Attorney Ze'ev Dasberg from the judicial institute for terror research, whose sister and brother in law Effi and Yaron Unger were murdered in a terror attack near Kfar Menachem in 1996 filed an additional petition in the high Court, the third of its kind against the Shalit
deal.
In the petition Dasberg claims that according to law, the President does not have the authority to offer a collective pardon, unlike his authority to pardon prisoners individually. The petition further claimed that international law obliges the State to take effective deterrence measures and in his opinion, this deal goes against that law due to the release of the terrorists.

Hamas' military wing Izz ad-Din al-Qassam Brigades spokesperson Abu Obeida said that the prisoners exchange deal between Israel and Hamas was signed in two separate documents – one between Egypt and Hamas, and another one between Egypt and Israel.
According to Abu Obeida, during the indirect negotiations, Shin Bet Chief Yoram Cohen asked twice to meet with the head of the Qassam Brigades' negotiations team Ahmad Jabari, but was denied.

Harsh words from Haim Karisi who lost his daughter Yasmin in the Azor Junction terror attack 11 years ago. On Sunday he was finding it hard to bear the insult as he discovered that Khalil Mohammed Abu Ulbah, the murderer who cost him his daughter, was one of the 477 prisoners set to be released in the first phase of the Shalit deal.

Abu Ulbah was sentenced to eight consecutive life sentences following the February 14 terror attack in 2001 in which he used a bus to run over a group of female soldiers near the Azor Junction. Eight died in the attack and 26 were wounded. Yasmin Karisi was one of those who did not survive.
"We sent our girl to the army, just like they sent Gilad. My girl never made it back and today I feel humiliated, what did we ask for? For them to show a little sensitivity? Cooperation?

"For someone to pick up the phone and say: 'The price is heavy but we decided to release them'. This is a proof of inadequacy for the State of Israel if this is how they act towards the bereaved families."
Another soldier killed in the same attack was Kochava (Kochi) Polanski. "This morning I woke up and I saw it in the newspaper and felt like someone gave me a slap in the face", recalls Tanya Polanski, Kochi's mother, of the moment she discovered abu-Ulbah was being released.

"A year or two ago when the Shalit deal fell through they made us a promise that before it would be published in the media – they would tell us who was being released and who wasn't."
The anger over the way the State conducted itself doesn't just end with their attitude towards the bereaved families. The bereaved parents and parents of those injured in the terror attacks are also critical of the legal process and the heavy price Israel has agreed to pay.
"All these petitions to the High Court are lip service," claimed Zion Yunesi, father of Yasmin Yunesi who was critically wounded in the terror attack.
"Apparently we aren't even a party in the matter. No one is asking us. They decided on the list, signed and that's it. The names are only published at the last minute and it's clear why," he said.
'Indescribable physical and emotional pain'
Yet the person expressing the most sympathy over the release of Shalit is victim Sigal Yunesi.
"It's a complex issue but I'm comforted by the fact that an abducted soldier will return to Israel after suffering for five years. Following the attack I became religious and now believe this is a divine move.
"It hurts that the terrorist who killed my friends and injured me is being released after such a short time, but I'm comforted by the fact that we're saving a life.
"I understand the bereaved families but we need to understand that at the end of the day it's a package deal. This week, God willing, a soldier will come back home alive. I would not want to be in his place."
Written promises
Another parent angered by the prisoner exchange deal is Ze'ev Rapp, father of Helena Rapp who was murdered by a terrorist in Bat Yam. Rapp was shocked to discover his daughter's murderer, Fuad Amrin, on the list of names of terrorists set to be released in the deal. On Sunday evening he angrily told Ynet that he heard about the release through the media.
"The prime minister comes and dumps this issue on us out of nowhere, that the murderer who slit open my daughter's chest with a knife and took out her heart – is being released."

Helena Rapp was 15 and a half years old when she was murdered on the Bat Yam boardwalk on May 24 1992. She left her house at 7 am in the direction of the bus station. Amrin from took out a kitchen knife and attacked her. He stabbed her in the back and in the chest.
Ze'ev Rapp said he had received promises that his daughter's killer would never be released. "I have promises in writing from previous prime ministers, from (Ariel) Arik Sharon and Ehud Olmert," he said.
He condemned Prime Minister Benjamin Netanyahu's actions saying: "If you do such a thing as prime minister, respect the families, let us know and then do it. Who are you to release the murderers of our children? We also have something to say."
Rapp noted that he was worried that his daughter's murderer would return to his terrorist activities: "My daughter's murderer is only 38 years old, his whole life is still ahead of him.
"He can go back and carry out more terror attacks and be released after the next kidnapper and then they will tell us again of the calculated risk that we're taking. What will the prime minister who took responsibility for the releases say then? Will he release another 1,000 terrorists?"
Meanwhile, the widow of Shalom Har-Melech, who was murdered in a 2003 terrorist attack in the settlement of Homesh, filed a compensation claim with the Jerusalem Magistrate's Court on Sunday against the five terrorists who were involved in the attack, and are slated to be released in the prisoner exchange deal.
In the lawsuit, Har-Melech's widow claimed that she suffered indescribable physical and emotional pain following the murder of her husband. The Har-Melech family is seeking a compensation of NIS 750,000 from each of the five terrorists.
In its response, the State Prosecutor's Office said that the public damage that might be caused by their request would be "ten times worse" than the damage caused to the plaintiffs.

Prime Minister Benjamin Netanyahu sent a letter to the bereaved families who lost their loved ones in terrorist attacks, explaining his decision to release 1,027 terrorists in exchange for kidnapped soldier Gilad Shalit.
"As a bereaved brother, I understand your pain. In my many deliberations throughout the negotiations, you were on my thoughts the whole time. My decision to bring Gilad home was affected by the commitment of Israel's prime minister to bring back a soldier sent on the State's behalf to defend its citizens," Netanyahu wrote.

The vast majority of Israel's citizens are in favor of the deal securing the release of kidnapped soldier Gilad Shalit in exchange for 1,027 terrorists, a public opinion poll commissioned by Yedioth Ahronoth shows.
Asked whether they were in favor of Shalit's release in exchange for 1,027 terrorists, 79% of the respondents said yes and only 14% said no.

The survey was conducted on October 16 by the Dahaf Institute, headed by Mina Tzemach, among 500 people constituting a representative sample of Israel's adult population. The maximum sampling error is 4.4%.
Among male respondents, 74% support the deal and 19% oppose it, while 86% of the women support it and only 5% are against it.

Sixty-five percent of the respondents believe a similar deal could have been finalized in the past, while 20% said a deal with similar conditions could not have been reached earlier.
As for Prime Minister Benjamin Netanyahu's conduct, 49% said he gave into public pressure while 43% believe he acted like a leader.
Asked about the deal's price, 53% said the Israeli government dropped some of its principles and 20% said Hamas conceded its principles more than Israel. Twenty percent said both sides gave up on some of their principles to a similar extent.
Respondents were then asked whether they fear for the security of Israel's citizens following the prisoner release. Fifty percent admitted that they were afraid, while 48% said they trusted Israel's security forces.
Finally, respondents were asked to describe their feelings towards the implementation of the Shalit deal. Forty-four percent said they were happy, 17% said they were excited, 15% said they felt proud, 14% were concerned, 5% felt humiliated and 3% were angry.

Gilad Shalit is coming home: The prisoner exchange deal signaling the end of Gilad Shalit's five-year Hamas captivity began in the early hours of Tuesday morning, as the Israel Prison Service (IPS) shuttled all 477 Palestinian prisoners slated to be released as part of the first stage of the deal to their rendezvous points with Red Cross.

At 2:30 am the order for the prisoners' transfer from the Hasharon and Ketziot prisons was given. At 5 am a convoy carrying 147 prisoners left Ketziot en route to the Kerem Shalom border crossing. By 6 am, all prisoners arrived at the border crossings and are now awaiting their release expected once the transfer of Shalit to Israel is complete.

Simultaneously, a special Prison Service convoy of buses escorted by police forces arrived at the Ofer Military Prison near Ramallah. Shortly thereafter, Red Cross vehicles arrived at the spot.
Egyptian Consulate officers arrived in Hasharon and Ktziot prisons overnight to monitor the process. The prisoners are being transported to the Kerem Shalom crossing near the Gaza border and the Beitunia crossing near Ramallah, ahead of the actual exchange.

The IPS' Nachshon Prisoner Transports Unit is overseeing the convoys. The transport is being held under heavy guard, and according to Israel Radio, over 1,000 police officers have been deployed across the convoys' routes to ensure both their safety and public order.
Gilad's grandfather Zvi Shalit and his sister Hadas are making their way from Kityat Ata to the Tel Nof base escorted by police cars. Aviva and Noam Shalit are slated to arrive at the base via helicopter.
Gilad Shalit is expected to be transferred to Rafah crossing at around 6 am, where he will be handed over to the Egyptian mediators, who will transfer him to Sinai. Once in Sinai, Shalit will be placed in the IDF's custody.
Outside Hasharon Prison, six extreme right-wing activists, including Itamar Ben Gvir, tried blocking the shuttles transporting prisoners by lying down on the road in front of them. They were detained by the prison's security forces.

Parallel to Shalit's release, Israel will release 450 prisoners and 27 female prisoners – 280 of whom were sentenced to multiple life terms for terror offense. The IPS shuttles will liaise with the Red Cross, which will ensure that the prisoners arrive at their destinations: Some will be allowed to return to their West Bank and Gaza Strip homes and 40 prisoners are to be expelled to Qatar and Turkey, via Egypt and Syria.
The first vehicles that left Hasharon Prison in central Israel were carrying female prisoners, most to be freed in the West Bank; and four of them, including Amna Muna, will return to Gaza, an IPS official said.
Gilad Shalit's first stop once back in Israel will be the Amitai IDF Base, where he will finally contact his family, as well as undergo a medical exam.
From there he will be flown to the Tel Nof Airbase, where he will reunite with his family for the first time in over five years.
The Air Force has arranged for special transport for the Shalits to Tel Nof, and a special "sterile zone" has been set up on the base, to ensure the family's privacy. Shalit is expected to undergo a second medical exam in Tel Nof, as well.
