EXCLUSIVE: Jacko's security chief reveals sick secrets he witnessed at star's Neverland ranchThe boy yelled: 'Get the f*** away Michael'
MICHAEL Jackson's former security chief last night lifted the lid on the sordid antics at the sick pop star's Neverland ranch.
Veteran cop Robert Wegner, pictured right, revealed how he witnessed Jacko GRAB, TOUCH and CARESS young boys.
The 45-year-old singer went so far with some of them that they SCREAMED for him to leave them alone.
One of those youngsters was Jordy Chandler—the 13-year-old at the centre of the original 1993 molestation allegations.
Legal action was dropped after the Chandler family accepted a multi-million pound settlement.
But now the star is charged with repeatedly molesting 12-year-old cancer sufferer Gavin Arvizo, Wegner has told us: "On two separate occasions I saw Michael talking to Jordy and then the boy become agitated.
"They were chatting softly and then, all of a sudden, there was this outburst as Jordy shouted, "Get the f*** away from me.' Then Jordy walked away very fast. I remember his words exactly because it threw me to hear a kid speak that way."
Wegner also saw three similar incidents involving child star Macaulay Culkin of Home Alone fame.
"Jordy and Macaulay were Michael's favourites," said Wegner.
Chilling
"One time I was up near the back of the house where the quad bikes were kept and I saw Michael with Macaulay.
"They were talking and suddenly the kid yelled, "Go f*** off, Michael. Just leave me alone!' That made me question what Michael was doing."
And the more Wegner saw the less he liked it - like how up to 300 boys under 14 slept over and shared Jackson's bedroom.
Now Wegner is offering his chilling dossier of evidence based on running security at the 4,000-acre California ranch from 1990 to 1993.
The 68-year-old grandfather revealed: "On one particular day Michael took a young boy of 10 or 12 into the recreation room at the back of the house.
"They'd been in there for quite a while so I peeked in through the window to make sure that everything was all right.
"The boy was playing on the video game machines and I saw Michael walk up behind him very slowly, stop and then move up to make full body contact.
"Basically he 'bumped' him, pressing his groin up against the child's back. Then he put his hands on the boy's shoulders and was rubbing them.
"It was an inappropriate act and made me feel sick to my stomach."
Wegner didn't challenge Jackson at the time as he believed the star would simply flare up and sack him.
On another occasion Jacko spent over an hour entertaining a little boy in the ranch's movie theatre - which housed a couple of large beds - when there was no projectionist around to run a film.
"There was nothing to do in there," insisted Wegner. "Who knows what they did for all that time?
"Another time a large group of children had been invited to the ranch and were having a water balloon fight.
"One boy got hit and was all wet and started crying. Michael went up to him, got down on his knees and just hugged him...and hugged him...and hugged him. Far, far longer than was necessary.
Star made kids strip to play slot machines
JACKO lured boys into his room with a slot machine that dished out 100-dollar bills - ;but insisted they strip naked to play.
The revelation comes from investigator and author Victor Gutierrez, who has interviewed Neverland staff and the family of Jordy Chandler - the boy at the centre of the 1993 abuse allegations.
He tells of a day in March 1993 when Jacko took Jordy and two other boys to the big-money game only "special friends" could play.
"But the star insisted there were two important rules," said Gutierrez.
"The game had to be played in the nude. And anyone who played was forbidden to tell anyone."

Dat heeft The New York Times gisteren gemeld.

Attorney Mark Geragos Defying Press Conference!!!!
26/11/2003
Reuters:
Michael Jackson's lawyer says child molestation accusations against the pop star are driven by greed and has threatened a "legal torrent" against anyone who besmirches Jackson's reputation.
"If anybody doesn't think ... that the true motivation of these charges and allegations is anything but money and the seeking of money then they are living in their own Neverland," attorney Mark Geragos said on Tuesday, in reference to Jackson's Neverland Valley Ranch near Santa Barbara in Central California.
Geragos also said Jackson on Tuesday sued the owners of a private jet that last week brought him to Santa Barbara to be arrested and fingerprinted by police -- claiming that someone with the XtraJet company had planted video cameras on the plane and then tried to sell the tapes to news organisations.
As Geragos spoke, prosecutors announced that they would not file formal charges against the onetime King of Pop until mid-December because they needed time to create a Web site where the documents could be posted online.
Jackson flew from Las Vegas to Santa Barbara last Thursday just long enough to be arrested on suspicion of molesting a young boy, before posting $3 million (1.7 million pounds) bail and leaving town again. Earlier in the week, police spent more than 14 hours searching Neverland for evidence.
Geragos took no questions from reporters and directed his remarks almost entirely at those who, he said, were trying to profit from Jackson's misfortune.
"Michael Jackson is not going to be abused. Michael Jackson is not going to be slammed, is not going to be a pinata for every person who has financial motives," he said.
"We will land on you like a ton of bricks," Geragos said. "We will land on you like a hammer if you do anything to besmirch this man's reputation, anything to intrude on his privacy in any way that is actionable. We will unleash a legal torrent like you have never seen."
The high-profile lawyer said Jackson had obtained a temporary restraining order against XtraJet which prohibited it from showing, distributing or selling the videotape.
"We will put XtraJet out of business for this outrageous act," he said. "Michael Jackson is no longer going to be on the receiving end of every scurrilous accusation known to man."
Representatives for XtraJet declined to comment on the lawsuit and restraining order.

Uri Geller Regrets ITV Documentary
27/11/2003
The following interview comes from MTV:
I told him, 'You'll end up in jail,' " Geller said. "Not because he's guilty ... but because this behavior of inviting children into the bedroom, the behavior is unacceptable to the outside world, to the community, to society, and society gets very, very suspicious."
Unfortunately, Geller said, his counsel wasn't enough because he wasn't being backed up by people in Jackson's camp, who should have taken a harder line with the singer and not just automatically agreed to whatever Jackson wanted.
"It's just, 'Yes, Michael,' and he might not like to hear this, but in my opinion, Michael needs help, and I don't mean for what he's been accused of doing. ... He needs more [people who aren't afraid to speak the truth]. I have my own chutzpah, I am an Israeli and I don't bullsh--. I couldn't care less what people think about me. I speak the truth."
"And let's get something straight. I have been approached nonstop to speak and talk about him. I try to defend him because I don't believe the allegations. It is impossible for me to believe Michael would abuse a child with cancer. And I would be shocked to the core, my belief system will be shattered, I would be absolutely devastated if I were wrong. Many people will be. I think this case will crumble. It won't go to court."

Accuser Said to Be Seriously Ill

Associated Press:
Jamie Masada, owner of The Laugh Factory in West Hollywood, said the child remains in poor health and requires a kidney transplant, Masada said Thursday.
"The kid is not doing very good," Masada said at an annual Thanksgiving dinner for the homeless that he holds at the club.
Masada said doctors removed a large tumor from the boy's stomach some time ago, and at the same time took out one of his kidneys and spleen. Masada said he saw the boy earlier this week and the boy's remaining kidney is failing and he needs a transplant.
He said the teenager was being treated at home, not a hospital, but was getting dialysis treatments.
It was unclear what effect the boy's condition could have on the case against Jackson. Masada said he and the boy had not discussed Jackson, and Masada declined to comment on whether he believes the molestation allegations.
Stuart Backerman, Jackson family spokesman, declined to comment on Masada's account but said he hoped the boy's condition would improve.
"I think it goes without saying that we all hope he recovers well and that everybody's heartfelt wish is for him to be healthy," Backerman said.

She says: In fact, its quite conversational, and they just talk about how blessed they are to be part of his family. Moeder 'misbruikte' jongen pleitte Jackson vrijUitgegeven: 27 november 2003 11:47

Jackson Facing Financial Meltdown?Troubled pop superstar Michael Jackson is facing more problems as he fights allegations of child molestation, his finances have spiraled out-of-control. The hitmaker is reportedly facing debts of up to $200 million and has been instructed by financial advisors to limit his spending to $1 million-a-month in order to remain financially solvent. According to newspaper The New York Times, Jackson has taken out a series of loans to retain his lavish lifestyle but is finding it difficult to keep up repayments due to his fading musical popularity. Before the recent charges were leveled at him, Jackson had been hoping that the sales of his new compilation album Number Ones would inflate his dwindling bank balance but despite hitting the top of the chart in Britain, he is languishing at number 13 in his native America. Now, with a hugely-expensive legal battle looming, Jackson may have to sell his prized possession, The Beatles back catalog - which is valued at $300 million, in order to solve his financial woes.

Jackson edges ahead as child abuse row hits new lows
Paul Harris in New York
Sunday November 30, 2003
If they thought it was an open-and-shut case, prosecutors investigating child abuse allegations against Michael Jackson got it badly wrong. Just 10 days after the heavily publicised police raid on the singer's Neverland ranch, the inquiry has hit several embarrassing snags.
While the lurid story still dominates tabloid headlines, Jackson's camp has scored notable victories in a public relations offensive. As both sides gear up for a long battle, it seems the star may even have won round one.
Tom Sneddon, the Santa Barbara district attorney in charge of the case, had to apologise for referring to Jackson publicly as 'Wacko Jacko' and welcoming reporters covering the case for the money they will bring to the Californian economy.
'I knew as soon as I said it, it was inappropriate. It was unprofessional,' he said.
The Jackson camp accuses him of mounting a decade-long vendetta against the singer after the collapse of a 1993 child abuse case following a multi-million dollar payoff to the alleged victim.
Sneddon denies any personal spite, but his climbdown was humiliating. 'If my mom was still alive she would take me to task for not being a good person,' the DA said. The apology was only the beginning. It has emerged that the alleged victim went to see a therapist - whom he told that he had been abused - only after his family had already contacted a lawyer linked to the 1993 case. The lawyer helped put them in touch with police.
Perhaps most damaging of all are reports of an audio tape on which the child and his relatives praise Jackson and say he never 'acted inappropriately' towards the boy.
Jackson's side has played a skilful media game, letting only Kimberly Guilfoyle Newsom, a CNN legal pundit, hear the tape.
Newsom said that on the tape the alleged victim, his brother and their mother all praise the singer effusively as a father figure, saying they were blessed to have him in their lives. The tape was recorded last February after the alleged abuse.
Newsom said the Jackson source who played it to her said the boy's mother and the alleged victim had signed an affidavit that Jackson had never abused the child.
Ugly details have emerged of the home life of the boy, a 12-year-old cancer sufferer. His family pursued two abuse-related lawsuits in the past, once winning more than $137,000 in damages.
That case occurred after the family said they were assaulted by security guards at a department store after the child left with clothes he had not paid for. His mother told a court then that one guard had sexually assaulted her. Charges were dropped and a settlement paid.
The boy's father has previously admitted domestic abuse. The couple had a bitter divorce in which the mother claimed her husband harmed her and was guilty of spousal abuse and child cruelty. The father accused her in turn of making the children lie.
Amid all the leaks, accusations and dirt digging, a sophisticated game is being played, as each side tries to control the flow of information to an insatiable media.
The press are playing dirty too. The FBI has launched an investigation into how Jackson and his flamboyant lawyer Mark Geragos were secretly videotaped on board a private jet as Jackson flew from Santa Barbara to Las Vegas after his arrest.
Geragos said he had sued the plane's owners, XtraJet, for placing cameras on board. The incident prompted one of the few comments nearly everyone agrees on. 'New lows are being hit daily in the case,' said Jackson's spokesman, Stuart Backerman.
Jackson's robust defence and his hounding by the tabloids have won him the support of celebrities, many of whom see a racial element in the case, including rappers P. Diddy and LL Cool J and rhythm and blues diva Alicia Keys. Civil rights leader Jesse Jackson has attacked Jackson's treatment by the media.
If Jackson's camp operating from a hotel in Las Vegas, has come out with guns blazing, the prosecution remains convinced it has a firm case. After saying they would charge Jackson this week, the prosecutors now signal this will not happen until at least mid-December, giving Sneddon more time to examine evidence from Neverland. Experts say the charge sheet should be far more detailed as a result of the extra time.

In early July 1993, Dave Schwartz, who had been friendly with Chandler, secretly tape-recorded a lengthy telephone conversation he had with him. During the conversation, Chandler talked of his concern for his son and his anger at Jackson and at his ex-wife, whom he described as "cold and heartless." When Chandler tried to "get her attention" to discuss his suspicions about Jackson, he says on the tape, she told him "Go fuck yourself."
"I had a good communication with Michael," Chandler told Schwartz. "We were friends. I liked him and I respected him and everything else for what he is. There was no reason why he had to stop calling me. I sat in the room one day and talked to Michael and told him exactly what I want out of this whole relationship. What I want."
Admitting to Schwartz that he had "been rehearsed" about what to say and what not to say, Chandler never mentioned money during their conversation. When Schwartz asked what Jackson had done that made Chandler so upset, Chandler alleged only that "he broke up the family. [The boy] has been seduced by this guy's power and money." Both men repeatedly berated themselves as poor fathers to the boy.
Elsewhere on the tape, Chandler indicated he was prepared to move against Jackson: "It's already set," Chandler told Schwartz. "There are other people involved that are waiting for my phone call that are in certain positions. I've paid them to do it. Everything's going according to a certain plan that isn't just mine. Once I make that phone call, this guy [his attorney, Barry K. Rothman, presumably] is going to destroy everybody in sight in any devious, nasty, cruel way that he can
do it. And I've given him full authority to do that."
Chandler then predicted what would, in fact, transpire six weeks later: "And if I go through with this, I win big-time. There's no way I lose. I've checked that inside out. I will get everything I want, and they will be destroyed forever. June will lose [custody of the son]...and Michael's career will be over."
"Does that help [the boy]?" Schwartz asked.
"That's irrelevant to me," Chandler replied. "It's going to be bigger than all of us put together. The whole thing is going to crash down on everybody and destroy everybody in sight. It will be a massacre if I don't get what I want."

FOX NEWS: Media Fails Public in Jackson Case
..., the media bears moral responsibility for promoting discussion that aids justice. Again, the media has failed.
Newscasts and commentary have deteriorated to the status of tabloid press, which seeks to create hysteria and stoke emotions ... not to inform. Consider the non-stop coverage of Jackson's Nov. 20 arrest. The war in Iraq was shoved aside while otherwise reputable journalists speculated on what kind of plane would carry Jackson to the Santa Barbara police department for his booking. At one point, the camera focused at great length on the wrong plane.
A typical commentary that purports to revolve around Jackson's guilt or innocence includes discussion of his facial surgeries, head-shaking over his eccentricities, a nasty dissection of his appearance, speculation on his past marriage to Lisa Marie Presley, a report on his sagging record sales, and commentary about which friends are or are not supporting him and why.
Interspersed with ad hominems and irrelevancies are interviews with legal experts that deteriorate into shouting matches with predictable regularity. A flood of commentators -- none of whom know if Jackson is guilty -- state their opinions with passion and persistence. They mix defamation with legal analysis, giving equal weight to both.
The media is actively subverting "information" and promoting hysteria, both of which make the court of opinion harm the court of law.

Jacko Loses Logo Rights; Manager Owns Sex Clubs AbroadMichael Jackson's got some big problems. And that's besides being arrested for child molestation. Jackson has no idea that his current manager, Dieter Wiesner, the man who helped hire attorney Mark Geragos and is now calling the shots in the Jackson camp, is known for operating sex clubs and brothels at home in Germany.
Prostitution is legal in Germany, in case you didn't know. But many other things, which Wiesner's former partners and employees say he has interests in, are not legal, including fraud - for which he was tried earlier this year in a German court - and selling stolen goods.
As well, because of debts Wiesner incurred on his behalf, Jackson has lost the rights to his MJ trademark in Germany and Europe to a technology company. The result could be that company's interference with the sales of Jackson CDs on that continent.
This is bad news for a number of reasons. According to my sources, in recent weeks Wiesner and his partner, Ronald Konitzer, have cut Jackson off from his regular group of advisers, isolating him. (Konitzer, a Vancouver businessman who is said to have many enemies, is apparently the one who actually called Geragos last spring.) Together they have been with Jackson since before the search of Neverland Ranch on Nov. 19, staying at the pop star's side.

Verse 1
Everywhere I turn, no matter where I look
The systems in control, it's all ran by the book
I've got to get away so I can clear my mind,
Xscape is what I need,
Away from electric eyes
No matter where I am, I see my face around
They then ask on my name, and push from town to town
Don't have a place to run, but there's no need to hide,
I've got to, find a place,
So I won't hide away
Chorus
Xscape, got to get away from a system lose in the world today
Xscape, the pressure that I face from relationships that's gone away
Xscape, the man with the pen that writes the lies that hassle this man
Xscape, I do what I wanna cause I gotta face nobody but me
(Girl)
Sometimes I feel like
I've gotta get away
Verse 2
I tried to share my life with someone I could love
But games and money is all she ever thought of
How could that be my fault when she gambled and lost?
I'm tired of silly games,
It's time to make a change
Why is it I can't do whatever I want to? (oh)
Went in my personal life and I don't live for you (you)
So don't you try to tell me what is right for me
You be concerned about you,
I can do what I want to

This is the court of opinion versus the court of law debate. It misses the point. Of course, Jackson's possible guilt should be discussed. The real question is how to conduct the public debate so that it does not reduce the probability of justice.
People have a right to debate the Jackson case because it may exert a defining influence on the laws under which they will live. As the direct result of an earlier allegation against Jackson, for example, California (search) state law was changed. Now anyone who brings such a molestation allegation can be forced by the state to testify rather than be allowed to accept an out-of-court settlement.
Moreover, the case raises some of the most unsettling legal and moral issues confronting our society: child molestation, false accusations and how the legal system should deal with them, how the media should handle celebrity cases.
There is no presumption of innocence in the court of opinion. That's a legal principle: A criminal defendant may not be convicted unless guilt has been proven beyond a reasonable doubt, with the accused bearing no burden to prove innocence.
The court of opinion can convict anyone on any basis. Issues of common decency certainly apply but everyone quite naturally speaks from their own concerns and opinions. This is healthy. This is human.
A key to whether the public dialogue harms the prospects of justice is information -- that is, getting solid facts out so people can base conclusions on evidence. This is the responsibility of the media to whom most people turn for information.
In the case of Michael Jackson, the media have failed the public.
Another key is to draw and maintain a line between the two spheres. On one side is the subjective swirl of opinion that may not be accurate or fair: the court of opinion. On the other side is the objective body of laws and procedures that determine someone's criminal guilt: the court of law.
The two spheres are distinct but they overlap and influence each other.
Public opinion can negatively impact the judicial system in many ways: It can prejudice the jury pool, encourage ambitious judges or DAs to push for inappropriate penalties and intimidate witnesses into silence or over-statement. Under public opinion, the police may stack on additional charges or proceed on inadequate evidence.
But public opinion can also benefit the judicial system. Open trial became a defendant's civil right because they allowed the public to judge the fairness of a court proceeding and, so, to serve as a check on judicial abuse. Trial by jury embodies a similar logic. If a court proceeding is manifestly corrupt, then it is unlikely that 12 jurors will participate in the injustice. Public awareness is a bulwark against crooked courts and bad law.
Again, the media bears moral responsibility for promoting discussion that aids justice.
A typical commentary that purports to revolve around Jackson's guilt or innocence includes discussion of his facial surgeries, head-shaking over his eccentricities, a nasty dissection of his appearance, speculation on his past marriage to Lisa Marie Presley (search), a report on his sagging record sales, and commentary about which friends are or are not supporting him and why.
To some extent, news coverage has always done this. Famous examples come to mind: For example, Sacco and Vanzetti, a notoriously political trial in which two men -- now widely considered innocent -- were executed. Media coverage both reflected and created a mass hysteria that contributed to their death sentences.
But there used to be a distinction between news media and the tabloids. Perhaps erasing this distinction became inevitable with the advent of court TV, through which the judicial system became television's first reality show, complete with public polls on innocence or guilt.
With the Jackson case, the media has a chance to redeem itself. It can retreat from the brink of O.J. Simpson-style reporting that Daniel B. Wood described in the Christian Science Monitor, "issues of jury selection, evidence tampering, and police conspiracy competed with topics such as the dating habits of O.J. houseguest Kato Kaelin and the favorite restaurants of prosecutor Marcia Clark."
Forget fairness to Jackson for one moment. Viewers deserve better.

SEAN HANNITY, CO-HOST: I'm Sean Hannity, reporting tonight from Phoenix.
Now that superstar Michael Jackson (search) has turned himself in on child molestation charges, what happens next?
Trace Gallagher, he joins us live tonight from Jackson's Neverland Ranch (search). He has the very latest -- Trace.
TRACE GALLAGHER, FOX NEWS CORRESPONDENT: Yes, Sean, I'll tell you. We're learning a lot more about the evidence police are collecting.
On the same day they had the raid here at the Neverland Ranch, they raided the studio of a Los Angeles videographer. He used to work for Michael Jackson. He compiled hours of footage and apparently, a lot of that footage is Michael Jackson and the alleged victim, the 12-year-old boy.
On one of the tapes, the boy and his mother are reportedly saying nothing untoward happened between him and Michael Jackson, but that same tape reportedly was taped before the alleged abuse.
The Las Vegas Sun is reporting that Michael Jackson and his brother Jermaine are back in the CMX studios, working on that music video they had been working on now for the past three weeks.
They are also reporting that tonight the Jackson family will meet to decide what to do with Michael's children. They say they -- apparently, it will turn out Michael Jackson will send his kids back here to Neverland Ranch and Michael will stay in Vegas.
On that note, Gloria Allred (search) held a press conference today, saying again that she wants child services to take Michael Jackson's children away.
The arraignment date is set for January 9. Legal experts are saying that attorney Mark Geragos (search), Jackson's new attorney, he will now spend time trying to pick apart the prosecution's case by attacking the credibility of not only the alleged victim, the 12-year-old boy, but also the mother, as well as the mother's character and the mother's motivation.
The hope, say legal experts, is to dissuade them from testifying.
And finally tonight, Sean, some of Michael Jackson fans will be holding candlelight vigils here at the Neverland Ranch as well as in New York, in London and in Las Vegas, where Michael Jackson remains tonight -- Sean.
HANNITY: Trace Gallagher, joining us from the Neverland Ranch tonight.
Joining us now is the host of The Big Story Weekend Edition, our own Rita Cosby, and also joining us, FoxNews.com columnist Roger Friedman.
Rita, let me begin with you.
You were there. You spent time with Michael Jackson at this particular ranch. You saw this child. Bring us inside there one more time. Give us an insider's view, what it is that you saw there.
RITA COSBY, THE BIG STORY, WEEKEND EDITION HOST: It really is a fantasyland. I mean, Sean, it is every child's dream. When you walk in, candy everywhere, sort of hidden compartments, hidden areas.
Also this movie theater. I cannot get away from seeing this movie theater. I remember it very vividly. Walking in, there are about 30 or 40 seats or in this movie theater. And behind it there are two sort of glass- encased bedrooms. So if you want to lay in bed and watch the movie theater, it's sort of his private bed area, which looked very sort of interesting.
In addition, I've been told today that there's sort of a secret room on top of the bedroom. Sort of a private area where maybe it's about 10 feet by about six feet, where, it's a two-way glass. It's a glass that you can look out and look at the movie theater, but they can't look in.
So a lot of sort of interesting, sort of hidden rooms and really, a child's paradise, if you will.
HANNITY: But you had limited contact with Michael Jackson himself?
COSBY: I had limited contact with him. I did not speak with him at Neverland Ranch. I did do an interview with him several months before.
And in my interview with him, he was very guarded but also very sensitive to the press. Very sensitive to issues.
And in fact, I asked him at that point because I had heard that they were extremely in debt. I'd heard it from numerous sources close to Michael Jackson. But he denied it. He said, "Look, I wrote a $500 million check today. All of these rumors about me being broke, those are untrue. Any rumors about any other thing, those are untrue."
He was very, very protective.
HANNITY: Yes. Roger Friedman, let me bring you in here.
You broke some interesting news today as it relates to his finances and the relationship he had with, "reputed mobster" was the headline in your piece.
ROGER FRIEDMAN, FOXNEWS.COM: Yes.
HANNITY: Tell us a little bit more about the finances.
FRIEDMAN: Well, it's funny. I was listening to Rita. And you say he said he wrote a $500 million check.
COSBY: He doesn't have $500 million. I know.
FRIEDMAN: This is the part where he's not in reality. And it's very strange. Because you know, we started writing about his finances on FoxNews.com, I think, in July of 2002, where we laid out the whole thing about how completely in debt he was.
And even though he has $750 million on paper, because of you know, assets, his cash situation has really been terrible, especially the last three years. I mean, at one point, he actually had to get a loan so that he could pay off a diamond watch that he wanted that he found on Rodeo Drive (search) and wouldn't give back. It was a $2 million watch they had given to him on consignment.
And when he wouldn't give it back and then finally gave it back all messed up, they said, "You have to pay us the money." And they sued him for it, the jeweler. And he had to get a loan for the watch. So getting $2 million is like a big deal for Michael.
Just last month he had a fund-raiser in September. He had a fund- raiser at Neverland just to raise $1 million.
ALAN COLMES, CO-HOST: But does he have a benefactor?
FRIEDMAN: So now he has this benefactor, Al Melnick.
COLMES: Who is he?
FRIEDMAN: Al Melnick, who is 69 years old. He's a lawyer from Miami who made his name being Myra Lansky's lawyer, when he was starting out as a lawyer. And he's always been, whenever you read about him, he is called, you know, "reputed mobster."
COLMES: Are you suggesting that Michael Jackson is getting mob money?
FRIEDMAN: No. I would never suggest that. I would never suggest such a thing.
Al Melnick on his own has made quite a career, because he is the loan king of America. He owns -- Maybe people out there have loans through his company. It's called Title Loans of America. And they're all over the country, and they loan people -- they loan money to people who are very poor at very high interest rates.
And now he's -- But I don't think he's loaned Michael the money. I think he's given to it him.
Michael met him -- Michael's been down in Florida trying to become a homesteader.
COSBY: In Boca Raton.
FRIEDMAN: In Boca Raton. Because he's been knowing -- See, we didn't know this, but all year long, Michael knew this was coming, this was chugging along. And that maybe a civil suit was attached to it.
COLMES: You reported earlier today he hired Geragos last January.
COSBY: The end of January. And in fact, a number of people anticipating. I'll have some more details, in fact, tonight.
But she apparently -- and we reported a little bit about this last night, but she apparently, the mother of this 12-year-old boy said, and I'm told to a number of people in the Jackson camp -- it's not clear if she said to it Michael Jackson directly or not -- but "I'm going to cause trouble. I want money. I want this." They hired a whole team.
And I'm told two people specifically were flown out just to keep an eye on this mother at Neverland Ranch and her son, knowing that this woman was going to be trouble.
One thing I wanted to accent also. What we just went over with Roger in terms of the finances, Michael Jackson did a special not too long ago, about a year or so ago. He was paid $3 million, I'm told, for that special.
I am told immediately he had to pay $90,000 to the electricity company to pay for electricity that he owed on Neverland Ranch. Just to show how tight they are with the cash.
FRIEDMAN: Yes. But he's out of touch with reality about the cost of Neverland. I mean, just looking at the ledgers from, you know, a month in his life, it's outrageous.
COSBY: $5 million a year is what...
COLMES: Yet he's telling people he's writing checks of outrageous amounts of money that can't be true. He has no concept of reality.
FRIEDMAN: He has no concept of it. So Melnick has stepped in. And he's restructured the finances. So actually, Michael does now have the money to pay lawyers for this case.
COLMES: But this guy is giving him money is what you're saying?
FRIEDMAN: I don't think that he's being charged the interest fee that the regular customers of Title One America are. Maybe he is.
But you know, but Melnick is down there in Miami. And the whole point of this is that Michael has been trying to get to Miami. He was trying to sell Neverland and get down there, because he could lose his house if he lost everything else.
COLMES: And are you, Rita, saying, are you saying the mother, do we have her on tape saying she wants money? Is that something that she has recorded as having said?
COSBY: No. And I do know what is on tape. It's her saying, "I love Michael Jackson." And I'm told the son's also...
FRIEDMAN: They praise him. Over and over.
COSBY: And this is interesting. This has not been reported before. I'm also told there is a written statement to the effect, as well, that she apparently -- Mark Geragos I'm told has a written statement from her and also the son saying, "I love Michael Jackson. He's wonderful. He's a great guy."
This is, of course, I'm told, just slightly before these allegations. But in the midst of her saying all these horrible things about him, as well.
COLMES: But you made a statement a little bit ago about her wanting money or making some kind of statement alluding to her desire for money?
COSBY: We know for a fact, I'm told, from a number of people close to Michael Jackson, that they were told personally by this mother, "I'm looking at money. I want a bigger" -- She apparently was given an apartment from Michael Jackson, the kid. And apparently she said, "I want a house instead. I want this; I want this." Was making a lot of demands.
COLMES: She got a car.
COSBY: She got a car and got a number of things.
COLMES: This is definitely going to hurt their case, if this is the case.
FRIEDMAN: Well, this is going to be part of the defense.
(BEGIN VIDEO CLIP)
COSBY: What is your financial situation?
MICHAEL JACKSON, ENTERTAINER: I'm in incredible financial situation. I just wrote somebody a check for $500 million. Good news doesn't sell. If it's something negative and that's a rumor, that's when it's blasted. I don't expect the press to say anything good.
(END VIDEO CLIP)
COLMES: That was an exclusive interview our own Rita Cosby had with Michael Jackson just last year.
There he was saying, "I just wrote a check for $500 million."
COSBY: I remember it to this day...
COLMES: Is that most money, walking around money?
COSBY: I remember saying, come on. You've got to be -- And as we know, I know back in February when all these incidents, all this issue of her fleeing and the whole Bashir -- I know for a fact that at that point he was $240 million in debt.
So you're saying now all of a sudden, you know, things are fine?
COLMES: But the amazing thing, this thing. If there is a story, Rita Cosby has been on the phone with that person. You just got off the phone before tonight's show, before tonight's HANNITY & COLMES, with Jermaine Jackson.
COSBY: Just spoke with him.
COLMES: You just spoke to him. What did he tell you?
COSBY: He was describing a little bit of, first of all, the atmosphere. This is the first time we sort of heard what was going on with Michael Jackson before he turned himself in, before he was arrested.
And he told me that Michael was actually relaxed. Was angry. He kept saying, "I'm innocent. I'm going to fight this to the bitter end."
COLMES: Jermaine believes that, too?
COSBY: Jermaine believes that, too. He said that he is defiant, much more defiant than fearful.
I said, "Is he worried."
And he said, you know, he's obviously nervous and upset about the allegations, but he said he is absolutely going to fight this to the end.
The other thing, this is interesting, he was saying that night before he turned himself in -- you kind of wonder what people are doing in this moment, especially anticipating it. Remember, they got warning. They made the deal that he was going to surrender?
He was watching Pinocchio on DVD with his three kids, finished the movie and then said, "OK. I'm ready. Let's go."
COLMES: That was it?
FRIEDMAN: Michael Jackson's seen Pinocchio.
COSBY: I guess about 300 times.
FRIEDMAN: ... since he was 5 years old.
COLMES: You're working on a story here about the changing team around Michael Jackson?
FRIEDMAN: Yes. I think for Monday we're going to have a story about what's going on in the inner circle. Because there's a lot of changes.
Well, this has been a strange year anyway, because of course, he knew things that we didn't know. He knew this was coming back in February, March.
But during the year, you know, he dropped his main lawyer, John Branca, which was a huge mistake. Because John Branca had been his regular lawyer for about 20 years, and that saved him from a lot of catastrophes.
And he went through a lot of management changes. The whole year has been very peculiar.
So when this happened now, bringing in Geragos, apparently, was the idea of an adviser who everyone doesn't like, who is very close to Michael. So the whole jockeying for position is going to take place over the next 45 days. And it will be interesting on January 9 to see who walks into the courtroom for the arraignment with Michael. Because it's not actually clear that Mark Geragos is going to be that person.
HANNITY: Roger, I want you to go a little bit deeper to this story you broke, that you're referring to here. They've been preparing for months...
FRIEDMAN: Yes.
HANNITY: ... for this defense and they knew a lot of this was coming here. Because I think this is very key. Because especially as it relates to the investigation and the search warrant that was issued, and what evidence they might have been able to take out of the Neverland Ranch.
FRIEDMAN: Well, it's a peculiar situation. Rita and I were talking about it, and we can't even explain to you for various reasons right now why we know that this has been going on since February, but we do know that it's been going on since February.
And that's when -- Interestingly enough, you know, as Geragos was hired by the Jackson camp back in February, at the same time, you know, the family of the child had their own lawyer. And that lawyer contacted Larry Feldman who was the lawyer for the family from 10 years ago.
So these people have been sort of getting into position. It's like a football game or a chess match, where they've been getting into position for months, knowing that this was coming.
HANNITY: And Rita, let me go to you. And I guess that makes it just all the more bizarre, considering that he was still allowing himself to be put in these compromising positions and sleeping with these kids.
There was one report also, I know you've been investigating, Rita, about these three missing kids from Norway. Do you have any update on that?
And in light of what Roger is pointing out here, about they've known about this for a long time. The fact that he continued this lifestyle is just -- one can only imagine why.
COSBY: Well, I think two things are happening. One is I think nobody is around Michael Jackson saying, "This is weird; what are you doing?" He's got -- And this is typical for a lot of these sort of amazing celebrities.
FRIEDMAN: It's not that no one's around him, it's that the people who are around him are afraid to say it.
COSBY: Absolutely. And this is typical with that kind of superstar.
FRIEDMAN: But this was in the O.J. situation, it was the kind of thing...
COSBY: Absolutely.
FRIEDMAN: In Whitney Houston it's the same thing.
COSBY: No one is saying, what are you doing with these kids? And they're saying, "This is OK. We totally agree."
FRIEDMAN: Because they're on the payroll.
COSBY: They're on the payroll.
FRIEDMAN: And also, and not necessarily Michael Jackson, but there have been other sort of celebrities who, as you know, when you hear something like you don't want to -- something you don't want to hear, they cut him off.
COLMES: We're going to get into that. Where are the other celebrities?
Roger, we thank you for the breaking news...
FRIEDMAN: Thank you.
COLMES: ... and new information you brought to light.
You, as well.
COSBY: Thank you.

Geragos remarks were made following two Stanislaus County Superior Court hearings keeping arrest and search warrant records sealed and rejecting defense motions to disqualify Judge Al Girolmai from the criminal case because he was involved in a related civil case where a local newspaper is seeking access to search warrants.

Michael Jackson's "Number Ones" could have been a contender. This last contractual obligation to Sony might have been a hit if Jackson hadn't wound up in a monstrous scandal. But last week it sold 130,000 copies and this week a paltry 80,000. It's fallen from No. 13 to No. 31 and is on its way off the charts this week.
But what does this mean, really? A Jackson insider who knows about his music business says, "We could have gone in the black with Sony if the greatest hits had done well. We were expecting maybe 2 million in the U.S."
'In the black' refers to Jackson's album contract with Sony and not all the loans, etc. But from a strict standpoint of the cost of the albums that came out, the source says, "We would have been re-couped - and they would have had to start paying us money." Sadly, this will not be happening.
Meantime, do read The New York Times' account of Michael's prosecution today, complete with lots of material they picked up here and elsewhere. The hook of the article is that the D.A.'s case is weak and he may never bring charges against Jackson. I told you on Day 1: the spin against the 12-year-old and his family would be brutal.

OS ANGELES, Dec. 3 - Two weeks after the arrest of Michael Jackson on felony child molesting charges, the case against him may have hit some snags.
The Santa Barbara County district attorney, Thomas W. Sneddon Jr., has twice delayed filing formal charges against Mr. Jackson, who was showily arrested, booked and set free on $3 million bail on Nov. 20. Mr. Sneddon now says the charges will be made public the week of Dec. 15. Veteran prosecutors say that such a delay is unusual, though not unprecedented, and does not necessarily indicate problems with the case.
But the tip line set up to field anonymous calls from anyone with information about the current case or similar complaints of misconduct by Mr. Jackson has yielded little, a spokesman for the Santa Barbara County Sheriff's Department said. Of 70 calls to the line over the last two weeks, only a handful have produced information relevant to the case against Mr. Jackson, said the spokesman, Sgt. Chris Pappas. And no one has come forward to tell of separate acts of molesting by Mr. Jackson, Sergeant Pappas said.
"At this point in time," he said, "none have clearly identified new cases for independent investigation."
The delay in releasing details of the charges against Mr. Jackson and the lack of new complaints have prompted some in the Jackson camp to say Mr. Sneddon is playing a weak hand based on a single child's shaky testimony. One of Mr. Jackson's lawyers suggested this week that Mr. Sneddon might be forced to drop the prosecution before a trial.
Mark Geragos, Mr. Jackson's lead lawyer, said he would not comment on the case "unless and until there is a charging document." Mr. Geragos said, based on his fragmentary knowledge of the identity of Mr. Jackson's accuser and the accuser's account, "I'm not so sure there's even going to be a charging document."
Mr. Geragos has characterized the accusation against Mr. Jackson as a "big lie."
Mr. Sneddon's office said the prosecutor would not speak to the news media until he made the charges against Mr. Jackson public. In a brief interview with CNN last week, Mr. Sneddon acknowledged that he had mishandled his announcement of the arrest warrant for Mr. Jackson by appearing to make light of the charges. He denied that he was pursuing a vendetta against Mr. Jackson. But he repeated his contention that the case was strong.
"It just doesn't make any sense that the sheriff and I would do something that is doomed in the long run to fail," Mr. Sneddon said. "We have a responsibility. We didn't go looking for this case. It came to us."
One California prosecutor with years of experience handling child molesting cases said it was certain that months of investigation went into the case.
"I imagine they're being very conservative, in light of the high profile of this case," said the prosecutor, Roseanne Froeberg, head of the sex crimes unit of the Orange County district attorney's office. "We have ethical obligations to meet a high threshold before accusing someone of such a heinous charge."
Ms. Froeberg added, however, that a case that turns on the testimony of one child, particularly one with health problems and a complicated relationship with the person accused, can be tough to prove in court.
"A lot can change between the filing of the charge and presentation to a jury," she said.
The accuser in the case is a 13-year-old former cancer patient who was befriended by Mr. Jackson last year and who stayed overnight at Mr. Jackson's ranch, Neverland, outside Santa Barbara, several times last winter. According to those familiar with his account, the boy has a troubled family history and has given several versions of his relationship with Mr. Jackson.
This year, the boy's family approached Lawrence Feldman, the lawyer who handled the case a decade ago of a 13-year-old boy who had said that Mr. Jackson molested him. Mr. Jackson reached a multimillion-dollar settlement with the boy, and no charges were brought.
Mr. Feldman referred the boy in the current case to a psychiatrist, who reported the account of abuse to Santa Barbara County authorities this summer.
Mr. Feldman said on Wednesday that he would not discuss the case until the charges become public.
John D. Barnett, a prominent defense lawyer in Southern California, noted that Mr. Sneddon publicly appealed to other potential victims of Mr. Jackson to come forward. He called it "advertising for witnesses" and said it could be taken as a sign of weakness in the prosecution's case.
Mr. Jackson's defenders and relatives contend that the case is groundless, the confluence of a frustrated prosecutor and a greedy mother exploiting her son's onetime friendship with a rich entertainer.
Michael R. Oxman, a lawyer who has represented several members of the Jackson family, said that Mr. Sneddon was "out to get Michael Jackson."
"At the press conference, the district attorney paraded before the world a bunch of uncharged and unsubstantiated claims to poison a jury," Mr. Oxman said. "He conducted a jocular press conference as if it's a Broadway opening. That is just unprofessional conduct."
He also said that he suspected that the victim's family was seeking money, not the conviction and imprisonment of Mr. Jackson.
"The D.A. says this isn't about money and there's no civil suit, like the last time," Mr. Oxman said. "Whenever anyone says it's not about money, it's about money."

Phone Lines Fail To Bring More Allegations
By Mark Sage, PA News, in New York
No one has come forward to make additional allegations against embattled pop star Michael Jackson after a tip-off phone line was set up by police, it emerged today.
The news came amid fresh doubts about the strength of the child sex abuse allegations made against Jackson by a 13-year-old cancer survivor. Jackson has called claims that he abused the boy at his Neverland ranch in Santa Barbara, California, a "big lie".
Sergeant Chris Pappas of the Santa Barbara County Sheriff's Department said today that about 70 calls had been received by police about the case in the last two weeks.
Only a handful had provided information which could be followed up and no further accusations had been made against the 45-year-old singer, he said. "At this point in time none have clearly identified new cases for independent investigation," he said.
Meanwhile, the New York Times reported that the Santa Barbara District Attorney, Thomas Sneddon, has twice delayed filing formal charges against Jackson.
Jackson's lawyer Mark Geragos has questioned whether the star will be charged at all.
"I'm not so sure there's even going to be a charging document," he said.
But in previous comments Mr Sneddon has defended the case saying: "It just doesn't make any sense that the Sheriff and I would do something that is doomed in the long run to fail."
The credibility of the accuser has already been called into doubt following a claim that he and his mother recently signed legal papers saying the pop star "never acted inappropriately".
It has also been revealed that the boy's family has launched two other abuse-related lawsuits in the past, winning a $90,000 settlement in one case.

MORE JACKSON ALLEGATIONS EMERGE
Former sheriff: 2nd child claimed in 1993 Jackson molested him
From Art Harris
CNN
Friday, December 5, 2003 Posted: 2129 GMT
SANTA BARBARA, California (CNN) -- Former Santa Barbara Sheriff Jim Thomas said there is a second child who claimed in 1993 that Michael Jackson molested him. Those accusations were audiotaped but not videotaped, the sheriff said.Sources close to the prosecution in the current alleged molestation case against the pop star say that the second alleged 1993 victim could be called to testify, unlike in 1993, when he was much younger and frightened.
District Attorney Tom Sneddon said Thursday he still plans to file charges in mid-December against Jackson for the singer's alleged molestation of another boy more recently. He also scoffed at published reports that speculate the case is weak because charges have not yet been filed.
"Everything will become clear when the charges are filed," Sneddon said.
Jackson, 45, was booked in Santa Barbara on November 20 on suspicion of child molestation and was then released on $3 million bond.
Jackson defense attorney Mark Geragos did not return several phone calls seeking comment about the second alleged victim from 1993, but a source close to the defense told CNN he believes the defense is aware of such claims.
Charges were never filed in 1993 after the first alleged victim dropped out of any criminal proceedings when his family settled with Jackson --- reportedly for millions of dollars.
Thomas, who conducted the decade-old investigation into molestation charges in cooperation with Los Angeles police, told CNN on Thursday the second accuser in 1993, a boy aged 9 or 10 at the time, decided he was too "ashamed" to testify against Jackson, and didn't want his friends to know. The parents also did not want the boy or themselves subjected to a "take no prisoners" defense, Thomas said.
"The child did not want to testify, and we can't force a child to testify, so that never went forward," he said.
A source close to the current prosecution confirmed to CNN there was a second alleged victim in 1993.
Thomas said he believed the second child would have gone forward with the allegations had other alleged victims come forward. He said the case was "strong," but "it would have been up to a jury to decide, and it never got that far."
The allegations by the second child did not go to the same level of molestation as that detailed in a graphic declaration by the first alleged victim in 1993, sources familiar with the audiotaped statement said. But, the same sources described the second claim as credible and said the pattern was similar to how Jackson courted and seduced his "special friends," as investigators referred to the boys.
The former sheriff said a parent of the second boy intervened upon learning of his alleged molestation and severed contact with Jackson. "That parent was angry," said Thomas.
The former sheriff sent investigators all over the country and as far as the Philippines to investigate other reports of sexual molestation.
Sneddon, who was also the district attorney in the 1993 case, presented evidence from that investigation to a Santa Barbara grand jury at the time. But ultimately no formal charges were filed against the pop icon.
Jackson is scheduled to be arraigned January 9 in Santa Barbara Superior Court on the latest allegation. A single count of child molestation can carry a prison sentence of up to eight years.
Jackson and his lawyers say he's innocent and contend that the boy in the current case and his family have brought the allegations for financial gain.
Another source close to the district attorney said Sneddon is leaving the door open if any former alleged victims decide to come forward.
"That's always a possibility," the source said.

Dunlap sues over arrest
By Mark Abramson - Staff Writer
12/5/03 Solvang attorney Gary Dunlap, who described his arrest and prosecution last summer as an emotional drain on his family and a financial fiasco for his practice, has filed a $10 million federal lawsuit against Santa Barbara County District Attorney Tom Sneddon.
Dunlap was acquitted in June of six charges, including perjury, witness intimidation, filing false documents and preparing false documents stemming from a case against one of Dunlap's clients. If convicted, Dunlap could have served up to 12 years in prison.
A 102-page complaint filed in U.S. District Court in Los Angeles last month alleges that Sneddon and his office violated Dunlap's civil rights. The complaint seeks $10 million for compensatory and special damages and asks for punitive damages and attorney's fees.
Dunlap and his attorneys, Burbank-based Joe Freeman & Associates, have requested a jury trial to resolve the suit.
The district attorney's office conspired against Dunlap, maliciously prosecuted him, and is guilty of racketeering and witness tampering, according to the complaint.
It also accuses Sneddon and his office of conducting illegal searches of Dunlap's property, violating his civil rights and defaming him.
"In fact, it is difficult, if not impossible, to discern any ethical standards on the part of the defendants; they appear to have been intellectually destitute and morally bereft during the entire sequence of events giving rise to this complaint," according to Dunlap's complaint.
Sneddon, who is preparing to file child molestation charges against pop icon Michael Jackson, said he could not comment on the Dunlap suit. He said all the defendants have been advised to withhold comment. Jake Stoddard, the county attorney handling the case, said he has not read the complaint.
The lawsuit also names Assistant District Attorney Christie Schultz-Stanley; Deputy District Attorneys Jerry McBeth, Kevin Duffy, Gerald Franklin, John McKinnon and Josh Webb; and district attorney investigators Tim Rooney and Mary Brizzola.
"I think they did it because I have a history of being a very aggressive litigator," Dunlap said. "I've always been a big critic of the district attorney's office. They tried to get me disbarred before I was even convicted."
After his acquittal in June, Dunlap filed a $10 million claim against members of the district attorney's office and the county. The claim was denied by the Board of Supervisors.
Dunlap had represented Agustin Salas Jr., who was arrested in June 2002. Salas's mother, Barbara Buontello, was recruited by the FBI to help investigate Dunlap.
Buontello wore a recording device during a discussion of her son's case, trying to engage Dunlap in an extended conversation, according to court documents. The aim was to record Dunlap's alleged willingness to commit perjury.
"Every time I interview a client, I have to wonder whether or not they are wired," Dunlap said. "Economically, yes, I've suffered and I continue to suffer, but the major loss is the pressure I felt and the emotional aspect of what this did to my family.
"It went on for a year, and that was pretty disconcerting. When your life is in the hands of 12 strangers (the jurors), that is a frightening thing."

Below is an article in it's entirety taken from the LA Times on December 3rd.
The error that keeps on erring
TIM RUTTEN
December 3, 2003
Error, according to the classical reckoning, enjoys no rights. But in the 24-hour news cycle, it sometimes achieves a kind of immortality.
That's never truer than in the coverage of criminal cases. One particular thread of the Michael Jackson case is strikingly instructive on how this can occur - even in the face of the news media's prompt and repeated attempts to root out the mistake.
In this instance, the error involves not some peripheral narrative detail, but an issue fundamental to the prosecution: Does a California law adopted after an abortive 1993 investigation into allegations that the singer had molested a young boy allow prosecutors to compel an alleged child victim to testify?
The answer is no. There is no such law.
If you thought there was, you're in extensive company - including a large number of the callers discussing the case on AM talk radio and a clutch of reporters and commentators. In part, that's because the error originated with one of the story's principals, Santa Barbara County Dist. Atty. Tom Sneddon.
In a nationally televised news conference Nov. 19, he recalled the 1993 situation in which the alleged victim declined to cooperate with prosecutors after Jackson paid him a settlement that amounted to tens of millions of dollars.
"The law in California at that time provided that a child victim could not be forced to testify in a child molest proceeding without their permission and consent and cooperation," Sneddon said. "As result of [that] Michael Jackson case, the Legislature changed that law, and that is no longer the law in California."
Within hours, cable news producers from coast to coast were beating the telephonic bushes for "legal experts" to explain this new law, which - oh, delicious causality - had been passed because of Jackson's earlier conduct in a similar case.
Here, somebody might have paused to apply what could be called the old how-would-that-really-work test. Imagine for one second the fate of an elected district attorney who compelled a child victim to recount the details of his sexual abuse by threatening to have the tyke jailed for contempt of court.. The operative words here are "elected" and "child victim." Any prosecutor who did such a thing would be out of office quicker than you can say Gray Davis. In fact, they'd probably be lucky to fend off involuntary commitment to a home for the criminally thick-witted.
But common sense notwithstanding, it is a now wearisomely unremarkable fact that there was no shortage of talking heads with law schools in their pasts willing to appear on camera that night to dance evasively around the nonexistent law.
What was remarkable is that they did so in the face of an Associated Press story filed later that very day, setting the record straight. In that piece, AP special correspondent Linda Deutsch and her colleague Tim Molloy noted that Sneddon's description of the law had "baffled legal experts."
In an follow-up interview shortly after his press conference, Sneddon told Deutsch and Molloy he was referring to another law. That statute regulates only civil settlements, forbidding payments to an alleged victim more than one year after the settlement is reached. In other words, no long-term hush money.
"Sneddon said he was aware that children cannot be forced to testify," according to the AP story, "and that reporters and other attorneys had misinterpreted his remarks at the news conference."
The next morning, however, there was NBC's "Today" show host, Katie Couric, interviewing attorney Johnnie L. Cochran Jr., who represented Jackson in the negotiations that lead to the 1993 settlement:
Couric: "Well, now a new law states that a minor can be called as a witness by the D.A. without consent. So, it's slightly ironic that this change in law that resulted from this previous case may be the thing that actually gets, possibly, gets Michael Jackson in the end."
Cochran: "I think the law was changed after that.. And now they can call witnesses and compel their testimony."
Oh no they can't, a slightly exasperated Jeffery Toobin, CNN's legal affairs analyst, told colleague Miles O'Brien later that same day, as they covered Jackson's surrender to authorities.
O'Brien: "As a parent, I can't imagine anybody trying to compel an 11-year-old to testify in court. I'm sure a lot of people would have problems with that."
Toobin: "No, it can't be done under California law. In fact, the law is broader than that. You can't even compel an adult victim of a sexual assault to testify. That statement by the district attorney is simply wrong. There can be no compulsion."
Less than a week later, attorney Daniel Petrocelli was on Fox News' highly rated "Hannity & Colmes" still vainly trying to set the record straight. Sneddon, Petrocelli said, "referred to a change of law which would permit him to compel the boy to testify, but that is not the law. In California, the victim of a sexual assault, including this young boy, cannot be compelled to testify against his will."
All this expert opinion to the contrary, the paraphrased assertion that Santa Barbara authorities can force the alleged victim to testify, should that become necessary, continues to ricochet undeterred through various parts of the Ameri- can, British and Canadian press.
As late as Monday, a New York Times story on the posture of the Jackson case by Dean E. Murphy was forced to note that though "Sneddon suggested differently at a news conference . legal scholars say California law does not allow prosecutors to compel a victim of sexual abuse to testify about it."
Santa Clara University law professor Gerald F. Uelmen is the bar's go-to scholar on issues of California law.
"This law I keep hearing about in the media doesn't exist," he said. "The Santa Barbara D.A. misspoke and completely blew it. Whatever he claims now, he said there was such a law and he was dead wrong. He was right that, since 1993, there have been a lot of changes in the California statutes that make it easier to prosecute child abuse cases. But there is no statute that allows anybody to compel any victim of abuse to testify.
"What's a lot more interesting is how the media picks up these things and then feeds off each other's misinformation so that it becomes impossible to put one of these pseudo-facts to rest."

Zal trouwens even MJ's zogenaamde geld-tekort weerleggen:
Despite speculation that Jackson's financial empire is collapsing, documents obtained by Rolling Stone indicate that his assets may be far greater than reported. A significant portion of Jackson's money comes from his fifty percent interest in Sony/ATV Music Publishing, the world's fourth-largest music-publishing company, a joint venture valued in 1999 at $931 million.

SANTA BARBARA, California (CNN) -- Former Santa Barbara Sheriff Jim Thomas said there is a second child who claimed in 1993 that Michael Jackson molested him. Those accusations were audiotaped but not videotaped, the sheriff said.
Sources close to the prosecution in the current alleged molestation case against the pop star say that the second alleged 1993 victim could be called to testify, unlike in 1993, when he was much younger and frightened.

Allegations Michael Jackson sexually abused a cancer-stricken boy were unfounded
http://www.thesmokinggun.com/doc_o_day/doc_o_day.html
DECEMBER 9--A confidential investigation by Los Angeles police and child welfare officials concluded earlier this year that allegations Michael Jackson sexually abused a cancer-stricken boy were "unfounded," according to an internal government memo obtained by The Smoking Gun.
The probe's findings were based, in large part, on interviews with the alleged victim, his two siblings, and the boy's mother. According to the memo, when the child was questioned in February by a social worker assigned to the Sensitive Case Unit of L.A.'s Department of Children & Family Services (DCFS), he "denied any form of sexual abuse" by Jackson and said that he never "slept in the same bed as the entertainer." While not specifically named in the DCFS memo, the 45-year-old Jackson is referred to repeatedly as "the entertainer."
The memo notes that the boy, now 14, and his 12-year-old brother--who also denied sexual abuse--expressed "a fondness for the entertainer and stated they enjoyed visiting his home, where they would often ride in the park, play video games, and watch movies." The pair's sister, now 17, told a social worker that she accompanied the boys on "sleepovers at the entertainers home," but had "never seen anything sexually inappropriate between her brothers and the entertainer."
The children's mother told investigators that Jackson was "like a father to the children and a part of her family." While acknowledging that her son "has slept in the same room as the entertainer," the woman claimed "they did not share a bed. The entertainer would sleep on the floor," according to the November 26 memo.
The joint probe by DCFS and the Los Angeles Police Department ran from February 14-27 and, the memo states, the "investigation by the Sensitive Case Unit concluded the allegations of neglect and sexual abuse to be unfounded both by the LAPD-Wilshire Division and the Department."
When an investigation is closed, child welfare officials can summarize their findings in one of three ways. If evidence is found to support abuse charges, the case is marked "substantiated." A case is termed "not substantiated" when evidence discovered is not sufficient to support allegations (though the charges may, in fact, be true). Finally, a matter is branded "unfounded" when officials determine there is no merit to the allegations.
As with many DCFS investigations, the Jackson abuse case began with a call to the agency's child abuse hotline. According to the memo, a "Child Abuse Referral" was phoned in on February 14 by a "school official" from the Los Angeles Unified School District, which oversees the city's sprawling public school system. Citing the prior week's ABC broadcast of "Living with Michael Jackson," the controversial Martin Bashir documentary, the school official lodged allegations of "general neglect by mother and sexual abuse by 'an entertainer,'" according to the summary memo. The school official identified both the cancer patient, then 13, and his younger brother as the "referred children."
While the school official is not further identified in the DCFS memo, published reports have indicated that the older boy was taunted by classmates after the documentary aired on ABC's "20/20" newsmagazine. During the February 6 program, the child was seen holding hands with Jackson and resting his head against the singer's shoulder. Jackson told Bashir that he had slept with many children unrelated to him, but insisted, "It's not sexual, we're going to sleep. I tuck them in...It's very charming, it's very sweet."
In a clear reference to fallout from the Bashir documentary, the boy's mother told investigators that "she believed the media had taken everything out of context," according to the memo, which summarizes the DCFS child abuse investigation. The "sensitive case" memo was prepared at the direction of Dr. Charles Sophy, a high-ranking DCFS official who joined the department in late-March, a month after the Jackson probe was completed. The memo was authored by Jennifer Hottenroth, a DCFS assistant regional administrator. In a brief telephone interview yesterday morning, Hottenroth declined to speak about her memo, saying, "I can't talk about it...I can refer you to our public affairs person. I can't comment on any of this." Sophy (pictured at right) did not return a message left with his assistant. Louise Grasmehr, a DCFS spokesperson, said that while she had been given a copy of the document by Hottenroth Monday morning, "We cannot comment on anything that is stated in the memo. Because it's all protected under confidentiality laws in California."
The boy's February 2003 interview with child abuse investigators--not to mention those with his family--appears to run counter to allegations he later made to law enforcement officials in Santa Barbara, where Jackson was arrested November 20 and released on $3 million bail. District Attorney Thomas Sneddon has said that he expects to file felony child molestation charges against Jackson next week. In addition to the boy's original denial of sexual abuse by Jackson, his younger brother's February 2003 statements also appear to contradict recent published reports claiming that the child has told Santa Barbara investigators that he witnessed his brother being molested by the star.
While it is unclear what, if any, effect the LAPD-DCFS investigation will have on a future Jackson prosecution, the performer's defense team will surely seize on the February 2003 probe's findings to question the current veracity and motives of the child and his family--and, of course, further muddy a case that already promises to be a difficult prosecution.
The child abuse investigation was immediately placed with the Sensitive Case Unit since department guidelines dictate that if "one of the clients in the referral is a public figure" or if the case's allegations "would be certain to generate media interest if they became known outside of DCFS," the matter requires utmost secrecy.
As with most DCFS abuse cases, a children's social worker (CSW) was dispatched to interview the boys, as was a LAPD investigator (the memo does not indicate whether the cop and the social worker conducted their interviews in tandem). In either case, it is likely that the children were questioned apart from their mother, since the abuse referral included allegations of neglect on the woman's part, according to a DCFS source familiar with agency operations.

A copy of Francia's sworn testimony reveals that Hard Copy paid her $20,000, and had Dimond checked out the woman's claims, she would have found them to be false. Under deposition by a Jackson attorney, Francia admitted she had never actually see Jackson shower with anyone nor had she seen him naked with boys in his Jacuzzi. They always had their swimming trunks on, she acknowledged. The coverage, says Michael Levine, a Jackson press representative, "followed a proctologist's view of the world. Hard Copy was loathsome. The vicious and vile treatment of this man in the media was for selfish reasons. [Even] if you have never bought a Michael Jackson record in your life, you should be very concerned. Society is built on very few pillars. One of them is truth. When you abandon that, it's a slippery slope."

D.A. Dismisses another Govt Agencys Report?
A governmental agency doing an independent investigation has previously vindicated Michael Jackson of any wrongdoing against the very accuser who is now making allegations against him. District Attorney, Tom Sneddon, has inexplicably disregarded the findings of a joint investigation done by the Department of Children & Family Services (DCFS) and the LAPD. In his response, Sneddon calls the conclusion of that investigation insignificant: Given what we know, we do not consider the DCFS statement a significant factor (see Internal Memo: Case Against Jackson Unfounded).
Reporters, commentators, and hosts of various cable and network shows all around the country have a problem with the dismissive attitude of the DA. Even Joe Scarborough (MSNBC Dec 9 show) expressed that this case is going up in smoke. He is, by no means, the only person who feels that way. To claim this bombshell of a memo has no bearing on their case would either be career suicide or symptomatic of a DA so blind that anything contrary to what he already believes to be true will be disregarded by him.
Besides the fact that the findings of an earlier investigation clears Jackson, there are other holes in the case which this DA cannot seem to overcome as of yet:
There are also rumblings from sources close to the Jackson family that this memo is only the tip of the iceberg as to evidence that will exonerate Jackson. It is reported the Jackson family will hold a press conference tomorrow afternoon (Dec 10).
quote:
LOS ANGELES, California (CNN) -- A leaked memo from the Los Angeles Department of Children and Family Services concludes that allegations of sexual abuse of a young boy by pop superstar Michael Jackson were "unfounded."But Santa Barbara District Attorney Tom Sneddon, who announced he will formally charge the entertainer by sometime next week, said he was "discounting" the memo, which was posted Tuesday on the "Smoking Gun" Web site.
According to the November 26 memo, the mother felt "the entertainer was like a father to the children and part of her family."
Sneddon confirmed she was referring to Jackson.
The memo, which was written in response to a request and summarizes an investigation conducted between February 14-27, concerns the young cancer patient on whose behalf Sneddon's office is prosecuting Jackson.
The memo said the child -- now 14 -- denied he slept in the same bed as Jackson or that any sexual abuse had ever occurred. It also indicates the boy's older sister said she had accompanied her brothers to numerous sleepovers at Jackson's Neverland Ranch and "had never seen anything sexually inappropriate between her brother and the entertainer."
"Our investigators were aware of the contents of the memo prior to seeking the search warrants and arrest warrant for Mr. Jackson," Sneddon said.
"We provided all the information to the judge about the circumstances and the timing of the child welfare investigation, and the judge still issued the warrants," he said.
Asked if the leaked memo that appears to exonerate Jackson hurts his case, Sneddon replied, "No, we are not worried."
A Jackson spokesman told CNN the leaked memo supports his innocence.
"There is no merit to the allegations, Michael is innocent," said Stuart Backerman. "This is in keeping with what we've said all along."
The L.A. child welfare agency got involved because the alleged victim is a county resident.
The 45-year-old singer returned to Santa Barbara, California, from Las Vegas, Nevada, to surrender to authorities November 20, was booked on charges of "lewd and lascivious conduct" with a child under 14, and released on $3 million bond.
If the formal charges are filed next week, he will be arraigned January 9.
CNN's Art Harris contributed to this report.
