Ik wilde mij eigenlijk van commentaar onthouden. Maar Piet is weer zo irritant bezig dat ik het toch maar doe. De bemoeienis van het Nederlandse bedrijfsleven met het belastingbeleid van de overheid gaat veel verder dan gangbare belangenbehartiging. Onderzoekstichting SOMO en ontwikkelingsorganisatie Oxfam Novib zeggen interne overheidsdocumenten boven water te hebben gehaald die een "belastinglobby'' blootleggen.
Uit de stukken, die ze via een Wob-verzoek los wisten te krijgen van de overheid, zou blijken dat werkgeverskoepel VNO-NCW, de Nederlandse Orde van Belastingadviseurs en de American Chamber of Commerce in Nederland in de praktijk meebepalen welk belastingbeleid het kabinet voert. Vooral met VNO-NCW zou het ministerie van Financiën "intensief samenwerken''.
SOMO en Oxfam zien hiermee opnieuw bevestigd dat Nederland een belastingparadijs is. De overheid gunt op basis van de verkeerde belangen belastingvoordelen aan grote internationale bedrijven, zeggen ze.
Het ministerie van Financiën laat in een reactie weten graag de standpunten van maatschappelijke partijen te willen horen bij de ontwikkeling van nieuw beleid. Daarbij hanteert het sinds vorig jaar een nieuwe lijn, waarbij het onder meer gebruik maakt van internetconsultaties om zo veel mogelijk belangenorganisaties te kunnen betrekken.
Ook neemt het ministerie tegenwoordig een gedragsrichtlijn opgesteld waarin staat uitgelegd hoe om te gaan met belangenorganisaties. Een woordvoerder van VNO-NCW was vrijdag begin van de avond niet bereikbaar voor commentaar.
Op dit moment staan er in totaal 683 lobbyisten vermeld op de website van de Beroepsvereniging voor public affairs, maar vermoedelijk zijn er honderden belangenbehartigers niet aangesloten.
Dat er zoveel rondlopen is niet vreemd, vertelde Tino Wallaart eerder. "De Tweede Kamer kan niet zonder hun adviezen." De directeur van public affairs bureau WKPA leerde alle facetten van de landelijke politiek kennen als woordvoerder en politiek assistent van twee ministers, partij- activist en hoofd public affairs van een grote NGO.
"De Kamer heeft in Nederland schandalig weinig geld, middelen en mankracht om zelf genoeg expertise in huis te hebben. Ze zijn dus ook afhankelijk van de kennis van lobbyisten." Volgens hem gebeurt het "vrijwel altijd" dat bedrijven, organisaties of NGO’s meewerken aan wetsvoorstellen

Trusts are particularly controversial because they can be used to create questionable tax structures, to hide corrupt activities or to facilitate money laundering. They are a feature of many common law jurisdictions, and have proved especially popular in the offshore world.
Saint-Amans’s comments highlight how isolated the UK has become in its insistence that trusts be largely excluded from international efforts to bring transparency to the most secretive corners of the corporate world. In 2013, Cameron wrote to top European officials making the case for trusts to be exempted from rules, then being drawn up in Brussels, requiring companies to report who they are owned by.
He wrote: “[Ownership] registries will … enable law enforcement and tax authorities to access, discreetly and at short notice, critical information for cross-border investigations.
“It is clearly important we recognise the important differences between companies and trusts. This means that the solution for addressing the potential misuse of companies – such as [ownership] registries – may well not be appropriate generally.”
After pressure from the UK, it was agreed that only those trusts which “generate tax consequences” should be subject to the new Brussels directive. Most tax experts agree this loose wording effectively releases many of the more controversial trusts – especially those offshore – from ownership disclosure requirements.
In the wake of the series of scandals exposed in the Panama Papers, the UK has led international calls for greater information sharing. Together with France, Germany, Spain and Italy, the UK responded with plans to open up their ownership register to one another’s investigative authorities.
In April, the chancellor, George Osborne, said this information sharing initiative was “a hammer blow against those that would illegally evade taxes and hide their wealth in the dark corners of the financial system”.
It remains to be seen whether a new UK prime minister will continue Cameron’s efforts to win international consensus on the best way to fight offshore corruption. But last week, the UK became the first major economy to require all companies registered here to state their true ownership in filings at Companies House.
Many other large countries are developing similar registers to record company ownership, but have stopped short of making that information public. More than 20 countries have joined the new European initiative allowing police and tax inspectors from each jurisdiction to access one another’s ownership register. They include Gibraltar, Cyprus and the Isle of Man.
Despite pressure from the UK, however, many other countries – including some crown dependencies and overseas territories – have resisted pressure to set up ownership registers.
Saint-Amans and other experts at combating offshore corruption and money laundering are expected to report to the G20 in October. A highly influential figure in international corporate reforms, he spent the last three years leading a G20-commissioned reform programme to end tax loopholes in international rules exploited by some of the world’s largest corporations, including Google, Amazon, Vodafone and Starbucks.

The files also reveal the offshore assets, including a luxury yacht and jet, of a Nigerian aviation and oil magnate who is reportedly close to a former oil minister and has recently had some of his assets seized as part of a $1.8 billion probe into oil sales.
The revelations published by ICIJ and media partners include investigations from countries that are being examined for the first time, including Tanzania, Burkina Faso, Ghana, Mozambique and Togo.
Businesses in 52 of Africa’s 54 countries used offshore companies created by Mossack Fonseca, a law firm that specializes in creating companies often sold and used for anonymity or lower taxes. In 44 countries, offshore companies were used to assist oil, gas and mining deals and exports, concerning advocates and governments in a continent where many nations rely on revenue from natural resources. In total, the Panama Papers include more than 1,400 companies whose names alone indicate activity in the extractive industries. Although many of these companies do legitimate business, ICIJ identified 37 companies within the Panama Papers that have been named in court actions or government investigations involving natural resources in Africa.
In the oil-rich North African country of Algeria, for example, investigations continue into nearly $275 million in alleged bribes paid through a cluster of offshore companies to secure energy contracts. Twelve of the 17 offshore companies listed by Italian prosecutors as belonging to the alleged middleman, Farid Bedjaoui, were set up by Mossack Fonseca. Italian investigators described one of those companies, Minkle Consultants S.A., as a “crossroads of illicit financial flows” that channeled millions of dollars from subcontractors to an array of recipients whose identities are still being untangled.
In a written response to ICIJ, Mossack Fonseca said it follows “both the letter and spirit of the law. Because we do, we have not once in nearly 40 years of operation been charged with criminal wrongdoing. We’re proud of the work we do, notwithstanding recent and willful attempts by some to mischaracterize it.”
The release of today’s investigations is a major collaboration of media organizations in Africa that range from traditional newspapers in Namibia, to popular radio stations in Ghana and to innovative start-up websites in Morocco. The reporting partners include journalists who have previously published stories as part of Panama Papers as well as journalists from Ghana, Tanzania, Niger, Mozambique, Mauritius Burkina Faso and Togo who are publishing stories for the first time. Many of the journalists worked in collaboration, exchanging contact information and court documents and with the editorial assistance of the African Network of Centers for Investigative Reporting, an ICIJ partner.
