russia’s 2016 behavior violates international law. Nor (I believe) has it even strongly claimed that infringements of sovereignty of the type the Russians engaged in is unacceptable in international relations. To have any chance of establishing a norm against the operation outlined in Mueller’s indictment (and I am not confident such a norm is possible), the United States needs to draw a strong principled line and defend it. That defense would acknowledge that the United States has interfered in elections itself, renounce those actions and pledge not to do them again; acknowledge that it continues to engage in forms of computer network exploitations for various purposes that it deems legitimate; and state precisely the norm that the United States pledges to stand by and that the Russians violated. It is revealing that the United States has done none of these things. And it is unclear whether it can do them. But this is a necessary first step to creating norms to prohibit what happened in 2016.

Assuming these proposals make sense, it is hard to see how the Trump administration can even begin to implement them. Far from standing up to Putin and wanting to draw a line, Trump shows every sign of accommodating Putin. The president is also in the amazing position of not being credible to his own intelligence agencies about his bona fides when it comes to the Russians. Even if the president were persuaded to push an international norm against what happened in 2016, any proposals along the lines suggested above would likely be pilloried as caving to the Russians or engaging in moral equivalency. I also fear that Trump’s performance Monday will heighten the angry concern that Americans and members of Congress feel about what happened in 2016, and that will make it yet harder to look in the mirror.

3. We Remain Vulnerable

Over the weekend Director of National Intelligence Dan Coats stated that “the digital infrastructure that serves this country is literally under attack” and that “the warning lights are blinking red again,” just as before 9/11. This is unsurprising, since the U.S. government has done amazingly little—at least in public—in response to the many cyber intrusions and attacks over the years. There are many reasons why the United States has reacted so passively. (See my recent paper with Stuart Russell and Sanger’s book.) It is understandable that adversaries would respond to the success of past operations, and the weak U.S. reactions, and the cheapness and plentitude of offensive cyber tools, to seek to wreak more havoc.

In this light, consider the standard phishing attacks described in Mueller’s indictment, which resulted in the theft and release of Democratic Party information that, in the unregulated U.S. speech environment, went viral and had an enormous impact that still reverberates. (President Obama once described the operation as “not particularly sophisticated.”) There has been a lot of talk and a bit of action about hardening voting systems, cleaning up fake accounts on social media, and cracking down more on propaganda efforts on social media of the type Mueller outlined in his February indictment. But when I read Friday’s indictment I thought: We have done nothing as a nation to redress the tactic of phishing, and once information is stolen and released, there is no possibility of regulating its use in the American free speech environment. Expect much more phishing and related tactics in November and in the 2020 presidential campaign.

4. Implications for the Press

Mueller has not yet indicted anyone who worked with the Russians in releasing the stolen information. The Lawfare team summarized the participation of “conspirators” in the indictment as follows:

[The indictment] describes extensive interaction between the conspirators and an entity, called “Organization 1,” which the Washington Post and other news outlets have identified as Wikileaks. In late June 2016, Wikileaks allegedly solicited additional stolen information from Guccifer 2.0, saying that its release of the data “will have a much higher impact than what you are doing.” In early July, citing the upcoming Democratic convention, it allegedly messaged Guccifer 2.0 that “if you have anything hillary related we want it in the next tweo [sic] days” and that “we think trump has only a 25% chance of winning against hillary” so stoking conflict between Clinton and her rival Bernie Sanders “is interesting.”

There is a lot of anger against WikiLeaks and a lot of support for indicting Julian Assange and others related to WikiLeaks for their part in publishing the information stolen by the Russians. If Mueller goes in this direction, he will need to be very careful not to indict Assange for something U.S. journalists do every day. U.S. newspapers publish information stolen via digital means all the time. They also openly solicit such information through SecureDrop portals. Some will say that Assange and others at WikiLeaks can be prosecuted without threatening “real journalists” by charging a conspiracy to steal and share stolen information. I am not at all sure such an indictment wouldn’t apply to many American journalists who actively aid leakers of classified information. And even if such a principle could be crafted that would nab WikiLeaks and spare the New York Times, a successful indictment and prosecution of WikiLeaks figures for conspiring to publish stolen information would certainly narrow protections for “mainstream” journalists and raise questions about SecureDrop and other interactions with sources who peddle stolen information.
