U.S. Sees Stalemate Emerging in Libya

Margaret Coker reports from Libya on the latest developments there, including an apparent rift among members of Gadhafi's inner circle on what Gadhafi's next move should be, including the possibility of stepping down.

The U.S. believes Col. Moammar Gadhafi has solidified control in parts of Libya, creating a stalemate with rebels and raising the stakes in the Obama administration's internal debate about whether to take military action to help the opposition, officials said.

Pro-regime forces pressed into the rebel-held city of Zawiya, near the capital, and appeared to have halted the opposition's momentum to the east in fighting Tuesday.

With the struggle appearing to settle into a standoff, the Obama administration, working with allies, looked into options for intervention, while the European Union prepared to announce broader sanctions on the Libyan government, including an asset freeze.

Rebels in their base in the eastern city of Benghazi, after first suggesting they had made an amnesty offer to the Libyan leader, denied any back-channel negotiations were under way.

After days of attacks and counterattacks, the opposing forces appeared to dig in east of the capital Tuesday, with rebels clinging to the oil-refinery town of Ras Lanuf and Mr. Gadhafi's forces solidifying their hold on the small town of Bin Jawad just to the west.

Rebels have taken heavy losses in their repeated attempts to take Bin Jawad. On Tuesday, Libyan state television broadcast images of dozens of bound men lying face down on the ground. It claimed they were captured rebel fighters.

Libyan government forces appear more cohesive and have been able to regroup, a senior U.S. official said.

What we're looking at right nowand things can change on a dime in these kinds of fluid conflictsis basically a stalemate in certain parts of Libya," another U.S. official said. "Gadhafi has solidified his control of some areas while the rebels have the upper hand in other places."

Pro-Gadhafi forces continued to launch airstrikes on Ras Lanuf, with at least four more strikes reported on Tuesday, according to witnesses.

Col. Gadhafi's loyalists also launched an attack on Zawiya, the rebel-held city closest to Tripoli and the sole rebel redoubt in western Libya, the Associated Press reported, citing a witness. Col. Gadhafi's tanks and fighting vehicles were roaming the city and firing randomly at homes, the witness said.

Rebels had held the center of Zawiya, 30 miles west of the capital, while government forces controlled the outskirts. There were no clear reports, however, that government forces had retaken the city following a counteroffensive that began Monday.

"The city is in ruins," the witness told the AP. "Some buildings have been entirely destroyed and everyone on the street is shot on sight. There are many wounded, but the hospitals are running out of supplies," he said.

The new assessment of Col. Gadhafi's gains come as Pentagon planning swung into high gear on a range of humanitarian and military options to curb the fighting in Libya, reflecting growing concern about deteriorating living conditions for refugees and Col. Gadhafi's use of air power against rebel forces.

The U.S. has said it wants Gadhafi to leave now and for the Libyan people to sort out what comes next.

In Tripoli, Libyan officials, promising access to Col.Gadhafi at an impromptu media briefing, succeeded in corraling most of the estimated 150 international journalists in the capital inside a luxury hotel from around 2 p.m. until midnight. Many journalists weren't allowed to leave the compound while waiting for the promised briefing, which never materialized.

At around 11 p.m., journalists got a brief glimpse of the leader sweeping into the hotel to a closed room where he conducted private interviews with Turkish and French television channels.

Col. Gadhafi told the interviewers that the United Nations Security Council couldn't endorse the imposition of a no-fly zone over Libya without first sending a fact-finding mission, a Libyan official said.

The Libyan leader also repeated his accusation that the unrest was engineered by al Qaeda, and denied that security forces have used indiscriminate force. "He was in a very good mood," the official said.

Rebels said they have had contacts with an array of foreign governments, and sent envoys to several European cities seeking support. An Italian diplomatic delegation was in Benghazi on Tuesday meeting with rebel leaders, the first official public visit by Western diplomats since the establishment of the provisional rebel government.

Earlier, Mustafa Abdel Jalil, the head of the Libyan National Council, the rebels' provisional government, said opposition leaders wouldn't pursue a domestic prosecution of Col. Gadhafi for humanitarian and other crimes, if the besieged strongman gave up power within 72 hours.

"If he leaves Libya immediately, during 72 hours, and stops the bombardment, we as Libyans will step back from pursuing him for crimes," Mr. Jalil, the rebel chief, told the al-Jazeera news service.

The International Criminal Court in The Hague, however, has begun to gather information with a view to opening a formal investigation into possible crimes against humanity by Libya's leadership.

Mr. Jalil's political adviser, Ahmed Jabreel, said rebels had received an offer from Mr. Gadhafi to give up power and leave Libya in exchange for immunity from prosecution and a pledge that his family's personal bank accounts wouldn't be frozen.

"The people are ready to accept the first condition, but the second condition we can't accept," Mr. Jabreel said.

A government spokesman denied that an official proposal had been made to the rebels that included the possibility of Col. Gadhafi stepping down.

And on Tuesday afternoon in Benghazi, Mr. Jalil's deputy, Abdel Hafeez Goga, who is also the Libyan National Council's official spokesman, said the rebels had received no offer and weren't prepared to negotiate.

"Our point of view is clear that we will not negotiate on the blood of our people," he said.

Rebel officials tried to clear up the confusion later by explaining that the regime's offer had been delivered by third-party mediators and it wasn't clear to everyone whether they represented Mr. Gadhafi himself or were reaching out on behalf of a separate regime faction.

The offer may have come from reform-minded officials in Tripoli who have been working to broker a solution to the standoff, rebel officials in Benghazi speculatedthough it wasn't clear how much weight the reformists carry in Col. Gadhafi's circle.

The United States and its European allies are considering the use of naval assets to deliver humanitarian aid to Libya and to block arms shipments to the government of Moammar Gaddafi, even as they weigh the legality of imposing a no-fly zone without United Nations authorization, according to U.S. and European officials.

NATO military officials began briefing governments Tuesday night on a range of options that will be presented to defense ministers in Brussels on Thursday.

The Obama administration, NATO and other international organizations are united in their belief that any military intervention in Libya would require some international backing. But with a U.N. mandate far from assured, those considering some form of intervention - including the United States, Britain, France and Italy - are looking for alternative support, officials said.

Officials, saying international support could come from regional blocs, noted that NATO's air attacks on Serbia in 1999 came without U.N. backing.

"If you have [support from] the Arab League, the African Union, NATO and potentially the European Union, you have every country within 5,000 miles of Libya," a NATO official said. "That gives you a certain level of legitimacy."

The intense international deliberations came as troops loyal to Gaddafi continued to besiege the rebel-held city of Zawiyah, 27 miles west of Tripoli, for a fifth day on Tuesday, with rebel officials there citing a mounting toll - dozens dead and hundreds wounded, including women and children.

In Ras Lanuf, about 400 miles east of the capital, Gaddafi loyalists were engaged in fierce fighting with rebels who had hoped to march on Sirte, Gaddafi's home town and a strategically vital city still under tight government control.

Gaddafi made a surprise appearance at a hotel hosting foreign correspondents in Tripoli, arriving just before midnight, the Associated Press reported. He raised his fist in the air as he walked from his car to the hotel, then went into a room for about an hour to give exclusive television interviews before leaving without speaking to reporters waiting outside.

As they weighed the prospect of intervention, the Obama administration and European governments continued efforts to size up the Libyan opposition. "We feel that we don't really understand who they are yet," said a senior European diplomat who, like other officials interviewed, spoke on the condition of anonymity to discuss closely held deliberations. "They are more fractured and complicated and less well-coordinated than we would like."

France and Italy said they were in direct conversations with some opposition figures, and the State Department said it had held face-to-face meetings and telephone conversations in Rome and Cairo with members of the Benghazi-based National Transitional Council.

"We're talking to others beyond the membership of this council," State Department spokesman P.J. Crowley said. "Eventually, you know, within Libya a formal opposition will emerge. We're watching to see how that develops."

The administration has chosen not to step out in front in advocating military intervention, even as it has come under criticism by some congressional leaders

U.S. military planners and those from other NATO governments have prepared a range of alternatives, including the establishment of an air and/or naval bridge to carry humanitarian supplies or escort civilian ships into Benghazi and other rebel-held areas, as well as close-in naval patrols along the Libyan coast to monitor an existing arms embargo.

The proposed naval actions would not require a U.N. resolution. But governments are divided on both the advisability and the legality of a no-fly zone. Russia and China, with the power to veto a Security Council resolution, have indicated opposition. Secretary of State Hillary Rodham Clinton, in an interview with Britain's Sky News on Tuesday, indicated that support from regional blocs might help win passage of a U.N. resolution.

In NATO, Germany has said it does not support a no-fly zone. NATO operates by consensus, and an operation would not be approved if any member chose to speak out against it.

In conversations this week with his U.S. and British counterparts, Italian Foreign Minister Franco Frattini said Italy would make its air bases available for no-fly operations if they were supported by NATO, the E.U. and the Arab League, another European diplomat said.

None of those organizations has yet declared unqualified support for any outside military action. The Gulf Cooperation Council, the six-member association of the Persian Gulf Arab states, voiced its backing Monday. The French Foreign Ministry said Monday that Arab League Secretary General Amr Moussa had voiced support for a no-fly zone during a meeting Monday in Paris, but the league has not declared itself, and some members, led by Syria and Algeria, are said to be opposed.

The Arab, European and African organizations have each scheduled separate meetings on the Libyan crisis this week, along with Thursday's NATO gathering. "We need some signal from the region that the action was welcome," one of the European diplomats said.

The Obama administration itself is divided on the utility of a no-fly zone.

"A no-fly zone is the robust man's option," one administration official said. "But what is it going to do to the balance of power in Libya?" With the Libyan government's assault concentrated on ground rather than air power, "it doesn't change it internally so it favors the rebels. It doesn't do much humanitarian good."

"It makes us feel good," the official said, and has some symbolic value in potentially frightening Gaddafi into giving up. "But what . . . if it doesn't work? Are you prepared to take the next step? We haven't had that debate yet, in part because we thought it was going to happen really quickly."

NATO maintained a no-fly zone over the disputed province of Kosovo for three years, while numerous atrocities occurred below, before sending its bombers to Serbia. In Libya, an imminent humanitarian catastrophe would be the best legal basis, short of a U.N. resolution, for a no-fly zone or other intervention, U.S. and European officials said. But such judgments are inherently subjective, said one official.

"This is the question," he said. "How many people being killed constitutes sufficient grounds?"

On Tuesday, witnesses in Zawiyah said the city, suffering from severe shortages of medicine and food, was coming under heavy mortar fire. "They are not yet rolling in with tanks like yesterday, but they are shelling us from a distance of three to four kilometers," said Mohamed Magid, an opposition spokesman in Zawiyah who spoke by satellite phone. Phone, Internet and electricity services had been cut in the city, he said. "They are hitting civilian buildings. There are civilian casualties. . . . We need help."

In a news conference in Benghazi, the opposition council denied widespread reports that Gaddafi had offered, through a third party, to give up power if he was allowed to leave the country. "There is no such proposal," said Abdul Hafidh Gogha, a council spokesman. "We have not been contacted. There is no emissary."

"We do expect the international community to impose a no-fly zone over Libya," Gogha said.

Koningin Beatrix heeft de sultan van Oman ook bezocht om te lobbyen voor de vrijlating van de drie Nederlandse militairen die in Libië gevangen zijn genomen. Het originele plan was dat het afgelopen weekeinde een staatsbezoek aan Oman zou worden gebracht. Vanwege de onrust in het land had de oppositie bezwaren tegen het bezoek.

Uiteindelijk werd het staatsbezoek uitgesteld. Kort daarna nodigde sultan Qaboos bin Said Al Said de koningin uit voor een privébezoek. Dinsdag bezochten Beatrix, prins Willem-Alexander en prinses Máxima de sultan, zonder vertegenwoordigers van het bedrijfsleven.

De drie militairen in Libië werden vorige week zondag gevangengenomen. Ook hun helikopter is in beslag genomen. Ze waren opgestegen vanaf het marinefregat Hr. Ms. Tromp. Volgens Defensie probeerden ze twee evacués in Libië op te pikken. Libië heeft hen beschuldigd van spionage. Minister van Defensie Hans Hillen (CDA) heeft dinsdag gezegd dat de militairen in goede conditie verkeren.

Die privétoestellen van de Libische leider Muammar Kaddafi zijn opgestegen van een militaire basis nabij Tripoli en zijn via Griekenland mogelijk op weg naar Egypte. Dat meldt Al-Jazeera.

Volgens Reuters zou dat echter onduidelijk zijn.

Volgens het Griekse ministerie van Buitenlandse Zaken is woensdagmorgen een Libisch toestel door het Griekse luchtruim gevlogen in de richting van Egypte.
