Inderdaad! April 02, 2010, (Sawf News) - Propofol level in Michael Jackson's body at the time of his autopsy was 10 to 100 times higher than the level attributable to the dosage Dr. Conrad Murray admits to having administered.

Dr. Bruce Speiss, Professor of Anesthesiology, who didn't' treat Michael Jackson, tells CNN:

"The levels of propofol in the toxicology report are considerably higher, perhaps by factors of 10 to a 100 time higher."

Murray told police that he administered 25 ml of propofol after three other drugs failed to help Michael sleep.

Dr. Bruce also highlights some other inconsistencies.

Murray says he stayed with Jackson for 10 minutes after administering propofol, in which case he should have noticed something was wrong.

Michael should have been adversely affected with seconds of being given the drug.

"If he was going to stop breathing he should have stopped breathing within 30 secs to 2 mins after the propofol went in," says Dr. Bruce.

Also, a quantity as small as 25 ml should have been injected, not administered using IV, Dr Bruce points out, sinc the IV tube itself would take up 25 ml.

Everyone knew my uncle Michael as one of the greatest performers that ever lived and while I don’t argue that, he was just simply uncle Mike to me. We called him uncle doo doo affectionately because he loved to joke around and play, all the time. He would call me and my brother up in the middle of the night, we hadn’t talked to him for months and he would prank call us using a different voice! We thought it was so funny until we found out it was him. The media may have said a lot of stuff about my uncle that wasn’t true but he never had to convince his family, we always knew what kind of person he was. I remember going to school and having to stand up for my uncle many times because kids knew that it would hurt me and my brothers. I remember all my friends thought I was cool because I was Michael Jackson’s niece but I thought my uncle was the coolest because he always had the time for me and always had a good heart. He never said no to us kids, we have a huge family and whenever Michael was around, and he laughed, tickled and played with us (yes, even when we got grown and older). People painted this picture of my family as being distant and not close, but we all were. We had family day where we would pick a day and somebody’s house, then we would all come and just have fun. I remember for my 7th birthday my uncle was on tour, he gave my mom the keys to Neverland and we had my party there, all my cousins had their birthday parties at Neverland. It was tradition!
Another memory for me is my uncle calling me Applehead, he calls everyone in our family apple head, even my cousins Prince, Paris and Blanket. It was a comfort word for him. I will miss him dearly and always have memories of happy times but in my heart, as long as I can hear my uncle’s laugh, his voice, still remember his hugs and kisses, then my uncle will never pass on. He is always with me!

Dr. Murray's Defense - Jackson Killed Himself

TMZ has learned Dr. Conrad Murray's legal defense is that Michael Jackson gave himself the fatal dose of Propofol.

Multiple sources familiar with the strategy tell TMZ the defense argument goes like this:

- At around 10:50 AM, Dr. Murray gave Jackson 25 mg of Propofol from a 20 ml bottle -- that's only about 1/8 of the bottle.

- The dose Dr. Murray administered would keep someone asleep for only 5 to 10 minutes, But the Propofol, along with the Ativan and Versed that was already in MJ's system, had a synergistic effect that put Jackson to sleep for a longer period of time.

- For the next hour, Dr. Murray stayed in the room and was on the phone for much of the time. Dr. Murray didn't leave the room to make the calls because MJ liked activity in the room, regularly sleeping with the lights on and cartoons blaring on the TV.

- At around noon, Dr. Murray left the room for approximately two minutes to go to the bathroom. While he was gone, the defense believes Jackson suddenly awakened and was frustrated he had spent nearly 9 hours trying in vain to sleep. The defense theory -- Jackson took the 20 ml bottle of Propofol and self-injected the remaining contents through the IV, causing a massive overdose that stopped his heart.

- Dr. Murray walked back in the room and saw Jackson with his eyes open and pupils dilated. Dr. Murray dropped the phone (he was speaking with his girlfriend) and began administering CPR.

The defense will argue Michael Jackson was a long-time Propofol addict -- something TMZ first reported shortly after the singer's death. As one source said, Jackson liked the sensation of Propofol being administered by IV, adding, "Michael liked to push it."

L.A. County Coroner's investigators took a picture in the room, showing an empty Propofol bottle on the floor, underneath the nightstand by Jackson's bed. The defense will argue Jackson grabbed the bottle from the nightstand, injected himself and then dropped the bottle.

Remember, law enforcement believes Dr. Murray hid bottles of Propofol before paramedics arrived. The defense will argue ... if Dr. Murray was really hiding Propofol, he would have removed the empty bottle under the nightstand that caused Jackson's death.

Ed Chernoff, Murray's attorney, could not be reached for comment.

This is complete BS. I've been under Propofol before. You are out in under 10 seconds. There is no possible way you could adjust the drip. Period. Murray is a lying coward. He dug his own hole,He needs to lay in the mess he created now. Like I said before,What kind of doctor not only does CPR on a bed,but leaves that person to make phone calls to his little mistresses to hide the extra propofol. The man is Guilty.

Kut Murray. Michael nog een keer door het slijk halen door zoiets te beweren.

Maar even advocaat van de duivel: als je door dit middel binnen enkele seconden al niet meer in staat bent om de dosering te bepalen, dan kan het toch juist goed dat je jezelf per ongeluk een overdosis geeft? Hoewel ik niks van dat bullshit verhaal geloof verder, hoor.

The upshot -- Jackson was a guy who wanted instant gratification ... so the notion that he would wake up when Dr. Murray was out of the room, become frustrated and self-medicate with Propofol is consistent with his personality.

Ongeveer een uur later werd ik weer wakker, en verbaasde me hoe snel je wegbent, en je totaal niet weet wat er gebeurd is achteraf. Heb er niks van meegemaakt (heerlijk )

Ik kreeg ook een keer narcose, dat is best wel relaxed inderdaad. Je bent inderdaad in 1 seconde weg en weer terug (zo lijkt het tenminste). Maar ik kan me niet voorstellen dat je van narcose echt lekker slaapt (goed uitrust), volgens mij ben je juist best gesloopt wanneer je weer wakker wordt. Het is echt niet goed voor je lichaam. Dus wat dat betreft was het wellicht wel echt een verslaving voor MJ (verslaving aan het chille gevoel) ipv dat het hem echt hielp.

Propofol is ook helemaal niet bedoeld voor thuisgebruik en ja, hij had aardige zelfdestructieve kanten, en deed rare dingen als dit gebruiken tegen zijn insomnia. Mogelijk gemaakt door zijn vele geld, roem, en het doctorshoppen wat daar mogelijk schijnt te zijn.

Sources tell TMZ the judge who will get the Conrad Murray manslaughter case is one of the toughest, smartest judges on the bench in L.A. County.

Court sources tell TMZ that L.A. County Superior Court Judge Michael Pastor will be assigned Murray's case today, following a brief hearing with the Supervising Judge of the L.A. County Superior Court.

Judge Pastor has handled some high-profile cases, including the case involving topless pics of Cameron Diaz, Jason Priestley's DUI case, and a slew of other high-profile, non-celeb cases.

Note to lawyers in the case -- Pastor is extremely tough, and nothing gets past him. He reads every legal doc in his cases and makes it a point to become an expert on whatever the case involves.

Judge Pastor also knows something about addiction -- he's renowned at the courthouse as having a frequent flier mileage addiction, often flying pointlessly over a weekend just to rack up mileage points.

He's getting the Judicial Excellence Award from the L.A. County Criminal Courts Bar Association this weekend.

Sources tell TMZ the judge who will get the Conrad Murray manslaughter case is one of the toughest, smartest judges on the bench in L.A. County.

Court sources tell TMZ that L.A. County Superior Court Judge Michael Pastor will be assigned Murray's case today, following a brief hearing with the Supervising Judge of the L.A. County Superior Court.

Judge Pastor has handled some high-profile cases, including the case involving topless pics of Cameron Diaz, Jason Priestley's DUI case, and a slew of other high-profile, non-celeb cases.

Note to lawyers in the case -- Pastor is extremely tough, and nothing gets past him. He reads every legal doc in his cases and makes it a point to become an expert on whatever the case involves.

Judge Pastor also knows something about addiction -- he's renowned at the courthouse as having a frequent flier mileage addiction, often flying pointlessly over a weekend just to rack up mileage points.

He's getting the Judicial Excellence Award from the L.A. County Criminal Courts Bar Association this weekend.

Heb gelezen dat dit een preliminiary hearing is. Wordt dus hartstikke spannend, want er moet genoeg bewijs zijn.

Within some criminal justice systems, a preliminary hearing (evidentiary hearing) is a proceeding, after a criminal complaint has been filed by the prosecutor, to determine whether there is enough evidence to require a trial. In the United States, the judge must find there is probable cause that a crime was committed.

At such a hearing, the defendant may be assisted by counsel; in U.S. jurisdictions, there is a right to counsel at the preliminary hearing.[1] Contrast this with some jurisdictions in the United States, where a person may be charged, instead, by seeking a "true bill of indictment" before a grand jury; where counsel is not always permitted.

The conduct of the preliminary hearing as well as the specific rules regarding the admissibility of evidence vary from jurisdiction to jurisdiction. Hearsay is typically allowed. Should the court decide that there is probable cause, a formal charging instrument (called the Information in some jurisdictions) will issue; and the prosecution will continue. If the court should find that there is no probable cause, then typically the prosecution will cease. Many jurisdictions, however, allow the prosecution to seek a new preliminary hearing, or even seek a bill of indictment from a grand jury.

Some important questions, generally addressed in such a hearing, are:

1. Did the alleged crime occur within the court's jurisdiction?
2. Is there probable cause, to believe that the defendant committed the crime?

If a judge determines that there is sufficient evidence to believe that the defendant committed the crime, it is said that the defendant is "held to answer" or "bound over" (in U.S. jurisdictions).

After a defendant is held to answer, the judge will set a date for arraignment. A new pleading is filed with the court (sometimes called an "information") and the defendant can enter a plea at his or her arraignment date. The defendant is usually given the date that he will officially stand trial at this arraignment.

Los Angeles, California (CNN) -- Michael Jackson's last doctor may learn Monday whether his California medical license will be suspended while he faces trial in the pop star's death.

California's medical board will ask the judge to order Dr. Conrad Murray not to practice medicine as a condition of his bail when he appears in a Los Angeles court Monday.

When Murray pleaded not guilty to involuntary manslaughter in February, a judge prohibited him from using any anesthesia on patients, but he refused the prosecution's request to suspend his license.

The state is trying again with a new judge in charge of the case.

Murray's treatment of Jackson "demonstrated a serious lack of judgment that should prohibit him from practicing medicine," California Attorney General Jerry Brown said.

Defense lawyer Ed Chernoff, in a filing last week, argued the state must show "changed circumstances" since bail was first set.

Murray currently has no California patients, although he has resumed his medical practices in Houston, Texas, and Las Vegas, Nevada, Chernoff said.

The suspension of his California license would have a "domino effect" on his practices in other states, Chernoff said.

"If his Honor restricts his California license even temporarily, then by application of Texas law, Dr. Murray's Texas license to practice medicine shall also be similarly revoked," he said.

The loss of his practices in Nevada and Texas "would be financially and personally devastating," he said. "He will likely be faced with the inability to adequately defend himself of the charges facing him in the Superior Court of California."

Murray's defense "will be scientifically based" and requires "intensive attorney work and fees," Chernoff said.

Murray is "hanging on by a thread" financially and could not afford to pay for his legal defense if he loses his medical license, according to his lawyer.

The Los Angeles coroner concluded Jackson's death on June 25 last year was the result of "acute propofol intoxication."

Murray told investigators he gave Jackson propofol, a powerful anesthetic, to help him sleep.

Murray's defense team denied a report by the gossip Web site TMZ on Sunday that cited unidentified "multiple sources" saying their strategy would be to argue that Jackson gave himself the final and fatal dose of anesthesia.

"We do not know what sources to which TMZ is referring," the spokeswoman for Chernoff said. "We only know it didn't come from Ed (Chernoff) who has the final word."

"It is premature to discuss defense strategy," she said.

The TMZ report said Murray would claim that while he had administered propofol to Jackson earlier in the morning, the singer gave himself another dose when the doctor left the room for two minutes.

The possibility that Jackson could have overdosed on his own was considered and ruled out in the coroner's autopsy report.

"It would have been difficult for the patient to administer the drugs (others besides propofol were administered) to himself, given the configuration of the IV set-up," Dr. Selma Calmes, anesthesiology consultant hired by the coroner, wrote.

The tube was in Jackson's left leg with a 5-inch-long injection port, she said.

"He would have had to bend his knee sharply or sit up to reach the injection port and push the syringe barrel, an awkward situation, especially if sleep was the goal," Dr. Calmes said.

Joe Jackson, the singer's father, is expected to attend Monday's hearing in the Los Angeles courtroom of Judge Peter Espinoza. The elder Jackson has filed notice that he will sue Dr. Murray for the wrongful death of his son.
