Under Ben Carson, HUD Scales Back Fair Housing Enforcement

The Trump administration is attempting to scale back federal efforts to enforce fair housing laws, freezing enforcement actions against local governments and businesses, including Facebook, while sidelining officials who have aggressively pursued civil rights cases.

The policy shift, detailed in interviews with 20 current and former Department of Housing and Urban Development officials and in internal agency emails, is meant to roll back the Obama administration’s attempts to reverse decades of racial, ethnic and income segregation in federally subsidized housing and development projects. The move coincides with the decision this month by Ben Carson, the secretary of housing and urban development, to strike the words “inclusive” and “free from discrimination” from HUD’s mission statement.

But Mr. Carson dismissed the idea he was abandoning the agency’s fair housing mission as “nonsense” in a memo to the department’s staff earlier this year, and reiterated that point during recent congressional hearings. A spokesman for the agency, Jereon Brown, said any programmatic changes are part of the routine recalibration undertaken from administration to administration, rather than a philosophical shift.

Advocates for the poor and career HUD officials say that Mr. Carson, a retired neurosurgeon, and his political appointees have begun weakening the department’s fair housing division at a critical moment. The agency now has its greatest leverage to right past wrongs thanks to the $28 billion in disaster recovery Community Development Block Grants that Congress has appropriated to rebuild the Gulf Coast and Puerto Rico after Hurricanes Harvey, Irma and Maria.

A Top Lawyer At The Justice Department Is Quitting To Fight For LGBT Rights

One of the government’s top civil rights lawyers since the Reagan administration told BuzzFeed News on Wednesday she will leave to become the litigation director for Lambda Legal, a high-profile exit that will put her at the vanguard of LGBT rights and likely place her in conflict with former colleagues at the Justice Department.

The departure of Diana Flynn, who has been chief of the Justice Department’s Civil Rights Division Appellate Section since the ‘80s, is the most recent example of legal veterans abandoning their posts since Jeff Sessions became attorney general.

“I never really expected to leave,” Flynn, a transgender woman, said Wednesday in an interview about her role as head of the influential office that seeks to sway circuit courts by asserting the government’s agenda.

She reflected on a three-decade tenure under four Republican presidents and two Democratic presidents, saying, “There have been some good times in the Civil Rights Division, regardless of the party.”

“But it appears to me — at this crucial time for LGBT rights — to make the arguments I want to make and take positions I want to take, I would be much better situated at Lambda Legal than I am at Justice,” she said.

Why Dangling a Pardon Could Be an Obstruction of Justice—Even if the Pardon Power is Absolute

While acting as Donald Trump’s personal lawyer, John Dowd reportedly discussed the possibility of presidential pardons for Michael Flynn and Paul Manafort in separate conversations with their lawyers. Reports by the New York Times and Washington Post on Wednesday suggest that Dowd’s intent might have been to influence Flynn and Manafort’s decisions on whether to plead guilty and cooperate in the investigations, but that legal experts are divided on whether Dowd’s offers could constitute obstruction of justice.

Some experts have argued that the pardon power is absolute and that the President’s motives in issuing a pardon thus could not be questioned, while others contend that it could be a crime to issue a pardon for corrupt purposes (such as in exchange for cash). But the debate over the absolute nature of the pardon power is actually not relevant to the alleged incidents involving Trump’s lawyer. Indeed, that entire debate can be set aside for the moment. Why? Because there’s been no pardon. Instead, a pardon has only been dangled before Flynn and Manafort, and the analysis of whether that action could become part of an obstruction case against Trump raises entirely different considerations.

Wilbur Ross Overruled Career Officials at Census Bureau to Add Citizenship Question

The Commerce secretary wrote a memo arguing that the benefits of the controversial question would outweigh any harm.

Secretary of Commerce Wilbur Ross’ decision Monday to add a controversial question on citizenship to the 2020 census came in the face of opposition from career officials at the Census Bureau who fear it will depress response rates, especially from immigrants.

Two people with knowledge of the deliberations said career leaders in the Census Bureau, which is part of the Commerce Department, had scrambled to come up with alternatives to adding the question. Those efforts were unsuccessful.

In a memo announcing his decision, Ross said that “The Census Bureau and many stakeholders expressed concern that [a citizenship question] would negatively impact the response rate for non-citizens.”

But Ross added that “neither the Census Bureau nor the concerned stakeholders could document that the response rate would in fact decline materially.”
