There is nothing in Windows 10 that is going to magically disable/uninstall your pirated video games. They only thing they have control over is software via xbox live and the windows store.

As you can see in context, this is about a Microsoft Account enabled for Windows 10, which syncs your settings, data, and accounts allowing you to move seamless between windows devices. Win10 (just like Win8/8.1) is cloud enabled. If you've used google/yahoo/amazon/apple at all in the past 5 years, they all have similar agreements in order to make your data available to you wherever you are. If you don't like that, then you can turn it off at install or at the desktop after. The settings aren't even hidden, its right under Privacy in the control panel.

So yes, MS collects the data (if you allow it) and can use it for personalized advertising (if you allow it). But this EULA covers everything from Desktops to XBox to Windows Phones. If you have an Android or iOS device, you've already agreed to a similar agreement with other companies. I don't know about you, but I use the shit out of Google Now, but I also don't need those sorts of features on my desktop that doesn't move anywhere. So while I disabled these features on my Desktop's Win10 install, it wasn't out of tin foil hattery, I just don't need those features.

You can use Win10 without a MS account, and then no more data collection. All the features are mostly targeted at mobile users as Win10 is a unified platform, but unlike Android, removing your services account doesn't gut the devices functionality, it's still a PC. Since location specific searching or Cortana (the reason or voice and text collection) are useful on a phone, and Win10 is unified, the defaults are enabled as they can be useful features on something like a Surface Pro, just like Google Now and Siri are useful.

Just as there's no MS account for Win7, you can operate exactly the same under Win10 without the new features and nothing is lost.
