Dominion says the falsehoods spread by former Trump attorneys Sidney Powell and Rudolph W. Giuliani, in addition to MyPillow chief executive Mike Lindell, amounted to a “viral disinformation campaign” that damaged the company’s reputation and its business and led to death threats against employees.
In each lawsuit, Dominion uses the defendants’ words against them, citing dozens of public statements they made in media appearances and at public events spreading the lie that the voting machine company helped steal the election from Trump.
Whether the lawsuits are successful, however, will hinge on Dominion’s ability to show that false, factual statements harmed the company and that the three were acting with “actual malice” in making their remarks. The high burden is on Dominion to demonstrate that Trump’s allies knew their statements were false or made with a “reckless disregard for the truth.”
That is not an easy standard to meet, according to Roy Gutterman, a First Amendment expert and director of the Tully Center for Free Speech at Syracuse University’s law school.
“It’s more than just being irresponsible, it’s really ignoring information,” he said.

Abrahams hoeft geen hard bewijs te hebben en zijn rol is essentieel anders, natuurlijk. FBI en DoJ moeten zaken beyond reasonable doubt kunnen bewijzen en dat is echt wel een heel stuk lastiger, bovendien wordt het als proces beinvloeding (prejudicial) gezien door rechters als FBI en DoJ hun onderzoek in de publiciteit gooien op dezelfde manier.quote:

Dat is nog niet zo simpel, denk ik, omdat je moet bewijzen dat ze wisten op het moment dat ze de uitspraken deden dat het niet waar was. Je moet dus bewijzen dat ze het wisten, niet alleen aannemelijk maken. Dat is best lastig.quote:
