Napoli summit creates new avenue

The fate of Napoli remains in the balance following a summit meeting between the courts and the FIGC, while new buyers come forward.

Luciano Gaucci is determined to keep the now bankrupt club in Serie B, while the Italian FA insists that the rules of the game must see them start again in Serie C1.

Now it’s reported the FIGC is ready to adjust the terms of the Lodo Petrucci rule, allowing potential investors to bid for the bankrupt club, with the proposal most likely to guarantee money to its creditors winning the auction.

“The FIGC has moved towards us on some aspects,” confirmed Tribunal judge Vito Frallicciardi, “but remains adamant that they must play in C1. We are all just trying to avoid a courtroom clash.”

Today’s summit in the city included FIGC President Franco Carraro – whose car was attacked and pelted with eggs by angry fans – representatives of the bankruptcy tribunal and Mayor of Naples Rosa Russo Iervolino.

“We are trying to pave the way for open negotiations, especially as time is running out,” continued the bankruptcy tribunal official. “Everyone is looking for a meeting point, although it is difficult to find a balance between our positions.”

Meanwhile, the Serie C1 fixtures have been drawn up with an ‘x’ in the Girone B section where Napoli can still be introduced. If they fail to accept the Lodo Petrucci route, then Andria will take that slot.

Former Perugia President Luciano Gaucci is refusing to accept a drop down in the divisions, but his hold on Napoli is increasingly tenuous. It emerged that the bankruptcy tribunal has not completed its paperwork to sell the side to Gaucci, so new buyers are welcome to make their offers.

Several have already come forward, including American businessman Aldo Caretti’s bid of £16.6m in one lump sum and Udinese patron Giampaolo Pozzo’s proposal to take over.

The press is also turning on Gaucci, with magazine L’Espresso claiming today he still owes £33m in unpaid taxes due to the bankruptcy of one of his other businesses.

Serie B teams unite against Napoli

Serie B’s 22 sides have issued a statement claiming they won’t play if Napoli are readmitted, but the club’s fate will be decided this weekend.

The San Paolo side, along with Ancona, has been excluded from the new 22-team division due to its financial instability, but patron Luciano Gaucci is leading a legal crusade to have them added on to an expanded Serie B.

“A Serie B campaign will not begin,” read a joint statement following yesterday’s meeting, “if it is anything except the planned division with 22 teams.”

A similar sentiment was expressed last summer, but Gaucci’s legal battle on behalf of Catania proved successful and the League was expanded to 24 sides.

“Napoli and Ancona do not have the right to play in Serie B,” added League Vice-President Antonio Matarrese. “If we accept their position, then we allow football to be ruled by magistrates. What we are doing today is choosing dignity.”

“It is unthinkable,” noted League chief Adriano Galliani, “that the fixture lists are to be drawn up by judges in the courts.

As expected, Gaucci (pictured) was unfazed by this latest mass movement against his latest legal crusade.

“I don’t care what the Serie B Presidents threaten to do,” snapped the former Perugia patron, “because they count for nothing. Besides, these clubs are all pushed to make certain statements by those in power.”

“All that matters here is what the tribunal will rule and if it says Napoli belongs in Serie B then there is nothing they can do about it.”

The Serie B meeting has also voted in five new representatives: Vice-President Enrico Preziosi (Genoa), plus counsellors Benigni (Ascoli), Lo Monaco (Catania), Dal Cin (Venezia) and Matarrese (Bari).

The clubs have agreed to implement a play-off and play-out system for promotion and relegation from the Second Division.

Napoli lose legal battle

Luciano Gaucci could lose control of Napoli after the Tribunal released its lock on the Serie B fixture list.

The Naples Tribunal had originally ordered that all League and Coppa Italia games that did not include Napoli were to be suspended, as the club fought against bankruptcy proceedings.

However, on Tuesday evening arbitrator Antonio Mungo ruled that they had no jurisdiction over sport, as the law passed on August 19 2003 made it clear that only the Lazio TAR could make decisions on football.

This Tribunal will look at the matter on September 6, just a week before the Serie B season is set to kick off, but it is looking increasingly unlikely that Napoli will make it back into the Second Division.

“The FIGC,” read an official statement, “are ready to continue negotiations with the bankruptcy tribunal and the local council to find a solution that will allow Napoli to register for Serie C1.”

“We have always maintained the jurisdiction was an insurmountable problem and our only worry is that it cost Napoli fans a month of time better spent preparing a new team.”

This is particularly bad news for Gaucci, who risks losing control of the club as film producer Aurelio De Laurentis has already offered a more substantial package to start again from C1.

“The fans should relax,” assured De Laurentis’ lawyer Cipriani Marinielli, “because playing in Serie C would only be a necessary stepping stone to Serie A. De Laurentis is a strong man who does things properly when he puts his mind to them. We want to earn our place in Serie B, not win it through a legal loophole.”

Ex-Perugia patron Gaucci is not going to let go of this dream without a fight and took it out on the council.

“I am very bitter about what has happened. The only thing I can say is that Naples sold its right to Serie B and didn’t do everything it could to stay up.”

It is highly unlikely that the Lazio TAR will accept Napoli’s proposal to stay in Serie B after its bankruptcy, but Gaucci won’t release his grip.

“It isn’t over,” he warned, “as at least I can have the satisfaction of putting a spanner in the works for those who planned to have Napoli demoted into Serie C and those who helped the powers that be in this quest.”

The chaotic situation at Napoli could be at an end, as the club has been auctioned off to film mogul Aurelio De Laurentiis.

The former Scudetto winners were declared bankrupt in July and told to start again from Serie C1, but Luciano Gaucci embarked on a legal battle to keep the side in the second division.

However, earlier this week the Naples Tribunal – which had originally halted all League and Coppa Italia games until Napoli were reintroduced – conceded it did not have jurisdiction over sport and passed the decision over to the Lazio TAR.

It now seems that even that will not be necessary, as the bankruptcy tribunal has taken the control of the club away from Gaucci and handed it over to De Laurentiis.

The movie mogul has offered a more substantial recovery package to take care of Napoli, providing greater investment and guarantees for creditors than Gaucci could have put forward, and is willing to start from Serie C1.

With this in mind, the FIGC has granted Napoli an extra 10 days to sign new players and Coaching staff, as the transfer window has technically closed.

De Laurentiis has already hinted that he would like to bring in former Livorno and Genoa boss Roberto Donadoni as their new tactician.

“Give me five years,” assured the new patron, “and I will take Napoli into Europe. My dream is to see Manchester United play at the Stadio San Paolo. First of all we need to put together competent staff and a game plan that we can hand-pick players to fulfil.”

Napoli will begin a new era on Tuesday, as the club will be enrolled into Serie C1 for the 2004/05 campaign.

The Azzurri were declared bankrupt in July but movie mogul Aurelio De Laurentiis has now taken control of a newly formed club.

He met with officials in the port city on Monday where an agreement over the outfit’s future was reached.

"I’ll be back in Napoli tomorrow to sign the contract," he told Radio Kiss Kiss. "The Italian Football Federation will enter us into Serie C1.

"The first thing that I will do is put together a new management structure. We need to build a team that knows how to entertain."

Napoli have officially been placed into Serie C1 and Como thrown out of the division, while Serie B introduces a play-off system.

Today’s FIGC meeting confirmed several important developments that had arisen over the last few days. The Lega’s proposal of introducing a play-off and play-out system to decide promotion and relegation has been implemented from the 2004-05 campaign.

Perhaps the most important decision was registering Napoli Soccer for Serie C1, ending a legal battle that had stretched on since July. Former patron Luciano Gaucci has confirmed he will not try to win back the club, but he will sue the FIGC for damages.

“This is the start of a new era,” smiled President Aurelio De Laurentiis. “I hope that the fans can have the patience and respect for this side, as it belongs to all of them. Now we need to have facts and action, as all this confusion serves nobody.”

Movie mogul De Laurentiis aims to start again from Serie C1 with a side free from debt and has some ambitious footsteps to follow.

“The example I am following is that of Fiorentina chief Diego Della Valle,” he revealed. “Now we must put together capable staff and I wouldn’t rule out Udinese’s Pier Paolo Marino.”

Della Valle proved just what this drop down the divisions means by taking on the new Fiorentina from Serie C2 and in just two seasons earning promotion to the top flight.

Napoli will have until September 23 to sign out of contract players and register them for the new season, so their first two Serie C1 games will be postponed.

Meanwhile, Como have been excluded from the professional football divisions after the TAR overturned a previous appeal victory from CONI arbitration. Fidelis Andria have instead been promoted to C1, pushing Pro Vasto up into Serie C2.

Giampiero Ventura is set to be named as the new Coach of Serie C1 side Napoli, according to reports.

Former Atalanta boss Giovanni Vavassori was the favourite to be hired but Ventura now seems in pole position.

An official announcement is expected to be made on Friday after movie mogul Aurelio De Laurentiis recently took control of the club.

It’s understood that new general director Pierpaolo Marino, who left Udinese this week, has convinced the new chief to appoint Ventura.

The latter does have experience in the lower Divisions even if he is better known for spells in charge of Cagliari, Sampdoria and Udinese.

Modena points penalty cut

Modena have had their five point deduction for their involvement in the betting scandal cut on appeal.

The CAF - Comissione d`Appello Federale – revealed this evening that the club will begin the Serie B campaign with a four point penalty instead.

The appeal court also scrapped the five-month ban handed to former Siena boss Giuseppe Papadopulo after he argued the original judgement.

However, numerous players have failed in their attempts to get their suspensions annulled or decreased.

That means that Antonio Marasco’s three-year stop has been upheld, as has Generoso Rossi’s 12-month suspension. Marasco was at Modena last term, while Siena employed the goalkeeper.

Roberto D'Aversa of Siena (6 months), Samp’s Stefano Bettarini (5 months), Maurizio Caccavale of Pescara (6 months) and Como’s Alfredo Femiano (5 months) also had their punishments unaltered.

The men were banned after the Italian Football League launched a probe into several of last season’s matches.

That after police intercepted phone calls and text messages which suggested there were links between gambling and match-fixing.

Former Udinese and Messina striker Roberto Carlos Sosa is one of the first players to sign for the new Napoli, while Parma release Junior.

The once great club will start again from Serie C1 under the tutelage of patron Aurelio De Laurentiis and he has pledged to bring in a series of star names.

The first is 29-year-old centre-forward Sosa, who helped Messina to promotion last year and is now a free agent.

“I grew up watching Diego Armando Maradona on television,” commented the Argentine, “so it will be an honour to play at the Stadio San Paolo, just as he did. I don’t think of this as a step down the Divisions, but rather as a promotion to this great city, its Stadium and its fans.”

Napoli’s reconstruction has just begun, as there are reports that new Director General Pierpaolo Marino has contacted Empoli to ask for four of their players: Francesco Pratali, Stefano Lucchini, Francesco Lodi and Pasquale Foggia.

Contracts are also being discussed at Parma, as the club has released Junior from a deal that was set to expire in June 2006. The Brazilian had spent the last six months on loan at Siena after five seasons at the Stadio Tardini.

Bari docked point for fan violence

In a new approach from the Disciplinary Commission, Bari have been docked a point after a flare struck Cesena goalkeeper Giovanni Indiveri.

The incident occurred during last night’s 1-1 draw and saw the ‘keeper stretchered off with blood pouring from his ear after the explosion less than a metre away from his position.

Indiveri was taken to hospital and kept in overnight for tests, but was released today with the all clear.

In previous years, when a player has been substituted due to an injury from objects thrown from the stands, the team is automatically given the victory.

However, changes to the rules in Italy will maintain the original result and dock the club points. Bari drop down to one point and will also be forced to pay a £1,360 fine.

“We take this decision into account and will consider our next move,” noted director of sport Fausto Pari. “There is real regret here, because the actions of one idiot have cost us dearly.”

This is the second incident in the space of a week that has seen objects thrown from the stands, as Roma’s Champions’ League match with Dynamo Kiev was abandoned when referee Anders Frisk was struck on the head by a coin.

Napoli may be forced to bring Diego Armando Maradona’s legendary No 10 shirt out of retirement.

The Azzurri withdrew the number in 2000 out of respect to the Argentine, who led the club to two League titles.

However, it is set to return this season after the San Paolo outfit were demoted to Serie C1 following their financial collapse.

Serie C rules insist that clubs in their Division must field their sides with shirts that run from 1 to 11.

"It would be a shame to see that number used again," said Franco Baresi, whose Milan No 6 jersey was retired in 1997.

"Maradona is an important part of Napoli’s history but also Italian football. I hope that the relevant authorities can make an exception."

However, their lack of fitness levels – as the team has been together for less than a month – showed all too clearly in the second half. Cittadella fought back and earned the point with Giacobbo’s free kick and a De Gasperini finish.

The future is nonetheless looking bright for Napoli, who have already sold 15,000 season tickets for Serie C1, almost as many as Juventus in the top flight.

Verona grabbed their first points of the new season after a frantic 5-3 victory against Arezzo. The away side led the game at one stage only to see the Bentegodi boys hit back.
