Maandag wordt er duidelijkheid gegeven over wat er met de zaak gaat gebeuren en of er een aanklacht komt, wat al wel duidelijk is:
- Ook al komt de zaak in de kast te liggen, hij wordt niet gesloten.
- De McCanns willen met alle geweld de arguidostatus opgeheven hebben.
- Er is nog onduidelijkheid over in hoeverre de zaak publiek wordt, maw of alles naar buiten gaat komen.

Goed, hopelijk de laatste en moge er eindelijk duidelijk worden wat er is gebeurt.

Reports suggested he would announce whether the case would be closed, charges would be brought or the police would be asked to undertake further inquiries.

Madeleine disappeared on May 3 last year, nine days before her fourth birthday.

The McCanns left her, and her twin siblings Sean and Amelie, alone in the flat while they dined with holiday companions at a tapas restaurant 50 yards across their holiday complex in Praia Da Luz.

Madeleine's parents, both doctors from Rothley in Leicestershire, were subsequently designated by Portuguese police as official suspects.

When the case is wrapped up the couple, who have denied any wrongdoing, could be cleared.

However according to reports in a Portuguese tabloid, the Correio da Manha, they could face neglect charges.

The paper said although the 50-page final police report on the case concludes there is no evidence the couple were involved in the disappearance of their daughter, it leaves open the possibility that the McCanns could be charged with abandoning Madeleine and the twins, then aged two.

The charge of abandonment carries a maximum ten-year jail sentence in Portugal, but only if prosecutors can prove the McCanns, both 40, intended to neglect Madeleine.

Ex-pat Robert Murat was the only other individual made an official suspect by Portuguese police. He also has denied any wrongdoing and, if the case concludes, will find out if he will be cleared or face further investigation.

The McCanns' spokesman, Clarence Mitchell, said the family had not been contacted by the Portuguese authorities.

"We've heard nothing official and our lawyers have heard nothing official," he said.

"It may well be true, but we can't comment because we haven't heard. We're not going to prejudice anything."

He earlier made it clear the family would 'vigorously' defend any neglect charges.

Last week a High Court Judge made an astonishing appeal for Madeleine's abductor to 'show mercy and come forward'.

Speaking as she ordered Lancashire Police to hand over details of 81 potential witnesses to the disappearance, Mrs Justice Hogg called for an end to Kate and Gerry McCann’s suffering and said she prayed Madeleine would be found alive soon.

One of the examples that were pointed out in one of the many reports that were written by the investigators was the fact that the soft toy was on the bed where Maddie slept, a bed that was partially undone. The animals detected odours on the child’s toy, but they did not mark her death on that spot. Which led the PJ to admit that Maddie had died in another area of the house, and then the toy was taken to the bed because it was the most likely spot in case of an abduction. Other details were analysed, like the fact that the furniture was too well positioned and the sofa was completely pushed against the wall.

Details

Investigated leads – The final report is clear. All the leads were investigated, the abduction theory was verified into detail. But the investigation’s main conclusions pointed towards the death of the child in the apartment, on the 3rd of May.

300 policemen were looking for Madeleine McCann during the first days. The PJ stresses that many among them spent several weeks sleeping only a few hours.

2000 diligences were made by the Judiciária during their search for Madeleine. International cooperation was requested on several moments, to exclude several cases of false sightings.

High costs – The PJ spared no costs throughout this investigation. Millions of euros were spent on the investigation into the disappearance, namely on the high payments that were made to the labs that collected the genetic profiles.

Suspicions – Dave’s involvement is considered again
Parents refused technical help

Works with endangered children and approached the McCanns in the Algarve. Found the behaviour strange

Yvone, who earned credentials from the English government to work in situations that involve endangered children, was in the Algarve when Maddie disappeared but the McCanns refused her help. The specialist told the PJ, during two depositions that were made one month apart from each other, that she approached the couple after the first few hours and that the behaviour from both left her with suspicions about their involvement in the disappearance.

The behaviour of David Payne, who was accused by a couple of doctors that spent holidays with him in 2005, of having attitudes that indiciated paedophile practices, also left Yvone intrigued. The McCanns’ friend had called them aside and advised them not to speak to the technician.

Yvone found another detail strange. David’s face was not unfamiliar to her, and the technician believes he might have been inquired before, within some case of sexual abuse. She tried to remember when but failed to locate moment and the circumstances under which she had met him.

The days went by and Yvone continued to think about the issue. She then sent a letter to the English police, where she pointed out the details that she had perceived. Namely, that the bedroom window had not been forced open, that it was not normal for a couple of doctors to leave their children alone and that Kate had reacted in an aggressive manner when she had approached her. She also alerted to the official statistics, that point towards the majority of these cases to involve a cover-up from the families.

Gonçalo Amaral’s book upsets the English

A delegation from the British justice left for London yesterday after having tried, in Portimão, to keep some details of the process under secrecy.

The English, who according to what CM was able to establish, are upset about possible revelations that the book from the former coordinator of the PJ in Portimão may make, tried to request the instruction judge to maintain the secrecy on the forensics reports about the blood traces and cadaver odour that were collected from the apartment at the Ocean Club, but also other parts from the process.

As far as CM was able to establish, the pretentions from the English delegation were denied, except in the case of the identity of persons that have condemnations or a police record of paedophilia which reside in the Algarve or were spending holidays in the region when the facts took place.

The British that were in Portimão are policeman Stuart Prior, one of the senior liaison officers with the Portuguese police, a magistrate and a jurist from SOCA, the British agency that specializes in investigation organized crime.

It is not known whether the trip was made under a rogatory letter or politically negotiated between the governments of both countries.

“In defense of my good name”

The book by Gonçalo Amaral is written in defense of his honour. “I felt the need to reinstate my good name, which was publicly rubbished while the institution that I belonged to for 26 years, the Polícia Judiciária, didn’t allow me to defend myself, or did so institutionally”, Gonçalo Amaral states in a text that justifies the book. In order to carry out that defense, he requested permission from the national directory but never obtained it. The book, which will be presented by Marques Vidal, a former director of the Judiciária, is launched on the 24th of this month, during a session that is scheduled for El Corte Inglés, in Lisbon. source: Correio da Manhã 19.07.2008, paper edition

Ik krijg als ik dit zo allemaal lees en vooral dan weer het nieuwe verhaal met betrekking tot David Payne heel sterk het gevoel dat er nog een enorme beerput aan ellende open moet komen. Je zou bijna zeggen dat alle indertijd aanwezige kinderen van de Tapas nagekeken zouden moeten worden op sporen van misbruik.
Als je goed om je heen kijkt zie je dat alles gekleurd is.

Dat zou wat zijn zeg, als hij er echt mee te maken zou hebben bedoel ik, hoe zou iemand dat in vredesnaam allemaal voor zich kunnen houden en zelfs de rechercheurs om de tuin kunnen leiden? Bovendien tegen zijn vrienden liegen en hen mee in de afgrond trekken.
Neemt niet weg dat Kate en Gerry gewoon een babysit hadden moeten inhuren.
Het past allemaal wel mooi in elkaar trouwens, mocht dit waar zijn, Payne had best de sleutels van de Scenic kunnen pakken en Maddy kunnen transporteren, hence die bodily fluids.......

"We did a lot of research before we came here," Joanne continues. "There is a kids' club in the hotel complex and all the staff are English and have been vetted, so we have used it a bit for our seven-year-old, Emily. But we don't use a babysitter at night. We take the children with us. It's an easy place to do that."

Indeed, Port de Soller seems the perfect place for a family holiday. It is small, sweet, pretty, manageable. There are boats bobbing in the harbour, sun-kissed children playing in the sea. There are lifeguards on the beach. A police car drives up and down the cobbled street. There is a tram that goes along the sea front to the town. There aren't many cars.

But ever since last May, when three-year-old Madeleine McCann disappeared from her bedroom in Praia da Luz, Portugal, there is an almost tangible parental fear that underlies family holidays: that someone will take our children and we will never see them again.

Post-Maddie, holidaying abroad has become a minefield. The parameters have shifted. Where once parents might have left children in a play area/on the beach/in a café while they quickly whipped off to go to the loo/order a meal/get some drinks, now we dare not. We reappraise all the time, scan people's faces on beaches, by the swimming pool, in the play area. We are constantly asking ourselves: who is safe? What is safe? Are kids' clubs fine? Are the staff vetted properly?

But is this paranoia universal to all parents or peculiar to the British?

In Port de Soller, the only naked children on the beach are Dutch. The ones in the sea that are not wearing arm bands and float costumes are Italian and Norwegian. They splash around while their parents chat away up on the beach. When I ask a Norwegian couple, Kai Henriksen and Kari-Mette Brunvatne, whether they feel affected by the Maddie case, they both shrug their shoulders and tell me that they believe it could have happened anywhere.

"It hasn't made us change our attitudes," they say, smiling at their children, Michael and Felix, 10 and eight, who are running around everywhere. "We give them the freedom we think they need. We use a babysitter when we go out." Do they have the babysitter checked? They both look at me as if I am mad.

All the British couples I speak to feel differently. One woman tells me how she could never have left her children alone and how shocked she is by people who do. Other mothers clamp their hands over their children's ears at the mere mention of Maddie.

Isobel van der Vegt, an attractive and obviously intelligent mother of two, lives in Twickenham with Focco, her Dutch husband. Their daughter Maria is four, their son Justin is two. "I don't want Maria to hear this," Isobel says, asking Focco to take her to the swings. "She saw the news last year when Maddie went missing and they showed the video of her in that Snow White dress. My daughter has the same dress. It feels too close for comfort, really."

Yet Isobel also believes she would like to give her children more freedom. "It's a difficult one. I would never leave my children alone at night. Never. I could not bear the thought of them screaming and me not being there, but I also would like Maria to have more freedom during the day. I would like her to be able to play on the swings and in the sea without me or my husband hovering over her. Yet I am very reluctant to leave my children alone and it makes holidaying pretty hard. If I want to buy a drink from a café, we all have to go together."

But surely holidays are supposed to be relaxing? Draen Millar and her husband, Jonathan, seem pretty relaxed. They are larking around on the beach with their four children: Louis, seven, Eva, six, John Joe, four, and one‑year-old Alice. Draen and Jonathan have holidayed in Mallorca for the past five years.

"We started coming here when Louis was small. We've never actually left our children alone, but I have friends who've been on a Mark Warner holiday and they say it feels like another world. They've left their kids at night. They say it felt so safe."

Ha ha, dat wilde ik ook net posten ivm het volgende: En misschien stond er iets in die onlangs vrijgegeven documenten wat bewust door het team McCann naar buiten is gelekt, tenslotte stonden daarin een aantal getuigenverklaringen en wijzen mogelijk enkele naar David Payne, of gewoon feiten over hem. Het zou de McCanns nu verdomd goed uitkomen. Ook al vanwege de pedo-kwestie in het algemeen, het Amber Alert. Spreading de fear ook, want er staat héél toevallig een lang artikel in de telgraph: "Madeleine McCann abduction leaves family holidays haunted by fear."

Kijk, het hoeft natuurlijk niet zo te zijn dat David Payne nú verantwoordelijk is voor wat er met Madeleine is gebeurd. Wat ik eerder schreef: "Zou dat The Pact Of Silence zijn geweest? Hij weet iets over de McCanns wat er mogelijk heeft plaatsgevonden, de McCanns weten iets over zijn verleden. Was deze informatie misschien ook onderdeel van die 81 documenten die de McCanns hebben gekregen via het gerechtshof? Ik weet het niet. Kan een enorme spin zijn, een gemeen 'lekje' van het team McCann om het komende nieuws van maandag te overschaduwen, dat hebben ze wel meer geflikt. Slecht nieuws 'verstoppen' met 'nieuws' wat de McCanns even in de luwte houdt. Kan ook een stukje uit het boek van Amaral zijn...Als het allemaal niet waar blijkt dan kan de krant een aanklacht tegemoet zien van de Payne-tjes wegen smaad/laster. Ook het 3arguidoforum moet oppassen. Bespreking van dit nieuws gaat soms erg ver. Iemand suggereerde Murat (die nu een PR-agency heeft ingeschakeld) als bron voor dit nieuws, tenslotte heeft Fiona Payne en twee andere Tapas-vrienden hem aangewezen als verdachte getuige."

Mogelijk hebben de McCanns het altijd al geweten van Payne, tenslotte zijn ze al jaren met die soms wisselende groep op vakantie, ook zoiets vreemds. Een keertje oké, ook soms met familie, maar dit is opvallend, iemand schreef: "2005 a group of doctors go on vacation together to Mallorca. 2006 a group of doctors go on vacation together to Greece. 2007 a group of doctors go on vacation together to Portugal. Slightly different group each time, but always doctors and their families. I wonder if the same person organised all 3 trips?"

Maar het is helemaal onbegrijpelijk dat als de McCanns de achtergrond wisten (if true) dat ze toch hem kennelijk vertrouwde, want wat werd er in de geautoriseerde docu van de BBC > transscript gezegd, op 3 mei: "At 6.30 Gerry McCann asks a friend, David Payne, to pop in on Kate to see if the children are coming down. He goes to the flat, he says all is well, but the children are too tired and are already in their pyjamas.At 7, lesson over, Gerry McCann goes back to the apartment." Weird... Overigens stond er in The Times, ook geautoriseerd, over David Payne niks, sterker nog: "Gerry had knocked up at the start of the 4.30pm tennis-drills session, but had decided not to exacerbate an injury to his Achilles tendon, so had dropped out and waited around by the courts until the children came back from the kids’ clubs at 5pm for tea. That had been one of the most enjoyable times of the holiday, all the children together for tea, then the adults playing with them afterwards."

En in de CdM van vandaag: "The same report exposes other contradictions in the English’s depositions. Kate and Gerry say that they picked up their children from the crèche at 5.30 p.m., but while the former guarantees that they went for a half-hour run on the beach and only then returned to the apartment, her husband states that they went to play tennis during that period."

Maar voor mij is wel duidelijk: they have everything to hide, including Clarence Mitchell...

This list is part of the disappearing process of Madeleine Mccann whose archiving will be announced next Monday.

The maintenance of this list under confidentiality is one of the pretensions of the English police, under the argument that the divulgation of the identities of those individuals would be an intrusion in the domain of the private life.

Monday the General Attorney’s Office is going to release the final dispatch from the Public Ministry that decides on the archiving of Maddie’s case, for lack of evidence to sustain any accusation. With this dispatch, Kate and Gerry McCann (Madeleine’s parents), as well as the British citizen Robert Murat, will cease being arguidos.

The fact that the process may be archived, does not obviates that it may be re-open in the future. However, that would occur only if appear new elements of proof that invalidate the fundaments invoked by the Public Ministry, as it is established by the Penal Process Code, artº 279º.

The decision to archive may be appealed. Only when that timing is extinguished, will the process be open to the public.

Many details of the investigation may, however, become known before, through the reading of a book written by the inspector of Policia Judiciária (PJ) that leaded the investigation, Gonçalo Amaral, and that will be launched, next 24th in Lisbon.

At least, that is what the author promises, who ended up by being removed from the investigation, in the sequence of declarations considered offensive to the English police.

With the opening of the process, it will be possible to clear the doubts, to know what diligences were made, what was the level of the English police participation in the investigation and to know the real motives that took the police and Public Ministry to constitute Murat and the McCann couple, arguidos. It will be also possible to detect the incoherence’s and contradictions in the investigation, as well as the falsities that were divulged publicly.

There is also interrogations about the destiny of Paulo Rebelo, the coordinating inspector that replaced Gonçalo Amaral in Maddie’s case investigation, and on whom were put so many hopes of success.

Paulo Rebelo was installed in Portimão and surrounded himself with the best investigators of the PJ from all the areas. The effort was fruitless. Rebelo was unable to repair some errors committed on the initial phases of the investigation. He was also unable to advance for new leads.

With the conclusion of the case, Rebelo hopes that the PJ Directory decides quickly to substitute him in the direction of the department, in order to put him again, in Lisbon, in a place compatible with his curriculum.

English defended the use of the dogs

An exhaustive report explains the possible scenarios to hide a body and defends the animals’ reliability

Mark Harrison, the English police who was designated to help the Polícia Judiciária in the search for Madeleine McCann, wrote a report last summer, in which he defended the usage of the dogs that are experts in the detection of cadaver odours and blood traces. The discovery of the residues and the signaling of the trail of a cadaver thus ended up formally changing the direction of an investigation that had been limited to the theory of abduction until then.

The report, which praises the Portuguese authorities’ work, suggested that the animals should be taken to all the locations where the body might have been hidden. From the apartment that had been rented by the McCanns up to the crèche, through the beach and the church area.



Mark Harrison explained that it was necessary to analyse the scenarios of Madeleine having been killed that night and her body abandoned by a person on foot or by car. The expert added that despite of the high costs of that search, it should be carried out in order to clarify the case.

Dogs are reliable

In the report, Mark Harrison says that it us very unlikely that the body was buried in the sand. The English policeman defends that a launch into the sea is the most likely scenario, while the body should also be searched for within an area of cliffs and dense bushes that lies east of Praia da Luz.

The two English dogs were presented as an indispensable help to the investigation, after their abilities and the manner in which they are trained were explained in detail, as well as the fact that they both react to blood traces and cadaver odours, without a single episode of “false positives” in the investigations.

In his report, Mark Harrison listed cases of success that offered a guarantee of reliability. And he asserted that if the dogs came to signal Maddie’s death, then it would be a fact.

Details

High costs - Mark Harrison stressed the high costs of the dogs. Their daily rate amounted to one thousand euros; the cost of the trip for them and their handlers was of 2750. There was also the cost of the passport for the animals (450 euros), adding to the lodging, the food and the transportation of the vehicles that were necessary for the animals.

False positives – Eddie, the dog that specialized in cadaver odour detection, has never given a false alert. He has participated in approximately 200 searches in homicide scenarios in Great Britain and never signaled any products that derived from meat or any other food item.

Human blood – Keela was trained exclusively with human blood; blood that is subject to strict testing and which comes from hospitals. She locates contaminated guns, smells vehicles and clothing items, and accurately detects residues, even if the locations are subject to cleaning.

Kate refused to answer the PJ

Kate refused to answer tens of questions from the Polícia Judiciária. After the first day of questioning, when she appeared in the company of her lawyer but was heard as a witness, Kate changed her stance. Being made an arguida and the fact that the authorities assumed that they admitted her involvement in the disappearance of her daughter Madeleine, led her to adopt a different attitude.

She refused to reply, for example, why she left the twins behind in the bedroom in order to call her husband and friends at the restaurant, after finding out that Maddie had disappeared.



She also failed to explain why she had not searched for her daughter in the first moments, sitting on the bed almost without moving, and she offered no explanation for the fact that the preliminary test results from the English lab detected traces in the car boot and behind the sofa, traces whose DNA resembled Maddie’s.

Other details from her personal and professional life remained unanswered. Kate refused, for example, to explain whether or not it was true that before the holidays she had admitted she had a bad premonition. Whether or not she had ever complained that the twins were very restless or had ever admitted to deliver the guard of Maddie to a relative.

Kate also remained expressionless when she was confronted with the possibility that she had quit working because she could not handle the pressure of raising he three small children.

She did not explain how the cadaver odour was found on her clothes and on the soft toy that was normally used by Maddie, or why the dogs marked the death inside the apartment.

Kate also chose not to clarify who had called Sky News, nor did she reveal whom she had called in the moments that immediately followed the disappearance.

In her deposition, Kate was also confronted with the fact that her refusal to make a statement might hinder the discovery of her daughter’s whereabouts. Nevertheless, she kept her silence.

Mother’s DNA on the window

The window had been forced open and the abductor had taken the child through it. That was the first possibility that was advanced by Kate to the authorities that collected residues on location. But the tests that were done at the IML [Portuguese forensics institute] ended up isolating just one DNA which did not belong to the child but rather to Kate. To the PJ, it is also practically impossible for anyone to carry the child out of that window, which does not even open completely.



Gerry accepted to speak to the police

On the day that he was made an arguido, Gerry accepted to answer all of the Judiciária’s questions.

Doubts about surveillance on the children

The PJ found contradictions in the friends’ testimonies concerning the manner in which the children were watched over.

Denied the use of sedatives on the children

Kate and Gerry have always denied to the PJ that they medicated the children or used any sedative to make them sleep. Maddie’s parents thus stated that their children went to bed early simply because they were used to that, and it was not even usual for them to wake in the middle of the night. CM knows that months after Maddie disappeared, Kate suggested to the Judiciária that the twins should be tested in order to find out whether they had been sedated that night. Something that the investigators found strange, given the fact that being doctors, they both knew that any residue would have disappeared by then. This was considered to be another indicator that Kate and Gerry were not telling the whole truth about what happened on the 3rd of May, hiding what had happened to the child.

Recorded | PJ taped action – The dogs’ search was recorded by the Polícia Judiciária. The handler also wrote an extensive report that translated the signs that had been detected by the animals during their search for traces.

TIR | English address – Kate stated her identity and her residence and gave her English address. Therefore, the return home was not considered to be an escape from justice.

Inderdaad Suko, het hele geval doet een beetje luguber aan zo langzamerhand, een thriller auteur had het rare gedrag van de betrokkenen niet beter kunnen verzinnen, helaas is dit geen fictie maar feit.

Dat hele circus, al die verdachtmakingen, sightings en plottwisten doen een beetje geregisseerd aan, nu is het afwachten of er boven water komt wie er aan de touwtjes trekt.

Maar er blijft in mijn achterhoofd rondspoken, dat heb ik geloof ik al bijna vanaf het begin gezegd, dat de Tapas9 meer lijken in de kast hebben zitten, niet letterlijk, maar alles wegstrepend kun je bijna niet anders concluderen dan dat die 9 meer weten, niets zeggen en zelfs de ouders van Maddy houden zich stil.....
Wat kan er in vredesnaam zo erg zijn dat je zelfs niet de waarheid spreekt bij de verdwijning van je kind?

He was runtish and rat-like, and yet also into body-building. He lived on his own. He was given to wearing dodgy-looking singlets and he was a devotee of the ancient pagan religion called Wicca. He had a picture of the Cerne Abbas giant inscribed on a black-painted wall in his flat.

Someone said that they had seen him, or a man very like him, on the common on the morning of the murder - and that was enough.

Gonçalo Amaral, who was chief of the criminal investigation police for the Algarve region, has scheduled a news conference in Lisbon on Thursday to launch the book, just three days after the widely expected announcement tomorrow that the case is being shelved by prosecutors for lack of evidence.

In the book, provisionally entitled True Lies, Amaral is also likely to reopen his assault on the role of the British police in the investigation. He has publicly suggested that they were influenced throughout by the leads which Madeleine’s parents, Kate and Gerry McCann, wanted pursued.

He is said to be convinced that Madeleine is dead, while the McCanns have continued to press investigators to follow the trail of potential kidnappers and ensure their daughter’s safe return.

Ik heb de commentaren van de journalist schuingezet, het leest nu wat makkelijker, vooral die link tussen Murat en Stagg vind ik interessant, het maakt blijkbaar niet zoveel uit of ze de echte dader hebben, een zwart schaap in de kudde die ze kunnen beschuldigen is genoeg, de dader is geidentificeerd en het leven kan gewoon doorgaan.
Ik heb het idee dat dit tov Murat is mislukt en dat die paranoia van nu komt omdat er geen 'dader' is gevonden en men dit dus gevoelsmatig niet heeft kunnen afsluiten. (Just my 2 cents. )

Tja Kahaarin, het is eigenlijk idd vanaf het begin klontje klaar dat niemand echt wat wilde zeggen (Russel zei vorig jaar aan de deur tegen een Sun-reporter dat Gerry McCann de woordvoerder is en gooide daarop de deur dicht) en niemand echt wil meewerken ondanks dat iedereen dag in dag uit via de media liet weten graag de PJ ten dienste wil zijn. Robert Murat kende iedereen wel en was daarom een makkelijk slachtoffer, who cares...Dát is ook voornamelijk wat het publiek stoort, die houding van iedereen, niet Madeleine op nummer één zetten, en dat heeft niets te maken met de secrecy. Waarom mocht Jane Tanner dan uitgebreid vertellen hoe die avond volgens haar is verlopen inclusief dat Bundleman+verhaal, in die BBC-docu in november? Die zus en andere familieleden die later een woordenbrij van kritiek hadden, met details, over de eerste dagen na de vermissing terwijl ze eerst nog zo lovend waren? Die kliek-McCann heeft op een schandalige manier misbruik gemaakt van de secrecy omdat de Portugesen niets tegen die smear en slur konden doen. Bovendien is men vergeten dat in september die secrecy-wetten werden versoepeld, maar met elk beetje pijnlijke vraag sloten de anders zo kwebbelende bekjes, dat ze niks mochten zeggen, liars! Nu blijkt wel hoeveel de PJ heeft gedaan en wat er allemaal aan tegenwerking is geweest en ook wát er allemaal niet is meegenomen in de eindfase, zo blijkt uit dit artikel op de site van Joana Morais, zie ook het 3arguidoforum

Judge mistrusts evidence used in an isolated manner

Tests that were performed on hair that was collected from the boot of the car that was rented by the McCanns in the Algarve have determined that 16 out of 18 markers match Madeleine’s genetic information. The information, which was released to DN by a source from the PJ, joins the results in the preliminary report from the Birmingham lab, in England, where it is verified that “15 out of the 19 genetic markers that were found in a residue that was collected from the couple’s car boot are a match” with the child.

“The evidence is unequivocal for the investigators”, the PJ source guarantees. “We are talking about a tuft of hair that was found in the spare tire well, in the car boot, which could not have fallen from the siblings’ clothes or have ended up on that spot by other means. The issue is that in order to make a solid proof in court, one has to reach 18 markers. But with 16, the investigators have no doubts left”, the policeman recognizes.

But for a judge that was contacted by DN, there is no reason for such certainties. “It depends on which markers are missing and if I had to decide only with a basis on that element of proof, I would not take a case to court, because the chances for success would be very small. This type of evidence always has to be articulated with other elements.”

Another source that is well positioned near the process, and with forensics knowledge, sustains the PJ agent’s version by defending that “these tests are like the collection of fingerprints, where a piece of evidence in court needs to detect 13 points, but from 11 onwards the police is already certain”.

For DN’s source, the conclusions from the tests that were performed on the hair that was found inside the Renault Scénic that was used by the McCanns were not included in the PJ’s final report merely because “if the evidence was not going to be used in court, the police did not want the Public Ministry to say that there is a persecution of the child’s parents”.

Although he mistrusts this isolated type of evidence, the judge that was heard by DN argues that there is matter to take the parents of Maddie McCann to court. “They could be judged over the crime of endangering a minor, because leaving their daughter alone inside a hotel room while they go to dinner is not acceptable within the social patterns, and over obstruction of justice. It is better to remember that the child’s parents called the televisions before they called the police.”

Maar goed, uit alles blijkft wel dat men het op neglect gooit en dat valt dus lasig te bewijzen gezien de tegenwerking van betrokkenen en IMO de Leicester Police én hun bazen. Vermoedens bestaan dat niet alle documenten (bv de volledige eerste DNA-results) in het bezit zijn van de PJ, of op z'n minst iets 'gewijzigd,' Het stinkt aan alle kanten.

Overigens meldt iemand op het 3arguidoforum: "Generally, English law only extends as far as the borders of the country, but in the case of murder or manslaughter a British subject may be charged and tried here irrespective of where the offence is committed." Afijn, zal mij benieuwen morgen, wát dit gaat betekenen: 'A solution'....

Nee idd, nu Murat is gecleared, het zal iedereen blijvend achtervolgen, maakt niet uit wat morgen die Solution inhoudt. En daar is Spudgun weer eens online en hóe, de maker van dit inmiddels overbekende filmpje wat nog steeds actueel is, scherp en IMO precies vertellend wát er vooral mis is met de verslaggeving in de UK en de smerige campagne tegen Portugal, eerder ook in dit verhaal van hem "A Story For Christmas..." Het is wederom een hele zit maar in IMO zeer waard, in afwaching wat er morgen en daarna in de pers zal verschijnen, indien de uitslag niet datgene is wat recht doet aan deze onverkwikkelijke kwestie:

No doubt, celebs’ agents are already in negotiation with tabloid editors, all lining up to prepare their clients to express their solidarity by way of ‘exclusive interviews’; “as a parent myself, I can’t imagine what hell they have had to go through………by the way, my new book, which is out this Monday……………………….”

Who knows?. Almost certainly an OBE or two will be in the pipeline, especially if the McCanns are allowed to take credit for the European ‘AMBER ALERT’.

Clarence Mitchell will almost certainly be given greater impetus, either directly or otherwise, to organise the Government’s Media Monitoring Unit, to clamp down and to CLOSE down those websites and bloggers that influence sufficient numbers of people to be potentially detrimental to New Labours diktats, (as he did the MIRROR Forum).

Tony ‘Glenda’ Parsons, will undoubtedly have accrued sufficient soundbites to keep his Mirror column going for the next 2 years.

But, Mr. Editor, just before you fall asleep at night in your bed, having finished the proof reading to your simpering, sycophantic, subservient homage to Clarence Mitchell’s release, please give a little thought to the following:-

Irrespective of what the Portuguese announce on Monday, the 20th July, there are a number of serious issues and questions which, FAR from being answered, have actually never been ASKED.

It may very well please you and whoever is dictating your editorial policy to perpetually vilify and BLAME the Portuguese authorities, their police or even their subjects for every aspect of the Madeleine McCann tragedy, but that would not explain, in any way, the following:--

The suspicions surrounding the McCanns and their possible involvement in the disappearance of their daughter arose, NOT because the Policia Judiciaria were inept and clueless, but because the McCanns made inaccurate statements, from the outset. Inaccurate statements about their movements, the movements of their friends, inaccurate statements about the state and condition of how they found the apartment and the shutters, inaccurate statements about what they discovered and discussed.

We know that they made inaccurate statements because what they said directly contravened and countered what the other stated, as well as what some of their friends stated. And they can’t ALL have been correct. Inaccurate statements, Lies or omissions?

Likewise, it wasn’t the ‘bungling Porto plod’ who strongly suspected or suggested that Madeleine may have died in the apartment.

It was a couple of British dogs. Specialist canines, who have a LONG and proven history and success rate in determining and locating the precise areas of residual tissue and and materials relating to cadavers. Specialist dogs who are currently proving to be both CRUCIAL and instrumental in unraveling the ongoing horrors being unearthed at Haut de la Garenne in Jersey.

Not, I am sure, that you will give much credence or space to their findings in Portugal, but HOW would you propose to explain away their behaviour in Praia da Luz, in the apartment, on Kate McCanns clothes and belongings? Having a bad day? Inconclusive? The fact that it is not wholly admissible in a Court of Law?

And what about that car boot sample? The Birmingham FSS, the acknowledged, finest Forensic science laboratory in the world? Martin Brunt is STILL on the Sky News website video, reporting a “100% DNA Match to Madeleine McCann”. Was he misinformed? Contaminated sample? Mistaken Process? Total fabrication? We may never know, especially given that the British authorities are fighting to ensure that particular aspect of this case remains secret. (Have you ever asked yourself why?, Mr. Editor, or are you simply not permitted to question Mr. Mitchells rhetoric?)

Are you also, Mr.Editor, going to lambast those bungling, inept, incapable LEICESTERSHIRE police, who were also widely reported as concurring, and in some cases even SUGGESTING, that Madeleine died in the apartment on that first night in May?

“ Licentious, lacklustre, Leicester Police loonies!” doesn’t quite have the same ring to it, does it Mr.Editor?

Friends in high places? Curious RICH associates and backers, underhand Government assistance? Prime Ministerial blessings, chats and advice?. Papal divine intervention, European and world leaders hob-nobs?. It’s all there Mr. Editor. Enough material to sell a billion Sunday journals. So why no interest?

You see, Mr. Editor; I don’t really know what happened in Praia da Luz in May of last year. I don’t know why, how or when. I wasn’t there. Neither were you. We can only listen to those that are either close to, or aligned to, the proceeding in question.

It boils down to who and what you want to believe. I am reminded of Herman Goering. He once stated, “it's always a simple matter to drag the people along whether it's a democracy, a fascist dictatorship, a parliament, or a communist dictatorship. Voice or no voice, the people can always be brought to the bidding of the leaders. That is easy” How right he was.

I realised just how right he was when George Bush convinced the majority of his people that Saddam Hussein had a hand in 9/11, just before he embarked on the massacre of an estimated 600,000 Iraqi men, women and children, just so that Halliburtons could procure the rich oil fields; (FAT lot of good THAT did with the current oil price, but I digress.)

What I particularly hate about that atrocity, is that the British went ahead and held his hand while he did it. Only at least Blair gave the British people SOME credit. He knew we wouldn’t buy the 9/11 angle, so he made up the WMD’s story, inventing documents, dossiers and ‘intelligence’ as he went along.

Charles de Mendez? We would know for sure, exactly what happened to him, poor chap, were we to examine the countless surveillance video of the event. Except, for some reason, we can’t. Because the tape is apparently damaged or lost, or the cameras malfunctioned or were facing the wrong way or were broken or vandalised. Or all of the above.

And of course, when Neil Mackay sensationally reported in 2003 that “senior members” of the Labour Government were being investigated for “pedophilia and the "enjoyment" of child-sex pornography”, as part of the infamous ’Operation Ore’, Tony Blair very quickly and effectively served a DA NOTICE on the press and media, banning details of these matters being reported. A ban that still stands today. A sublime example of how a Government and its press can lie, mislead and fool its people.

So, you see, Mr. Editor. You will have to forgive me if I choose not to believe a single word that your paper publishes on the Madeleine Mccann case.

You will have to excuse me if I do not join in the rejoicing and celebrations when the illustrious couple are exonerated , nor contribute to their inevitable NEW fund to help them “find their daughter”.

Because, although it may be ultimately true that there is insufficient evidence to prove the culpability of the McCanns in the disappearance of their daughter, there is most definitely AMPLE and OVERWHELMING evidence that the authorities of this country do not wish for the truth to ever come out.

BUT; if there IS a god, and the leaders who presided over this debacle and cover up ever have to stand and atone before him, then rest assured that their minions:- the paltry, gutless, servile cowards who spread their lies and diktats in their respective newspapers, will have to atone also.

That’s YOU, Mr. Editor.

Perhaps you’d care to dwell on that point before you fall asleep tonight.

That, and the image of a precious, angelic and innocent little girl for whom, with your able assistance, Justice was denied

Pinto Monteiro promised a solution for the Maddie case for today. The archiving of the process is most likely to be announced on the General Attorney’s Office’s website, after more than a year of an investigation that was made of breakthroughs and retreats.

The Judiciária lost some battles and diligences that were not carried out may have compromised the discovery of the truth. That is the understanding of Gonçalo Amaral, who launches the book ‘The Truth about the Lie’ next week, in which he promises to explain the reason why he believed in the child’s death and in the involvement of the parents in concealing the cadaver.

CM knows that Gonçalo Amaral was not alone in this fight. Only days after Kate and Gerry were questioned and after they returned to England, the PJ inspector who was in charge of the process defended that he wanted to hear the couple again and that they should be subject to a more serious coercion measure. He also requested the reconstitution of the facts.

In a dispatch that is dated September 19, Magalhães Menezes, a prosecutor of the Republic, manifested himself against it. He said it was an unnecessary diligence, because Kate had refused to answer and Gerry had clarified little or nothing.

Concerning the change in the coercion measures, he said there was no legal basis for any modification. The couple had given their English address when they were made arguidos, and remained available to be contacted at that residence.

Later on, when the PJ made the requests again, the magistrate ended up admitting to the new questioning. But he postponed the decision for a later moment in time, because he understood that hearing the friends and the numerous persons that the PJ had requested might raise new questions.

It should also be noted that the judge kept some reservations about the requests that were made by the Judiciária’s investigators. Concerning Kate’s diary, for example, the judicial magistrate argued that only later would it be possible to know whether it could be validated, because it revealed facts from Maddie’s mother’s private life.

Judge Pedro Frias refused the Public Ministry to access the text messages that were sent and received by Gerry McCann, alleging that the messages were telephone interceptions and that judicial authorizations could not be given after the occurrence.

Mysteries of the process

Investigating the friends – A strong suspicion, prompted by three testimonies, fell over one of the McCann couple’s friends. But that doctor returned to his country after the disappearance and he did not explain many of the questions for which the PJ had no answers. The Judiciária failed to understand his life story.

Reconstitution – Right after the interrogation of Kate and Gerry, the PJ requested the reconstitution of the facts. The English were asked to return to Portugal for the diligence to be carried out. Kate and Gerry ended up accepting, but the friends denied it. The Polícia Judiciária did not carry out the reconstitution and the archiving of the case, waiting for better evidence, renders the diligence useless.

Irishman not heard – An Irish citizen who stated he saw Gerry carrying a child on the evening of the 3rd of May should have been questioned again through a rogatory letter. But that was not fulfilled, and his deposition ended up not being obtained. What was known was that the witness made himself immediately available for a deposition.

Text message register – The PJ wanted to access the contents of the text messages that were sent and received by Gerry during the hours immediately before and after his daughter’s disappearance. The Public Ministry validated the request, but the judge did not defer the pretention, considering that it would be equal to listening operations. And that at that point in time, there was no judicial permission for them to be carried out.

Clinical records – The Public Ministry decided that the PJ should not access the clinical records of Madeleine and the twins Sean and Amélie. The prosecutor sustained that such would violate the privacy of the children and their parents, and the evidence might be considered null. For the magistrate, the request was not duly sustained, either.

To find out whether Dave saw Madeleine in the apartment

The last time that Maddie was seen by someone outside the group was at around 5.30 p.m. on the 3rd of May. After that, only David Payne asserts to have seen Maddie in the apartment, when he went there to exchange a few words with Kate. The PJ mistrusts that thesis and ends up having doubts about the time span of the disappearance. There are also contradictions about the time that Dave spent inside the apartment. Kate says they only exchanged two or three words, but Gerry guarantees that his friend stayed inside the house where his children were, for half an hour. The fact that three witnesses launch suspicions about Dave made it fundamental to clarify this situation.

Brother-in-law washed the car due to fish smell

Gerry’s brother-in-law was also heard in a rogatory letter. He was the usual driver of the Renault Scénic and he explained to the police that he had washed the car boot because one day he had perceived that fish blood had spilled from the bag that he had just acquired at the supermarket. Alexander also added, in April this year, when he was questioned by the investigators, that one day he had noticed a strange smell in the car. But he guaranteed that was due to the fact that they usually transported waste in the car boot. He also said that the twins’ nappies were usually placed there, and that was the reason for the intense smells.

Trip to London without results

It was the last great hope for the investigation. Already in the possession of the final documents from the English lab, which launched strong doubts and rendered the results from the residues that were found inside the car that was rented by the McCanns 22 days after Maddie disappeared inconclusive, the Polícia Judiciária from Portimão made themselves available to watch the questioning of the McCanns’ friends. Paulo Rebelo, who had substituted Gonçalo Amaral, and two other investigators went to Leicester, but returned empty-handed.

It was in April this year and the hearings were held at the English police’s headquarters, a few kilometers from the couple’s house. But the witnesses added little or nothing and in many moments pointed towards what they had already told the Portuguese authorities after the disappearance. The PJ’s final report, which is most likely to prompt the dispatch for archiving by the Public Ministry today, reinforces just that and it is ultimately accepted that the investigation has reached a dead end.

Many situations remain unclear, namely how it was possible for Jane Tanner to have seen a man carrying a child while Gerry, who was standing two or three metres away, saw nothing; and how an abductor could have carried a child horizontally, through a small window that only half opened.

Notes

Teachers | Heard – The PJ heard Madeleine’s teachers through a rogatory letter. They guaranteed that Madeleine was happy with the McCann couple and that there had never been any incident.

Hajo Kahaarin. Nou, als je de Portugese artikelen bij elkaar zet, en ook die van zojuist dan snap ik wel waarom er geen zaak komt. Zoveel tegenwerking, zoveel protectie van privacy, zoveel van alles en nog wat, mocht men dus van een misdaad verdacht worden, bv in Portugal, en je hebt wat vriendjes die wat te zeggen hebben.... don't worry, alles wordt weggepoetst, kwijtgemaakt, veranderingetjes hier en daar, en niks aan de hand...helemaal niks. "At the end of the day that is the most important thing - finding their daughter and keeping the search going."

Last week Mr Murat received a £600,000 settlement and apology after a libel claim over allegations in 11 UK newspapers. In March Mr and Mrs McCann reached a libel settlement and got an apology from Express Newspapers for suggesting they were responsible for her death.

The McCanns and Mr Murat both strongly denied any involvement in Madeleine's disappearance.

'Good job'

In an interview with the BBC, Goncalo Amaral - the former police chief leading the Madeleine inquiry - said he believed she was dead. "The evidence that we had gathered by the time that I left the case pointed to the girl being dead - and having died inside the apartment," he said.

"I don't know what happened next, I can't say. We'll have to wait for the case files to be made public." Mr Amaral was removed from the case last October after reportedly criticising the British police. He is now publishing a book about the investigation and denied that Portuguese police had failed to carry it out properly.

"Let's wait, and people will see that the Portuguese police and the British police did a good job - because various British agencies were involved. "We tried and we worked hard, so we can't be accused of incompetence or failure."

Mr Amaral also insisted that despite them being made formal suspects, there was "no persecution" of the McCanns. "The police don't want to persecute anyone - just to investigate what happened in a given case," he said.

Case shelved: Portugal's Attorney General says the investigation into Madeleine's disappearance has been halted

Kate and Gerry McCann have been formally cleared by Portuguese authorities investigating the disappearance of their daughter after 14 months as suspects.

Portugal's Attorney General announced the police investigation had found no evidence of a crime committed by the couple or by the first man to be named a suspect in the case, British ex-pat Robert Murat.

All three have alway strenuously denied any involvement in the three-year-old girl's disappearance in the Algarve resort of Praia da Luz last year.

Attorney General Fernando Pinto Monteiro said the case had now been shelved, although it could be reopened if any new evidence about the three-year-old girl's disappearance emerges.

His statement said: 'In an order issued today ... the investigation into the disappearance of the minor Madeleine McCann has been halted because no evidence was discovered of any crime committed by the suspects.'

It added that the investigation could be re-opened 'if new evidence emerges from any serious, pertinent and authoritative' source.

The McCanns are now expected to ask for access to the police files to help their personal hunt for Madeleine, who vanished from their holiday apartment while they were eating dinner with friends nearby.

The pair, both doctors from Rothley, Leicestershire, are due to speak out about the decision to lift their 'arguido' status and the move to close the case this evening.

Their spokesman, Clarence Mitchell, said the couple had been informed of the statement and were liaising with their lawyers in Britain and Portugal.

'They are a wronged couple. For the past nine to 10 months they have had this agony as well as the pain of losing their daughter,' he said from Rothley.

He continued: 'There is a degree of relief but no air of celebration whatsoever. They should never have been arguidos. The fact that they have emerged from this without being charged proves that.

'I know they will welcome this news but the whole thing has been a distraction since September.

'The main thing now is to get everything back to finding Madeleine. All of this has damaged their good reputations and they will have to assess where they go from here.

'The only thing they care about is finding Madeleine. We hope that the Portuguese authorities will continue to cooperate with their private investigation.'


End of a nightmare: The McCanns are due to speak out about being cleared and the decision to shelve the investigation this evening

Child protection expert Mark Williams-Thomas says the couple should have had their suspect status lifted far earlier but attacked the decision to shelve the case.

'The arguido status should absolutely be lifted. I don't believe they should be kept as suspects any longer - there is no evidence to support it and this should have happened a long time ago,' he said.

'But we have lost sight of the most important thing here, and that is Madeleine. I don't believe 14 months into an investigation you can put it on the shelf. I think this is appalling.

'Would this happen in the UK? No. I think it is unacceptable to shut a case 14 months down the line.'

The disgraced former head of the investigation, Goncalo Amaral, had earlier insisted the decision to make the couple suspects was not police 'persecution'.

Mr Amaral claimed the decision last September was not taken by police alone and stressed it was done based on the 'leads' his team had at the time.

But on Thursday, he is due to deliver another heartbreaking blow to the McCanns with a new book promising 'explosive revelations' about the inquiry.

Mr Amaral, 48, was responsible for authorising the decision to make the couple official suspects last September.

He was widely criticised for ignoring potential leads because of his focus on the MrCanns and his rigid belief that Madeleine died in their holiday apartment.

But today, he stressed he still believed that is where she died as he revealed his frustration that he was not able to solve the case.

'The evidence that we had gathered by the time that I left the case, pointed to the girl being dead - and having died inside the apartment,' he told the BBC.

'I don't know what happened next. I can't say. We'll have to wait for the case files to be made public.'

The move last September to make both parents suspects was taken by various officials, not 'purely and simply by police', he said.

'There were others involved - public prosecutors and the national directorate of the Portuguese police.

'They all knew there was a necessity to put everything on the table, in light of the advances we had made... the combination of leads we had.

'There was no persecution. The police don't want to persecute anyone, just to investigate what happened in a given case.'

The former detective today denied he was trying to profit from the three-year-old's disappearance with his book and said it was an attempt to find the truth.

'People can say what they like. All I would say, is that I'm trying to contribute to the discovery of the truth.

'I worked 27 years as a police officer - and my conscience can't accept that this is the first case that slipped through my fingers. I worked hard with colleagues, and it's still unresolved.'

The memoir reportedly contains allegations that Madeleine died accidentally in her parents' care, and that they disposed of her body to cover up the death.

The McCanns, both 40, vehemently deny the claims. Friends say the couple's legal team will study the book and had not ruled out bringing libel proceedings against him.

Mr Amaral was rumoured to be responsible for many of the lurid smears and bizarre leaks from inside the police inquiry.

They stopped abruptly when he was removed from the case last October, a month after the McCanns were made 'arguidos'.

1 en al Clarrie spin natuurlijk, de zaak zou in GB nooit geshelved zijn en de McCanns zijn een wronged couple, na het vertrek van Amaral zijn er geen smears meer geweest en Madeleine zelf wordt wel 2 keer genoemd in het hele artikel,

Maar goed, de arguido status is gelift en de zaak ligt in de kast, ben nu erg benieuwd naar het boek van Amaral, wie weet kan dat nog wat stof doen opwaaien, evenals de zaak zelf, is er zicht op dat er gedeeltes publiek worden? Is dat al bekend op 3arguido's?

Ja natuurlijk, het ligt aan de Portugezen dat Maddy nog niet is gevonden, ze moeten als hondjes de files komen apporteren.

Hoe kwam het ook weer dat Madeleine in de eerste plaats verdwenen is? Omdat de McCanns zo goed hebben opgelet? Omdat ze voor een oppas hadden gezorgd zodat ze rustig uit konden gaan? Omdat ze daadwerkelijk elk kwartier de moeite hebben genomen bij hun kinderen, je weet wel die 3 kleintjes onder 4jaar oud, te gaan kijken?

Maar nee, de Portugezen, de pers en de fora hebben hun reputatie door het slijk gehaald en er voor gezorgd dat ze nog zoek is, echt waar......

Ohw, de komende tijd is het alleen maar de McCanns & Co, wat ze allemaal hebben meegemaakt, nou ja, zie het verhaal van Spudgun, en hier moet idd rekening mee worden gehouden: "Clarence Mitchell will almost certainly be given greater impetus, either directly or otherwise, to organise the Government’s Media Monitoring Unit, to clamp down and to CLOSE down those websites and bloggers that influence sufficient numbers of people to be potentially detrimental to New Labours diktats, (as he did the MIRROR Forum)."

Het zal ook mij benieuwen of álle files straks openbaar worden gemaakt en ik ben des te meer nieuwsgierig naar die 81 documenten die nu net toevallig door de McCanns zijn veilig gesteld vlak voor deze bekendmaking, zien we hier een regie? Ik wel. Mogelijk zal nog steeds alles in het werk worden gesteld om bepaalde pijnlijke feiten verborgen te houden, vergeet Metodo 3 ook nog niet, indien er getuigen of anderzins verhalen gaan vertellen. Zal er nu eindelijk eens goeie onderzoeksjournalistiek komen? Voorlopig heb ik daar een hard hoofd in. Ik heb nog net voor de crash van het 3arguidoforum kunnen lezen dat de McCanns achter schadevergoedingen aangaan. En er komen grote sommen geld in het verschiet middels interviews en alles wat men verder kan verzinnnen, de zo gewilde celeb-status ligt binnen handbereik. En natuurlijk...keep Madeleine alive, wéér sightings, wéér geld bedelen en nu zullen goedwillende mensen zeker geld gaan geven, omdat de McCanns er nu zielig alleen voor staan....



Maar wat zijn er letterlijk voor conclusies zijn getrokken? De zaak gesloten wegens gebrek aan bewijs? Er is geen bewijs van a stranger abducter, wat is er dan wel duidelijk?

Een aantal posters zijn dus even hier aan het posten nu het 3arguidoforum down is, was voorspeld, die grote aantallen bezoekers kunnen ze niet aan.

Bovendien hebben we door haar e.a. nog iets van een andere berichtgeving kunnen lezen. Ze zal dit niet lezen maar ik bedank de Portugese posters en bloggers die de moeite hebben genomen alles te vertalen en het nog even blijven doen als er iets zomaar naar buiten komt...
