quote:
Federal and state regulators are again considering legal action to force Microsoft to alter a new system, Windows XP, which tightly integrates Internet services like music, instant messaging and shopping into this basic operating system.

They face the same troubling alternatives as before. As Microsoft gets ready to ship Windows XP, antitrust regulators fear that the new operating system represents a rerun of the company's tried-and-true tactics — some of which a federal appeals court agreed in June were illegal.

"No strategic decision" has been made on asking a court to block or force modifications to Windows XP, said one person involved in the discussions.

If the federal government and states are going to move, it would likely be soon. Windows XP is scheduled to go on sale Oct. 25, but the "final" code will be shipped to personal computer makers for installing on machines in August, Microsoft says.

It is often forgotten that the Justice Department and a number of the states did take legal action to try to force Microsoft to alter the earlier Windows 98. When they filed their antitrust suit against Microsoft in May 1998 — a month before Windows 98 went on sale — the federal and state authorities also sought a preliminary order forcing Microsoft to change its new system. The judge hearing the case combined the antitrust case and the motion to alter Windows 98, allowing the software to be shipped without modification and on time.

"It's the same situation as last time," said Andrew Gavil, a professor at Howard University law school in Washington. "The difference, though, is that now Microsoft has been found to be a monopoly and to have violated antitrust laws."

Yet going to court could prove complicated and time-consuming. A preferred path, according to government officials, would be to prod Microsoft into settlement talks to modify certain planned features in Windows XP.
