PASADENA, California (AP) -- A three-member federal appeals court panel, clearly troubled by the prospect that some 40,000 voters might be disenfranchised by the use of punch-card ballots in the recall election, challenged lawyers Thursday to explain why the election should be allowed.

The legal challenge echoes problems with "hanging chads" in Florida during the 2000 presidential election. It appears to be the last major legal challenge that could halt the October 7 election on whether California Gov. Gray Davis should be recalled.

U.S. 9th Circuit Court of Appeals Judge Harry Pregerson said in court it was clear that the California secretary of state had found the punch-card system, still used in six counties, unacceptable because of errors. The six counties are already under court order to replace them by March.

LOS ANGELES, California (AP) -- Arnold Schwarzenegger hopes to take the state GOP convention by storm with a major rally and speech, as he works to win over party activists who may be leaning toward his conservative opponent.

Schwarzenegger is scheduled to attend a morning rally Saturday outside the convention hotel, then woo the faithful with a lunchtime address aimed at casting him as the successor to California Republican leaders such as Ronald Reagan and former Gov. Pete Wilson.

Republican rival Tom McClintock, a state senator from Northridge, was giving his own speech Saturday evening, buoyed by a new poll showing him edging close to Schwarzenegger.

"The momentum's entirely on my side," the state senator said Friday on KSTE-AM in Sacramento as he discussed a new Los Angeles Times poll showing Bustamante with support from 30 percent of likely voters, Schwarzenegger with 25 percent and McClintock with 18 percent.

McClintock's support rose by 6 percentage points from the last poll, compared to 3 points for Schwarzenegger.

The survey of 922 likely voters, conducted September 6-10, also found support growing for Davis, with 50 percent saying they would vote yes on the recall against 47 percent against it. The poll's sampling error margin was plus or minus 3 percentage points.

Arnold Schwarzenegger, an Austrian immigrant who became a U.S. citizen in 1983, has called for tighter controls on illegal immigration as part of his campaign to become California's next governor.

But the Austrian native may have stretched the bounds of U.S. law to secure his own ticket to America in the 1960s, according to a report by the San Jose Mercury News.

The B-1 visa, which Schwarzenegger used when he came to the U.S. in 1968 as a 21-year-old bodybuilder, allows visiting athletes to take part in competitions, ministers to lead evangelical tours, engineers to install computer systems and musicians to record albums, but bars them from drawing a salary from an American company.

However, some immigration attorneys say an arrangement Schwarzenegger talks about in his 1977 autobiography appears to have violated the visa.

The Hollywood star struck a deal to work for bodybuilding magnate Joe Weider while he had a B-1 visa so he could train at the legendary Gold's Gym in Venice, Calfornia.

''I worked out an agreement with Joe Weider to spend one year in America,'' Schwarzenegger wrote in his autobiography. ''My part of the agreement was to make available to Weider information about how I trained. He agreed to provide an apartment, a car and to pay me a weekly salary in exchange for my information and being able to use photographs of me in his magazine.''

If Weider did pay Schwarzenegger a salary to write for his magazines in 1968 and 1969, that would have been a violation of his immigration status, six immigration attorneys told the Mercury News.

''It allows you to come in to conduct business, but to be gainfully employed you need a visa that allows you to be gainfully employed in the United States,'' New York-based immigration attorney Steven S. Mukamal told the paper. ''It would seem that Mr. Schwarzenegger violated his own status.''

Last month in an interview with the San Jose Mercury News, Weider said he paid Schwarzenegger $200 a week, a generous sum in 1968 when the average weekly wage was about $114. ''I paid him right away,'' Weider said. ''How do you think he was going to live?''

Schwarzenegger spokesman Sean Walsh also told the Mercury News last month that the young bodybuilder was paid a weekly salary, but Walsh said that it was only $65 a week.

Schwarzenegger told campaign aides last week that he does not recall earning a salary during his first year in America, even though he wrote about it in his autobiography and the arrangement has been reported in numerous accounts over the decades, reports the paper.

Schwarzenegger declined be interviewed by the Mercury News or release immigration records that detail his employment history in the United States.

The actor, who came to the United States from Austria during the late 1960s, has acknowledged voting for Proposition 187, the 1994 initiative that denied some social services to illegal immigrants but has since been mostly voided by the courts. As governor he has vowed to fight a law Davis signed earlier this month that allows illegal aliens to get driver's licenses.

Schwarzenegger also was criticized last week about his membership on the advisory board of a group that supports making English the country's official language.

Immigration issues have become a central part of the campaign in recent days as Bustamante, the grandson of Mexican immigrants, has tried to consolidate the state's large Hispanic population around his candidacy.

Recall players pair up and square off at state conventions

Republican candidates Arnold Schwarzenegger and Tom McClintock addressed the state Republican convention separately, while at the Democratic convention, Gov. Gray Davis and Lt. Gov. Cruz Bustamante appeared together on stage for the first time since Bustamante entered the race to replace his boss.

Davis -- fighting to keep his job in the October 7 recall election -- and Bustamante have avoided each other since early last month.

But Saturday, as Davis was in the middle of his stump speech at the Democratic convention, Bustamante stepped on stage in what appeared to be an impromptu act.

"Bienvenido, lieutenant governor," Davis said, welcoming Bustamante. The governor said the people had wanted to see when the two men would stand together.

Sunday, in an effort to boost his prospects, Davis plans to appear with former President Bill Clinton at a black church in Los Angeles.

Democratic presidential candidates Sen. Bob Graham of Florida and Sen. John Kerry of Massachusetts also plan to stump for the governor in California in the coming week, the officials said.

LOS ANGELES - Een Amerikaans federaal hof van beroep heeft maandag bepaald dat de verkiezingen die voor 7 oktober in de staat Californië stonden gepland, niet mogen doorgaan. Volgens The Los Angeles Times vindt de rechtbank het niet goed dat in zes gemeenten alleen gestemd kan worden met een systeem van ponskaarten.

Op 7 oktober zouden de inwoners van Californië vervroegd naar de stembus gaan om te beslissen over het lot van gouverneur Gray Davis. Hij werd vorig jaar voor een tweede termijn herkozen, maar zijn populariteit daalde snel als gevolg van het enorme begrotingstekort van de staat. Meer dan 1,6 miljoen mensen hadden gevraagd om een herroepingsstemming. Onder anderen acteur Arnold Schwarzenegger had zich in de verkiezingsstrijd gegooid.

Het ponskaartensysteem leidde tijdens de presidentsverkiezingen van 2000 tot grote problemen in de staat Florida. Het kwam daar tot hertellingen omdat veel ponskaarten niet of slecht 'leesbaar' bleken, en dat terwijl de kandidaten Bush en Gore dicht bij elkaar zaten. In reactie op al deze commotie zijn op veel plaatsen stemmachines ingevoerd, maar nog niet overal.

In Californië ontbreken stemmachines onder meer nog in Los Angeles, de grootste gemeente. Een van de belangengroepen die ijverden voor de vervroegde verkiezingen in Californië heeft al beroep aangekondigd tegen het besluit. Het is niet bekend wanneer er een beroepsuitspraak kan liggen. Als de huidige uitspraak van kracht blijft, zullen de verkiezingen waarschijnlijk alsnog in maart 2004 worden gehouden. Dan moeten alle betrokken gemeenten het ponskaartsysteem hebben afgeschaft.

Appeals court blocks California recall

SAN FRANCISCO, California (CNN) -- A federal appeals court Monday ordered California officials to halt preparations for the October 7 gubernatorial recall election, citing concerns about a "hurried, constitutionally infirm" process.

Specifically, a three-judge panel on the 9th Circuit Court of Appeals said the state needed to upgrade its voting equipment first.

"The inherent defects in the system are such that approximately 40,000 voters who travel to the polls and cast their ballot will not have their vote counted at all," the court ruled, citing voting machines that the secretary of state's office has declared unfit.

Voters had been scheduled to go to the polls October 7 to decide whether to remove California Gov. Gray Davis, a Democrat.

But the ruling leaves the election in doubt -- at least for now. The court stayed its order for seven days to allow appeals. If Monday's ruling stands, the recall vote could be moved to March 2004, when it would share space on the ballot with California's presidential primary.

Davis, who Monday spent a second day campaigning with former President Clinton, said he was "prepared to conduct this election whenever the courts tell me the election is going to occur."

Davis had pushed for the recall vote to take place in March, when the state's presidential primary was expected to draw a higher Democratic turnout.

"It seems to me that the more people think about the recall, the more that decide to oppose it," he said.

ACLU objections

The ruling follows a hearing last week at which the American Civil Liberties Union argued that election officials should have more time to replace antiquated voting machines in several California counties.

The ACLU said the punch-card system could disenfranchise voters in six counties, including Los Angeles, the state's largest. Those six counties include 44 percent of state voters and have heavy concentrations of minority voters.

A lower court last month had rejected the request, but the appeals court disagreed.

"In sum, in assessing the public interest, the balance falls heavily in favor of postponing the election for a few months," the court concluded, citing the U.S. Supreme Court's Bush v. Gore decision that settled the 2000 presidential election.

"The choice between holding a hurried, constitutionally infirm election and one held a short time later that assures voters that the 'rudimentary requirements of equal treatment and fundamental fairness are satisfied' is clear."

The 9th Circuit has a reputation as being one of the most liberal appellate courts in the federal judiciary, and its decisions are often reversed by the Supreme Court.

Appeal urged

Actor Arnold Schwarzenegger -- the leading Republican candidate to replace Davis should the recall succeed -- said he would continue his campaign for governor and called on Secretary of State Kevin Shelley to appeal the decision immediately.

"Historically, the courts have upheld the rights of voters, and I expect that the court will do so again in this case," he said.

Lt. Gov. Cruz Bustamante, the leading Democrat among the 135 replacement candidates on the ballot, said he was confident the court would reach "a carefully thought out and considered decision.

"We will continue our campaign until there is finality in the courts," he said in a written statement after the decision.

But state Sen. Tom McClintock, one of the Republican candidates hoping to replace Davis should the recall succeed, said the ruling is "simply a distraction and will have no bearing on this election."

McClintock said the 9th Circuit "has become a national laughing stock" for previous rulings, such as one that found the words "under God" in the Pledge of Allegiance amounted to an unconstitutional establishment of religion.

"I have every confidence that, in a short time, the U.S. Supreme Court will allow this election to go forward," he said.

McClintock trails both Bustamante and Schwarzenegger in recent polls.

In Washington, officials at the Justice Department and the White House declined comment.

Maar dit uitstel lijkt me helemaal funest voor het vertrouwen van de Californische kiezer in de politiek. Die rechter gaat erg hard terug gefloten worden... en als dit nog langer doorgaat dan is het voorbij met dit circus voor illegale immigranten (die meer rechten hebben dan ik als legalle love-immigrant )

In 2000 is naar aanleiding van de tellingsproblemen in Florida besloten dat ook California alle oude stemmachines gaat vervangen. Dit diende dan wel te gebeuren voor de Primaries (**) in Maart 2004. In een aantal gebieden - het gaat om zo'n 40.000 stemmers geloof ik - zijn deze machines nog niet vervangen, en de rechter heeft vandaag besloten dat de Recall moet worden uitgesteld tot ook die machines vervangen kunnen worden. Dit kan betekenen dat de Recall ook pas in Maart 2004 plaats vindt.

(**) De "primaries" zijn de verkiezingen waar de leden van een partij kunnen kiezen welke presidents kandidaat ze naar voren willen schuiven voor de Presidentsverkiezingen in November 2004. Mijn vrouw is lid van de Democratische partij en stemt voor Howard Dean
